ROLL CALL Presents Jess Hall, Ray Measles, Chris Monfor, Jahn Wise, Tom Wagoner, Tom Ackerly, Sally Bailie Absents None A-1 Agenda Approval Be Mayor Wagoner asked that item G-4, Resolution 84-6, be changed to item C-6, as it required a public hearing. b. Mayor Wagoner asked that item C-7 be added, Resolution 84-7, Requesting Alaska Board of Fish Hold Their March Meeting in Kenai/Soldotna Area c. Mayor Wagoner asked that Games of Chance h Skill Application for the Holy Assumption of the Virgin Mary Orthodox Church be added as item G-6a. This was held back at the last meeting because some amendments were requested. d. Mayor Wagoner asked that the requisition for Contractor's Equipment;in the amount of $2,559.36, distributed this date, be added under item G-29 Requisitions Exceeding $1,000. A-2 Consent Agenda MOTIONS Councilman Measles moved, seconded by Councilwoman Bailie, to approve the Consent Agenda as submitted. MOTION, Amendments Councilman Wise moved, seconded by Councilwoman Monfor, to delete a portion of item G-2, Morgan Steel, in the amount of $6,231.11 from the Consent Agenda. Any item specifically noted for deletion from the Consent Agenda is automatically deleted. No vote is necessary. Mayor Wagoner explained the Consent Agenda concept. He added, all it deals with is housekeeping items. It is meant to make quicker response time for meetings. Motion passed unanimously by roll call vote. B. PERSONS PRESENT SCHEDULED TO BE HEARD B-1 Bruce Robson, McLane 6 Assoc. - Section 36 Preliminary Corridor Concepts Mr. Robson explained, McLane do Assoc. has the contract to develop the subdivision plan for Section 36. They have had 3 meetings with Planning do Zoning. There are 3 schematics for the corridor - primary access for the internal flow of traffic and primary utility lines. From this the secondary streets will come off. The report was submitted a couple of weeks ago. a. Schematic 1i1. Spur Collector corridor. There is a major front road parallel with Spur. b. Schematic #2. McLane recommends this. The primary corridor divides it into 1/2, there are 4 primary accesses. i T KENAI CITY COUNCIL 3ANUARY 19, 1984 Page 2 c. Schematic 03. The primary corridor goes to the bluff. It is much like the Thorpe plan of 1980. There is a 4-point access. The collecting street is on the bluff. McLane presents these to Council, then they will go forward ' with one. They recommend #2 as the most viable. P&Z agrees. It provides the City with the most flexibility for development and optimum cost of utilities. It allows immediate access to property. Park systems, vegetation screening, highway screening, and primary control of traffic are included. 01 is low cost, immediate return will make it more expensive. A2 provides for better development, least cost for immediate return. #3 would be the most expensive for immediate development, there would be much traffic on the bluff, it would decrease the value of that property. The primary corridor is 80 ft. right-of-way, the secondary streets are 60 ft. right-of-way, with 24+ ft. width. They did not recommend a narrow width, it would cause problems at a later date. They have not defined the tract as final, just preliminary. It can be changed. With all 3 alternatives, they noted a storm drain to the north, the City will have to maintain legal right to access there and not allow development. The property to the south would be good for a park. A pocket park is recommended in the center, the size could be determined at a later date. Councilman Wise noted it was their intent, and it would be = written in• that no lots would front on collector streets, but on secondary streets. Mr. Robson agreed and added, it would control traffic. Councilman Ackerly asked, is Section Co 40 acres? Mr. Robson replied, without right-of-way, about 38 acres. He added, if they get into design, they will have to provide costs for water & sewer. Councilman Hall asked if the City was planning to put in main water & sewer lines. Mayor Wagoner said he thought that is why the City passed LID's, so they would not have to stand the costs. Councilman Hall said a developer would take a look at main streets, that they could not do developing. Mr. Robson explained, they were talking about driveways. Councilman ` Hall said, but the streets with lots on both sides and you had access on the main street, there would be less streets. If the City puts collectors in, okay, if the developer puts them in he will have to put in a lot of streets. Mr. Robson explained, you are talking about 150 acres, 4 lots per acre, "t.. 500 lots, 3-4 people per lot, There would be a lot of _= traffic. MOTION: Councilwoman Bailie moved, seconded by Councilman Ackerly, = i to accept alternate 02. MOTION, Correction: Councilwoman Bailie, with consent of second, changed the wording to accept the guidance of concept #2. Motion passed unanimously by roll call vote. `-- - Lj Mr. Robson explained they will take this schematic and provide 3 concepts from that. Mayor Wagoner noted the completion date is April 30. He asked Mr. Robson if he had ' '. discussions with the company, and were there any problems. Mr. Robson replied, there were no probleioa. It will go back to P&Z 1-25-84. k• KENAI CITY COUNCIL JANUARY 18, 1984 Page 3 B-2 Bob Bielefeld, Kenai Aviation - Airport Lease Mr. Bielefeld explained he wished to discuss the lease he has been trying to finalize. City Manager Brighton, Atty. Rogers are in disagreement on this. He has an unimproved block, not connected by road or taxiway. He had agreed to put in a road with a difference in the lease payment. He had to develop 500 ft. to the taxiway. He would like to have it in his lease that he would be guaranteed taxiway to his property. They have guaranteed access. He wants a taxiway no one can park on. The fish ramp is near the taxiway. They will block it in summer if his taxiway is there. He can get them to move the planes, but how long will it take? Also, the extended ramp will go in front of his property and he will be blocked again. He intends to have one definite point for access. Mayor Wagoner said if the City designates it, they cannot park there. Mr. Bielefeld noted every airport he has been on, there is access to the taxiway. Atty. Rogers explained, it is incumbent for the City to maintain the taxiway, per City Code to ensure access. If we frustrate the primary purpose of the lease, he has a right to take action. The concept of Ultra Vires & Void act says we cannot make a contract on a thing that is already required by law. Mr. Bielefeld replied he is not asking the City to maintain it, he would maintain and put in lights till the City takes over. Atty. Rogers noted that clause does not exist in any other lease. Mayor Wagoner asked, what process would the City have to go through if Mr. Bielefeld built a taxiway and the City designated it as a taxiway only? Airport Manager Swalley explained, it would have to be on the Master Plan. Public Works Director Kornelis added, when the City receives something like this, it goes to engineering, then to FAA for approval. City Manager Brighton noted, it would not make any difference if the taxiway access was in the contract or not, the City still has the responsibility to move planes parking there. Mr. Bielefeld asked if he would be required to move the lights also? Mayor Wagoner replied, if it is designated parking area, that would take care of it. He added, it is the City's responsibility to keep it clear. Mr. Bielefeld said then they would have to maintain it. Mayor Wagoner said if FAA reviewed it, they would designate and we would have to maintain. Councilman Measles said if it is designated in the Master Plan, there would be no need for that. MOTION: Councilman Measles moved, seconded by Councilwoman Bailie, to direct Administration to proceed in this manner. Councilman Hall asked if Mr. Bielefeld would put in the taxiway, Mr. Bielefeld replied yes. Councilman Hall asked, we would have to maintain? Mr. Kornelis replied, when FAA accepts, it would be just like a City street. He added, we are asking for funds to extend the ramp. That would alleviate the problem. Then you would have access to the ramp. Mr. Bielefeld said he wants a definite area for access, if the City would plan with the ramp to put a taxiway on the inside of the ramp, it would solve the problem. C-3 Rainbow Bar, Pizza Paradisos, Peninsula Oilers 3= MOTIONs Councilman Measles moved, seconded by Councilman Ackerly, that a letter of non -objection be sent to Alcoholic Beverage Control Board regarding Pizza Paradisos send Peninsula Oilers and a 30 day extension regarding Rainbow Bar. There was no public comment. Motion passed unanimously by roll call vote. C-6 Resolution 84-6 - Awarding Contract - Library Expansion and Renovation of Police Dept. - Carmen Gintoli MOTIONS Councilwoman Bailie moved, seconded by Councilman Measles, to adopt the resolution. PUBLIC COMMENT: a. Troy Castimore, Library Commission. The information in the packet refers to a work session. This recommendation was formalized at the Jan. 15, 1984 Library Comm. meeting. b. Linda Swarner, Library Commission. At the work session they recommended Lane, Knorr, Plunkett. They did tho design of the original building. They would stay with the original design. the building has not been re -painted inside. Also, this building is of excellent quality. Councilman Ackerly asked it they had considered the fact that Lane, Knorr, Plunkett have substantial litigation at this time? Commissioner Swarner replied yes, but not on this building. Councilman Hall asked, is there some reason why the i,. 1� KENAI CITY COUNCIL JANUARY 18, 1984 Paqe 5 Commission felt Mr. Gintoli rr,uld not do the some thine with the same quality of workmanship? It should not make that much difference. Commissioner Swarner replied, when the original building was designed, it was planned for an addition. Councilman Measles noted, the wall designed for expansion is not in this section. Councilwoman Bailie asked if the Commission had considered the fact that Lane, Knorr, Plunkett would be $40,000 more? She noted on a limited budget that could be used in addition. Commissioner Swarner replied, they considered it, but they did not know if those funds would be used in the building or for furnishings. Mayor Wagoner noted it is up to the Commission to make recommendations, but Council has to make the decision. Council usually goes to the lowest bidder. The Commission is asking Council to reverse this policy. He noted Mr. Gintoli has done a lot of worn for the City and has had no problem. He has never gone over budget. Commissioner Swarner said she understands this as a taxpayer, but as commissioners, they felt this was better. Councilwoman Bailie asked Mr. Gintoli, doeu he have a plan to follow on the some line as the present building? Mr. Gintoli replied he prepared schematics 2 years ago, they are the some so what is there now. Councilwoman Bailie said she was told they would not be feasible. Mr. Gintoli replied, he can duplicate the present building. He added, the people that did the original drawings are not still there. Both the Library and Police buildings are done that way. MOTION, Amendments Councilman Ackerly moved, seconded by Councilwoman Bailie, to amend the resolution to read in the NOW THEREFORE clause, last line, add after the word "specifications," the words "on library expansion and police station renovation and expansion." VOTE, Amendments Motion passed by unanimous consent. Councilwoman Monfor said she had trouble with the cost difference and the major law suit involved. She noted the City has not had problems with Mr. Gintoli'a buildings. She also would like to keep the money locally. Councilman Wise said the Soldotne High School roof problem did not come from the architect, but the inspector. We should retain the architect to do the inspection. Mayor Wagoner said the contract will be drawn up that inspection costs remain the some for one year. VOTE, Main Motion as Amended s Motion passed unanimously by roll call vote. C-7 Resolution 84-7 - Requesting Alaska Board of Fish Hold Their March Meeting in Kenai/Soldotne Area MOTIONS Councilman Ackerly moved, seconded by Councilman Measles, to adopt the resolution. OLD BUSINESS F-1 Lease Application - Fisherman's Packing Inc. - Kenai Spit Subdivision MOTIONS Councilwoman Bailie moved, seconded by Councilwoman Monfor, to approve the lease application. PUBLIC COMMENTs a. Lottis Edelman. This has been kicked back & forth since April 1982 when they applied for the lot to the west. The reason they applied for the lot was at that time Mr. Dragseth had applied for the lot to the north of them, that was their lot choice. They thought they could work it out. Council approved with the stipulation they dedicate their private driveway. If they were to use it for anything, they would have to place a security fence around 2 parcels. With a 60 ft. drive through the center, there is not much left. When this came through from Council for dedication, she talked to the City and found out the dedication to the north was available. So they put in an application and released the one to the west and paid their $1,000. On ! = Oct. 12, P&Z recommended approval with completion date of improvements. Long range improvements were not included because of the 2 year completion deadline. It will take a year to get permits. Council postponed on Oct. 19, and returned it to P&Z. Their objection was the amount of waterway and no long-term improvements. Then it went to Harbor Comm. She was not aware of that meeting. She would have come if she had known about it. She is major stockholder and president of this company. They purchased in March 19829 all assets, buildings and lease -hold interest of Fisherman's Packing. Since then, several changes have been made. They have long term financing arranged; they have signed a 2 year marketing agreement. It is rated a high product, when the Feds went through they pulled only one bruised salmon. The company has pulled 1 Million fish with a $3 Million value. Every fisherman has been paid. $10 Million was turned over in raw fish. There were 85 r.. people per 12 hour shift. They need more space. They --- have one of the smallest work places in the area. They can only expand to the north. The shortest time in _ handling is the most efficient. Their long range plans go further than that. The only way they can expand is to their holding area. They are benefiting the area. They pay taxes to the City, raw fish tax to the State which the City gets back. Their lease is for 55 years. It is not true you cannot build on lot 1 or 2. Lot 1 is already filled. To put in long range plans would be impossible, it would be too expensive. Mayor Wagoner explained Council referred this item to P&Z and Harbor Comm. to ask if they considered the waterfront capabilities of the area, and there was the problem with Bob Roper to consider. Mrs. Edelman said they are on the edge of a cutbank. The City property is not going to he feasible for dockage, it would be beyond i their line. They have 600+ ft. Beyond that would be the place for a dock. Mayor Wagoner noted, regarding the private driveway. It is not, it ie an access point on City property. Mrs. Edelman replied, it woo built by Standard Oil and gated by her oinee then. Mayor ` a Wagoner noted the City has adopted a policy with new l leases. The lease has to be deoignated as to corporation and lease holders. Mrs. Edelman agreed, `: adding they have to take care of other lease problems KENAI CITY COUNCIL JANUARY 18, 1984 Page 7 lat. Councilman Wise noted the lease application says "as long as possible." Did she have any problems with that? Mrs. Edelman replied, she would like it to run concurrrently with the other. Councilman Ackerly asked about the development plan. Land Manager Labahn replied the original was received by P&Z on Oct. 12. Those conditions encompass his concerns. NOTION. Amendment: Councilmen Wise moved, seconded by Councilman Ackerly, to amend the lease application in length of lease to Dec. 31, 20331 and proposed completion date to Jan. 10 1986. Councilwoman Bailie asked if that would be enough time for all proposed improvements. Mrs. Edelman replied, that is not quite 2 years. It would depend on how fast they can procure permits. NEW BUSINESS i G-2 Requisitions Exceeding $1,000 ` Morgan Steel and VF Sales Council agreed that both items should be discussed as they related to the same subject. NOTIONS Councilman Wise moved, seconded by Councilman Ackerly, to approve the requisitions for Morgan 5teel and VF Sales. Councilman Wise explained, the reason he asked for discussion on these items is, the fuel distributor is privately owned. We are apparently adding on to that system. Is it our system, are we going to sell when we don't control, are we going to sell to Grizzley and at what price? Airport Manager Swalley explained, this item first came up during airport remodeling diecuseions. It was suggested the fuel pits be moved. In the original Stoahner lease in .July 1968, the provision was if they are relocated the City could relocate at their expense at the most expeditious method, but would not be liable for loss of income. The City is doing that now. We are adding on to the existing system and will use the present ones for emergency only. Public Works Director Kornelis addsd Mike Teuriainen woo the engineer on the ramp and parking. Engineering of the fuel pits was an addition to his contract. G-7 Lease Amendment - Dan Pitts - Freight Terminal, Condominium Proposal - FSO S/D MOTIONS Councilman Wise moved, rseconded by Councilwoman Bailee, to approve the lease amendment. VV KENAI CITY COUNCIL JANUARY 18, 1984 Page 8 C nuncilman Ackerly asked Mr. Pittot what is going to happen with the condominium proposal, will he sell parts of the building? Mr. Pitts replied, he sub -let some of the area to other companies. They are interested in becoming part of his proposal. The simplest way is to give them permanent part of the development and insure them of spaces. The condominium concept is the easiest way. He added, the building to in harmony with the terminal. Mayor Wagoner expressed his congratulations on the appearance of the building. Motion passed unanimously by roll call vote. Mayor Wagoner noted, when the City moved freight out of the terminal, they were told by the air carriers they would take care of it themselves - they have. G-8 Cancellation of Lease - Al Hendrickson Atty. Rogers explained, initially we collected arrears on rent, then we said we would consider mutual rescission of the lease. There were improvements but there was a berm pile. After meeting with Administration we thought the footeat way to get the land on the market would be to rescind the lease and remove the berm ourselves. He noted Land Manager Labahn has said there are 2 applications out for that piece. If we have to wait till he moves the berm pile it may be tied up for some time. Administration recommends we mutually rescind the lesoe, contingent on taxes paid and all other matters complete with the exception of moving the berm pile. MOTION: k Councilman Measles moved, seconded by Councilman Ackerly, to go ahead with rescinding of the lease, pending taxes being current. Councilwoman Monfor asked Atty. Rogers, if something like this happens, and these same people come back for another lease, would this be a consideration? Atty. Rogers replied Yea* Motion passed by unanimous consent. G-9 Discussion - Ski Trail, E. Kenai Park Area Mayor Wagoner asked that this be deleted, as it has to go to PAZ first. Council agreed to the deletion. G-10 Discussion - Temporary Hire, Police Aid Police Chief Rose explained, the purpose of this is to relieve the sworn officers for their work, and use an aid. By hiring this type of position we can do it more consistent with the least coai, and he would not be subject to being called away. It would attempt to get acroso Council intent on off -road vehicles, camping and some parking problems. He is looking at a college student with law studies background. It would be one person, but he would be tying up one person to overuse. The proposal would be with a pick-up for 3 months. It would involve beach patrol also. He checked on lasso of a 3-wheel vehicle, it would be $7,500 for 3 months. Finance Director grown explained, we would only fund for June, there may be some transfers. KENAI CITY COUNCIL JANUARY 18, 1984 Page 9 MOTIONS Councilman Measles moved, seconded by Councilwoman Bailie, to proceed with the idea. Motion passed by unanimous consent. G-11 Di.scussion - Report on Royal Pacific, Salematof Dock Proposal City Manager Brighton asked that this item be postponed. He has not received the report yet. The land is being surveyed. They should have the proposal by Feb. 1. Council agreed to the request. G-12 Discussion - TAMS Report - Small Boat Harbor Mayor Wagoner noted Council has received the report, he suggested a work session with the Harbor Commission. Councilman Wise asked if the Harbor Commission could obtain a report on the Homer problem with TAMS. TAMS has already made a report to the Harbor Commission, he asked for the Homer viewpoint. Council agreed to attend the Jan. 24 Harbor Commission meeting, if possible. EXECUTIVE SESSIONs MOTIONS Councilman Ackerly tived, seconded by Councilwoman Monfor, to have an executive session to deal with matters affecting the finances of the City. Mayor Wagoner explained the reason - a proposal dealing with properties needed for development in a situation similar to the FAA proposal. It will affect the finances of the City, it is not new to Council. Motion passed unanimously by roll call vote. City Manager Brighton requested that Atty. Rogers and Land Manager Labahn attend. Council agreed to the request. EXECUTIVE SESSIONS 9s10 PM to 9s50 PM. MOTIONS Councilman Hall moved, seconded by Councilman Measles, to direct Administration to go into discussion with HEA to locate their new facility within the City of Kenai. Motion passed unanimously by roll call vote. COUNCILMAN HALL LEFT: 900 PM. H. REPORTS H-1 City Manager City Manager Brighton spoke. a. He noted the announcement from FAA regarding location of the FAA station in Kenai, distributed this date. KENAI CITY COUNC V. JANUARY 18, 1984 Page 10 b. He noted the proposed fee schedule for the gym distributed this date. He asked Council to review and discuss at the Feb. 1 meeting. c. He noted the Governor's budget for capital improvement projects, distributed this date. He pointed out the 1; $610,000 for the Peninsula, Kodiak - $16.5 Million, Anchorage - $30 Million, Juneau - $15 Million,Cordova•- $10 Million. He and Atty. Rogers will go to Juneau Jan. 19 and 20 to talk with our legislators and other j legislators to help get some of the requests. d. Councilwoman Monfor noted in the last pacxet there was a letter from Public Works Director Kornelis regarding = patting ourselveo on the back. She felt this was a good idea. We have done many good things, it is nice to invite people to come and take a look. She would like to see it pursued. Council agreed to let Administration pursue this. e. Councilwoman Monfor said at the last meeting there was a discussion about planes landing at our airport and staying on the planes for hours. Is there any way we j can get them off to spend money or time? Mr. Brighton i replied we do not have security clearance here. Airport Manager Swalley added, the decision to leave them on the planes was made by the airlines. Security ' --�-- is also necessary. Since then, Mr. Brighton asked him to do some research. In no case here or in the States has an airport purchased their own security equipment. " It is an airline function. Councilman Wise suggested " we go to the airlines concerned and find out if they would de -plane. Mr. Swalley said Alaska and Western have alternate sites, he has written to Wien.
