CITY OF KENAI
ORDINANCE NO. 3320-2022
AN ORDINANCE ACCEPTING AND APPROPRIATING A DONATION FROM HILCORP ENERGY
COMPANY TO ASSIST WITH THE ANNUAL AREA-WIDE SENIOR THANKSGIVING DINNER.
WHEREAS, annually the Kenai Senior Center hosts a Thanksgiving Dinner that is open to seniors from
all over the Central Peninsula; and,
WHEREAS, the City has received a donation from Hilcorp Energy Services in the amount of $3,500 for
the purchase of food and supplies for the dinner; and,
WHEREAS, it is in the best interest of the city of Kenai to accept and appropriate this donation for the
purposes described above.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, AS
FOLLOWS:
Section 1. That the City Manager is authorized to accept a donation from Hilcorp Energy Company
in the amount of $3,500 and to expend the donated funds to fulfill the purpose and intent of the donation
and this ordinance.
Section 2. That the estimated revenues and appropriations be increased as follows:
Senior Citizen Special Revenue Fund:
Increase Estimated Revenues –
Donations $3,500
Increase Appropriations –
Congregate Meals – Operating Supplies $2,000
Home Meals – Operating Supplies 1,500
$3,500
Section 3. Severability: That if any part or provision of this ordinance or application thereof to any
person or circumstances is adjudged invalid by any court of competent jurisdiction, such judgment shall
be confined in its operation to the part, provision, or application directly involved in all controversy in
which this judgment shall have been rendered, and shall not affect or impair the validity of the remainder
of this title or application thereof to other persons or circumstances. The City Council hereby declares
that it would have enacted the remainder of this ordinance even without such part, provision, or
application.
Section 4. Effective Date: That pursuant to KMC 1.15.070(f), this ordinance shall take effect
immediately upon enactment.

SUBJECT: Ordinance No. 3320-2022 – Hilcorp Energy Services Donation
Hilcorp Energy Services has donated $3,500 for the annual Areawide Senior Thanksgiving Dinner
to be held on Friday, November 18, 2022. This is the ninth year Hilcorp has provided funding for
this event. During the COVID-19 years, we were able to provide curb-side and home-delivered
meals. This year we will have in-house dining, as well as curbside and home-delivered meals for
this event.
The Areawide Senior Thanksgiving Dinner is a tradition that began in 1976. A Homemakers Club
provided and served the first meal. From there it grew and has been passed on through Unocal,
Agrium, and Marathon Oil and since 2012, Hilcorp has continued the tradition by providing the
funding and the volunteers. We are fortunate to live in a community that celebrates the elders
who helped make Alaska what it is today.
The donation will be used as follows:
Congregate Meals – Operating Supplies $2,000
Home Meals – Operating Supplies 1,500
Total Donation $3,500

CITY OF KENAI
RESOLUTION NO. 2022-74
A RESOLUTION ESTABLISHING DATES FOR REGULAR MEETINGS OF THE CITY COUNCIL FOR
2023.
WHEREAS, pursuant to KMC 1.10.040(a), regular meetings of the Council shall be at a time set by a
resolution of the Council on the first and third Wednesdays of every month; and,
WHEREAS, pursuant to KMC 1.10.040(b) on or before the last meeting of December, the City Clerk shall
introduce a resolution, on behalf of Council, establishing the dates for the subsequent year’s Council
meetings; and,
WHEREAS, pursuant to Kenai Municipal Charter 2-6, this calendar must include a minimum of twenty
regular meetings each year and at least one regular meeting each month; and,
WHEREAS, the City’s Charter allows for cancellation of meetings by the Mayor due to lack of a quorum
or for an emergency, or by a majority of council members for any reason as long as at least twenty (20)
regular meetings are held each calendar year and at least one each month; and,
WHEREAS, it is in the best interest of the City for the Council to provide as much advance notification as
possible to the public and administration of their meeting schedule; and,
WHEREAS, timely adopting a calendar of meeting dates, including any cancelled meetings, provides
advance notice to the public and administration; and,
WHEREAS, pursuant to KMC 1.10.040(c) the Council may cancel or reschedule a regular meeting during
the calendar year for any reason by majority vote; and,
WHEREAS, cancelling the second regular meeting of the City Council in July allows for Council,
administration, and residents to participate in the personal use fishery and other seasonal activities; and,
WHEREAS, cancelling one Council Meeting in July complies with the minimum standards for meeting
requirements as provided in the City’s Charter and Code; and,
WHEREAS, the second regular meeting of the City Council in October falls on October 18, Alaska Day,
which is a City recognized holiday and City Hall will be closed, rescheduling the second meeting to
Thursday, October 19 is necessary; and,
WHEREAS, rescheduling the second meeting of the City Council in October to Thursday, October 19
complies with the minimum standards for meeting requirements as provided in the City’s Charter and
Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA:
Section 1. That the City Council of Kenai establishes the following Calendar of Meetings for 2023:
regular meetings shall be held every first and third Wednesday of each month, except that there will not
be a second meeting in July, and that the second meeting in October will be rescheduled to Thursday,
October 19.

SUBJECT: Resolution No. 2022-74 – Setting Council Meeting Calendar
Pursuant to KMC 1.10.040(b), this Resolution is intended to establish a calendar for the regular
meetings of the City Council in 2023.
Pursuant to City Charter, a meeting may be cancelled by the Mayor due to a lack of a quorum,
for an emergency, or by a majority of council members for any reason as long as at least twenty
(20) regular meetings are held each year and at least one each month. The proposed resolution
maintains at least one regular meeting each month and more than the minimum twenty (20)
regular meetings each year.
After reviewing previous calendars, this resolution proposes scheduling regular meetings every
first and third Wednesday of each month, except for the month of July, when the second meeting
would be cancelled. The second meeting of July coincides with the peak season of the personal
use dipnet fishery which consumes the full attention of the administration and is a busy time of
year for other residents.
This resolution also proposes an exception during the month of October, when the second
meeting falls on October 18, Alaska Day, which is a City-recognized holiday when City Hall will
be closed; this resolution proposes to move the second meeting of the month to Thursday,
October 19.
The second meeting in November or the first meeting in December may be cancelled as it could
coincide with the Alaska Municipal League conferences in Anchorage; however, there are five
Wednesdays in November 2023 and having five weeks between meetings makes it difficult for
Administration to accomplish the business of the City.
The calendar attached to this memo is included for your reference and is not an exhibit to the
Resolution.

A Regular Meeting of the Kenai City Council was held on October 19, 2022, in City Hall Council
Chambers, Kenai, AK. Mayor Gabriel called the meeting to order at approximately 6:00 p.m.

Clarification was provided that this would appropriate the $6.5 million received from the State of Alaska
Legislative Grant and would help support the 35% match requirement of the City; there was discussion
regarding the number of individuals who worked towards this goal over the last 30-years.

Clarification was provided regarding the upcoming City Manager Recruitment timeline and that the
request before the Council at this time was to authorize the Supervisory Subcommittee to compose a list
of interview questions for Council review at the November 2, 2022 City Council Meeting.

6. Discussion – Scheduling a Work Session with the Kenaitze Indian Tribe. (Administration)
Clarification was provided that the purpose of the work session would be to strengthen the relationship
between the two organizations; provide an opportunity to discuss items of importance to both
organizations; and explore ways to partner in future projects.
The work session was scheduled for November 2, 2022 beginning at 4:45 p.m. through 5:45 p.m.

Council Member Knackstedt thanked Council Member Pettey and Vice Mayor Glendening for their
service; congratulated newly elected Council Members Askin and Douthit and re-elected Mayor Gabriel.
Vice Mayor Glendening stated his thanks for the opportunities; noted is gratitude for working with
everyone over the years; congratulated the newly elected Council Members and reminisced some of the
high points of his last six year serving on the Council.
Council Member Winger thanked Vice Mayor Glendening for his service; noted she enjoyed working with
him and his sense of humor; thanked the City for the Alaska Flags being posted on Alaska Day; thanked
the Kenai Fire Department for their service to our community; and reminded everyone to be cautious and
watch for the kids on Halloween.
Council Member Sounart welcomed newly elected Council Members; thanked Council Member Pettey
for her service and for standing her ground during COVID to keep our community open; and she thanked
Vice Mayor Glendening for his service.
Student Representative Thibodeau thanked Vice Mayor Glendening and Council Member Pettey for their
service; and welcomed the newly elected Council Members.
Council Member Pettey stated that it had been an honor serving the community; congratulated the newly
elected Council Members; thanked the Department Heads of the City for their exemplary work; thanked
the citizens for their trust; and stated she was proud to live in the City of Kenai.
Mayor Gabriel presented Vice Mayor Glendening and Council Member Pettey with plaques noting their
service to the City and thanked them both for their service.

SUBJECT: Action/Approval – Grant Utility Easement within Lot 2, Block 5, General
Aviation Apron Subdivision No. 1 Amended
Scott Huff, on behalf of Homer Electric Association, Inc. (HEA) has requested for a utility
easement within Lot 2, Block 5, General Aviation Apron Subdivision No. 1 Amended, filed under
plat no. 2004-20 in the Kenai Recording District, Third Judicial District, State of Alaska. HEA
received a request from the current leaseholder, SOAR International Ministries, Inc. to remove
the existing electric line between the subject lot and adjacent lot (i.e., Lot 3) and place the primary
electric line along a portion of the southwest boundary. The proposed easement would be
approximately 15 feet wide and 135 feet long, for a total area of +/- 2,025 square feet. The
proposed utility easement would allow for the property to be improved and allow the current
leaseholder to access the taxiway with aircrafts.
Kenai Municipal Code Subsection 22.05.135(b), states that “[r]ights-of-way and easements may
be accepted or issued by the City Manager after approval by the City Council for utility lines and
services of all types and for necessary rights-of-way easements. This requirement does not apply
to rights-of-way or easements dedicated through the City and Borough platting process.”
If City Council approves the request for a utility easement, then the City Manager will be
authorized to sign the Utility Easement Agreement.

Please find enclosed a utility easement request that will allow Homer Electric Association, Inc.
(HEA) to install a primary electric line within Lot 2, Block 5, General Aviation Apron
Subdivision No. 1 Amended, plat no. 2004-20 KN. HEA has received an application from the
lease holder of said lot to rework the existing service by removing the existing electric line from
the middle of the property and place a new primary line on the southwest boundary. As this is a
primary electric line, an easement is required to be granted by the landowner to allow HEA to
have the ability to install and maintain the primary electric line.
Please review the attached easement document to verify that the information is correct and meets
your satisfaction. If the language meets your satisfaction and you are agreeable to granting the

UTILITY EASEMENT
The City of Kenai, whose address is 210 Fidalgo Ave. Ste 200, Kenai, AK 99611, for a good
and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant to
Homer Electric Association, Inc., an Alaska non-profit electric cooperative, 3977 Lake
Street, Homer, AK 99603 (“HEA”), its successors and assigns, the following described sole
and exclusive easement in perpetuity:
Within Lot 2, Block 5 General Aviation Apron Subdivision No. 1 Amended according to
the official plat thereof, filed under plat number 2004-20, Kenai Recording District, Third
Judicial District, State of Alaska.
More particularly described as follows, 15 foot wide by 135-foot-long beginning at the
west corner of said Lot 2 Block 5 and adjoining the southwesterly boundary of said Lot
2 Block 5, being +/- 2025 sq. ft. in area.
Said easement is shown on EXHIBIT A, attached to and made part of this easement.
This grant gives HEA the right of ingress and egress together with the right to construct,
reconstruct, repair, maintain, operate, upgrade and patrol, for the transmission and distribution
of communication services and electric current, wires, cables, poles, and all necessary
appurtenances, and to remove, renew, replace, add to any or all of such facilities, through, over,
in, under and across the aforesaid premises as may from time to time be necessary or desirable
for the exclusive use, occupation, and enjoyment of such right-of-way, and the right to excavate,
remove soils or fill on said premises, and the right to cut and keep clear of all trees, shrubbery,
under-growth, and other obstructions on said premises as maybe reasonably required for the
construction, reconstruction, relocation, installation, operation, and maintenance of such
facilities, including the trimming or removal of trees within or without the easement described
above, which Grantee believes threaten its facilities.
Grantor(s) warrant and covenant that Grantor(s) are the owners of the above-described land,
have the right to convey this easement, and that HEA shall have quiet and peaceful use of the
easement. Any entity to whom HEA is legally or contractually obligated to allow the use of
HEA’s easements is also hereby warranted and covenanted the right of ingress and egress and
the quiet and peaceful use of this easement for the entity’s utility purposes.

Session
At the October 19, 2022 meeting, City Council scheduled a meeting for a joint work session with
the Kenaitze Tribal Council for November 2, 2022. Administration was informed this week that
November 2 will not work for several of the Tribal Council Members and they have suggested
moving the joint work session to January 4, 2023 instead.
The meeting would be scheduled for 4:45 – 5:45, prior to the regularly scheduled City Council
meeting. This discussion is intended to determine if a joint work session with the Tribal Council
on January 4, 2023 from 4:45 to 5:45 will work for the City Council.

Commissioner Rigall MOVED to recommend that the perimeter of the Kenai Municipal Cemetery
Expansion be created by landscaping around the property. Commissioner Dennis SECONDED
the motion.
Assistant Director Best provided a staff report discussing how a landscape-based plan for the
Kenai Cemetery Expansion would be much more feasible and could potentially allow for more
funding for other areas of the expansion.
Commission discussed the potential for vandalism, moose getting into the cemetery, and the
species and height of trees that would be planted. It was noted that there is not yet a final plan
for what would be planted.

Commissioner Joanis thanked the City and all the hard work they do, and asked about how the
Kenai River Marathon went.
Commissioner Rigall noted that it would be great to see an economic impact study done to see
the effect of Parks & Recreation events.

a. Chera Wackler, Peninsula Period Network
Chera Wackler discussed the mission of the Peninsula Period Network to provide readily
accessible supplies in bathrooms at Kenai Peninsula Borough schools. Her presentation
explained how the program would be working with student volunteers to supply the bathrooms;
reported on current finances; how to donate supplies or money; current approval status with the
school district board; and vendor agreements for bulk purchasing.
Further discussion involved timeline for implementation; plans for future program expansion;
that the program does not intend to provide menstruation education in schools and will leave
that to schools; how the program plans to get the word out about the program; and how the
mini-grant will provide startup funds to get the program off the ground. It was clarified that the
program has not yet been presented to school principals, and is currently seeking
superintendent approval.

school district. Clarification was provided that the funds should also be spent within the City.

Douthit SECONDED the motion.

Clarification was provided that the Clerk’s Office had reached out to the applicant several times
via voicemail and email over the course of several months, and had not received a response.
Committee Member Bernard noted that he had reached out to the applicant who had confirmed
that he was no longer interested in pursuing the mini-grant.

Attached is a relatively easily produced quarterly financial report for the General Fund, Personal
Use Fishery Fund, Airport Fund, Water/Sewer Fund, and Senior Fund as of September 30, 2022.
This report is essentially on a cash basis, so there are accounts that may not look reasonable. In
the General Fund for example, sales and property tax revenue only includes payments made to
the City by the Borough through August. The third calendar quarter 2022 sales tax filings and
tax payments are not in at this point and we will not be received for this quarter until the end of
October or early November.
State and Federal is below budget in all funds because of PERS aid. The State doesn’t actually
give us any money. Instead they make an ‘on-behalf’ payment to the pension system. Similarly,
we have not booked expenditures for the PERS the State is covering, so the Non-Departmental
department is way under budget. At year-end we will record revenue and expenditures for these
items.

City of Kenai Investment Portfolio
At September 30, 2022 the City had investments with a market value of $30,305,609. That is
down from $30,305,609 at June 30, 2022. The City’s portfolio is yielding 2.16% that is up from
1.65% at June 30, 2022. The Federal Reserve increased the Federal Funds Rate in July, 0.75%
and again in September, 0.75%, to combat inflation. The current Federal Funds Rate ended
September at 3.25% with additional 0.75% hikes projected. A rise in interest rates has an inverse
effect on the portfolio’s value. Fair market value adjustments to the portfolio through September
30, 2022 are a negative $1,141,658. As of June 30, 2022, the portfolios fair market value
adjustment was a negative $688,957. As rates continue to rise further negative fair market value
adjustments are expected but higher yield on the portfolio will also occur.

Permanent Fund Investments
The third quarter 2022 saw volatility and losses in the equity markets. Losses as a result of rising
interest rates and declines in the equity markets resulted in third quarter total losses of 5.22%.
Since inception the portfolio has returned 6.61%. As of September 30, 2022, the portfolio value
was $28,718,382, comprised of $24,510,683 (85.35%) Airport Land Sale Permanent Fund,
$3,042,450 (10.59%) General Land Sale Permanent Fund monies, $1,003,535 (3.50%) Kenai
Senior Connection monies, and $161,714 (0.56%) Kenai Community Foundation holdings.

Notice of Public Scoping Under Administrative Order 266
for Possible Regulations Regarding Derelict Vessels
The Alaska Department of Natural Resources (the Department) is considering drafting regulations
regarding the derelict vessel prevention program fund outlined in the Alaska Statutes at AS 30.30.096,
and derelict vessel enforcement authority outlined at AS 30.30.010(e) and (f) and at AS 30.30.165.
Regulations for the fund would allow the Department to direct disbursement of monies that have
accumulated in the fund to benefit communities, agencies, and organizations impacted by derelict
vessel issues. Enforcement regulations would outline administrative processes for citations issued
under AS 30.30.010.
The purpose of this notice is to ask the public for their ideas and suggestions before the Department
undertakes the task of drafting any specific proposed regulations for public review.
Written input must be received no later than 5:00 p.m. on November 14, 2022. Please send all
