A. ROLL CALL
Presents Ron Malston, Ray Measles, Dick Mueller,
Tom Wagoner, John Wise, Vince O'Reilly, Betty Glick
Absents None
SUBJECTS Candlelight & Linwood, Paving, Water & Sewer
Councilman Measles noted the title should be "Roads"
instead of "Paving."
Council agreed to the change.
Mayor O'Reilly explained the motion voted at the
April 21, 1982 meeting was the road project was
cancelled and the entire project, including water
& sewer, would be re -bid. An amendment was passed
to delete the portion relating to Lawton to Fiddler
to reduce the cost on the water & sewer portion.

Councilman Wise moved, seconded by Councilwoman
Glick, to suspend the rules to allow discussion
on the matter.

Motion passed, with Councilmen Measles, Mueller,
Wise, Mayor O'Reilly, Councilwoman Glick voting
yeas Councilmen Malston, Wagoner voting no.
Councilman Wagoner said he had asked for the special !
meeting. He felt Council was making a mistake in
handling this matter. They were talking $120,000 to
cancel the project, plus another $10,000 to do all
the engineering. For $91,000 we could solve the
sanitation problems by running water from Kaknu. '
For one year we could leave the gravel cap on, do
a little extra maintenance and do the water & sewer,
with 8" of sand & gravel.
Public Works Director Kornelis reviewed the water
tests. They had 14 samples, they had not received
the results yet. They will be returned 4-28-82.
The lab had said so far there is no growth. They
had 14 of the 17 homes available. Councilman Mueller
asked if any chemical or mineral analysis had been

the motions
1. Cancellation of the road contract.
2. $527,000 on water & sewer, totaling $800,000
for water & sewer and new road on Candlelight
and Linwood.
3. Propose continuation of road contract, water
& sewer into Candlelight & Linwood (that could
be done this year) and leaving aside where the
funds will come from.

PUBLIC COMMENTS
1. Frank Getty. He noted the City did not take
a water sample from his bad well.
Mayor O'Reilly noted some people want road, water &
sewer; some want nothing; some want water only; some
want sewer only. Councilman Wise asked, how deep an
excavation are they making? Mr. Kornelis replied,

the water is sewer? Mr. Kornelis replied, the sewer
is 5 ft* and sloping. The water is 10 ft. The sand

Councilman Wagoner said, basically, they will have good
soil to water & sewer line. Mayor O'Reilly asked,
would the present contractor add on water & sewer to
their present contract? Mr. Kornelis replied he
would, but would want to negotiate. would object, we are addingSome contractors

contract.
Frank Gett He has problem with water on his rental,
t s worse than his own. He is having a well driller
in 4-28-82 to start a well. He will have water in
before the year is out. He didn't feel he was out of
Place for asking for pure water. He thought the sewer
went 12 £t. He will have to have a lift in his base-
ment. The other day he pulled out his 2 assessment
requests for his attorney to review. He will be bring_
ing them back. His interest was in developing his
property to sell and move South. This has no bearing
on the prk74ect. He will put water in his rental no
matter what Council decides.
Atty. Delahay said there was a time problem. There
are 2 ways for assessment, one by petition and one
by resolution of Council. The survey & report have
been made, but the public hearing must be held. You

Councilwoman Glick said she found it amazing they are

P&Z. We decided to form an assessment district,
that was not in conformance. In March the Admin-
istration was asked to petition the people and this
was done. The majority of the people wanted water
& sewer, or one or the other. Council has madA a
decision that did not set well with Administration,
and has been snowballed with dilatory tactics.
Council has made a decision based on inaccurate
figures at a work session. The engineer estimate
was not accurate. Now we are being told we have
to go through a hoop and have a time crunch. Had
we discussed this in Feb., these things would have
been taken care of. She would object to just

cient balances in unappropriated fund balances.
Councilman Wagoner said at the same time when we talk
about using fund balances and capital reserve, this
could have an effect on the mill rate, sales tax, etc.
Councilman Wise asked, what do we do if we come in
bad on this thing? Why did we not get at least one
metal test done? The allegation was made that there
was a problem. We hAye p history of arsenic in the
area. He noted Mr. Williams had said he had copper
and we did not test for it. Mr. Kornelis explained

at the last Council meeting Administration was directed
to cancel the contract and go ahead with water. & sewer,
When the special meeting was called, they started the
tests. The metal tests will have to go to Anchorage
and will take 2 or 3 weeks. Councilwoman Glick asked
John Williams if he had tests done.
2. John Williams. He replied he had done tests,
He added Fe -agreed with Councilwoman Glick re-
garding the, time frame. This dates back to
meetings in the old library building. He had
his tests done for copper sulphate only, at
the college. They may not be conclusive but
did indicate 2 parts per million copper. There
is an unacceptably high level of copper. He
didn't know if they were run properly or not,
but it should be checked. It can be a result
of dissolving of the copper in the house itself.
Testing minerals can take 3 weeks and be very
costly, but some of these should be run. Perhaps
the City should set aside funds to have tests
in areas not served by City water. Those tests
could guide Council as to where future water
should be put. The City should install water
mains, not sewer. Let's finish the road project
and get it done. Councilwoman Glick said she
had been told by some people they have fairly
good water but they have greening that builds
up in the tub. There may be other areas that
are having problems. Mr. Kornelis explained
the $91,000 we were talking about does not
include Linwood south of Kaknu. It will be
$89#000 to do Linwood south of Kaknu. Council-
man Wagoner said if we do that we have expanded
the contract where we cannot negotiate with the
road contract. Mr. Kornelis said if we do
all the water, it comes up close to $400,000.
Councilman wagoner said we still don't know
if we have contamination. The BOD's won't be
in till 4-28-82. He is not in favor of putting
in water till we know, then go to DEC and see
if we can get funding and assessment districts.
He asked, does there have to be 501 of the
property owners for an assessment district? Atty.
Delahay replied, yes, anyone protesting has to
have official written protest. This is not in
conformance with the ordinance. Anyone paying
has to be in accordance with the ordinance.
Councilman Wise said the ordinance also provides
that Council by ordinance can overrule the wishes
of property owners and set up assessment districts.
We don't have that problem before us, the majority
have asked for it. Mr. Kornelis said he could
have the results by 4-28-82. The reason Mr.
Getty's well wasn't tested is it did not show
on the Borough list.

Councilman Measles moved, seconded by Councilwoman
Glick, to recess till Friday, 4-28-82 at 6:00 PM and
d, direct Administration to sample the rest of the wells
first thing Friday morning and get one or two of the
worst well samples to chemical labs for copper and
arsenic: tests.

Public Works Director Kornelis said they cannot,
get samples from some of the buildings. They have
gone out 2 times now. He will hit the worst, Mr.
Williams, Mr. Getty (rental) , Mr. M.acomsey, ea&
Mr. ieethers. Councilman Measles said if there is
in fact a health problem, we could go to DEC for
an appropriation. This will solve the problem over
where funds will come from. At the same time Council
should take another look at Capital Improvement
project.
VOTES
3. Wayne McMillian. Council mentioned that some
;&-nted sewer, some water, some both, some
neither. Better than 50% of those on Candlelight
and Linwood signed the assessments. City Manager
Brighton reviewed the figures. Of 22 on Candle-
light, 12 were returned saying yes. Of 9 on Lin-
wood, 5 were returned saying yes. There were
no stipulations.
4. Judy Peters. She noted the City is talking about
t e other end of Candlelight than her home. If
Tha City takes care of the worst wells, where
does that leave her? She doesn't understand why
it would not be feasible to do the whole thing
at once. Mayor O'Reilly explained $90,000 would
be close to where we would have to re -bid the
job. That would involve a different time cycle
than we have now. Mrs. Peters asked, when -he
job was bid out, was there not the thought that
residents may have wanted water & sewer? Mayor
O'Reilly said it was considered, but information
Council received indicated there was no dem-ind
for water & sewer. Since those meetings they
have had input that they did want it. Now we
have information that it may be contaminated.
Councilman Mueller said the only other mineral we
may have to check is lead, is there any problem
with that? Councilman Measles said he didn't see
any problem. Councilman Wise asked if we could
defer action on the contract till next week. Mr.
Kornelis replied the contractor keeps hanging tight.
He is looking at receiving a good profit for no
work all, but he is anxious to know.
Motion passed with Councilman Wise voting no.
