CITY OF KENAI RESOLUTION N0. 73-39
FINDING FOR THE NECESSITY r~ND PROVIDING FnR THE FORMATION OF WATER IMPROVEMENT
DISTRlCT N0. 73-W3 WITHIN THE CfTY OF KENAI, PROVIDING A METHOD OF EQUITABLE
DISTRIBUTION AND APPORTIONING OF COST THEREOF, AND AUTHORIZING THE CITY TO
PROCEED WiTH SAtD IMPROVEMENT.
WHEREAS, the City Council directed the City Manaqer to make a survey and report
to the Council concerning the need for and estimated costs nf the proposed water improvement
project designated No. 73-W3, and;
WHEREAS, The City Manager made such survey and report which is before the
Council and submitted in connection w~th the other documents in support of the project, all
pursuant to Sec. 16-15 (b) of Ordinan~e 218-73, and;
WHEREAS, appropriat~ notice has been given to the citizens and property owners
by pubiication and by mail, all as required by law, outlining the boundaries of the proposed
Water Improvement District No. 73-W3, and that the prelimina~y assessment roll and maps
were made available for review, discussion, protest and objections, and;
WHEREAS, said water system improvements have been constructed accordinq to
plans approved by the City Council, and;
WHEREAS, it has been determined hy City Council that a portion of the total cost
of this project shouid be borne by the property owners benefited by this installation, and;
WHEREAS, the public hearing has been held and written objection by property
owners within the proposed district boundary are less than fifty (50$) of the total benefited
property owners, and;
WHEREAS, it is now time to make a finding as to the necessity for said improvement
and to authorize that the city proceed with the project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
KENAI, ALASKA:
SECTION 1. NECESSITY OF WATER IMPROVEMENT DISTRICT NO. 73-W3
That the above described improvement is necessary for the public health, welfare, safety,
necessity and convenience and will benefit the properties to be assessed. The plan for said
im~rovement is approved. That the findings of the Council herein are conclusive.
SECTION 2. ESTABLISHING WATER IMPROVEMENT DISTRICT N0. 73-W3
That Water Improvement District No. 73-W3 is established and that the boundary is as described
by the description attached hereto as "Exhibit A" and speci~calty incorporated herein by
reference, except for revisions as indicated in Section 4.
SECTION 3 PROJECT TO PROCEED
That the City should proceed with the proposed improvement as by ordinance and law provided

SEC~fION 4 REVISIONS 7~ WATER IMPROVEMENT DISTRICT NO. 73-W3
That the following revisions to ~hlater Impr~vement District No. 73-W3 are made:

SECTION S. COST ACCOUNTING FOR WATER lMPROVEMENT DISTRICT NO. 73-W3

That total costs will be kept by the City Administration for engineering, riqhts-of-way,
construction, administration and financing resulting from development of Water Improvement
District No. 73-W3. That the percentage of development cost to be assessed aqainst the properties
located within the boundary of Water Improvement District No. 73-W3 is to be /GG $.
That all preliminary actions of the City Administration, enqineers under contract to the
Cibj or initiating petitioners with respect to the above described improvement district are
hereby ratified and approved.

SECTION 6. PREPARATION OF FINAL ASSESSMEIVT ROLL
That a final assessment roli will be prepared by the City Manager for Water Improvement
District No. 73-W3. That prior to con~rmation of the final assessment roll the property
owner will be given the prescrib~d notice of hearing thereon and time to review the final
assessment roll. That a further hearing shali be held on the ~nal assessment roll 3n
accordance with Kenai Code Ordinance 218-73, Sections 16-15, Sub-paragraph "g" as to all
provisions thereof.
