s. Mayor Wagoner asked that G-4 be removed from the
consent agenda.
b. Mayor Wagoner askod that G-7 be removed from the
agenda and noted that information wee provided for
Council review only at this time.
Council approved the agenda so amended.

Councilwoman Railie moved, seconded by Councilwoman Monfor
to approve the Consent Agenda with the deletion of G-4.

B. PERSONS PRESENT SCHEDULED 10 RE HEARD
8-1 John Russell - Kenai Moose Lodge - Purchase of Land
John Russell, 520 Ash, Kensi. Said the Moose Lodge needs
more room. The organization is a fraternal one. The land
they are interested in is fronted by the Spur Highway and
Evergreen Street, They want the back section (approx. 4
acres), thus leaving the highway frontage to the City. Want
a conditional use permit and commeneerste value of land sold i
across the Spur Highway, Mayor Wagoner stated that this
land woo traded by the City from FAA for the property we
donated to HEA. This is airport lands controlled by the
airport regulations. He needs to take your proposal to
Planning do Zoning first and it would be submitted by them,
7ohn Russell stated that the appraisal done by Ed Warfle was s
1$340,800 for 8 1/2 acres and it seamed very high. Mayor p
Wagoner said that after the deposit is made by the individual
of $19000 for the property, an appraisal would be ordered.
If the party was not Ratiofied with the appraisal figure, he
had the right to go the City Administration on this. Land i
Manager Labohn said Mr. Russell was requesting Council's
permission to initiate the sale of this land. If Council
has no objection, they need to consent to the concept and
then Mr. Russell can submit his deposit. Attorney Rogers �
referred to KMC 22.05.040 wherein it stated that no action
can be taken until an agreement to purchase is presented to
the City along with the deposit.
C. PUBLIC HEARINGS
C-1 Ordinance 977-84 - Limiting Number and Type of Vendor

for approval of Ordinance 977-84.

MOTION, amendments
Councilwoman Bailie moved, seconded by Councilman Ackerly to
amend two different areas on 02 instead of 4 car rental
spaces, move to amend that to 5, and in 03 strike the words
"an area of not leas than" and instead put the words "of
approximately" so that it would read; One lima -taxi con-
cession to occupy an area of approximately...
Attorney Rogers asked Councilwoman Hailie if she also
intended to strike those words in 3, 4, 5, 6, 7. Council-
woman Bailie so concurred.
There was no public comment.

C-6 Resolution 94-144 - Approving Petition for Annexation
to the City - Cninulns Point Subdivision
MOTION$
Councilman Measles moved, seconded by Councilwoman Bailie,
to adopt this resolution.
Barbara Olsen noted a letter that the Carters wantea read to
the Council. Since Council had a copy, it was so noted in
the records.
Tim Downs said he had a fire in his house in Belugs Bay,
bordering on the city boundaries. The Fire Department
responded within B - 9 minutes. He said that there would
be enough time for the Fire Dept. to respond to fires in
Chinulno Subdivision and said getting annexed to the City
was a good idea.
Linda Hudoc, Box 547, Kenai. Since we've had well over the
25: needed by law for this petition to go through, she would
like to have the Council pass this resolution so the
residents of this subdivioion can be allowed to vote. Mrs.
Hudec checked into other alternatives - fire service area -
but the Borough Assembly said it was illegml to have a fire
service area and would be twice as expensive as to join the
city. She spoke with City Manager Brighton about contracting
for fire service but i` would be unfair to be billed for
services rendered in case of a fire when city residents pay
for fire service whether they use it or not. Another
alternative was a differential mill rates based on the
services we received. All homeowners in their area would
save money if they joined the city on insurance, increased
income tax reductions on paying city taxes. The only
complaints she had about not joining the city were from two
builders who said they would have to conform to the building
code. Jim Barr was upset about joining the city and perhaps
we could go around his property.
Drew Sparlin, Box 594, Soldotna, resident in fielugs Bay.
There is more than one person who objects to joining the
city. Maybe we should consider a fire contract service In a
will levy. The City has nothing to offer them besides fire
service.
Mervin Drogseth, Cannery Road. He's lived in the City of
Kenai for 15 years. There are two canneries and three
residents there. City will not put water and sewer there
nor will gas be brought down there. Police protection stops
at the end of Cannery Road. Said tt-.t the residents should
consider all those things before voting.

Councilmen Wise moved for introduction on this ordinance.
Motion died for lack of second.
G-5 Ordinance 998-84 - Amending Kenai Zoning Map by Rezoning
Govt, Lot 69, Sec. 34 to Suburban Residential
Approved by Consent Agenda with the notation that a correction
should be made in the third paragraph to change "Suburban
Commercial" to "Suburban Residential".
G-6 Discussion - Relocation of Marathon Road
Mayor Wagoner referred Council to a rnerno distributed tonight
from Jack LaShot to Keith Kornelia on the estimated costs
for relocation of Marathon Road. Councilman Ackerly wanted
to know if there wary money to cover the coat of any of the
alternatives. Finance nirector Brown said it would probably
come out of airport mon!ea. Thinga that have to be considered

on financing this are, alternate 02 includes water and sewer
and runs along HEA's property. Will the City assess 50% for
water and sewer? If so, HEA would be assessed a large
portion on that. The way this would be financed would
depend upon which alternate is chosen. Mayor Wagoner said
we would be premature to include water and sewer at this
time. Planning & Zoning recommendations are that we approve
relocation of Marathon Road according to alternate 01.
MOTIONs
Councilman Measles moved, seconded by Councilman Ackerly, to
selecting Alternate #1 and approving the Administration to
go ahead with the engineering design portion of the project.
MOTION, amendments
Councilman Wise moved to make an assessment district
applying to Baron Park and to the HEA tract, 50: assessment. �=
Motion died for lack of second.
Councilman Wise has a problem with building HEA 39200 feet
of road at no expense to them, which would amount to
$650000. He feels HEA should share the cost of the road.
Mayor Wagoner said the motion only includes the engineering
and we might have Administration approach HEA and ask if I'
they are willing to share the expense. Councilman Measles
said that this road relocation is not for the convenience of
HEA but for the City so we could not charge HEA for this.
Mayor Wagoner said we could charge HEA for this if we so
desire.

H-1 City Manager
Finance Director Brown said that Info #6 on increasing Mike
Tauriainen's contract for design has been denied by Administration.
Mentioned Keith Kornelis' memo that was handed out tonight
on DEC and where the City may get matching funds. Some of
the projects were not requested on the State priority list,
therefore, some of the matching could come from LIDS. The
City could run out of money on special assessments (LID)
because we have only $1.2 million left of bond money. The
next time someone brings in a petition he'll meet with Keith
Kornelis and we'll lay out where the money can go and what
money we have left.

a. Mayor Wagoner said at the Municipal League meetings on
the Conference of Mayors, Mayor Knowles was elected President
J3 and Mayor Wagoner was elected Vice -President this year.
Mayor Wheeltight was elected Secretary/Treasurer.
a b. He discussed with Mayor Knowles' staff what they had
available on landscaping architects. They have taree on
their staff. This would be a good discussion at a work

session to discuss what we plan on doing in the city. We
could probably loan out the architect for a short time.
There are several landscapers locally but he does not know
if they could attempt a Master Plan or not. Councilwoman
Bailie said the Beautification Committee is meeting next
Tuesday and this was one of their concerns.
c. Mayors Council on Aging. The proposed redraft on the
by-laws were presented. Some changes need to be made by the
City Attorney and brought back before Council.
j d. The Mayor is going to present a list to Council during
one of the next two meetings on goals for the next two years
that the City should be working on.
e. While in Anchorage he met with Frank Cunningham,
District Director of FAA. We discussed moving of the FAA
towers and incorporating that with the Flight Service
l Station. Mr. Cunningham will come to Kenai with his staff
I for a work session to meet with our staff, Council, & Admin.
j set up tentatively December 7.
f. The bowling area facility leased by Walt Church is not
being built according to the name plans as approved. Would
like Administration to pull the meeting minutes where his
testimony is presented. Something needs to be dose about t
this.
g. He mailed copy of local preference from Valdez to
-- Council members. Would like to have a work session on local q
preference. Councilman Ackerly said we should invite the
local contractors to this work session. Mayor Wagoner said
he would wait until City Manager Brighton returns and plan a
work session for January.
h
h. Mayor Wagoner would like to see an ordinance drafted i
that would not allow slash to be buried on leased property.
Councilman Hall said there needs to be a place for this
slash to be brought to. Mayor Wagoner said we could
probably get permission to use some of the qravel pits.
i. Mayor Wagoner would like Administration to prepare a two
to three paqe summary of the information that was distributed
from the Borough on the solid waste facility.
f Councilman Ackerly said we should send a letter to the Department
-- - of Transportation regarding the deterioration of the Spur
Highway. .00,
