wHEREAS, to further the health and welfare of the fnhabitants of the Cfty
of Kenai, Alaeka, it Ss aeemed eecessary and advisable that the City purchase,
construct, or otherwise acquire the capital improvenuants listed in Sectfon 2 of this
resolution, ancl to provide funds to pay part or all of the costs of the eeid pro-
posed capita2 impsovements, that the City issue and sell its General Obligation
Bonds in the principal sum of 54,000,000 andf
WHEREAS, the Constitution and laws of the State of Alaska provide that que~tions
of whether or not such bonds may be isaued for such purposes muat be submitted to the
qualigied voters of the City for their ratificatfon or rQjection,

Section l. It fa hereby foun$ ancl declared that the public health, welfare,
safety, and convenience zequire the Cfty to carry; aut the plans for capital im-
provemente within, and outside the City limits, as hereinafter provided.
Section 2. The Cfty shall purchase, acquire, build, construct or otherwise
acquire the capital imprrn,rements as enumerated below:

Section 3. The bonde of any or each issue authorized by a speciai election
ehall bs sold in auch aimounts of not less than par plna accrued interest to d~te
ot delivesy aud at sach time or times as ~ound to be necessary and as permitted
by lav-, shall bear intereat et a rate not tc exceed the maxinium rate permitted
by law, an8 shall mature at such tiate or times rvithin thirty (30) years from date
of ies~e as the City Council may hereinafter determiae. The exact date, furm, terms,
maturiti~s and covenants of said bonds shall be as hereinafter fixed by ordinance of
the City.
Section 4. if the ~ur~ae available wiil not permit the conatruction, installation,
or acquisition, or are not ia sufficient quantities to match all or part of the above
deacsibed improvements, or if anticipated Federai or State graata for thc constructi~n

of sdid improvements are not obtained or reduced, then such portion af the aut-
horized bond issue as may lre found to be most necessary under all the circ~unstances
by the City Council, upon the advice of its engineers, shall be constructed, in-
stalled or otherwfse acquired.
Section 5. The proposition or propositfons whether or not the City shall iasue
said generai obliqatfon bonds far the purposes described in Section 2 hereof, shail
bs sut~aitted to the qusliffed voters of the City for their ratification or re~ectfon at
s special election to be held withfn the City on May 25, 1971. Said proposit.ion sball

Section 6. Those eligfble to vote at said special election must posaess
the foliowing qualifications:
(a) They must be at least 18 years of aqe.
(b) They must be citixens of the United States, and for at least one year
preceding the eleation, citizens o€ the State of Alaska, and for thirty
(30) days fmmediately preceding r~e election residents of the City ot
Kenai, Alaska.
Section 7. Reqistration in advance of the election shall not be requfre8
as a qualflicatfon of troters at this special election.
Seation 8. Notice of the election shall be publiahed once a week for aot
less thaa three consecutive weeks and the first aotiee thereoP shall be published
aot less thar~ n+enty (20) days prior to said special election. Said notices sball
ba publiehe8 in the Cook Inlet Courier, which is determineS ta be a neWapaper of
gensral circulation in the City of Kenai, or srall be posted at least twenty (20)
days prior to said election in thsee conspicuous pAaces within the Citiy.

City Recraation Center Building. said polls shall be open from 8:00 A.M. to 8:00
P.M. on the 25th day of May, 1971.

Funds for the City's portion of this capital improvements pro~rr~m shall

by the City Council, upon the adVice of its engineers, shall be con-
structed, installed or otherwise acquired.
