CHAIR JEFF TWAIT, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chair Twait called the meeting to order at approximately 7:OI p.m. 1-a. Roll Call Roll was confirmed as follows: Commissioners present: J. Brockman, K. Koester, R. We11s, J. Twait, P. Bryson, and K. Rogers Commissioners absent: S. Rornain Others present: City Clerk C. Freas, Council Member R. Ross, and City Planner, M. Kebschull A quorum was present. 1-b. Agenda Approval Commission was requested to amend the agenda, noting an excused absence for Commissioner Romain. MOTION: Commissioner Brockman MOVED to approve the agenda, including the excuse absence request for Commissioner Romain. Commissioner Wells SECONDED the motion. VOTE: There were no objections. ITEM 3: SCHEDULED PUBLIC COMMENT -- None. ITEM 4: CONSIDERATION OF PLATS 4-a. PZ08-46 -Rogers Subdivision - A subdivision of Government Lot 1.56. Plat submitted by Jesse Lobdell, Surveyor, P.O. Box 7517, Nikiski, Alaska. City Planner Kebschull reviewed the staff report included in the packet, noting the following: • Approval of the plat would subdivide Government Lat 156 into two lots. • Both lots would meet the minimum lot size and dimensions required for the Rural Residential zone. • The plat would dedicate a half dedication for the Highbush Lane and Rainbow Drive rights of--way. • The property is served with on-site water and sewer as city utilities are not available. • The current nonconforming structure located on the lot to be designated as Lot 156B and accessed via a driveway along Rainbow Drive. • From the survey, the existing structure on the new Lot 156B encroaches into the front setback along Rainbow Drive, but because it is a nonconforming structure and the subdivision would not increase the nonconformity, the property could be subdivided. • No installation agreement for the Rainbow Drive right-of--way was being required because the property was accessible off Rainbow Drive by a driveway in use since at least 1984. • Administration recommended approval with the correction of the street name to Highbush Lane. The floor was opened for public hearing. There being no one wishing to be heard, the public hearing was closed. MOTION: Commissioner Wells MOVED for approval of PZOS-46 with the change of the street name from Highbush Street to Highbush Lane as noted. Commissioner Koester SECONDED the motion. Commissioner Bryson recused himself because the issue would come before him at the Borough Planning Commission level. PZ08-47 -- A resolution of the Planning and Zoning Comrz~ission of the City of Kenai, Alaska, recommending to the Council that the Kenai Zoning Code at KM C .14.20.180 be amended to prevent the same or substantially similar variance permit applications from being considered by the Planning & Zoning Commission more than once in any nine- month period. Kebschull reviewed the staff report included in the packet, noting the action was a housekeeping issue to correspond with other areas of the code providing for anine- month period before reapplying for a variance. The floor was opened for public hearing. There being no one wishing to be heard, the public hearing was closed. The subdivision is located in the Suburban Residential zone. The resulting parcel meets the minimum lot size and dimensions for the zone. This subdivision creates a lot with frontage on two streets, Baker Street and Cooper Lane. These parcels are under single ownership. There is a house on the current Lot 2. This residence is served with city water and sewer. On the current Lot 5, there is an accessory structure which is considered anon-conforming structure since there is no principal structure on the lot. The current Lot 3 is vacant; however is used for gardening and the plan is to place a greenhouse on the lat. This plat is being proposed to eliminate the non-conforming use and to allow the placement of the greenhouse on the property. The plat also vacates a 20-foot utility easement. There are no city utilities in the easement. Cooper Lane and Baker Street are gravel and maintained by the City of Kenai. No installation agreement is required. The applicant has made an offer to purchase this residence to use for administrative offices far his wife and himself. The applicant notes there will be no customex activity or retail of any kind at this location. Also, no signage is planned. This business is solely carried out by use of phone, fax, and mailldelivery service. As described, if the applicant intended to reside at the residence, no zoning permit would be required {KMC 14.20.230(g){1}. Because the intent is to use the residence solely for an administrative office, a Conditional Use Permit is required. KMC 14.20.150 details the intent and application process for conditional uses. The Cade also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. "The RS Zone is intended to provide far medium density residential development in areas which -will be provided with common utility systems. " (KMC 14.20.09Q) The code provides for uses which do not violate the residential character or generate heavy traffic. This is a request to use the residence as an administrative office for the applicant and his wife. No renovation is planned for the residence. No signage is planned. The use, as described in the application, should be conducted so that the average PZO8-49 -Comments Page 2 neighbor, under normal circumstances would not be aware of its existence. The proposed office does not appear to violate the intent of the zoning district, 2. The value of the adjoining property and neighborhood will not be significantly impaired. The proposed use is in harmony with the Comprehensive Plan, The Neighborhood Residential Land Use Classification is defined on Page 29 of the Comprehensive Plan. However, due to the description of the proposed business, the use appears in harmony with the Comprehensive Plan. 4. Public services and facilities are adequate to serve the proposed use. The original. permit was approved in October 2006. The Commission approved a temporary permit for one season {2007) requiring a review after that season to determine if a permanent permit should be issued. Because of the extensions granted, this year is the first season Kenai Cottages has been operated. Ms. Fleck sent in a request that the Commission review her permit and grant the permanent Conditional Use Permit. The applicant is in compliance with sales tax and State business licensing requirements. The fire inspection is due for follow-up in December. There is no record of any complaints being received by the City.
