CITY OF KENAI - RESOLUTION N0. .~-7 PROVIDING FOR THE SIIBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF KENAI, ALASKA, AT A SPECIAL ELECTION TO SE HELD THEREIN ON MA]F 25, 1971, UP A PRDPOSITION ON WHETE~R OR NOT THE CITY SHOULD PROVIDE WHOLLY OR PAItTIALLY FOR RGPJIYMEDiT OF ITS OBLIGATIOAI TO REPAY GENERAE. OSLIGATION BO1iDS, AS MAY BE AUTHORIZED IN THE PRINCIPAL SUM OF SA,000,000, FROM SUCH CONSUMER SALES TAX LEVY AS MAY BE MADE FOR THE CITY OF KENAI UPOti ALL RETAIL SALES, RENTS, OR SERVICES WZTFiIN TFtE CITY LIMITS OF THE CITY OF KENAI, ALASKA. wHEREAS, to further the health and welfare of the inl~abitants of the Gity of Kenai, Alaska, it is deemed nece~ssary an8 advisable that the City pur- chase, construct, or otherwfse acquire capital impzovements through the author- ization and issuance, ff approved, of 54,000,000 of its qeneral obliqation bond, and eaid bonde can psimarily be repaid from taxea levied on real and pemonal property witt-in the city liwiLs of the Cfty of Kenaf, and= WHEREAS, it would appear to be more equitable to secure the feeling of the residents og the City of Kenai, to determine whether or not all ar a part of the funds for repayment of the abliqation of such qeneral obligation bonds may be authorized should come from a consumer retail sales tax= BE IT RESOLVED BY THE CaI1NCIL OF TFIE CITY OF KENAI, ALASKAz Section 1. it is hereby found and declared that the pubifc heslth, welfare, safety, and convenience require the City to acquire capital Smprovements ia ac- cordat-ce with the plan at a regular Council meeting. Section a. A proposition ahether or not the Cfty shall secure qeneral tax reveaues to repay such qeneral obliqntion boade, as may be authorized at a special eleation to be held ia the~.City of Kenai on May 25, 1971, shall be sub- mitted to the qualified voters of the City"for their ratffication or rejection. Said proposition ahall be in the £ollowinq tenns: PROPOSITION NO. 2 Regerendum on ir~position of Consumer Sales Tax in the event Proposition No. 1, to authorize the snle of $4,000,000 of "Kenni 1971 Capital improvement General Obliqation Bonds" is authorized at a special election to be held in the City of Kenai on May 25, 1971, then shall repaya~ent of the funds borrowed pursuant to such bond authorization be wholly or partially repaid by the imposition of a one percent (1~) consumer retafl tax on dll. retail sales, rents, and services made or renderea withfn the City limits of the City of Konai, Alaska, such tax to be levied on or after July 1, ' 1971 as the Cfty Counci~l may decide? Those eligible ta vote at said special election must possess the folla+ing qualifications: (a) They must be at least 16~years of aqe. (b) Tliey must be a citizea of the Unitad States, and for at least one year pre- cedinq the election, citizena o£ the State of Alaska, and for thirty (30) days imoasdiately precedinq the eleation, residents of the Citp of Kenai, Alaskas Ssotion 4. Registration in advance of the election shall not be required as s qualification of voters at this special electfon. Seation 5. Notice og the election shall be publishe8 once a week for not lese' thaa thrae consecutive weeks and the first notice thereo£ shall be published not less than twenty (20) days prior to said apeciai election. Said notices shail be publi~hed in the Cook Inlet Courier, Which is determined to be a newspaper of general ciraulatioa in the City of Kenai, or ahali be poated at least t~naty t20) dsys prfor to ~aid election in three conapicuous places aithin the City. Section 6._ The designated pollinq place for r~ll City precincta will be the City Recreation Center 86ildinq. Safd polls shall be open from 8s00 A.M. to 8:00 P.M. on the 25th day of May, 1971. It is hereby found and declared that the public health, welfare, safety, and convenlence require the City to acquire capital improvements in accordance with the plan outlined in City Resolution No. 71-6, passed April 7, 1971 at a regular Council meeting. Section 2. Those eligible to vote at said special election must posaess the following qualifications: (a) They must be a least 18 years af age. (b) They must be citizens of the United States, and for at least one year preceding the election, citizens of the S~ate of Alaska, and for thirty (30} days immediately preceding the election, residents of the City of Kenai, Alaska. Sectian 4. Registration in advance of the election shall not be required as a qualification of voters at this special election. Section 5. Notice of the election shall be published once a week for no'~ less bhan three consecutive weeks and the first notice thereof shall be published not less than tw~nty (20) da,ys prior to said special election.
