Atty. Rogers reviewed the proceedings and explained, Council
would have to make a determination if they want to have an
appeal in view of his memo (in the packet). Councilman
Measles said he did not believe there was a legitimate
reason for appeal.

Councilman Measles moved, seconded by Councilman Ackerly,
that Council sit as an Appeals Board and hear the appeal
that is before them.

8-1 Michael Treat - Treat's Custom Cabinets - Extend Water to
Gusty S/D
Michael Treat, 358 Coral, Kenai. Mr. Treat reviewed the
letter in the packet. He Is asking for a water main to be
put in his building. it would be approximately 700 ft. to
his building. Their insurance company has said if they
cannot put in a sprinkler system they will lone their
coverage. If they go to another company, their premiums
will go up 2-3 times. With a sprinkler eystem, their rstes
will be out in half. They have now started doing modular
cabinet work and feel they will do well. They employ 7
people year round and hope to expand to 12 people. They are
located behind the car wash, if it is developed it would be
leased out to businesses and would beautify Kenai.
Councilman Ackerly asked if he would be willing to fors an
assessment district. Mr. Treat replied, yes and noted it is
City -leased land. Mayor Wagoner added it cannot be sold,
just leased. Public Works Director Kornelis reviewed the
cost, it would be $700000, That does not include the road
work. There is a lot of silt there. The request is for
water onlyp not sewer. It is f16 on the capital improvement
list. Mr. Treat explained he needs a plan from the City and
a date for the insurance company. Mayor Wagoner asked if he
had checked into an electric pump and tank. Mr. Treat
replied it would be expensive. Councilwoman Bailie
suggested running water from the cemetery. Mr. Kornelie
replied, there is no water on that street. He added, Cohoe
has a line, it is a small line and is not sufficient. Mayor
Wagoner asked if he could use a chemical system. Mr. Treat
replied, it would coot $159000 and could not be used if they
got water. Also, water is safer. Mayor Wagoner said they
would have an answer for Mr. Treat at the May 21 meeting.
Mr. Kornelis noted there is water on Main St. Loop, he will
check if they can go that way. Councilman Ackerly asked if
they could put a well in. Mr. Treat explained, they could
not gent enough pressure, they have a well but they would
need a reservoir tank. Council agreed to discuss this item
at the work session scheduled to review items G-6 through
0-9 .
8-2 Nick Miller - S. Ames Road Extension
Nick Miller, 609 Amee, Kenai. This road project has been
engineered, but he is hearing conflicting reports whether it
will be done this year or next year. He has heard there are
different sources of income. There Is increased use of the
road and the and of Ames Rd* does not have a good turnaround
for City truck@. He asked if it could be done this year.
Mayor Wagoner ssid, we will know what happens in Juneau
(Legislative session) by May 21 and asked if this was
acceptable* Mr. Miller replied he realised it was on the
capital improvements list.and amid Hey 21 would be
aoceptable. Councilmen Wise suggested the City has 0750000

Mr. Kornelis explained# they only did part of Ames Rd. The
extension was to be re -platted. The preliminary plat was
filed# the final needs to be done by June 6.
MOTION$
Councilman Wise moved for Administration to proceed with
advertisement of bids.(for Ames Rd.).
Motion failed for lack of a second.
Mayor Wagoner said Council will have the information by the
May 21 meeting.
13-3 frank Arbelovskyj City Electric, Mile 16.3 Spurt Kenai. Mr.
Arbelovsky distributed information. He is asking Council to
assist in resolving a problem. The City advertised for bide
to replace fixtures in 3 subdivisions last fall. NO was low
bidder and ordered the materials. He found out the poles
are owned by HEAq they cannot work on HEA poles. He
understood HEA purchased the poles when they purchased the
old Kenai City Light. He is unable to fulfill his contract
and cannot get paid for $399000 worth of fixtures. They
have to be operational before he can get paid. HEA told him
they did not want the fixtures on their poles. There is a
possible re -stocking charge, it will be a 30% lose. He has
discussed this with HEA and Public Works and they have
reached an impasse. He suggested the City take ownership of
the poles. If they did that, everything would be metered
and the City can do what they wish with the poles. Because
of the costs involved and the agreement with HEA they will
not accept the fixtures at this time. Public Works Director
Kornelis said this is more involved then is presented# he is
not prepared to talk about it. Mayor Wagoner suggested this
be put on the work session agenda with items G-6 through
G-9.

Mayor Wagoner noted he has received calls from busi.nesse•
asking for phones in the airport. He suggested purchasing
or leasing a phone bank board and putting it where the 4
public phones are. It would not have long distance
capability

Airport Manager Ernst explainedg every time they do a
pre -application for airport funds they have to submit a sap
of current airport boundaries. Every time they change land,
they have to emend. The one they have is very large. This
will be in book forms they can change the pages. This is
AIP funds, they will get reimbursed.

Councilwomen Bailie noted we have 7 mowers, 3 are riding.
Recreation Director Mcall�ivray explained, one has been here
since before he was hired and cannot be fixed. The others
mrs'not running continuously. This one is diesel and will
be better. He has asked the shop to surplus the old mower.

Councilman Ackerly asked if it we could state the funding
sources# property taxi bed taxi etc. Atty. Rogers replied
it would not be appropriate. Mayor Wagoner said this may
not be paid for without an increase in the mill rate, the
budget has not been passed. Councilwoman Bailie sold
finance Director Brown has distributed o memo regarding
financing and the Community Center Committee has figures.
The memo from Atty. Regale states we can have a bed tax. We
will not have to rules the mill rate. Mayor Wagoner noted
the $2109000 figure was the bond pay off and that amount
ggoing to the Community Center. If we are going to use the
i210,p000 we will have to take out something in the budget.
Councilwoman Beilie asked, what other project would bring
money into the City? A big plus for community
renters in other cities is the spin-off. HEA will be going
in# this may be the last year we will get money from 3unesu,
this is f1 on the capital improvements list. The bed tax is
allowing a portion to the Chamber Visitor's Bureau. We have
a large convention coming the end of May, we can see the
impact. Mayor Wagoner said he did not see this as the and of
the line in 3uneaug in 2-3 years it will go up.
Councilwoman Dellis noted we are facing an increase (in
taxes) at the Borough level. The mill rate will go up. We
should look at methods to stimulate the economy. It is
needed by all of the community. Councilman Wise explained
the amendment (to list all costs). If we know we have to
spend $1.5 Million to finish, we should be honest with the
people. Mayor Wagoner said we are looking at a lose of
interest income if we use the $210.000. Clerk Whalen
reported the Borough will not be able to have their election
on June 249 they are 300 signatures short on the petition.
It will be at least July 1. She will have an amended motion
with the Borough election date if Council wishes to uae that
date.

sample now and it agrees with the space. They feel the
asphalt is good. Councilmen Ackerly asked if they draw from
the stockpile. Answer - yea. He asked, whet if they change
piles? Mr. Kornelie replied, they must submit a new
sample.

Visitor Industry Program with Motel/Hotel Tax
Councilwoman Bsilis explainedp Soldotne is anxious to
promote tourism but cannot levy a bad tax. She is not sure
the Borough can without an additional person on the payroll.
She thought it better if each city did their own. Kenai is
in a unique situation, we are a let close home rule city
under a Borough and can levy a bed tax. She suggested we
not urge the Borough.

does not feel comfortable with the narrow right of way.
Future roade going in will have a problem with this.

Clerk Whelan reviewed the proposal and stated she would
recommend a contract basis. Councilwoman Monfor said she
had thought using high school students was a good ides, but
now felt that would be difficult. The comm. & comm. deserve
better than they are getting. It is not right for a
commissioner to be a secretary. Councilman Ackerly said he
would prefer not having a city employee. It would be $49320
annually with a contract. Councilwoman Bailie said this is
the only way Council can keep abreast of what goes on at the
meetings. Clerk Whelan added she would recommend keeping
the same person for all meetings if possible. Councilman
Ackerly noted conflicts of meeting times would be a
problem.

from the agenda because there has been some progress.
They have had .several meetings. The Peninsula Learning
Resources people in the communit center have lost
a substantial amount of their grant but Still need
apace to continue a part of their program. They are
willing to use the Recreation Director's old offices in
th*.Fine Arts Center. We could put the Preschool in
the community venter building. The Historical Society

Update). The doctor wants an increase, we have not put
this in the budget.
e. Regarding item Info #13 (DOT - Airport AIP
Pre -Application). DOT says they will not okay surplus
moneys for a float plane basin because the State is not
in the business of developing float plane basins.
Mayor Wagoner noted there are State-owned float plane
basins in Juneau, Fairbanks, Sitka and Ketchiken. He
suggested Atty. Rogers review and contact our
legislators.

Atty. Rogers spoke.
a. Regarding item Info 03 (Wildwood Devel. -
Purchase of Property by City). In view of the
rejection without a counter-offer, he suggested the
City withdraw the application for 1986 and continue
negotiations in hopes the seller would offer a fair
price. He will talk to FAA. If we get it in a timely
manner, we would re -submit. We will take the negotiated
figure subject to FAA approval.
Council agreed to the suggestion.
Airport Manager Ernst said the float plane basin is put
back to 1987. Councilman Wise said the owners have not
made an effort to get an appraisal. Atty. Rogers
suggested we contact the owners, make a proposal to pay
them our offered price, have them give us a doed, enter
into a contract to stipulate to a Master's Hearing and
pay what the Master's Hearing decides. it would limit
the risk, but would bind the City to a Master's
Hearing. Mayor. Wagoner suggested condemning that
section, go ahead with the project and pay what it is
worth. We do not need 60 acres. Atty. Rogers replied
the City can only condemn what is imperative. There

Mayor Wagoner spoke.
9. A citizen recently asked why we do not have library
hours on Sunday. Librarian DeForest replied# we would
need another person. Mayor Wagoner suggested the
library be closed on Monday. Librarian DeForest
replied that Is their busiest day.
b. He was told that the Dept. of Highways was moving the
position of purchaser from Soldotne to Anchorage. They
make ;1•.5 Million worth of purchases per year from the
Kenai/Soldotne area. All purchases would be in
Anchorage. He requested a resolution opposing this,
have City Manager Brighton contact the Highway Dept* to
see if there is something we can do. The reason for
the transfer is because Anchorage has been out and this
is to fill the lost positiun.
Council agreed to the request.

tournament of softball (Little League) to Soldotne.
Mayor Wagoner told him he would give them 500 "Kenai"
pine if Soldotne would match it. It would cost $500.

d. Councilwoman Monfor said she reviewed the Kenai River
Special Management Area report, she felt it was bad.
Mayor Wagoner said they were supposed to come back with
recommendations from all committees and turn it over to
the Div. of Parks. The have come out with an
environmental impact statement. It is not what the
committee thought would happen. He may want to have
concurrence of Council to speak to the association that
the City will not take pert in this because it is not
in the beat interest of the City. He will review with
PAZ at a later date. Even if he votes negative it is
part of the action. Councilwoman Monfor noted this was
not the intention of the Board at the beginning.

ratifying, it wee listed under item G-2.

at this date, but the Atty. General's office rejected
this. They require a notice of every change since

Librarian DeForeet said regarding hours at the library. This
will be coming up more and more. She wee hoping Council
would see the need for additional people in the future. One
evening worker is paidg the other is volunteer. It is not
safe to work alone and it is too busy.
I. PERSONS PRESENT NOT SCHEDULED TO BE HEARD
Be Fr. Tergonsky, Russian Orthodox Church. Tourists are
arriving already, when will the museum be opened? Sr.
Citizen Coordinator Porter repliedg it will open on
Memorial Day.
b. Fr. Tergonsky, Russian Orthodox Church. Regarding the
Mission Rd. sign. That is a private road, but the sign
is gone now Now was that placed on Church property
without permission? There is no mail pick-up at the
boxes, they can be removed. Mayor Wagoner referred the
matter to Administration.
c. Fr. Tergonsky, Russian Orthodox Church. He asked for a
salary for his services as a guide for the Russian
Orthodox Church. He noted they may have to stop the
service otherwise. He requested a reply in writing.
Mayor Wagoner replied he has requested this before and
has been refused. He explained, the City is not in a
position to provide tour guides in the City. There
would be others with the some argument. He suggested
he check with the Chamber of Commerce. Fr. Tergonsky
replied they have said they would love to but do not
have the funds.
d. Councilwoman Bailie. She distributed a proposed
pamphlet for promotion of the community center. She
noted the Borough wanted to provide a hockey facility
for the area but did.not. If we pput a hockey rink
outside (regulation size - 8gx200)p it would cost
$95,000, it is needed in the area. It could be used
for barbecues and dances in the summer* it could be
taken from federal revenue funds. in addition, per
Atty. Rogers' memo, the City may be able to promote the
issue. If it is legal, she hopped the City would
appropriate funds to promote Me. It has been 11
priority for 3 years. We have 10% of the funds to show
the Legislature our interest. Mayor Wagoner suggested
private donations to the promotion, and keep it away
from the City. He would prefer the City publish a fact
sheet only. He asked if that could be dons without
going to APOC. Atty. Rogers esplied, his'aamo says we
can, Mayor Wagoner said at the time this was started,
we wore.not looking at a short fail in revenue .Shoring.,
and'suhlcipol assistance. We are looking at s larger

Wagoner felt it was premsture to go the voters at this
time because of the antenna fare and the clissto of the
people at this time. Councilman Hall noted this is
just introduction of the ordinance for a Special

election. it will be debated at public hearing. He
asked to postpone public hearing till we get numbers
from Juneau (Legislative session). Councilwoman Bailie
noted if we don't go out to vote, we will never know,
if we don't go out this year we will never get funds
from Junesu. We are not doing anything to promote the
economy. Mayor Wagoner asked if she thought we would
got the funding from Juneau. Answer - yse. Mayor
Wagoner said, even if the Legislature approvest it will
still have to go to the Governor. Councilwoman Bailie
said if we get $1.5 Million, that will start the
project. The rest will be landscaping and roads. it
wou d not be completed for 1 to 1-1/2 years. We can
Institute a bed tax to start immediately and put that
into reserve. The need will be greater 3 years from
now. We owe this to the voters to say yse or no. She
asked if the funds from the Legislature could be saved
for 5 years and not be spent. Finance Director Brown
replied yea. Mayor Wagoner asked if the money could be
re -allocated by legislative action if it was not used.
Mr. Brown did not know. Councilwoman Sallie noted that
is a chance we would have to take. Mayor Wagoner sold
we should know what the Legislature will do by the May
21 meeting, it will adjourn May 12, Councilwoman
Bailie asked if the Council had any opinions on the
hockey rink. Mayor Wagoner said he preferred it to be
with the achool district.
