ROLL CALL Presents Ron Holston, Tom Ackerly, Sally Bailie, Betty Glick, Ray Measles, Tom Wagoner, John Wise Absents None AGENDA APPROVAL s. Mayor Holston said William Snyder, S,B & D Products had asked to speak regarding the itinerant merchants license, but he was not present. b. Mayor Holston said Administration had asked that item G-9 be added, Assignment of Lease, Arctic Aviation to Grizzley Air. c. Mayor Holston noted items C-1 & C-2 had been copied front and back in error. Council approve the changes. C. PUBLIC HEARINGS C-1 Ordinance 864-83 - Incre,saf.ng Rev/Appos - Boat Romp, Water & Sewer Facilities, Showers, Dock Fueling - $300,000 MOTIONS Councilman Wagoner moved, seconded by Councilman Ackerly, to adopt the ordinance. There was no public comment. Councilman Wise asked, what is anticipated to be done with these funds, and will Request for Proposals and other data be provided to Council and the Harbor Commission before bidding? Public Works Director Kornelis replied, they have already received specs from TAMS and seat them back. They are ready for the final steps. We have one boat ramp now, we are enlarging to 2, with floats between. The grant work will not be done at this time. The bidding will be done in Sept. there was some difficulty with permits. Some dredging had to be done. It will not be operating till next season. Motion passed unanimously by roll call vote. C-2 Ordinance 865-83 - Adopting Budget - 83-84 MOTIONS Councilman Wagoner moved, seconded by Councilman Ackerly, to adopt the ordinance. There was no public comment. VOTE (Passed)s Yeas Maloton, Ackerly, Bailie, Glick, Measles, Wagoner Nos Wise Councilman► Ackerly noted there ire a dumpator needed at the end of Foraut Dr. KENAI CITY COUNCIL JUNE 1, 1983 PAGE 2 C-3 Ordinance 866-83 - Construction, Inspection and Surveying - Evergreen, Haller, McKinley, 4th, 32nd, 3rd 6 2nd - $440,176 MOTION: Councilman Wagoner moved, seconded by Councilman Ackerly, to adopt the ordinance. PUBLIC COMMENT: a. John Williams. There was some concern as to whether the low bidder could perform. There is no mention in the ordinance of decreasing $440,000 from the road grant. How does Candlelight, etc. relate to Haller, etc.? Mayor Malston explained there was a substitute ordinance 866-83. Public Works Director Kornelia explaineu Administretion does not intend to eliminate any of Candlelight, etc. They recommend awarding all alternates. Candlelight, etc. does not include alternate #2. Alternate 03 includes alternate 02. This ordinance transfers funds to Evergreen, etc. from the Candlelight, etc. project. There ere more than sufficient funds in the Candlelight, etc. project. Councilwoman Glick asked if there was some question regarding the construction outfit that bid on Candlelight, etc.. ALty.Rogers explained Council is either going to award or not award. They have 10 days to accept. He suggested an executive session if Council wished to discuss the qualifications of the bidders. Mr. Kornelis explained, the normal procedure is, they are planning to award the project to Spruce. They have 10 days to deliver the documents. If we have a problem we have the option to go to the next bidder. If we do, there may not be enough funds. Councilman Wise noted if we wait 10 days, we may not get the pipe ordered. He wondered why it did not come to Council till last meeting. Mr. Kornelis explained they were waiting for DEC funds. City Manager Brighton said Council can speculate but cannot address this till it happens. MOTION, Substitutes Councilman Wagoner moved, seconded by Councilman Measles, to amend the motion to Substitute Ordinance 866-83. Mr. Williams said there is a disparity of $270,000. Yf�K��T 4wa< Will there be an adverse effect? Mr. Kornelis replied, no, in fact these 2 ordinances will bring it together. C-4 Ordinance 867-83 - Increasing Rev/Appns - 1st & 2nd Sts. - Paving 6 Sewer : $741,000; Aliak, McCollum, Cinderella, Fox, Princess, Linwood Ext. - Gravel : $746,000 City Manager Brighton suggested an amendment to delete on the basis that the engineering has been done. Public Works Director Kornelis said the enqineering is in process. It will be 1-1/2 to 2 months. Mr. Brighton said since this is not ready for bid, it would be an appropriate place to extract money for Candlelight, etc. if We have to go to the 2nd bidder. MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to adopt the ordinance. a -a I- KENAI CITY COUNCIL JUNE 1, 1983 PAGE 3 "gars waa nn nnhl i n nnmm, an* MOTION, Amendment: Councilman Wagoner moved, seconded by Councilwoman Glick, to delete the words "and in the Aliak, McCollum, Cinderella, Fox, Princess and Linwood Extended gravel" in the title. Also, delete the financial breakdown described "Aliak, McCollum, Cinderella, Fox, Princess, and Linwood Extended gravel." Councilman Wise asked if we are putting sidewalks on lot h 2nd? Mr. Kornelis replied yes, on one side with an alternate for the other side. Councilwoman Glick noted Birch do 4th have concrete sidewalks, Walker Lane has blacktop. She did not recall Council making a decision on this. Mr. Kornelis replied this was engineered 2 years ago. When this was discussed, there was a funding problem. Mayor Holston asked about the sidewalks on lot and 2nd. There are no sidewalks in Mommsen. He questioned if we should do this. Mr. Kornelis replied there is a provision for the main portion to have sidewalks. The asphalt is also in poor condition and will have to be checked, also Wildwoed Extended. Councilman Wagoner said these have been subdivided and platted and will be up for sale. He suggested a work session. C-6 Resolution 83-82 - Transfer of Funds - Fertilizer, Lime, Seed for Beautification Effort - $2,500 MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to adopt the resolution. C-7 Resolution 83-83 - Transfer of Funds - Metal Siding on Old Portion of Airport - $47,525 MOTION: Councilwoman Glick moved, seconded by Councilman Ackerly, to adopt the resolution. PUBLIC COMMENT: Architect Gintoli reviewed the action of the work session before the Council meeting this date. Council asked for one section with color. He distributed this. Councilman Wagoner suggested a white building with masonry or brick veneer in the center. Councilman Wise asked if there was any money left in contingency for brick facing. Finance Director Brown replied, we have $85,000 before this $47,000 is taken out. Councilman Wise said he would prefer all - white with trees of appropriate size in the area of the cargo door. This would be less than panels. MOTION, Amendments Councilman Wise moved, seconded by Councilman Measles, to amend the resolution to provide white metal siding instead of painting; and at the next planting season, Council intends to plant sufficient trees to outline the building. C-8 Resolution 83-84 - Fixing Rate of Levy of Property Tax for FY 83-84 - 2.1 Mills MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to adopt the resolution. J i 9 r KENAI CITY COUNCIL JUNE 1, 1983 PAGE 5 i C-9 Resolution 83-85 - Awarding Contract - Lawton, Aurora, Kiang, Kaknu, Candlelight, Linwood - Water, Sewer, Road Improvements - Spruce Construction - $1,314,148.75 MOTION: Councilman Wagoner moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Councilwoman Bailie asked, where did these streets come from? They were low on the CIP list. Mr. Kornelis replied these are little streets off Candlelight, that was always the intent of the project. They are cross streets. I MOTION, Amendment: Councilman Wise moved, seconded by Councilwoman Glick, to amend the resolution to award the bid to Prosser Construction and change the amount to $1,592,668.93. Councilman Wise said it was his understanding Spruce has ' made an effort to withdraw. MOTION, Executive Session: Councilman Wagoner moved, seconded by Councilwoman Bailie, to withdraw to executive session. Motion passed by unanimous consent. Mayor Malston asked that Atty. Roger, City Manager Brighton and Public Works Director Kornelis be invited to attend. Council agreed to the request. r. , Council adjourned to executive session from 8:45 PM to 9:15 PM. C-10 Resolution 83-86 - Establishing New Airport Terminal Lease Rates & Fee Schedule MOTION: S+ Councilman Wagoner moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Councilman Wise asked about the statement that airline baggage use 15% of use rental. Airport Manager Swalley replied the baggage claim area in the back, not for public use. It was divided by a percentage system of lease rate. Councilman 'rise asked, what if one airline does not get custodial service, would they get a lower rate? There was no public comment. Councilwoman Glick asked if the airport job includes snow removal from the sidewalk. Mr. Swalley replied yes. Councilman Wise asked, in view of the letter in the packet, what is Administration recommendation? Mr. Brighton replied, the letter is his recommendation. Motion passed by unanimous consent. C-12 Change Order #10 - Gym - Blazy Construction - $1,762 So Resolution 83-88 - Transfer of Funds - Change Order #10 - Gym - $1,762 MOTION, Change Orders Councilwoman Bailie moved, seconded by Councilwoman Glick, to approve the change order. C-13 Resolution 83-89 - Opposing HB-211 - Competition in Contracting Procedures MOTIONS Councilman Wagoner moved, seconded by Councilwoman Glick, to adopt the resolution. PUBLIC COMMENTS a. Mike Tauriainen. He wanted to caution Council on the wording saying cost as the primary factor. Bidding of professional services is what Council should consider and to just out-of-pocket oppose this is saying cost is paramount. To.make it the highest importance is a mistake. A lot has to go into engineering and architectural that is difficult to put a low bid figure on. Councilman Wise asked if this resolution commits the City to the lowest bid. Mr. Tauriainen replied, no, it makes it the most important factor. MOTION, Amendments Councilwoman Glick moved, seconded by Councilwoman Bailie, to amend the resolution to direct the Clerk to send copies to Gov. Sheffield and all Legislators. Councilman Wise said the word is not modified in this paragraph as it is in the 3rd WHEREAS paragraph. Atty. Rogers replied he felt the 3rd WHEREAS paragraph is generic, the 4th is specific. There was no public comment. Motion passed by unanimous consent. DISCUSSION ITEM, Well House p1 1 Councilwoman Glick noted the metal on well house U1 is beginning to oxidize. Are there plans to repair? Public Works Director Kornelis replied no, it was taken out of the budget. City Manager Brighton said Revenue Sharing can take care of it. He added he could provide an ordinance for the next meeting. C-17 Resolution 83-93 - Awarding Bid - Parks & Rec Facilities - 3 Multi -Purpose Courts & Restrooms - Pioneer Construction - $31,381 KENAI CITY COUNCIL JUNE 1, 1983 PAGE 8 MOTION: Councilman Wagoner moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Recreation Director McGillivray explained, the multi -use courts are in 3 parks, used for volley ball courts. The slabs are in the shop area where the 2 old well houses are going to be placed. Councilman Wise noted the basketball courts should be positioned so the thumping does not bother people. Motion passed by unanimous consent. C-18 Resolution 83-94 - Support of Construction of Pioneer Home in Kenai MOTIONS Councilman Wagoner moved, seconded by Councilman Ackerly, to adopt the resolution. There was no public comment. MOTION, Amendment: Councilman Measles moved, seconded by Councilwoman Glick, to amend the ordinance in the heading, line 2, delete the words "the" and "area" on either side of the word "Kenai." In the 2nd WHEREAS, delete the words "has offered to" and add the word "will." In the "NOW THEREFORE" paragraph, line 3, delete the words "the Central Peninsula area" and add the word "Kenai." In the same paragraph, line 4, delete the words "the" and "area" on either side of the word "Kenai." VOTE, Amendments Motion passed by unanimous consent. Councilman Wise asked, when did we formally offer the land for the Pioneers Home? City Manager Brighton replied, we have not, we are putting a package together. He added Rep. Malone has asked for $8 Million for this. Councilman Wise asked, how many people will use the home? Senior Citizen Coordinator Porter replied, 40 to 60. There will be no problem filling it up. This does not count those who have left the area that would come back or the ones from Homer and Seward that would use it. MOTION, Amendment: Councilman Wise moved, seconded by Councilwoman Glick, to add after the let WHEREAS paragraph, "WHEREAS, there is now a documented need for nursing beds to Keep our senior citizens in this community, and" VOTE, Amendment: Motion passed by unanimous consent. VOTE, Main Motion as Amended: Motion passed by unanimous consent. D. MINUTES KENAI CITY COUNCIL JUNE 1, 1983 PAGE 9 D-1 Regular Meeting, May 18, 1983 Clerk Whelan said Atty. Rogers asked that page 19, item I -a, line 5. the word "appoint" be changed to "appointed". Line 6, the words "in matters of" be deleted and the words "that presently prosecutes in" be added. Line 7, after the word "City" add "unless we started prosecuting cases that require appointed legal counsel." Council approved the minutes as changed. DISCUSSION ITEM, Off Road Vehicles: Councilwoman Bailie noted we could get caught in the middle if the violator is indigent. Atty. Rogers replied it depends on the penalty. E. CORRESPONDENCE None F. OLD BUSINESS None G. NEW BUSINESS G-1 Bills to be Paid, Bills to be Ratified MOTION - Councilwoman Glick moved, seconded by Councilwoman Bailie, to approve the bills as submitted. Motion passed by unanimous consent. G-2 Requisitions Exceeding $1,000 MOTION: Councilwoman Glick moved, seconded by Councilwoman Bailie, to approve the requisitions as submitted. G-3 Ordinance 868-83 - Amending Kenai Municipal Code - Charter Change, Special Election of June 7, 1983 Regarding Assessments Greater than 25% of Property Value MOTION: Councilwoman Glick moved, seconded by Councilwoman Bailie, to introduce the ordinance. Councilman Wise asked that the ordinance be completed by adding the parts of the Code relating to chaages, public hearings, notification, time delays, etc. Atty. Rogers replied he would bring to the public hearing. Motion passed by unanimous consent. G-4 Ordinance 869-83 - Increasing Rev/Appns - Senior Citizen Grant - $80,321 MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to introduce the ordinance. Motion passed by unanimous consent. KENAI CITY COUNCIL JUNE 1, 1983 PAGE 10 G-5 Ordinance 870-83 - Establishing Public Use Easement - Candlelight MOTIONS Councilwoman Glick moved, seconded by Councilman Measles, to introduce the ordinance. MOTION, Amendments Councilwoman Glick moved, seconded by Councilwoman Bailie, to amend the ordinance to read, the NOW THEREFORE paragraph, line 2, the word "is" be changed to "be." The last line be changed to read, change the period to a comma, and add "nor costs of perfecting this easement." City Manager Brighton suggested Council review the drawings before the 2nd reading. Both sides have been retained for parks, later the Council may want to think in terms less than permanency. Recreation Director McGillivray asked that the Recreation Commission have a chance to review first. Councilman Wise asked, how can we turn park land into borrow site? Mr. McGillivray replied, that was excluded. Land Manager Labahn explained this plat was drawn up with conditional use permit, the borrow site was not dedicated for parks. Councilman Wise noted the road has been there for many years, would there be a restrictive easement? Atty. Rogers replied you don't acquire restrictive rights against a government. City Manager Brighton asked if the public hearing be held on July 6, to give the Recreation Commission and P&Z time to review. G-6 Lease Application - Doyle - Gusty Subdivision MOTION: Councilwoman Glick moved, seconded by Councilman Measles, to approve the lease application. Motion passed unanimously by roll call vote. G-7 Contract Approval - Lawton, Aurora, Kiana, Kaknu, Candlelight, Linwood - Engineering Inspection MOTION: Councilwoman Glick moved, seconded by Councilwoman Bailie, to approve the contract in a not -to -exceed amount of $138,625. Councilman Wise noted the McLane proposal is attached. What is the relationship? Public Works Director Kornelis replied McLane submits surveying only. It is not part of the Taurfainen proposal. Have we , checked if the assignee is reputable? Atty. Rogers explained this is not assigned to a corporation, it is a partnership. He insisted it be with names listed. There has been no check of financial solvency. Another problem is, the lease is not current. There is no money to bring them current till the closing. He told them if Council wanted to approve, it be on condition the lease be made current by carrying the lease over to the signing and exchange moneys. Mr. Brighton noted the equipment in the room is the surplus that did not sell. He suggested we store the word processors and the printer and give the rest to the Salvation Army. He asked the Council if they had any suggestions. f. Councilwoman Glick reviewed the request by Darby Howell to dedicate a roadway on Aliak. Those are old government lots with 50' right-of-way. MOTIONS VOTE: Councilwoman Glick moved, seconded by Councilwoman Bailie, to start official right-of-way proceedings dedicating 60' to property owners on Aliak. Councilwoman Glick said it will have to go to P&Z and the property owners will have to sign a petition. Councilman Wise said in the even any utility lies in appropriate areas, easements would be appropriate. Councilman Wagoner asked to see a plat of the area. Mayor Malston explained that will be part of the P&Z review. He added, it is City property, the City has to take the initiative to get this started. Mr. Brighton said 51% of the owners abutting the right of way have to sign the petition. There is only one street. Councilwoman Glick said there is one house on Aliak that encroaches on the right-of-way. This can eliminate this. Mr. kornelis replied they are not, but it is close. Mayor Malston asked if they will come back to the City for maintenance. Mr. Kornelis replied they had said no. Our population exceiads 59000, he is asking for an increase to 7,000 so we will be exempt. b. Regarding SB-255, counsel for indigents. Atty. Rogers reviewed this with Sen. Regarding the Gymnasium. She is concerned with the appearance. She thought the wood siding would tie the buildings together. It does not. Is it too late to do anything about it? Architect Gintoli replied he suggested metal, but Council wanted red wood. Councilwoman Bailie asked if it could be stained or painted. Mr. Gintoli noted if Council wanted it painted, they did not need red wood. We could have used cheaper wood. Council did not want it stained to match. The sealant used will not darken. Public Works Director Kornelis said Administration was directed to take the existing trim down and add red wood. The cost was too high, Council turned it down. Councilwoman Bailie asked, what will happen to the existing duct work? Mr. Kornelis replied it is already done. Mr. Gintoli explained, he has no involvement with the project since he designed it. He had no idea about the trim. Councilwoman Bailie said it is upsetting that we are adding on to buildings that look like add-ons. We are not cutting corners, but we are ending up with a facility that looks like an add -on. It should be pointed out to us that it would not look right. Mr. Kornelis explained, this situation is unique. The original contract was with Mr. Gintoli, but he had nothing to do with it. We have been dealing with Blazy. Administration was instructed not to go with the original siding. Administration brought samples to Council and they chose red wood. There was concern regarding tying in with the original. Council wants add-ons to look like completed projects. We are not getting adequate advice. C-7 Resolution 83-83 MOTION, Reconsideration: Councilman Ackerly moved, seconded by Councilman Wagoner, i for immediate reconsideration of metal siding on the airport. She noted we say we want advice, but when we get it, we don't accept it. Councilman Wagoner noted, this is an advantage. We can take the advice and then decide. He added, white will not look good for long. Mr. McMillan, from Mr. Gintoli's office, said originally he felt siding and plaster would give it an image of 2 separate entities. He doesn't see anything wrong with ' white, it is a neutral color. If Council goes with color, there may be an argument. To keep it neutral and consistent is an advantage. The building should not be looked at just as a building, but as a building in the City of Kenai. We should look at the environment of Kenai. Councilwoman 1 Bailie said if one color buildings were pleasing, we would see many of one color. There are not many with one color in Kenai. = MOTIONs Councilman Wagoner moved, seconded by Councilman Ackerly, to have the architect bring back samples of masonry at the blank wall section of dark stone for review and cost _ estimates. Mr. Gintoli said he is looking at this as a professional, he graduated from one of the top 7 schools in his field. r There are many buildings of one color. Stone will not add "y anything. He has asked many professionals, they all suggested all -white. He would like to know from those who object to white metal, what reason they have other than "- personal preference. He did not think the Council could ever agree on a color. Councilwoman bailie said white gives a feeling of sterility. Mr. Gintoli asked, what about singularity, clarity, orderly line texture? Councilwoman Bailie said she didn'tsee any choices other than metal submitted. Council only chose paint to save money for paving. Mr. Gintoli replied Council made a decision to make the building as maintenance -free as possible. That is why he went to metal. The clients are the passengers and the users. He tried to express the function of the building on the exterior. It is a transportation building with a lineal TF function. Contemporary architecture is a reaction to the ' times and higher costs. Councilman Wagoner said the 1st r"', thing in the proposal is the color schedule. We have tied none. With the colors available today, we have come up with . .4 a stark white building. Dollar Rent-A-Car and Avis Rent-A-Car have a problem at the airport terminal. They would like a response from the Council, especially about moving the temporary counters. They were told it would be for 2 months, but these are the main months for them. This is when they make their profits. Their business is hurting, they are losing walk-up business. She would like to know why people she talks to are opposed to it. They were told they would be moved. It is an easy solution. The City does not have to be involved, it will not cost them anything. Airport tanager Swalley explained, he placed Raven Transit because of the work load they get with the people with much gear and long waiting time. He heard tonight for the 1st time that the agencies would move at no cost to the City. Councilman Wagoner asked if this matter could be handled administratively. City Manager Brighton reviewed the situation. Mr. Swalley had said the temporary locations were based on the same criteria as the permanent ones. It is only a 2 months situation. Mr. Brighton had spoken to Betty Miller and Rita Womak, and told them he would speak to Mr. Swalley. He decided it was best left alone. If we moved them, we would have complaints from the others who were not moved. A Council person came to Mr. Brighton's office and asked that we move them. He was not enthralled but said he would. He told Mr. Swalley to go ahead and get a coat. He was told it would cost $500 during the week or $90n on a week end. He said to go ahead. He received a call from another Council person and was caught between 2 opinions. He decided he was right the lot time and cancelled the move. Councilman Wagoner asked Architect Gintoli if he was involved with working with the customers on where they would be located during construction. Mr. Gintoli replied yes, hp took the recommendation of Mr. Swalley. Betty Miller explained, they had no problem with the permanent locations. Raven Transit is in front and has no competition. Raven and Hertz face the doors. Dollar Rent-A-Car and Avis Rent-A-Car face Southcentral Air. She faces a pole. This is affecting her business. Dollar Rent-A-Car has had a $2,600 drop and Avis Rent-A-Car a $3,000 drop in business. Rita Womak said the 1st time she was told Raven would be at the end, then they changed. Betty Miller said she asked Mr. Swalley if they could be step -laddered for a view of outgoing passengers. They were not consulted. Rita Womak said their business is based on contact and smiles,they do not have that. Hertz is doing very well, they have brought more cars down. Betty Miller said it would not hurt Hertz. All they are asking is to be moved up and face the entrance. Councilman Wise asked, what was done when they moved 1n7 Mr. Gintoli replied they were told their positions and given a sketch. Betty Miller said she was not given a sketch. Councilman Wagoner noted all his car rentals were pre -rentals. Do they have that much traffic that is not pre -rental. Betty Miller replied yes, Hertz is lit because of pre -rentals. Dollar Rent-A-Car cannot compete on that. They have to do their service at the KENAI CITY COUNCIL JUNE 1, 1983 PAGE 18 counter. 75% of their business is walk-up. Councilwoman Glick said she was contacted by Betty Miller and Rita Womak after they exhausted all other avenues. She didn't believe in getting into the day to day activities of Administration, but when she is contacted she tries to do something. She talked to Mr. Brighton and Mayor Malston. Mr. Brighton was not happy with the decision. These are our lessees. They do pay their money. We are in the business of serving the public. She made a suggestion that was a simple solution. She was told they would move, then Mr. Brighton said he had heard from another Council member and would not change. She was under the impression they would pay for the move. She did not talk to Mr. Swalley because she believed in establishing protocol and went to Mr. Brighton as his supervisor. Councilman Measles explained he was the other Councilmember. His biggest objection was 1 Council member reversing the f f decision of 2 members of Administration. Council does not have that prerogative to override Administrative decisions. Mr. Brighton said these are not normal circumstances we are operating at the airport. He tried to explain that a lot of people would be inconvenienced from time to time. It was his hope they could get through with as little inconvenience as possible. You make a decision on circumstances as they exist. We cannot make everybody happy. We cannot say that others will be happy if we move these people. Councilman Wagoner said he was contacted and he referred them to Administration. He said he would not get involved. We have known all along there would be inconveniences. It will just be till July 23. Betty Miller said they knew they would be inconvenienced, but why should they be if it is unnecessary? She spoke to Raven and they don't n care. They are not in competition with anyone. As for -- Hertz, how could they complain? They would be in a r better location than they are now. If Hertz is moving in cars now, they are running 36. She has to make her money in the summer to sustain during the winter. Councilwoman Glick said Dollar Rent-A-Car is paying extra money to park extra cars, other agencies do not. Do we have a policy for paying for extra spaces? fir. Brighton replied, yes we have a policy. Mr. Swalley said there are 36 cars operated by Hertz. They are not in the lot, they are authorized 10 cars. If they have additional, they have to pay for them. They had extra the day of the move for Turnaround. Rita Womak said at one time she could not get into her parking lot. She added she has more than 10 cars. Councilman Wagoner said we should address what the policy is on parked cars. It should be in writing. Betty Miller agreed, saying one of the problems is inconsistency. Raven feels they should park out front. This has never been enforced. She paid for extra spaces, no one else has. Mr. Swalley said there have been numerous letters sent out regarding cars parked there. He added, the move was covered in the lease. We did not know exactly what we would do. He went right to the people involved when he was directed not to move. He took the rental people out and showed them where they would park. As for the u� step ladder effect, it would not work. The customers I would be behind the Dollar Rent-A-Car counter. Councilwoman Glick said she was bothered by discriminatory enforcement. Mr. Swalley said he tries ! to enforce the regulations without discrimination. He and Police Chief Roua are trying to work on a better plan. He cannot take all his time enforcing. Councilwoman Glick asked, if Hertz has more then 10 cars, should they be paying? We probably don't have time to read all this now, uh, do you wish to carry on any further? Betty Millers Well, 1 think we've just about said everything in this um, little file and we would like to have some kind of response here and one of the things that I'm mainly concerned about is the part in here about the moving of our temporary countero. Uh, we are moving to the summer months and we've had some response on this that the temporary counters are only for 2 months, but what a lot of people don't seem to realize is that in these 2 months are our main months. This is the time that we E make our revenue and make our profits. Um, the way you're 4 ' situated right now Avis and Dollar our businesses hurt. We're losing all of our walk-up business and the thing that I am very surprised and (inaudible) is a very easy solution and it's not gonna cost the City any money and I'd like to know why the people that I have talked to are so opposed to it, because the users have offered to move our counters voluntarily. I have already bought our extension cords because at one time we were told that you were gonna move the temporary counters for us only to call back later on that day and said no you are not. Now at that time, we did buy the extension cords because you told us that was one of the things we were gonna need. And, um, I just think it's a very easy solution if we had volunteered to move us and the YCity doesn't have to be involved in it at all because it's not a= gonna cost them any money. In regards to placement of the temporary counters for the rental car agencies and Raven Transit, there was a lot of time and thought put into it what was gonna be the best way to do it to maintain a smooth operation. As to Raven Transit I placed them In their present location because of the occasional workload that they get a group of people coming in from or going to the platforms with several pieces of gear and sometimes they're there for an hour or 2 hours or more. I felt it was more advantageous to have an open area so that gear could be stored out of the middle of the floor. So once I made that decision I went back to the policy I recommended and the Council accepted last August, dated August 6th, on the (inaudible) spaces on the car rental agencies. What I did was on the criteria that was listed on that policy, 1 took the agencies (inaudible) that they were able to select their positions in the completed terminal (inaudible). I don't know else about this, if you'd like me to read the rental agency policy that the Council approved last August, I will. 1 might further add that a few moments ago was the first I had heard of any agency volunteering to move at no expense to the City. City Manager Brightons Councilman Wagoner Councilman Wagoners Is this matter not capable of being solved at the administrative level that it has to come to Council now, Is all the administrative avenues been approached? City Manager Brightens tor. Chairman, Council, Jim has said that the temporary locations were based on the same criteria that we're going to use on a permanent basis. It to only a 2 month situation, and he did locate Raven on the end of those counters _--` and provided justification 1 thought was reasonable for locating Raven at that location on the basis of the number of people and ! the baggage that piles up, and felt that on the basis of 2 months this was a reasonable situation. I did talk to Betty and Rita and who were reiterating what they have said tonight. I told them that after talking to them that I would talk to Jim, I + talked to Jim after I talked to them and somewhat decided that it was probably better left alone. It was a (; p y possibility that if we moved them that we would have as many complaints as we had now on i the basis of the others who weren't, at this point, complaining, i; might be complaining because they were getting moved. A Council person came to my office and suggested that we make a move and suggested a particular move. I was not enthralled with the idea, but suggested at that point that we would make that move. I -=- informed the manager of the airport to prepare to make that move, find out what the cost was. The cost came back that if it was done during a week -day it would be $500 plus and if it was done on a week -end it would be in excess of $900 and was told that they probably couldn't do it through the week, they'd probably I S - r= tial Verbatim June 1, 1983 Page 3 have to do it on Sunday. I informed him, at that point, that we were going to make move. I then got another telephone call from another Councilperson who wanted to know what was taking place with those counters ano found myself in the middle; one wanting them moved, one suggesting a move and another one suggesting there was not a move, and felt that under the circumstances 1 had arrived at the correct decision in the first place, and informed Jim that we were not going to make the move. In sum and the substance, that's where we've come from, that's what we've been through, and here's where we are. Councilman Ackerlys Are they located where they're gonna be permanently now? City Manager Brightons No, they are not. As you walk in the door, into the terminal the first counter is Dollar, the next is Avl , the next is Hertz, and the next is Raven. And Raven is the first one you see when you walk off the airplane coming irsto the terminal building. ' Councilman Ackerlys Councilman Wagoner Councilman Wagoners Mr. Gintoli, weren't you involved, I don't want to get you in the middle of this time, weren't you involved in working with the customers and working out a temporary location of all customers or users of that airport during the time of construct ion? Architect Gintolis I was and I took my direction free the airport manager who said this is the order they should be moved. i Councilman Wagoners And, why did this come up at this time because it's been known for I don't know how long, that those were the places they were gonna occupy? Betty Millers I think it's little bit misunderstood here. We '., don't have any problems with the orders that were being put in. That was long ago decided that we were gonna do it by revenues. The problem that we're having is, is that Raven Transit is right in front of the doors. And they're not in competition with anyone. If you don't mind, I'd like to draw it out on the board so that you can see exactly the way we are facing. The only people that are facing the incoming possengerway, is Raven Transit and Hertz. Avis and Dollar Rent -a -Car are facing South 1 Central Air and Sesir. In front of me I have a pole; and that is �! the thing I look at all day long. Now, I don't think this is right, this is restraining my business. Since last month, you can look on there, I've done my revenue report for the months my business has dropped $2,600. Avis has dropped $3,000. Also, what about in the old terminal? They had less room than they do now, they make do. They were right by the front door and it didn't seem to bother anyone because they came up, they got their ticket, and they either went and sat down, or went and had breakfast, or they were moved on to their van right away. So, I don't understand why this is such a problem all of a sudden. Rita Womaks First time I was told (inaudible) Raven was gonna be at the end of the bars. That came up just prior to when they moved us that they had switched Raven frGm, the end to the - beginning. Betty Millers As it shows in these notes, we were told every 2 - weeks for about 6 weeks that we were going to be moving into the terminal. And it wasn't until, I believe it was the 15th, that Mr. Swalley walked up to my counter and said, did you hear the exciting news? We're moving this week -end. And I asked Mr. Swalley if he knew where he was going to put us. At that time he knew how he was going to out us, which means the order that had been decided on. But he did not know exactly which location he was gonna put us, all he knew was that it was in front of the ° window. And I asked Mr. Swalley at that time if there was any way that he could step -ladder all the locations so that they would all be facing the entrance where the passengers came in. We would all have a clear view, we wouldn't be in anybodys way. It ° seems like such an easy solution but Mr. Swalley told me that well, we'll see once you get in there. Well, when we got in there, we were moved and that was last we saw of Mr. Swalley. We were not consulted whether it was good for the users, it was just what was good for the airport. And I don't believe this is right. Rita Womaks Welcome business is based on eye contact and smiles _ and there is no way you can get it. By the time the customer's in the door, and picked a rent -a -car, he's at the Hertz counter. Betty Millers Yesh, Hertz is makin' out like a bandit. Rita Womaks You bet, they even run more care now. Betty Millers The only thing that I can say is its, ya know, I >` can understand Hertz not wanting to move, but if I was in that --- location I wouldn't want to move either, ye know, I'd love to �j steal everybodys business, but ah, the thing that, the way we've _ ( asked to move our temporary counters, it isn't going to hurt Hertz's chances at all. If anything it is going to them in the ° same position that Raven Transit is now, so they still will have i 'I , M Partial Verbatim June 1, 1983 Page 5 the ideal location. All we are asking is to be moved up and facing the entrance way a little bit more so that we at least have a fair chance at it. And if we are gonna do the move ourselves, frankly I don't see how you can object. Because it's not gonna cost anybody anything. Mayor Malstons Councilmen, any questions? Councilman Wises What was done when they did move in? What did the contractor do? How'd he set, ya know, what was done to install these people? They had to have power, temporary power, and telephonee,uh, how was this, this was set up by you or how? Architect Gintolis The actual position that trey were in? Councilman Wises They have to have, ya know, power and telephones Architect Gintolis We were told which position they were in and we were given a sketch, we gave that to the telephone company and said you put their extension here, their extension here and there, etc. and there's power behind in the wall under the windows. Councilman Wises So, you're given the sketch Architect Gintolis Yes Councilman Wises of where the things were going. Were you given a sketch? Betty Millers No, air, we were not. We haven't been consulted on much of anything when it comes to the airport. Mayor Malstons Councilmen Wagoner Councilman Wagoners Yeah, 1 wanna ask one question of each of you. I do a lot of travelling and I rent a lot of cars, and all my rentals are pre -rented with a reservation and I, you mean to tell me you've got that much traffic comin' through that airport is not pre -arranged car rentals? Betty Millers Yes, sir. Now the only person Hertz is 0 1 because of their reservation system. There is no way that any of the car rental agencies can beat it. They've been in the business the longest, they're established all over the world in the smallest towns to the biggest towns. Dollar Rent -a -Car cannot beat their reservation system. We have to do it by service personal appearance. Since I've taken over that business, I'm sure you can tell on the revenue sheets it has increased quite a bit and Partial Verbatim Page 6 has been on our service at the counter. 750 of the business that Dollar Rent -a -Car does is on walk-up basis. When they come into the airport and we catch their attention, we smile and we get them to come to our counter. And this is something we don't have right now. Rita Womaks If you'd been in the old terminal, you'd have noticed it a long time ago, cuz there was a lot of jokes between the people made about the smiles between Dollar and Avis all the time, the customers, everybody camin'in noticed it, especially people who come in all the time. Hertz is almost even never there and when they were it's just, I mean they're not even in uniform. But right now they're, employing the people and they're learning, hey this is kinds fun, it's easy, ya know. We don't even get the chance to even stand out there where they see us. A lot of our customers have been walking over there because they can find this place and then they go Oh wow wrong counter and they walk on down. Mayor Malston: Councilwoman Glick Councilwoman Glicks Yes as the council members read through here they will find that I was contacted by Betty and Rita and they contacted me after they had exhausted all other avenues. Apparently they were very frustrated in that they were not being able to communicate to Mr. Swalley and they talked with Mr. Brighton and evidently they were not satisfied to the fact that i, he didn't get hack to them. They thought the next step was the i Council. I know it was questioned why was I even involved? I �I don't believe in getting involved in day to day activities but once they people feel as though all their avenues are exhausted, and a #!ouncil member is contacted and I know I'm not the only one, then you need to do something. When I went down after talking with Betty and Rita, I went down to talk with Mr. Brighton, Mayor Malston was in the office and sure enough Mr. Brighton was not too happy about making the move and of coursz, maybe we should go into Executive Session, I don't want to make comments here that can get into personalities, but in any case, 1 feel like whether these people object to some of the activities on a regular basin, semi -regular basis, they are our lessee's, I they do pay their money, I don't believe any of them, either of 'i them, are in arrears. And we are in the business of serving the public. And whether we like it or not we need to address some of these concerns. And I made a suggestion which I thought was a ______ simple solution to what could get irsto a very volatile problem, and that is washing all thr City's dirty linen and laundry in the public and I thought that it was just a simple little matter, no big deal. And I know I talked with Rita on Thursday, the 19th, and she was really happy, she said we're moving. The next ,. Monday, I got a call and they said what happened7 we didn't move =a Partial Verbatim ""O 1 19A3 Page 7 and of course I called Mr. Brighton right away and he said he had had a call from one of the other council members and they objected. Well, what was being told to the other council member as 1 understood it was that the administration objected to it and that the Mayor objected to it and yet I was being told, while another council member, I was a little frustrated myself in that I don't feel like, ya know, all of the facts were being given and 1 didn't even know that there was even a dollar amount involved because in talking with Betty and Rita I was under the impression that they were going to move the counters themselves. And evidently there were some misunderstandings as to the dollar amount, who was going to pay, how it was going to be paid, and I think that, ya know, when we have lessee's, we, as long as they're good paying customers, or even otherwise it seems like we bend over backwards to accommodate people and yet sometimes it seems like we ignore them or try to just disregard the fact that they have even asked for some consideration. I think that even if you come back with a negative answer, at least you've addressed the problem. I would also comment that I did not talk to Mr. Swalley when this was brought to my attention because I am a firm believer and really try to practice going through the proper protocol and that is Mr. Brighton is Mr. Swalley's boas and I felt that while I don't mind talking to Mr. Swalley as far as how many airplanes are coming in and how the operation is going in a positive manner I do have problems when it to a discu:eion as tar as hi-z job performance. And that's why I went and talked with Mr. Brighton. As I say, the only reason I'm pointing this out is you will notice that they did contact me and 1 did what 1 thought was in the best interest and that was to contact the City Manager. Mayor Malstons Councilman Measles Councilman Messiest Yeah, everybody keeps dodgin around so I'll just lay it out front. I was that other councilman. My biggest objection to start with was the fact that one council person came in and reversed the decision that had been made at two levels of the administration. And I don't think that is perogative of any of us sittin' here. As a body, yes, but not as an individual. ,. Especially not if it's gonna cost the City some money which at that time I understood it was gonna cost the City close to a $1,000. And under any situation I don't feel it's the perogative of any single council person to try to override a decision that's made by the administration. City Manager Brighton: tor. Chairman, let me add to this if I can, I don't went to drag this out all night. These Rre not normal circumstances that we're operating under at the airport. We tried to explain to everyone who was in that airport that when we undertook this project, a lot of people from time to time Partial Verbatim June 1, 1983 Page 8 were going to be inconvenienced. And it couldn't be helped in some cases. And with that explanation, everybody, ya know, felt that once the airport terminal was done and we settled back into a normalcy, that things would be fine and it was my hope that we could get through with as little inconvenience as possible. We're not operating under normal circumstances down there, and you know, having been councilmen as long as each one of you have, it would be nice if every decision we made was a popular decision and was a decision that made everybody happy. But when you make decisions, you don't mamma them on the basis of making everybody happy, you make a decision on the basis of the circumstances as they exist. And that's what we have tried to do. I won't be upset in the least, if the Council turns the administration around in this particular situation but I'm here to tell you that you will not make any tough decisions on this Council, at which that decision is going to make everybody happy. The only reason you have to make the decision in the first place is because some are gonna be happy and some are gonna be unhappy. And we hope that the unhappy people that It lasts a short of time, we've made those decisions and we hope that they were in the best interests of everybody concerned on the basis that they obviously were a temporary situation. And if you decide that we've made the wrong decision, it doesn't bother me one bit for you to tell me that we ought to go down and do thus and so in this situation. Mayor Malstons Just a second, Betty, Councilman Wagoner again. Councilman Wagoners Well, it bothers me because I was also called by another party, I don't even remember who their names were or who they represented. And I told them I referred them back to the administration, I told them I would not get involved in it at all. And then they told me there was gonna be added cost, I told them I still would not get involved in it. 1 think we discussed, as I refer back to Carmen, the fact that hey we could have put everybody, we were talking about putting everybody in the trailer house at one time. And that would have been a tremendous inconvenience and we've known all along there's gonna be inconveniences on this airport and according to Carmen, the longest this inconvenience is gonna last is until July 20th at the latest and we're talking about the interior of the building and it'll probably be less than that. So, we're talking probably a month maximum, wouldn't you say Carmen? A month to a month and 10 days. If we move them I concur with what the administration has said. If we move them, them whoever's left, and I don't even know how many agencies are over there, girls, I'm sorry, but whoever's left is going to have just as legitimate of a claim to come down here to Council or next meeting and say I didn't like that and here's the way I want it to be lined up and go that way. Partial Verbatim June 1, 1983 Page 9 Betty fillers 1 would just like to point out is that all of us knew we were going to inconvenienced in some way, but why do we have to be inconvenienced when it's so unneceavary? I could see if there was absolutely no way that we could move us around. I could understand that, but there is. There's all kinds of different options as how to put us so that we all have a good view of the in -coming passengers. ers. And the second thin is I g spoke with Raven Transit about this and Raven Transit doesn't care. They don't care if they get moved to the end of the line, because like they also said they are not in competition with anyone. They are going to receive their business whether they are at the and of the line, the beginning of the line, or outside the airport. They are going to find Raven Transit. And I just, as far as Hertz, that will be the only party that would be likely to complain about it. As far as Hertz is concerned, how can they complain? How can they possibly complain if they're in j their right mind? Because they're gonna be in a better location than what they are now. All we are asking is just a fair chance at the business and yes, it is only for a month and a half. But you look at these revenue sheets and for July, our revenue for Avis was $269000, that is the highest month of the year. Dollar was $20,000. After that it dropped down. June and July are the peak seasons. If we are gonna loose, we are already losing between $2,500 and $3,000 a month. If Hertz would not be pulling in any more cars, yes, we would get the overflow. But we don't -' have that guarantee because when Hertz saw that is was just a piece of cake out there, they already ordered more cars and they are now running 36 cars. Now if they are gonna keep pulling more cars in, from Anchorage which they can do at any time, how am I gonna stay in business after this summer, when I am supposed to make my money during the summer time to sustain me in the winter time. Mayor Malstons Councilman Wagoner t Councilman Wagoners Point of clarification. In other words, I r y you're saying the figures on this sheet is 10,, f h Y Y 9 9 o the overall gross that you gross. You lost me there for a while, I didn't �I follow. Mayor Malstons Councilwoman Glick Councilwoman Glicks Yes, I'd like to ask the question of the administration and of course earlier when I talked to Mr. Brighton he indicated to me that he wasn't aware of this and that is the fact that Dollar indicated to me that they were paying extra money to park extra cars. And yet the other car rental agencies park extra cars and they do not, and of course after a period of 3 months, I believe it was, Dollar quit paying. Now, do Partial Verbatim June 1, 1983 Page 10 we have a policy that requires payment for extra parking spaces? And if we do, are we enforcing it? And if we're not, why are we not? City Manager Brightons Yes, we do, answer to the first question. I'd have to refer to Jim Swalley on 2nd and 3rd part of that question. Airport Manager Swalley: (inaudible) 36 cars being operated by (inaudible) at the present time. Those 36 cars are not on the lot, they're operated by (inaudible). (inaudible) They are supposed to request (inaudible). If I could find them out there with (inaudible) cars. Now, the week -end of the big move (inaudible) care out there, there came in a truck, I believe, and the manager came to me and said, they're there for• that day cuz he had gone out and (inaudible) bunch of cars. Other than that, I (inaudible) something wrong. Betty Millers Can I make a comment? Mayor Malstons Sure. Rita Womaks At one time I couldn4t get in my parking lot because the whole line's been down there the whole week it's been down there, it's been down there for months. I got more than 10 cars, my guys, 99: of the time, because I won't guarantee there's not extra cars on my lot, cuz in my lot guys aren't always real good at movin' them. We're the ones who requested the five additional spaces. Avis backed out cuz they saved some money because my lot guy which I'd hired (inaudible) anyway runs them around at night, finds little spots all over long term parking lot, the next morning we run around finding our cars and pull them back into the line over there because that's public parking during the day, we rent all our care out, we hope to keep them all out so there isn't even 10 during the summer, you'll hardly ever see them. But there are times that they're awful, nothing's ever been said to Hertz, and they've been out there a long time with a long line of cars, every night. Betty Millers As to the truck that Mr. Swalley is referring to, that truck with cars on it did not belong to Hertz it belonged to Dollar Rent-a-Cer because my new shipment had arrived that day with 10 brand new cars. City Manager Brightons Mr. Chairman, may I make a suggestion in order to resolve this situation, it doesn't look like it's goin' anywhere. One of two things can happen. If you bring me a stipulation from everybody involved, saying there's no objection to the move and you folks'll pay for the move, I have no i Partial Verbatim June 1, 1983 Page 11 objection. If you cannot get a stipulation from everybody concerned, then the only way I'm willing to change my decision is that if the Council requests that I change my decision. Rita Womaks I don't think Hertz'11 give it, why should they? they're makin' money, lots of it. Betty Millers They're not gonna do that, they're not stupid. Mayor Malstons Does Council wish to take any action? Councilman Wagoner. Councilman Wagoners Not a matter of action, but there is a matter that several things have come up here that need to be addressed. To assure everybody that they are treated fair and equitably on things other than these temporary locations such as parking, etc. etc. I think that does need to be addressed, the best way to address it is to receive a written proposal as to exactly what the policy is and how it'-- enforced. I think that needs to be done, if we don't already don't have it down in writing, I don't see how you can have a policy that operates an airport to the magnitude that we're apparently operating. I was surprised that the amount of money that the gross sales are there on the car rentals in the airport, but I don't see how we can operate an airport without a policy manual stating exactly what is expected of each person that's in that airport and exactly what the City expects. I think that's imperative that we have that. Betty Millers I must say I agree with that. One of the things that we've had a lot of problems with lately is the inconsistency of that airport. And this has gone all the way back to last year. This problem with these cars bring parked out front is gettin' utterly ridiculous. We are tired of being singled out about havin' our cars parked up front. Everybody parks their care up front and no-one is supposed to be there, including Raven Transit, which I believe they are under the impression that their parking space is right in front of the doors, in front of the airport, and I have pointed out to Deacon several times that no, you're wrong because your parking space is across the street. Well, it doesn't matter to Deacon, I guess, because he parks in front anyway, but nothing is ever said. As a matter of fact, compliments of Carmen, even though he didn't know it, he did bring a picture out which indeed shows that Raven Transit is parked, once again, out front. But this parking situation is,ys know, it's totally out of hand. One week we are being jumped on because there's all kinds of cars out there, the next week it kinds gets elided by and I know there's been letter sent out, but nothing has ever been enforced. As far as those additional car spaces, it has never been enforced. I paid for 3 months for Partial verbatim June 1, 1983 Page 12 additional spaces, I was stupid enough to he honest and make a check out to the City of Kenai. No one else paid. And it's bee^ like this over and over and over and over again. I think it's about time that, if there are decisions made regarding the airport whether it comes from Mr. Swall-ey or Carmen Gintoli or the City Council, that I would really appreciate it if they wrote me letters. I really would because that way I know what's goin' on. And also that way maybe they'll enforce it. And we know they mean business and they mean business 365 days out of the year and nut just two weeks at a time. Because right now we don't know. Next week we may be in trouble, the week after or we may be real good. Mayor Malstons Councilman Wise Councilman Wises I'm just curious, what is the move, uh, in the way you say they move themselves, and yet we say it's a $1000. 1 don't understand what's involved in a move? Now I'm not for or against. I'm just tryin' to figure out what the difference is, that's a big difforence. Betty Millers We were told by Gly, who I believe is the foreman for Halvorson, that if he were to move on a Sunday, and from my judgment on that day that they did move our counters, it takes them approximately 6 people to move one counter. And if they do it on a Sunday it runs into time and a half, triple time, whatever. 1 wish I had (inaudible). Mayor Malstons Guaranteed number of hours. Betty Millers Right. And the other thing was of course the extension cords, but when we were told, that yes we will move you down, but you need to buy the extension cord, Avis and Dollar already went out and bought the new extension cords for the move, but then we were told no you're not moving, so if you do decide to move we do have the extension cords. Councilman Wagoners It's simply then the man handling the (inaudible). Rita Womaks Right cuz all our husbands, and boyfriends, and whatever'll come in and we'll pick 'am up and move 'am down. Partial Verbatim June 1, 1983 Page 13 Airport Manager Swalleys (inaudible) Tonight's the first I heard them voulunteering to move the (inaudible) whatever, uh, in regards to the parking out front with terminal emplloyeas several cars ready and (inaudible) there have been numerous letters put out to all terminal employees and to all public agencies in regards to their cars out there. I feel that that area is for the use of the public, (inaudible). Uh, the move was covered in the lease the fact that (inaudible) may have, at the time we didn't know what was gonna happen (inaudible) the last year (inaudible) the lease that there agencies temporary or whatever in course of the construction (inaudible). Other than that, I really don't know other than the fact that (inaudible). 1 got the first word from Mr. Brighton Thursday night, I hear Wednesday night and the next day (inaudible). I did discuss it with a few people, 2 people to be exact and as soon as it got resinded I went right straight back to those 2 people and (inaudible) movers about a move. But anyway, that's all I have right now if anyone has any questions. Mayor Malstons Councilman Wises Councilman Wises I gather from Carmens comments, Carmen was provided with a sketch of where these counters were to go. Were the rental car companies provided with a sketch where they're gonna go? Airport Manager Swalleys I didn't page them out individually, we walked through the area, I said approximately here (inaudible) the (inaudible) got into the move and I'm measuring the counters and I'm not tryin' to put 'am in, they did not fit into that area. As a result we had to fall back and as Betty says she had lined up poles. However when you walk in the doors the passenger coming off an airplane (inaudible). I might add that (inaudible) expire that we went back moved Betty and I went back with her (inaudible) also and with Johnny from Avis and Raven, went back with all of them and pointed out the areas and the approximate locations the actual move the spacing didn't allow what I had in mind and had to alter it. In regards to Betty stating that she mentioned the step -ladder affect, I went back after she talked about it, I drew it out on paper, anJ it did not work because it (inaudible) moved In for example, her customers would have been standing behind her counter. I didn't think that was a very good situation. Mayor Malstons Councilwoman Glick Councilwoman Glick: Yea, when 1 heard all this, the move was a very small part. The things that worried me and bothered me was the lack of enforcement or .he discriminary kind of enforcement that appeared to be going on and those kinds of things really B ,F 1 Partial Verbatim June 1, 1983 Page 14 bothered me. Mr. Swalley, you said you'vs sent out numerous letters regarding the parking. 00 you, in fact, enforce that parking and do you enforce it in a non-discriminatory manner? Airport Manager Swalleys I do. Raven Transit originally had a space in their (inaudible) way. That sign stolen, knocked dawn, or whatever. I'm working on a plan and I intend to give them to Chief Rosa as soon as we get the construction out of the way so we can look at actually what we've got and other ways to control that are discussed. Signs giving a 3 minute or 5 minute whatever time, or signs stating unattended vehicles that we do Impound or wherewith (inaudible) that out yet. So, we are working on the plan, we're trying to get something devised for controlling (inaudible). And as far as enforcement., to the parking out there, when I go out and 1 see and obvious violation I try to enforce it, however I can't spend all my time out there walkin' around (inaudible) cars. Councilwoman Glicks And the second question, 1 want to go back to the car rental spaces. I'm not talking about one month. Ovur the year, ya know, there are busy times at the airport, I know, and slack times. But over the year, did you not or see realize that they had more cars than their ten spaces? And if Hertz has more than ten cars at any one time, shouldn't they be paying? 1 think you have a policy of sorts don't you, there Jim? Airport Manager Swalleys I don't have a copy of that so far as the extra car spaces. Councilwoman Glick$ thy, I didn't mean, uh... Airport Manager Swalleys The policy I have here is this (inaudible) side of this counter spaces. I go out, if I notice extra cars in the lot, they each are allowed ten cars. O.k, there are times they've all got more than there ten care in the area but they are out. Now when they come in for one day or two days, they might have an extra car out there. I don't feel that 1 should go out and chastise them or whatever (inaudible) all their cars are in the lot, and it is strictly a temporary thing not a long term thing. For example, she brought out that Hertz has 36 cars in the area right now, but I've seen times in the last ten days that all of their lots were empty. Betty Millers Not quite Airport Manager Swalleys I've seen where there wasn't hardly a car left to be rented at the Kenai Airport. We do definitely have a policing problem out there. As far as maintaining the traffic flow and parking problem it's a matter of priorities and time. Partial Verbatim June I 1983 Page 15 Councilwoman Glicks Again, I wouldn't go and directly discuss this with Mr. Swalley because I Felt like some of the things that I was told amounted to job performance and I felt like the best plane to go was to the City Manager. Right or wrong I still felt like I should discuss it with the City Manager because if he was going to address it or had addressed it, then it was being taken care of that 1 feel like these ladies felt as though they were not getting any consideration and based on some of the comments I'm not too sure but what maybe they weren't being ignored a little bit. And I'm not trying to take their side one way or the other here but I think that, ageing all the lessee's should be treated a courteous manner. Mayor Malstons Well, we've sat here and listened to these ladies and commented back and forth, it doesn't appear to me that this Council is going to be able to sit here and give the necessary directions. I think it is an administrative things it does appear that there are some irregularities, possibly in the way that things are being handled there. 1 do believe it's an administrative thing and I think that the administration needs to take care of it. Unless the Council feels differently and wishes to make same type of motion. I think we should..... Councilwoman Glicks Well, Mr. Brighton had a suggestion there, and perhaps if they, the administration, approaches the other agencies, Raven and Hertz, in a positive, non-discriminatory manner, you might be able to get it all solved, but the whole problem was trying to get it solved because it appeared as though these people felt as though they were being discriminated against. And I don't think that's right either. Mayor Malstons Do you agree, Councilwoman Glick, that this is an administrative situation. Councilwoman Glicks I've said that from the very beginning. Mayor Malstons I realize that. Councilman Wise Councilman Wises I haven't been in the terminal so I don't even know what the lay -out is, but I would suggest that the administration review..# see if there is any justification as to... look at the thing again and look at the adequacy of access which is obviously a closure, and if there is a inequitable problem, I think then they ought to take some action. I don't know, euz I haven't been in the terminal since it opened, but obviously if the economics are significant then there may be real administrative problem. I would like the administration to look at it, carefully, and take whatever action in necessary. Partial Verbatim June 1, 1983 Page 16 Mayor Malstons Councilman Wagoner Councilman Wagoners 1 would like to make one motion; I'd like to make a motion that directs the City administeat"ion to provide the Council prior to the opening of the new airport, a users manual which would contain all regulations pertaining to users in the airport. That includes both airlines, car rentals, and any other use that may be available on leases basis. 1 think we do need that and I think that would insure that these people would have a guide line to follow, the Airport Manager and the Council would know what the guide lines are and I think it should avoid these type of situations in the future from even coming to the Council level. And it should insure that people are treated fair and equitably without Council involvement. Betty Millers I would like to point out that if any of you do go into the airport and check out this situation that I don't want you to get the wrong idea and think that we're saying our sign is not visible from the psseenger entrance. The sign is visible, it's the employees that are not. When you first walk into the airport it looks like Avis and Dollars' counters are unattended. And the only one you can see is Hertz with its employee there. I'd move to direct the administration to bid all sidewalks included in the City of Kenai Capital Projects as alternates, and direct the administration to also send out an adendum to all bidders on First and Second Streets so notifying the bidders of this change.
