HomeMy WebLinkAboutRESOLUTION 1967-46 ,~--~ CITY OF KENAI RESOI,UTIOr - 07__`~(o , AUTHORI'LING TRANSFER OF LAND FOR t•JATER AND SE41F.R RTriiT-OF-4lAY Ora LOT 32 , SECTION 6 , T 5 ra , R 11 Y1, S , r1, l•1NEREAS, right-of-way for a main sewer trunk line is required across Government Lot 32, Section 6, 'Pownship 5 faorth, Hange 11 'rJest, Seward Meridian, and WHEREAS, contiguous Government Lot(33) Thirty-three is owned by the City of Kenai and is not dedicated nor used for a public use, and WHEREAS, a transfer of a portion of Lot Thirty-three (33) has been requested as consideration for right-of-way across the contiguous Lot Thirty-two (32), and WHEREAS, the said real property has been appraised in its un-• improved condition and has been valued at six cents per square foot before installation of any put,lic improvements, NOW THEREFORE, be it resolved by the Council of the City of Kenai, as follows: Section 1. -- It is found and determined that Lot Thirty-three (33), Sec on x (6), Township Five North, Range )Eleven West, Seward Meridian, Alaska, is not dedicated nor contemplated to be forseeably required for public use. Section 2. -- It is found and determined that the securing of right-o~=way 3'or water and sewer improvements slated for the vicinity are best facilitated by the transfer of land on said Lot Thirty-three in exchange for said right-of-ways and a retention of a fragmented piece of Lot Thirty-three by the City would serve no public use noris there a Porseeable public use paramount to the need for the right-of-way fo:~ the improvements in question. Section 3. -- The transaction value will be established at the rate of s x can s per• square foot of land in excess of that retained for right-of-way or road purposes and will be determined as follows: SQUARE FEET Total area of Lot Thirty-three (33) 85,813 Less right-of-way on Lot Thirty-two (32) 4,95 subtotal 80,863 Less retained for right-of-way on Lot 33 4,950 Subtotal 75,913 Lgss retained for road ROW on Lot 33 6,125 Subtotal - Final 69,788 Area to be paid for by Loran J. Whittington and Agnes M. Whittington 69,788 69,788 sq. feet x $G.i,6/sq.ft.= $4,187.28. Section 4. -- It is found and determined that it is in the best pub~ic`inte`rest to enter into a transaction with Loran J. Whittington and Agnes M. Whittington for the transfer of Lot 33 to the said parties as a said consideration for right-cf-way plus the payment by the said Whittingtons of $4,187.28 in addition to the right- of_way received by the City. Any preliminary negotiations accomplished to secure the right-of-way by the City are hereby ratified.
