MALSTON PRESIDING PLEDGE OF ALLEGIANCE 1 A ROLL CALL Presents Ackerly, Bailie, Glick, Measles, Wagoner, Wise, Malston Absents None A-1 Agenda Approval a. Mayor Malston noted the memo distributed this date + regarding item C-29 Ord. 892-83. b. Mayor Malston asked that item C-3, Ord. 893-83 be postponed till the Oct. 19, 1983 meeting. c. Mayor Malston noted the item listed as G-5 in the packet is G-4. G-5 was distributed this date. Changes and corrections were approved as submitted. ADDED ITEMS Vice Mayor Measles presented Mayor Malston with a plaque and proclamation of appreciation for his terms as Councilman and Mayor. B PERSONS PRESENT SCHEDULED TO BE HEARD 8-1 Paul Ross - Speed Limit Signs in Woodland Mr. Paul Ross was not present. Chief Ross said he and Public Works Director Kornelis had discussed putting signs at the entrance to Woodland. 8-2 Tim Wisniewski - Christmas Decorations in City As Chairman of the Beautification Committee, Mr. Wisniewski explained the committee would like to have Christmas decorations to enhance the City and bring in the Christmas spirit during the holiday. They would like to hang them from the light poles. They would be $200 to $400 a piece. They would need close to 40 to do from Dairy -Queen to Tesoro, and Willow from the gas stations to the airport. The total cost would be about $11,000. They also suggested displaying wreaths and decorating windows. City Manager Brighton had said there may not be monies available this year, perhaps the Council could think about it in the future. He will be getting the information soon. Council took no action. 8-3 Dorothy Lee - Report on Museum Committee They had their organizational meeting Sept. 27. Mrs. Porter has applied for the $60GDD grant. We have not got it, but it is spent. Al York will get or build a sled for the museum, and will donate other artifacts. Loretta Breeden will donate artifacts. Peter Kalifornsky will contribute history and books. The Forestry Service gave us 8 postera for the children's corner. Councilman Wagoner suggested the fishing boat on the grass strip could be put in the compound. Me. Lee explained she was the treasurer for petty cash, and passed a hat for donations. B-4 Mike Horton, TAMS - Boat Ramp Harbor Commission Chairman Williams explained this has been called because of business that should have bean taken care of and was not. The contractor has requested extra charges. The Harbor Commission was not informed of this nor did they i " I i i ti 1 i r KENAI CITY COUNCIL OCTOBER 5, 1983 Page 2 approve the extra work. TAMs is not respons inspection, the City is. The Public Works Dept. is responsible for extra work and inspection. The Harbor Commission does not want to use their monies for this, they were given to them for a specific purpose. He suggested the City pay for this as the work was not necessary. Mayor Holston asked Mr. Horton, why did they overlook the bulkhead? Mr. Horton replied, 2 change orders have been issued. Regarding the placing of typar in the general parking area, he did not include that. His intent was to re -grade. Typer is generally to prevent putting in a third gravel pad. There was already a gravel pad. They did include under the boat ramp, but not in the parking area. Regarding the bulkhead, it is not in great shape, but is sufficient for the purpose. It is only 4 ft. high. The steel pipes holding them are in good shape. They did not want to spend money on anything they had to pull out later. If it did fail it would not be a problem as it is not high. There is only a bulkhead on one side. If it did fail it would just be a natural incline. They were not overlooked. They did not feel the service float needed to be replaced either. They should have cost reports soon. Originally they did not include any fill, it was requested by Public Works Director Kornelis. They thought it was a reasonable request. They are attempting to spend the minimum possible. He did not see any reason why they could not drop some of the planks on the Coyle property in there. The area up -stream may be City property. There could be a natural slope the same as the other side. He would have to check ownership. Councilman Wagoner asked if the change order was approved. Mr. Horton replied the typor was. He has been down there, he does not see the reason for it. Councilman Ackerly asked for an estimate of total cost. Mr. Horton replied, $1809000 is the engineer's estimate. The bid came in over estimate. Councilman Ackerly asked if that concerned him. Mr. Horton replied yes. He thought it was not worth over $200,000. He also thought there would be more interest. It did seem a job tailor made for a local contractor. Mr. Kornelis said they determined the typar was necessary because they felt the parking lot was very bad. They wanted to use typor where they enlarged. The change order- was a small amount, it was just in the bad areas. Mr. Horton said that Was something they could not predict. ADDED ITEMS -- Mayor Holston noted the government students in the audience. C PUBLIC HEARINGS C-1 Ordinance 863-83 - Amending Kenai Municipal Code - Utility i Locations Within Rights -of -Way %4 1 City Manager Brighton explained, all of the utility companies have written to Public Works and said they were in the height of their season and cannot meet with the City. Public Works has asked for a postponement till Feb. 1, 1984. MOTION: Councilman Wagoner moved, seconded by Councilman Ackerly, to postpone action on the ordinance till Feb. 1, 1984. 'there was no public comment. Motion passed by unanimous consent. Councilman Measles suggested there be a stipulation this will be the last postponement, with or without input. Council agreed to the suggeation. City Manager Brighton explained these monies were appropriated previously, but reverted because the buildings did not get moved. He asked to have the monies reappropriated. MOTIONS Councilman Measles moved, seconded by Councilwoman Glick, to adopt the ordinance. MOTION, Amendments Councilman Measles moved, seconded by Councilman Ackerly, to amend the ordinance to add $4,000 and $1,000 per memo distributed this date. VOTE, Amendments Motion passed unanimously by roll call vote. There was no public comment. Councilman Wise said he objected to spending monies given to the City as a whole being spent on activities that are not City-wide. C-6 Resolution 83-139 - Establishing Fee Schedule for Recreation Center - MOTIONs Councilwoman Glick moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Mayor Molston said they were having difficulty working out the fee schedule. MOTION, Tables Councilman Wagoner moved, seconded by Councilman Wise, to table action till the let week in November and have Administration send it back to the Recreation Commission. MOTION, Additions Councilman Wagoner moved, with consent of second, to change the date to the lot meeting in November. VOTE, To Tables Motion passed by unanimous consent. C-7 Resolution 93-140 - Transfer of Funds, Patch City Streets- $5,000 MOTIONS Councilman Mesoles moved, seconded by Councilwoman Glick, to adopt the resolution. PUBLIC COMMENTS John Williams. He asked if Lawton and Walker were to be repaired. Public Works Director Kornelia replied, by the contractor. Mr. Williams noted when the asphalt was laid, a criteria was established that it would not be cut open for a period of time. Why was it cut? Mr. Kornelis explained, the City did not request it. P&Z Code allows 6-plexes on residential lots. When the City goes through, they do not know the number of buildings. On Walker Lane an individual built a 4-plax and needed a larger line. The $5,000 is included in this. There are 3 areass Cypress - sewer line Walnut & Elm - storm drain Deepwood - sewer line Also, the hot mix was in the wrong budget item. Councilman Ackerly asked if the hole by the Court House could be filled. Motion passed by unanimous consent. C-8 Transfer of Liquor License - Katmai to Pines Club Clerk Whelan reported all taxes are current with both businesses. MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to send a letter of non -objection to ABC regarding the Pines. Motion passed by unanimous consent. C-9 Request for Liquor License - Peninsula Moose Lodge #1942 MOTION: Councilwoman Glick moved, seconded by Councilman Ac:kerly, to remove the request from the table. KENAI CITY COUNCIL OCTOBER 5, 1983 Paye 5 Motion passed by unanimous consent. Clerk Whelan reported the difficulty has been cleared up, all taxes are current. MOTION: Councilwoman Glick moved, seconded by Councilman Measles, to send a letter of non -objection to ABC regarding the Moose. Councilman Ackerly asked, how could they be in business without a license? Atty. Rogers explained they had asked for a license last year and thought they had it. They were shut down, they had a paper work snafu trey are trying to straighten out. Motion passed by unanimous consent. D MINUTES D-1 Regular Meeting, Sept. 21, 1983 Minutes were approved as submitted. E CORRESPONDENCE E-1 Office of the Governor - Goals for Alaska Report Council took no action. f OLD BUSINESS None G NEW BUSINESS G-1 Bills to be Paid, Bills to be Ratified MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner,to approve the bills as submitted. Motion passed by unanimous consent. G-2 Requisitions Exceeding $1,000 Regarding PO added this date. Public Works Director Kornelis explained, the cost per light is $500. it is a not -to -exceed figure. He stated the figure for 5 lights should be $2500. MOTIONS Councilwoman Glick moved, seconded by Councilman Measles, for approval of the requisitions to include Airtech for $29500 for repair of street lights. Motion passed by unanimous consent. G-3 Ordinance 894-83 - Declaring Certain City Lands not Needed for Public Use MOTION: Councilman Measles moved, seconded by Councilman Ackerly, to introduce the ordinance. KENAI CITY COUNCIL OCTOBER 5, 1983 Page 6 Councilman Wise suggested the ordinance be clarified, it seems to imply all lands are for sale, Some are for lease only. Council agreed to the sugg6stion. G-4 Ordinance 895-83 - Appropriating Rev/Expend - Aliak, McCollum, Cinderella, Fox, Princess, Linwood Ext.; Thompson Park MOTIONt Councilwoman Glick moved, seconded by Councilman Measles, to introduce the ordinance. Motion passed by unanimous consent. G-5 Lease Amendment - Kenai Air MOTIONt Councilman Measles moved, seconded by Councilman Ackerly, to approve the lease amendment. Motion passed by unanimous consent. G-6 Assignment of Lease - Glacier State to Snelson Cos., Inc. Atty. Rogers explained, the assignment will be to Snelson, but there will be a rental by them to another. The lease is specific for poles, he will bring an amendment. It will be used for a vehicle impound yard. MOTION: Councilman Measles moved, seconded by Councilman Ackerly, to approve the assignment of lease. Motion passed unanimously by roll call vote. G-7 Amendment to Lease - FSO S/D, Lots 1 thru 3, Block 1 - Dan Pitts MOTION: Councilman Ackerly moved, seconded by Councilman Measles, to approve the amendment to lease. Motion passed unanimously by roll call vote. G-8 Approval - Airport Fence Repair - Change Order 03 - Alaska Fence - ($2,100) MOTION: Councilman Measles moved, seconded by Councilwoman Glick, to approve the change order. Councilman Wagoner asked why we tied to go through the change order process for credit? Atty. Rogers explained, it does constitute a change in the contract. Motion passed by unanimous consent. N REPORTS A -- 1 I KENAI CITY COUNCIL OCTOBiER 5, 1983 Page 7 H-1 City Manager City Menager Brighton spoke. a. Gov. Sheffield will be in the area Oct. 15. Council is invited to a no -host breakfast in Soldotna and a no -host lunch in Kenai. b. He distributed some informational pamphlets for the new councilmembers, results of previous public opinion polls, notice of Fire Prevention Week and a summary of the use of Ft. Keney. c. There is a problem with the pay Care program. Allocations were made by the State based on the number of day care centers in a city, not on the number of recipients. Soldotna had $80,000, Kenai had $33,OOO. Kenai will run out of money in Dec., before the end of the fiscal year. $40,000 will carry them through. Soldotna is $40,000 over. They would like to re -allocate the funds or make it Borough -wide. There will be difficulty in 'getting s re -allocation. The Soldotna surplus will be distributed by the State to other areas. Soldotna has no objection to re -allocation. d. He will be having a meeting with Jess Hall and Chris Monfor in City Hall for an orientation. Councilmembers are invited to attend. e. Councilman Ackerly suggested while the Governor is here, that he be shown the boat harbor. There was some discussion that the City is not interested in a boat harbor. f. Councilman Wise asked about the Warnke problem (fence in right-of-way, Redoubt S/D). Land Manager Labahn explained, the plat says the walkway was dedicated for public use. She can fence to the area or petition with the other land owners to vacate. It is public but the City has not assumed maintenance or upgraded it. Councilman Measles asked, since it is dedicated for public use, what is the status of utilities installed on the property? Mr. Labahn replied, according to the plat, that should not be there. Public Works Director Kornelis said we can request they relocate but they will probably relocate in front of residents. g. Councilman Ackerly asked about the end of Toyon Way. Mr. Kornelis said it is dedicated but only maintenance on the pavement. Horizon Const. has put in water & sewer but it is not complete. Councilman Ackerly asked if it could be gradod before Winter. Mr. Kornelis explained it has not been accepted yet. h. Mr. Brighton asked Council to review Land Manager Labohn's memo regarding investigating of Moose Range property. i. Councilwoman Glick asked about the driveways and culverts problem in Linwood area. Mr. Brighton replied the engineers and contractor working on those streets had been putting back in the driveways they took out. The engineering firm was not adheriny to Council resolution. The additional cost for the City to put back as they were would he about $6,000. Having gone as far as they had, Administration recommended they continue. We lost money either way. He recommended Mike Thomas for student ro,..000"VU....o to the Recreation Commission. Council approved the recommendation unanimously. Clerk Whelan was asked to send a letter to Mike Thomas. b. He requested a joint work eeegton with P&Z for Oct. 129 1983 at 8t00. Council agreed. H-4 City Clerk a. If any Couneilmember wished to attend the DEC dinner, please contact her. b. There are still some Councilmembers who have not made their Municipal League reservations yet. Pleaae contact the Clerk as boon as possible. c. She apologized for the condition of the packets again. Copies were made early to keep the machine from being overworked and the numbers were changed. H-5 Finance Director None H-6 Planning h Zoning None H-7 Harbor Commission None H-8 Recreation Commission None H-9 Library Commission Troy Costimore said they are working on a proposal, the library is overcrowded.
