AUTHORIZING TRANSI•'ER OF CITY 041NED LAND FOR WATER AND SEWER RIGHT-OF-
WAY SITUATED IN DEPENDENT RESURVEY ~ SUBDIVISION OF SECTION 6, T 5 N,
R 11 W, S.M., and 041NED BY WILLIAM H. AND CLEONE E. 4JELL5.
WHEREAS, right-of-way for a main water and sewer trunk lines
are required across real property owned by William H, and Cleone E.

WHEREAS, contiguous real pf~operty is owned by the City of
Kenai and is not dedicated to nor used for a public use, and a trans-
fer of a portion of said real property has been requested as consider-
ation for right-oP-way needed by the City, and
WHEREAS, the said City owned real property to be exchanged
for water and sewer right-of-way is of no presently forseeable value to
the City,
NOW THEREFORE, be it resolved by the Council of the City of
Kenai, as follows:
Section 1. -- It is found and determined that said real
property descr~6e~c as "Parcel A" and ':!a7 on the attachment hereto,
is not dedicated nor contemplated to be forseeably required for u~ blic
use.
Section 2. -- It is found and determined that the securing
of right-oP-way for water and sewer improvements slated for the vicinity
of said real property are best facilitated by the transfer of said land
in exchange for said right-of-ways and a retention of the fragmented
parcel would serve no public use nor is there a forseeable public use
paramount to the need for the right-of-way for the imporvements in
question.
Section 3. -- It is found and determined that it is in the
best public n~3~eres~ to enter into a transaction with William H. Wells
and Cleone E. Wells Por the transfer of the described real property in
consideration for right-oP-way.
Section 4. -- Any preliminary negotiations accomplished to
secure the r g -o -waq by the City are hereby ratified. The required
documents to be executed and quitclaims for the transfer of the property
in question, shall be executed by the City Manager, James W. Harrison.
