Ord. 967-84 was distributed this date. d. Mayor Wagoner asked that item G-13, Ord. 978-84, be taken off the Consent Agenda. A-2 Consent Agenda NOTION: Councilman Hall moved, seconded by Councilman Measles, to approve the Consent Agenda as changed. Councilman Wise asked that item G-7, Ord. 977-84, be taken off the Consent Agenda. Notion passed by unanimous consent. S. PERSONS PRESENT SCHEDULED TO BE HEARD 8-1 Ed Call, Kenai Be Cook Inlet View Dr. Right -of -Way b. Section 36 Ed Call, 1202 Lilac. Regarding the memo from the Borough in the packet. It is their opinion that area cannot be fenced. He wanted to know what is happening down there. There is garbage accumulating there. Atty. Roys:s rer-lied he did not dispute the letter, but they are attempting to ascertain where the section line is. There has been contact with the Corps. of Engineers. Alaska Title report is not sufficient. It encompasses the area from Wildwood gate to Spur and out to the Bluff. It may cost more money if it has to be staked, engineered and surveyed. He will come back to Council when he has a firm figure. If it is settled that it is on a section line, then they will have to decide if it is City duty to remove. Mr. Cell said the road to the beach has been used since the Air Force left. The City has maintained it. Mayor Wagoner noted the Council has taken a stand that they will find out, and added, it is 05 on the Capital Improvements List. 1 Mr. Call discussed Section 36. The section line has been closed off to the general public with dirt. COUNCILMAN ACKERLY ARRIVED AT THIS TIME (7s2O PM). f Mayor Wagoner asked if there was a road there. Mr. Call did not know. Mayor Wagoner asked Administration to make a -} report to Council. Mr. Call said, at the Wildwood intersection, if that road is clna ed, there would be no way { f� to get down the road in case of emergency. It is not a street, but a right-of-way. -A7 �. Total would be changed to $176,146. Public Works Director expleined we have a chance to purchase a tractor and line spreader. VOTE, Amendment (Passed): Yost Wagoner, Ackerly, Bailie, Hall, Measles, Monfor Nos Wise MOTION, Amendments Councilman Wise moved, seconded by Councilwoman Monfor, to delete appropriations and related data pertaining to airport land system. Councilman Wise said there is no justification to use General funds to subsidize the airport. VOTE, Amendments Notion passed unanimously by roll call vote. There was no public comment on the ordinance. MOTION, Amendments Councilman Wise moved to delete $135#0009 Water do Sewer -Sewer; and related entries. Notion died for lack of a second. Councilman Wise said this is not the way to use the monies. He would like to see Richfield (street) completed. Councilwoman Monfor asked for assurance the library would get their funds. C-7 Ordinance 970-84 - Rezoning - Parsons Homestead MOTION: Councilman Measles moved, seconded by Councilman Ackerly, to adopt the ordinance. 7 =P KENA1 CITY COUNCIL SEPT. 5, 1984 Page 4 PUBLIC COMMENT: a. Mike McLane, McLane & Assoc. They are going to record the final plat. Inlet Woods West provides alternate access and 3 more parcels. At the time they do construction, they will provide gravel access for safety reasons. That is why they combined 2 rezones. There has been an outstanding assessment against the entire parcel and was due at the divorce settlement. By going through this procedure, Mrs. Parsons has an opportunity to put some on the market. Atty. Rogers explained, he still wants the option to say we want the funds from Mr. Parsons also. If Council wants to go ahead and approve in hopes to expedite payment, he wants them to know it has not been finalized in the courts. The City will get the money whether Council approves it or not. G-8 Discussion - Salamatof/Drageeth Land Exchange Land Manager Labahn explained, Salamatof surrounds Drageeth, this would put Oragseth to one side. Mayor Wagoner noted this enhances City property as much as Drageeth. Councilman Wise said he thought there was a deed restriction. City Manager Brighton said he did not find any restrictions. Councilman Wise said the Sslsmstof lease had to go to granting authority for approval. Mayor Wagoner replied, Land Manager Labahn could check on this. MOTION: Councilman Ackerly moved, seconded by Councilwoman Bailie, to continue on the same course with the swap. Motion passed by unanimous consent. C-15 Resolution 84-113 MOTION, Remove From Tablet Councilman Measles moved, seconded by Councilman Ackerly, to bring the resolution back to the table. Motion passed by unanimous consent. In the 3rd WHEREAS, line 1, change the words "were to" to "should." Pay Estimate #4 (Final) - $62,822.88 MOTIONS Councilman Ackerly moved, seconded by Councilman Measles, to approve the change order. Councilman Wise noted this is after the fact, it took 1-1/2 months to come. Public Works Director Kornelis explained, he used an old form. The inspection firm chose to zero out by change order. Councilman Ackerly noted the original amount was $41390009 the change order brings it to $532,000. Is there a surplus? Mr. Kornelis replied yes, the reason for the large amount of change orders is requests by the City. Councilman Ackerly asked, what happens to what is left? Mr. Kornelis replied, we have to apply to FAA, he has the application in. The seeding was deleted when they extended the itinerant parking, there was an erosion problem. They used rock tnsteed. G-10 Discussion - Moving City Shop & Storage Buildings NOTES Mayor Wagoner postponed this item till Sept. 19 meeting. G-11 Games of Chance do Skill - Beta Sigma Phi Approved under Consent Agenda. G-12 Change Order - Thompson Park Roads - Construction Unlimited- ($19,250) MOTIONS Councilman Ackerly moved, seconded by Councilman Measles, to approve the change order. Mayor Wagoner asked, how long will the road remain soft? Public Works Director Kornelis replied, they are still compacting. Motion passed by unanimous consent. G-13 Ordinance 978-84 - Amending KMC - Competitive Bidding MOTIONS Councilman Measles moved, seconded by Councilwoman Bailie, to introduce the ordinance. I .. Atty. Rogers noted page 2, paragraph (f), it is "shall" not "may." If you get into 41neretion with Council, you get into preferential treatment, there is exposure in court. Paragraph (f), line 1, change the word "shall" to "may." REPORTS H-1 City Manager None H-2 City Attorney None H-3 Mayor Mayor Wagoner spoke. a. He noted the letter from Gov. Sheffield distributed this date regarding municipal grants. b. At Chamber of Commerce this date, Senor Cantu of Mexico woo a guest, and presented a Mexican flag to the City. He would like to display it at City Hall for a timo. c. He asked, who is responsible for the dent in the airport facility? Airport Manager Ernst replied, they have put cement barriers in front of the terminal. Mayor Wagoner requested an estimate on repairs. Council agreed to the request. e. Alaska Assoc. of Realtors has invited him to a meeting. He asked for guidelines from Council regarding fees. MOTIONS Councilman Measles moved, seconded by Councilwoman Monfor, to approve reimbursement to the Mayor for his attending functions (with his wife when appropriate) for expenditures in his duties as Mayor,. Motion passed by unanimous consent. H-4 City Clerk Clerk Whelan spoke. s. Absentee ballots for the Nikishka incorporation are available in City Hall from Sept. 10 to Sept. 17. This is a service the City of Kenai has extended to North Kenai area for some time. b. Filing period has closed for the City of Kenai election. There are 4 candidates for 2 Council seats, and 2 propositions. H-5 Finance Director Accountant Parnell asked Council to make a decision on the memo regarding FSS Facility Financing (item H-5 in the packet). Council agreed to go with option 0, amending existing ord. H-6 Planning h Zoning None H-7 Harbor Commission Councilman Ackerly said there was a meeting Aug. 28. The Salamatof/Dragseth land swap was discussed, a resolution of support was passed. Mayor Wagoner said a report was made from TAMS on the dock. The Commission decided to postpone action because of Seaway interest in a commercial facility. H-8 Recreation Commission Recreation Director McGillivray reported Capital Improvements List was discussed at 9-4 meeting. H-9 Library Commission None I. PERSONS PRESENT NOT SCHEDULED TO BE HEARD a. Councilwoman Bailie, Beautification Committee. The Committee wants to plant mature trees in the downtown area. 3 members have offered to set up the plan and coordinate with Public Works Dept. for the week of Sept. 17. They will do all the groundwork. The Committee would like to review the landscaping plans on building permits. s: KENAI CITY COUNCIL 4, 1984 Page 13 Mayor Wagoner said the tree planting is the responsibility of PAZ. He asked for Council approval of planting. He is not unhappy with the concept, but is unhappy with the location of the 600 seedlings planted all over. Counc,:.woman Bailie said they hoped to meet with people fron, vreenhouses and planned to /r,;• group the trees. The trees should be planted very # soon. Councilman Wise said we do not have a landscape plan now. It should be adopted by the middle of Feb. Councilwoman Bailie said the Committee would like to be ; a Commission. Mayor Wagoner asked for time to review this request. b. Councilwoman Bailie, Cemetery Committee. Packet item Info 019 is a map of the present cemetery. The Committee has asked for approval of a survey. Land Manager Labahn explained, a Federal survey was done some time ago. Councilwoman Monfor said the Committee would like to close this one up and use new lands. Mayor Wagoner said there are 12-18 burials per year between here and Spruce Grove. Councilwoman Monfort added, there are 60 Peninsula burials. Mayor Wagoner said we need to survey, see where we can expand, set R plots out, have a map done, and set up procedures. Councilwoman Bailie noted Mr. Wood has agreed to co-chair the Committee. Mayor Wagoner suggested it be closed down except for those who want to be buried next to people deceased. G MOTIONs i, Councilman Ackerly moved, seconded by Councilwoman Monfort, to authorize Administration to survey the perimeter of the �'- cemetery for a not -to -exceed figure of $Zt000. Mayor Wagoner told Council he was scheduling a special j meeting for Sept. 10, 1984 at 6s00 PM to discuss Ord. --Y— 973-84 and Res. 84-117 _ d. Ed Call, Kenai. Regarding the Wildwood entrance. There has been an offer of a quit -claim deed from the Native Assn. We should pursue it. Atty. Rogers - replied he has had discussions with George Miller. They are amenable to divesting themselves of the u roadway. They are also talking with the City regarding a swap of lands on Section 35. Prior to quit -claim deed -- they may want to have some assurances regarding up -grade and maintenance. These things will be coming to Council. Mr. Call said there have been offers before but they were not pursued. This would relieve j some of the problems. Atty.•Rogers explained, there !" was a reservation by the military as long as they used the serer lino, it was transferred to the Natives. We are trying to find out if the sewer line was conveyed. e. Carmen Gintoli, 117 Deepwood Ct. Regarding local contractor preference. It is not any difference between contractor and salesman. Public dollars should be the same as everybody else. It is expensive to run a business here. You want to encourage local hire. The Borough ordinance does not limit competition. Clarence Ladd, Kenai. Regarding the American flag. fie has been trying to have the Senior Center fly flags. The Police and Library do. If we cannot put one outside, let's put them inside. Or get tall flag poles. City Hall says the other buildings have flags, but he felt they needed one at City Hall. The Chamber of Commerce has one. It would be nice to put up the Mexican flag when Mr. Cantu was here. If we had one for City Hall we could fly both flags high enough to see and put foreign flags up when visitors are here. g. Councilman Ackerly noted the cars for sale are back on on the Strip. There were 9 over the week end. h. Councilwoman Monfor. She referred to the letter from the Sno Shoe Gun Club distributed this date, on the solid waste incineration proposal. There have been no public hearings proposed for the site selection. We should be on top of this at all times. Mayor Wagoner said he would talk with Borough Mayor Thompson. The Borough engineer would be at the Sept. 19 Council meeting to speak. Councilwoman Monfor said most of Thompson Pk. does not know about this. We should do something as a City. i. Councilman Wise asked about hiring a consultant to survey Old Town. Land Manager Labohn said a report will be available at the Sept. 10 meeting. J. Mayor Wagoner noted the tat ads for Section 36 will be out next week. (9-10-84) k. Mayor Wagoner said Joe Arnesa has asked the City to support naming the high school auditorium for his grandparents. There will be a resolution at the Sept. 19 meeting.
