Kebschull reviewed the staff report included in the packet, noting for accessory structures greater than I20 square feet, the rear setback would change from 20 feet to five feet, and one story was defined as 12 feet from the ground to the highest point of the roof. The floor was opened to public hearing. Kristine Schmidt, 5I3 Ash Avenue, Kenai -- Schmidt spoke in apposition to the resolution., noting setbacks create separation between structures and there were no maximum square footage limits in the resolution. There being no one else wishing to speak, the public hearing was closed. MOTION: Commissioner Brockman MOVED to approve PZO8-39 and Commissioner Romain SECONDED the motion. Kebschull noted the maximum lot coverage was 30 % for rear yards. Commissioner comments included: • Should the resolution be for smaller lots only? Should the size of the structures be limited? During the review process it was determined the shed encroached into the rear property setback. A 20-foot rear setback is required for structures over 120 square-feet. The applicant is able to meet the 5- foot side setback, but not able to meet the rear setback and have a useable backyard. The applicant advised that this shed is approximately 9'6" high from the ground to the peak. Attached is a site plan of the property showing the location of the shed. KMC 14.20.185 details the definition, intent, and permit application process far Encroachment Permits. Code also lists the review criteria that should be considered by the Planning and Zoning Commission when determining if a permit should be granted. The Commission is to establish that the following conditions exist before issuing an Encroachment Permit: • An encroachment as defined in KMC 14.20.185 (a) exists. "Encroachment means any object or structure above or below ground and constructed or located in a manner other than set forth in the Development Requiremenfs Table." The 160- square foot shed is being builf into the rear setback and meets the definition of encroachment. • The encroachment does not encroach upon a Federal, State or City right-of-way 0840 Comment.doo Page 2 or utility easement. The shed does not encroach into aright-of-way or easement. • The issuance of the encroachment permit will not authorize a use which is a not a principal permitted use in the zoning district in which the property is located. The structure is a permitted accessory structure use in the Suburban Residential Zone. • The encroachment is not located across a platted lot line. The shed does not cross a lot line. Public Works Director: No Comment. Buildin Official: Approval of this encroachment will not violate the building code. RECOMMENDATIONS Mr. Wehrstein was unaware a building permit was required for structures over 120- square feet. After being notified of the requirement, the applicant immediately applied fior a building permit. During the review process it was determined the 16 X 10 foot shed encroached into the rear setback. The applicant is requesting a 15-foot encroachment for asingle-story, 160-square foot, shed built in the rear setback. Structures 120-square feet or less may be built within three-feet of the side or rear lot line. Requiring the shed to meet the rear setback would drastically reduce the useable rear yard. The house sits approximately 35-feet from the front property line and is approximately 45- feet deep, sy requiring the shed to meet the 20-foot rear setback there would only be approximately 9-feet between the house and the shed leaving very little useable yard. The property owner has a tree on the east side of his back yard he would like to keep. By allowing the property owner to keep the shed where it is he will be able to have some use of the back yard. After measuring the parcel, the Building Official believes an as-built will not be required for the shed. The Commission is in the process of reviewing the required 20-foot rear setback for accessory structures. The encroachment would meet the guidelines in the proposed resolution recommending an amendment to allow single story accessory structures to be placed up to 5-feet of the rear lot line. At this time, there is not a plan to hold a yearly event but the applicant would~like to have that option. In the Land Use Table under Miscellaneous Uses, Assemblies (Large Circuses, Fairs, etc.) are listed as a Conditional Use in the Rural Residential zone. Footnote 15 is listed as PZ08-41 -Staff Report Fage 2 a requirement for the Conditional Use. Footnote 15 states, "Allowed, provided the following conditions are met: a. An uncleared buffer strip of at least thirty (30) feet shall be provided between said use and any adjoining property in a residential zone. b. Exits and entrances and off street parking for the use shall be located to prevent traffic hazards on the public streets." The proposed location for this event is off Beaver Loop Road. The parcels are zoned Rural Residential. The applicant awns three adjoining parcels containing approximately b.8 acres. Aerial photographs show a single access to the parcels via a long driveway. There is a large cleared area buffered by trees on all sides of the parcels. It appears there are sufficient trees along the perimeter of the site to meet the required 30-foot buffer. Beaver Loop Road is straight in this area and access to and from the event should have clear visibility. There should not be a traffic hazard created by patrons of the event. KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. The RR Zone is intended to provide for low density residential development in outlying and rural areas in a form which creates a stable and attractive residential environment. This is an application for atwo-day event. The use is specifically allowed as a Conditional Use as long as the trvo conditions in Footnote 15 can be met. These conditions are met and it appears that the proposed event should not violate the intent of the zoning district. 2. The value of the adjoining property and neighborhood will not be signifcantly impaired. This event is a planned fora 2-day period. The value of the adjoining property and neighborhood will not be significant impaired. 3. The proposed use is in harmony with the Comprehensive Plan. The area is designated as Rural Residential in the Comprehensive Plan. Compatible institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply with zoning design guidelines. " The Comprehensive Plan provides for development policies for growth and change in the community (City of Kenai Comprehensive Plan, Page 2$). This is an outdoor event, planned for two-days, and does not include any permanent development to support the event. These types of events are not considered in PZ08-41 -Staff Report Page 3 the Comprehensive Plan and should not affect the long-term development of the area. 4. Public services and facilities are adequate to serve the proposed use. Public services are adequate for the proposed use. There are no public facilities in the area. S. The City of Kenai Police Department and Fire Department were asked to review the application. - Police Chief Kopp advised the department does not have any concerns or objections. He did add that once an event has been held, they would have a better idea if there are issues that should be considered for any future events. - Fire Chief Tilly advised he did not see any problems since the event is being held on private property. Chief Tilly added that if there is a plan to hold large warming fires, a request should be submitted to the Fire Department and the Department would process the burning permit. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Building Official: No building code issues. RECOMMENDATIONS This is a request for a Conditional Use Permit fora 2-day fundraising event for public radio. The applicant owns three parcels of land off Beaver Loop Road. The property has sufficient space to accommodate the event and provide screening from the adjoining properties as required. The Kenai Police and Fire Departments don't believe there are health and safety issues related to the event. Because this is a 2-day event and doesn't involve long-term use or development, it appears to meet the intent of the zone and is not in conflict with the Comprehensive Plan. The applicant leases space from the City of Kenai in the City of Kenai -Conoco Phillips Multi-Purpose Facility and wishes to install a sign to advertise his business. Applicant notes he would like the sign visible from the Kenai Spur Highway and does not believe a wall sign on the building would meet his needs. Because there is already a freestanding sign an this parcel, a variance is needed for the additional freestanding sign. The sign code allows one freestanding sign per parcel. Because the applicant leases space in a City facility, permission of the City of Kenai is required for the application. The City Manager has given verbal permission to process the permit. If the variance is approved, the applicant's lease will be amended to allow for the sign and the City will approve the actual sign location. Chapter 14.20.1 SO outlines the criteria that must be met for the Commission to grant a variance. The sign code, Chapter 14.20.220 (a) (9) specifically allows for relief from any section of the sign code by applying for a variance. - Special conditions or circumstances are present which are peculiar to the land or structures involved which pre not applicable to other lands ar structures in the same zoning district. The applicant leases space from the City of Kenai in the multi-purpose facility operating a retail business far sporting goods that provides goods and services for the ice rink consumers. The City of Kenai has placed a freestanding sign on the premise that advertises the facility. That signage does not provide space far the business to advertise. The multi-purpose facility is located in an education zone. The customary businesses in educational facilities area a part of the main facility, i.e. bookstore, etc. Because this is a fully separate retail business, operating within a public facility, it does appear to meet the criteria that it is different from other uses in the same zoning district. - The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. Applicant is asking for a variance for an additional freestanding sign for this parcel. The business was not given an opportunity to advertise on the facility sign. The option far a wall sign does not meet the business's needs for visible advertising from the Kenai Spur Highway. During the hockey season, advertising is not necessary as the activity at the facility provides day-to-day business from facility uses. However, during the off-season, the business needs to insure that consumers know the business is open. - The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. Freestanding signs are permitted in the district. Applicant is asking for a variance for an additional freestanding sign for the premise. The sign, as shown on the drawing provided in the application, is 96 square feet. The height of the sign will be 1 Q feet. It could be argued that a smaller sign would meet the business' needs; however, due to the location of the parcel and with the large Kenai Spur Highway right-of--way, the requested sign appears to meet the requirements for a minimum variance. It should be noted that the applicant has been notif ed that in the future should the City of Kenai determine that it needs to advertise events in the facility and wishes to place a sign for advertising combined uses within the facility, the City would retract it's permission for the variance and provide an allowance fox advertising this business in conjunction with the combined sign. - The granting of a variance shall not be based upon other non-conforming land uses or structures within the same land use ar zoning district. This request is not based on any other uses or structures in this district. Cit En ineer: The sign location should not impair street traffic visibility. Building OfFicial: The location appears to meet sign code regulation. RECOMMENDATIONS The City's sign code provides relief through the variance procedure from any section of the sign code. The location of the facility and the need to provide direction to customers appears to justify the need for a directional sign off the Kenai Spur Highway. Recommend approval with the following requirements: l . Sign location must be approved by the City of Kenai administration. 2. Four of the cabins are currently located in a fenced area, behind the Russian Orthodox Church (Fort Kenay) and one is on private property. The cabins will be moved to the City's property at 186 Cook Avenue. They will be refurbished and opened to the general public during the summer months. This is the site of the old city hallllibrary and city jail. The five cabins have been assigned AHRS numbers having been identified as having historical significance. To move the cabins requires building permits. Kenai Municipal Code 14.20.105 (h) states, "Review Process. The Commission will review all building permit applications as well as all exterior architectural alterations and demolition to properties included in the Historic Preservation Plan. Upon submittal of such an application, the Planning Department shall schedule the application for review by the Planning and Zoning Commission at the following appropriate meeting. Any other building permits within the Townsite Historic District shall be handled administratively by the Building Official." Because of this requirement, the project is being brought to the Commission. The property at 816 Cook Avenue is located outside of the Townsite Historic District. However, the structures located a# this site, were included in the "Kenai Townsite Historic District Survey Report -- July 199&." The Kenai Firehall & JaiI1F'ine Arts Center was determined as historically significant and is assigned AHRS #280. The Kenai Civic League BuildinglKenai Cooperative Preschool was also determined significant and assigned AHRS #281. Kenai Historical Society states their mission is to, "collect, disseminate and preserve the history of the City of Kenai and the Central Kenai Peninsula. To ensure we are not only preserving our past, but protecting our future and its knowledge of our history." The project will meet that mission by placing these cabins in a location that is open to the public and provides an opportunity for learning about these cabins, their occupants, and the history of Kenai. The cabins will be lifted and, if required, logs replaced along the lower wall. When moved to the new site, they will be placed on new foundations. Moving these cabins will not affect their historical significance. The historical walking tour guide will be revised to show the new location for the cabins. Public, Works Director: Public Works is interested in the final plan for movement of these structures. Building Official: The foundation must meet current code requirements and the actual buildings must be safe for use. PZ08-43 Cornmants RECOMMENDATIONS Page 3 Kenai Municipal Code requires the Commission review applications for building permits for properties included in the Historic Preservation Plan before the permit can be issued. This is an exciting project combining the efforts of the Kenai Historical Society, the City of Kenai, the Kenai Chamber of Commerce, the Kenai Visitor and Cultural Center, numerous businesses, individuals and fraternal organizations. The project will locate the cabins in one location, place them on new foundations, and provide a center for historical education to the public. Attached to this report is a conceptual drawing of the new historic park, site plan, photographs, excerpts on each of the cabins from the historic survey, and a copy of the grant application to the Rasmuson foundation. This project meets the mission of the City of Kenai Preservation Plan. Even though the cabins will be located outside of the Townsite Historic Zone, the new location will provide an exhibit of the history of the City of Kenai and preserve the buildings for future generations. The Arness family made a number of improvements and additions to the small l~uil.ding, They ixxstalled indoor plumbing, converted the porch into a kitchen, and added a se:cor~d level, half-stoxy and a first ~Elaor addition. It rests upon a wood post-and-beam foundation, and measures 16' by 30'3". The southern 12'9" is covered with wood shingles but the log un.derstructure is apparent. The gable roof is covered with corrugated metal. The main entrance is located in an enclosed gable entry which projects to the east. This entry is constructed with horizontal planking over square logs. Cornerboards are used in both the shingled and plinked portions. H'sto and Ph si al han es: The cabin was built about 1922 by Mike Dolchok. Tt was originally constructed on the east side of what is now Overland Street, across from the U.S. Fish and Wildlife Service (USFWS) buildings. It remained the Dolchok family home until the late 1940s when it was sold to Dick Wilson who then sold it to the Juliussens. Julius Juliussen moved it to its present location and raised his family in the cabin in the 1950s. A large home occupied by other members of the Juliussen family was formerly located on the eastern portion of this lot. The cabin is currently unoccupied. A large, sixteen-pane window facing south toward the bluff was recently added, replacing a small fixed-pane window. The other window openings of the Cabin are boarded, so it was not possible to determine if the original windows were in place or not. A plywood door lies to the right of the sixteen-pane window. A twelve-foot wide particle board addition with flat roof has been recently constructed on the north elevation. Substantial in size, the addition extends past both the east and west elevations. Outb it in s• None ant ri Although the building was moved to its current location in the 1950s, its present site (Riverview Street) in a small residential neighborhood is similar to its original setting on Overland Street, only three blacks away. There are na topographical features in its present location that are markedly different from those of its original location. The Society has worked tirelessly in its endeavor to preserve aitd showcase our history to leave a legacy for not only Chase who make Kenai their home, but to all who pass through our wonderful•area and beautiful state. Kenai, ' the second Russian establishment in Alaska, is diligent in its efforts to provide the impetus far groups such as the Kenai Historical Society to proceed with such projects as the "Log Cabin Relocation and Restoration" to ensure we are not only preserving our past, but protecting our future and its knowledge of our history. B. The City of Kenai, Chamber of Commerce and the Kenai Historical Society have joined together to facilitate the relocation of five historic lag cabins dating back to the ~.90t) era. Three of the cabins were owned by Alaska hlative families and the other two homestead families. The relocation of a 7.917 75mm Howitzer cannon is also planned to be moved to land which is awned by the City of Kenai. In 19G7, the City of Kenai leased land from the Russian Orth.o~dox Church and built Fort Kanay with a bicentennial grant from the State of Alaska, Fart Kenai was a replica of the army fort which was built in 7.569. The Cfty used this building a5 a community center, senior center and museum. It was during this tune tk~e historic cabins were moved ants the property to display them to the general public. The cabins were museum, restored and maintained by the City pursuant to a prior agreement, the lease was terminated and the Church resumed ownership of the building and the land, The cabins were not removed and have remained in a locked fenced area, unavailable to the general public, since 1992. The cabins have #aeen t~ept in fair condition and used far storage. During the past year, the City, the Satiety and the Kenai Chamber of Commerce have met with local and state representatives of the Russian Orthodox Church to tame to a viabf~ agreement relative to the cab~ins~. Since the cabins have na historic value to the thwrch they nave granted permission to transfer the cabins back €nto city ownership and work wltii the Kenai Historical Society, Chamber of Commerce and Cifiy of Kenai to transfer them to a new site. It is averyone's goat to allow their relocation/restoration for public view. They will be moved i'rorr~ Fort Kenay to a city-owned site north of the old Civic League Building and the Kenai Fine Arts Canter. Over the years, the Society has not only contributed volunteer hours to assist in the repair of the Church and Chapel, but through a r~czanetary donation of $40,000 toward the purchase and installation of a new heating system to better protect the Church and its valuable icons. Historical background of the cabins (allows: • The City of Kenai and Kenai Historical Society rnaved the cabins to behind Fort Kenay at the time the City was in possession of the Fort, • It is not believed the cabins have any direct historical connection to the Church. The State of Alaska plans to use the property for a parking lot. When the Alaska Court 5ystern, designed the addition to the courthouse, the development met the current parking requirements. However, to allow for better access, the Court System requested they be allowed to delete seven spaces. By deleting those seven spaces, the site is two parking spaces short of meeting parking requirements. However, even with the seven spaces, the Gourt System recognized that additional parking is needed and that is why they are pursuing the lease. The zoning code (KMC 14.20.250(b)(3}ollows parking on adjoining lot to meet the parking requirements. The City of Kenai will design and develop the property. (see Ms. Howard's memo dated July 31, 2008.} Kenai Municipal Code 21.15.130 provides guidelines for the City to construct improvements and to include the cast of the improvements as part of the lease. The property is zoned Central Mixed Use ~GMU}. Off-street parking is permitted in the CMU zone. The "2003 City of Kenai Comprehensive Plan" identifies the land use as "mixed used." Mixed use is defined as, "The Mixed Use district fosters a compatible mix of retail, service, office, public, Institutional, recreationaE and multi-family residential uses. The district does not prescribe specific proportions for these uses, only that all these uses are desirable within the district. Mixed uses are particularly desirable in the Townsite Historic District and City Center overlay zone."
