WHEREAS, the City o£ Kon~ii received a Quitclaim Ti~;od from the Federal
Aviation A;ency on December 1, 1963 for a tract o£ land containing among
othor,proportios, the lands in Etolin Subdivision.
AND L•1HEtZEA3, the Federal Aviation Agency will remove all terms, condi-
tions, reservations and restrictions contained in the original quitclaim
deed, provided any sale or lease o£ the land is subject to the following
conditions to run with the land;
A. Thews is hereby reserved to the City o£ Kenai, its successors aid
assir_,ns, ror~the use and benefit o£ the public, a right o£ flight
for the I~ass~•i~e o£ aircraft in the airspace above the surface o£ the
premises herein conveyed, together with the right to cause in said
airspace such Holes as r.~ay be inherent in the operation of aircraft,
now known or hereafter used for navi~,ation of or flight in the air,
using said airspace or landin3 at, takin; off from or operating on
the Kenai kirport•
B. The Grantee or Lessee by accepting this conveyance expressly
agrees for itself, successors and assigns that it will not erect nor
permit the erection of any structure or object nor permit the growth
of any tree on the land conveyed hereunder which would be an airport
obstruction. In the event the aforesaid covenant is breached the
City of Kenai reserves the right to enter on the land conveyed here-
underand to remove the offending structure or object and to cut the
offending tree, all of which shall be at the expense of the grantee
or lessee.
C. The Grantee or Lessee by accepting this conveyance expressly
agrees for itself, successors and assia s that it gill not make use
of tha said property in any manner which mi3ht interfere r~ith the
lending and taking off of aircraft from said Kenai Airport or other-
wise constitute an•airport hazard. In the event the aforesaid cove-
nant is breached, the City o£ Kenai reserves the right to enter on
the land conveyed hereunder and cause the abatement of such interfer-
ence at the expense of the Grantee or i.essee=

KEI7AI that any revenues receivdd either by lease or sale of tho
afore described tract are dedicate-d for t he development, improve-
ment, operation or maintenance of the Kenai Airport;
AMID BLS IT F`UdTHER ~iIs'30J~VED that ar.y sale or lease of land in the
afoeesaid tract shall be sub3c:ct to conditions "A", "B", and "C"
above mentioned.
