RATIFYIN(i ALL NEQOTIATIONS, ACTIONS, AND COMf+IITINF.NTS RELATING TO THE
SAi.E OF REAL PRQPERTY BY THE CITY TO '1'HE KENAI PENINSULA BOROU(fH FOR
SCHOOL PURPOSES.
WHEREAS, the Kenai Peninsula Borough as the legal entity
responsible for school financing and constructions requires a tract
of real property described as government Lot Two (2), Section Four
(4), TSN, R11W, Seward tderidian, xhich is presently owned by the
City of Kenai;
AND WHEREAS, negotiations Por purchase of the degcribed
real property from the City of Kens~i have been conducted betwe~!n
the City and the Borough by the City Manager pursuant to preliminary
authorization by the Council con~encing on or about the 18th day af
March 1970;
AND WHEREAS, two appraisals have been secured on the sub-
~ect real property, which said appraisals are available in the re-
cords o! the City of Kenaii
AND WHEREAS, it is in the public welPare and interest of the
Ctty to assist and facilitate with the development oP the public
aehool aystem by the Kenai Peninsula Borough, and such land is to
be utilized tor a public purpose;
AND WHEREA3, Council preliminary approval was given to the
City Manager ai. a special meeting held on the 8th day oP April 1970
to conalude the sale ot the deacribed real property for the sum of
~40,pU0.00, said price to include diacharge of the obligation of
the described tract oP real property for benefits represented by all
water and aeWer asaessments existing as oF the date oP the trans-
ter ot the real property, such obligation being a cash obligation
of =17,411.53•
NOW, THEREPORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF KENAI:
l. That all prior actions, negotiations, and conveyar,cEs
of the City of the real property described as:

Range 11 West, Sexard Meridian, Alaska,
are hereby formally ratiPied.
2. That it is Pound that a public purpose exists for the
proposed use of the real property conveyed and therefore the custo-
mary requirements for public advertisement of a competition sale are
not required.
3• That barabara and other archeologically valuable sitts
will be protected and utilized for historical and educational pur-
poses by the Kenai Peninsula Borough.
4. That the sum of $40,000,00 ix a reasonable compensation
for the real property as of the date oi' transaction.
5• That eale of fee simple interest, rather than a leasing
Por a term of years, i$ authorized and JustiPied and ~ustified because
the trana~ction 16 with a public entity, the Kenai Penin$ula Borough.
