Although this was voted down at the budget hearings, Atty. Delahay stated it would still have to be up for public hearing. Mayor O'Reilly asked that the letter brought to the meeting tonight (5-20-81) for the Dept. of Engineers be added as item E-1. Mayor O'Reilly asked that the Cason lease brought to the meeting tonight (5-20-81) be added as item P-4. Mayor O'Reilly asked that the bills over $1,000 submitted tonight (5-20-81) be added to item G-1. Mayor O'Reilly asked that the two P.O.'s for Oil- field Salvage and Carmen Gintoli be added as item G-2. It is all metered, The City is going to a new system that will be better, Councilwoman Click said she would like them monitored more closely. CORRESPONDENCE E-1 Letter to the Dept. of Engineers Regarding the Bluff Erosion Mayor O'Reilly explained up to this time, the Dept. of Engineers would not work on the bluff as it was private property. Recently City property has sloughed off. Council approved the letter as submitted. F. OLD BUSINESS F-1 Water 6 Sewer Service Regulations Finance Director Brown explained wo have water and sewer regulations now, this is just cleaning it up. MOTIONS Councilwoman Glick moved, seconded by Councilman Malston, to adopt the regulations for water and sewer as revised and submitted to Council this date. (5-20-51) I t KENAI CITY COUNCIL MAY 20, 1981 Page 5 Councilman wagoner said he felt the City does not have the right to require an individual to disconnect their well. Mayor O'Reilly explained this is a State regulation. Motion passed with Councilman wagoner voting no. F-2 Draft Letter From Mayor O'Reilly to Dept. of Natural Resources Regarding Oil & Gas Lease Sale Mayor O'Reilly explained two of the proposed leases are at the mouth of the Kenai River. He has brought this to the Harbor Commission. Councilwoman Glick asked that a notation be added at the bottom of the letter that all drilling activities conform to City Planning 6 Zoning ordinances. Council agreed to send the letter with addition. F-3 Appropriation for Un-^_:rading Public Boat Launch Facility - $25,000 City Manager Brighton explained this was at Council before, and was sent back to Harbor Commission. He told the Harbor Commission the City could not do it all, the cost will also be less as City employees are doing much of the work. Some of the work has already been done. Mayor O'Reilly asked Public Works Director Kornelis to tell the men that they did good work. F-4 Cason Lease Amendment Atty. Delahay explained the Council has already approved the settlement, the lease was just returned from Mr. Cason's attorney. Since Ordinance requires all leases be approved, Council has to approve this. Finance Director Brown explained that should read "replaced." He noted this was approved in October. Councilman Malston asked to register his objection to the consent agenda. G-5 Ordinance 681-81 - Amending Kenai Municipal Code - Increases in Qualification gay to Some Employees MOTIONS Councilwoman Glick moved, seconded by Councilman Malston, to introduce the ordinance. Motion passed unanimously by roll call vote. G-6 Ordinance 692-81 - Amending Kenai Municipal Code - Change Pay Range - Fire Marshal MOTIONS Councilwoman Glick moved, seconded by Councilman Wagoner, to introduce the ordinance. City Manager Brighton explained this was one of the requests at the salary review. He did not have enough information to submit at budget time, but the approved budget includes this. Motion failed, with Councilmen Wagoner, Hal]., Mayor O'Reilly voting yes; Councilmen Mueller, Malston, Measles, Councilwoman Glick voting no. G-7 Ordinance 683-81 - Amending Kenai Municipal Code - Increasing Uniform Allowance MOTION s Councilwoman Glick moved, seconded by Councilman Malston, to introduce the ordinance. Councilman Measles asked if this item could be postponed also, as it relates to Ord. 684-81. Council agreed to the postponement. G-10 Resolution 81-54 - Awarding Contract for Fabrica- tion of Pumper Test Tank to Jim Satathite welding MOTIONS Councilwoman Glick moved, seconded by Councilman Malston, to adopt the resolution. Councilwoman Glick noted there was considerable difference between the bids and asked Public works Director Kornelis if he was comfortable with it. Mr. Kornelis replied it was a Fire Dept. bid, but Chief Winston feels the job can be done. There was no public comment. Motion passed unanimously by roll call vote. G-11 Resolution 81-55 - Transfer of Funds - water Testing - $500 MOTIONS Councilman Malston moved, seconded by Councilman Mueller, to adopt the resolution. There was no public comment. G-13 Resolution 81-57 - Awarding Bid for Various Truck Tires KENAI CITY COUNCIL MAY 20, 1981 Page 9 MOTION: Councilman Halston moved, seconded by Councilman Mueller, to adopt the resolution. There was no public comment. Motion was approved by unanimous consent. G-14 Resolution 81-53 - Awarding Bid for Public Works Pick -Up Truck MOTION: Councilman Malston moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Motion passed with Councilman Wagoner voting no. G-23 City Clerk, City Attorney, City Manager - Set Salaries MOTIONS Councilwoman Glick moved, seconded by Councilman Measles, to set the salary of City Clerk at $26,000, the City Attorney at $55,000, and the City Manager at $55,000. Councilwoman Glick explained she had raised the City Manager's salary because at title salary work session there had been some discussion to grant him PERS. Atty. Delahay says this is not legal. It was the intent of the Council to make both equal. Councilman wagoner said the City has gotten itself into a dangerous situation with negotiating with employees. We should get a salary schedule that we could adhere to. Motion passed unanimously by roll call vote. G-25 Transfer of Funds - Maintenance of the City Dock Recreation Area - $5,070 MOTION s Councilwoman Glick moved, seconded by Councilman Mueller, to adopt the resolution. There was no public comment. Motion was approved by unanimous consent. H. REPORTS I _ _ H-1 City Manager i City Manager Brighton spoke. i - 1. The Health Center has not moved in. Council ! had said the rent would be $.62 per sq. ft., they j had proposed $54 per sq. ft. for the lot 12 months, and up to $.70 per sq. ft. at the lot 12 month re- newal. MOTIONS Councilwoman Glick moved, seconded by Councilman ' Malston, to direct Administration to consider fer- the sum of $.54 for the first 12 months and $.70 for each succeeding 12 months. .y; Councilwoman Glick explained that was because they budget one year in advance. Motion passed unanimously by roll call vote. <<>- 2. Regarding the Daubenspeck Cannery. The City is renting houses to Fred McGill during the fishing season, June 20 to Aug. 20. It is all worked out, _. the furnishings are not to be included, they will take them out. �I 3. He attended a seminar in Anchorage with DOT. They have hired a consultant to do a study on port facilities throughout Alaska to have Statewide -- port authority. He suggested the Harbor Commission s . or himself should pursue this. �'411 4. Yvonne Hakkinen, of Kenai Cable TV, asked him to send a letter regarding the City's actions at the Council meeting. He has sent the letter. Councilwoman Glick asked if the letter had been sent to ARCO regarding the water line. Mr. Brighton replied yes. Councilwoman Glick asked regarding the status of the property the City Administration building is on. Has this been settled yet? Finance Director Brown replied the purchase has been made, the money will be transferred at the end of the fiscal year. H-2 City Attorney Atty. Delahay spoke. 1. He had received a letter from Salamatof re- garding the rate schedule for the dock. City Manager Brighton and he agree it would be in violation of the lease, and would jeopardize City ownership of the land. He recommended the Council not approve and after the Administration could work out some- ---thing with the attorneys. Motion passed unanimously by roll call vote. —... 2. The Kenai Municipal Code says resolutions are subject to public hearing. He suggested they be -•� put under item "B" in the agenda. .� Council agreed. 7 H-3 Mayor Mayor O'Reilly spoke. 1. There is a vacancy on the Harbor Commission. he would like any recommendations from Council. 'fvFj 2. Regarding the Dow project. This is a massive j project. The implications are great if it is lo- cated any where near us. He would like to schedule �S i KENAI CITY COUNCIL MAY 20, 1981 Pace 12 a meeting June 2, 1981 with F. McIlhargey of the Kenai Peninsula Borough, Dow Chemical the Council and the public as to implications of the Dow pro- posal. Kenai has a very good chance. It would be a general discussion meeting. They are talking 4500 employees at the site, and 21 Million gallons of water per day. There will be another meeting June 16, 1981, and a reception July 7, 1981. 3. He has reported to the Council his discussions with the Legislators. These are not quotes, just his opinions. Fie would like to discuss: a. Municipal Assistance. It was his under- standing the current proposal is 81-82 funds will be paid in June 1982 to be used for 82-83 year. The municipalities will receive their supplement, then a second supplement, then the Dankworth proposal funds. The Legislature feels this is too much, too fast. He will be in Juneau next week and would like Finance Director Brown to go with him to talk with the Legislators. Mayor O'Reilly's suggestion is to fund Municipal Assistance under the regular formula. Finance Director Brown noted if the next Municipal Assistance is June 1982, we have $154,000 in this year's budget, he will be off by that amount. This could affect our mill rate. Councilwoman Glick said she still feels comfortable with the action we have taken. There are many variables. The Legis- lature has not come to a conclusion. We should get a year at a time. mayor O'Reilly noted we should be helping them make decisions for next year. We should tell the Legislators what we think will happen if different actio::s are taken. Councilman Wagoner said the City should operate within the funds taken in each year. We should be lowering the mill rate with the funds. Councilwoman Glick agreed, and said the City should be in a good financial condition but should not tax when we have money in the bank. We should not totally wipe )ut the Capital Im- provement money. Councilman Wagoner noted if we take our four mill rate, we would still have $450,000 left. Mayor O'Reilly suggested we should isolate Municipal Assistance and Fed- eral Revenue Sharing and try to influence the Legislators. Councilwoman Glick said we should point out the City did follow through with the State intent on supplementary funding. We KENAI CITY COUNCIL MAY 20, 1981 Page 1.'. would like them to get full municipal funding now instead of waiting till the end of the fiscal year. If they can provide us with full municipal funding without attaching strings, we will follow through next year to help the citizens. Councilman Wagoner said we are not being honest with the taxpayers and the legis- lators. They could say we have been salting it away. We are putting ourselves in a vul- nerable position. Councilman Malston said there are many capital improvements we could make with the Capital Improvement Funds, that is what the money is for. Sometimes it must be held till enough is available. Councilman Wagoner said he did not think it was in good keeping to say you're going to use general revenues to generate capital improvement funds. Capital Improvements are done through the bonding process. Mayor O'Reilly replied the reason we did that is because we could not bond. Now with high interest rates, the cities cannot get funds. Councilman Measles agreed the City should be looking at the next several years. The taxpayers are not looking at a zero mill rate at the expense of getting a high mill rate next year. Councilwoman Glick agreed, but noted we have a good balance in unappropriated balance in addition. Finance Director Brown said it should be smaller this year than last. Councilwoman Glick said even if the State does not come through with additional money, we can ,A%r the same mill rate. Mayor O'Reilly replied we should try to see what we can do with the Legislature to keep from having an up and down mill rate. b. Capital. Improvement Funds. Mayor O'Reilly and City manager Brighton went to Juneau. Sen. Gilman has proposed a new Roads & Trails method of funding. During the discussions they came up with $11.3 Million figure for items 1 through 18. Items 19 an on were on roads. The larger communities want a per capita in- come, the smaller communities want a different method. The Legislature thinks the Dankworth proposal plus the other would give us $35 Million. Mayor O'Reilly pointed out the airport add -on, this meets with the Governor's criteria. Mayor O'Reilly asked Public Works Director Kornelis if he felt that would take us through. Mr. Kornelis replied yes. Mayor O'Reilly said essentially we will not be able to do items 19 through 26. Councilman Malston noted we can do them next year. Councilman Measles asked if the City could bury the electric cable on Frontage Road at the same time the road is built. Could we borrow from funds available? MOTION: Councilman Measles moved, seconded by Councilwoman Glick, to appropriate from Capital Improvement Funds $75,000 to bury electric cable on Frontage Road. Motion pasze"' unanimously by roll call vote. Mayor O'Reilly said that would up to that amount. Public Works Director Kornelis noted there may be j a conflict with HEA. Councilwoman Glick asked the Administration to contact HEA May 21, 1981. Mayor O'Reilly asked about the airport terminal. Councilman Hall said he didn't think the add -on to the terminal was that critical, but the ramp is. City Manager Brighton said they had several conversations regarding the airport. In his opinion the single most important item to this community is the airport. The terminal is just as important as the runway. Public Works Director aornelis said we have gone out for proposals from architects on the terminal ex- pansion and renovation. Carmen Gintoli is preparing schematics for Finance Director Brown and Mayor O'Reilly to take to Juneau. Councilman Hall asked, what happens if you do not get total funding? How does it look? Mr. Brighton replied he thought it looked good. This is not strictly confined to the City, it serves the entire central Peninsula. if we don't get the money, we are still further down the road when the money is available. Councilman wagoner questioned the need for new schematics. We already have 3 concepts. Mr. Kornelis replied all 3 are very different, they would like to consolidate all 3. Mayor O'Reilly said the airport items are $4 Million, the others are $4 Million. $8 Million is not unreasonable for 17% of the population. Mayor O'Reilly noted the Cultural Facility, the Legislators feel there is a great amount of trouble with the cultural facility. But the people voted for this. Councilman Wagoner said h-- felt we should stick with the prioritized items. Councilwoman Glick said whether we voted for or are in favor of it, we should consider the desires of the people. We have had 2 bond votes on the Cultural Facility. Councilman Wagoner said if it won't fly, he would rather have better roads. This is in the "other pricritized" list. Councilwoman Glick said consideration should be given to those who have put work into this. The Cultural Facility could be added in. Councilman Malston said the object of a prioritized list was that they could stay on their own. Council thought the Cultural Facility and library work would be given some direct funding. City Manager Brighton said one of the problems is our priority list was set by Council, now come the wishes of the Legislature. We must get the 2 together. If we stick with the Council priority list, we may come out with only half of what is wanted. Mayor O'Reilly noted if we get too difficult, they may cancel all monies. Councilman Wagoner said from the latest word, it looks life the Cultural Facility has a very small chance of going through. Council agreed with the $8.520 Million figure. Mayor O'Reilly said we will have to get the sense of the Legislature to see if we go to roads or with the Cultural Facility. Councilman Wagoner noted many have a real concern over the high cost of the Cultural Facility. Councilwoman Glick said perhaps we need to look at the Convention Center aspect. Mayor O'Reilly said the Governor is interested in the Dankworth proposal of $1,000 per capita. But when he getsoutside of that, he wants to veto Culture Centers. 4. Council agreed. H-4 City Clerk Clerk Whelan reported on the telephone poll conducted by Recreation Director McGillivray to purchase water line materials for µoftball fields. The cities just have what is delegated by the Borough. 4 H-7 Harbor Commission Admin. Coordinator Davis spoke. 1. At the May 12, 1981 meeting, the proposal sub- mitted by Bob Roper and his real estate agent was i discussed. It was agreed that nothing could be done till the City gets the port facilities development money. 2. The Council approved the alternate development plan on the port facilities development plan, it i should be a couple of months. 3. CH2M Hill has submitted the sediment study. The ' Harbor Commission is not satisfied with the proposal, and has asked for other proposals. They are due June 2, 1981. 4. The Harbor Commission will have monthly meet- ings starting June 2, 1981. S. The boat ramp recommendation on $25,000 was discussed tonight (5-20-91). 5. Mr. Davis attended a meeting in Wisconsin re- garding planning, development and construction of harbors. He will submit a report. 7. There was a meeting with Murray Walsh, OCM, and Community & Regional Affairs 5-19-81. The City will need to wait the Borough position on Coastal Manage- ment till additional funding is available. There are monies for a 3 month extension, he will have a report at the next meeting. City Manager Brighton noted the Salamatof lease was reviewed by the Harbor Commission. They had no advice for Council. At City Manager Brighton's request, Admin. Coordi- nator Davis explained why the Harbor Commission was unhappy with the CH2M Hill study. It was be- cause of the $100,000 figure for a month sedimenta- tion study, Councilman Wagoner added it was a very inadequate plan. Mr. Davis said they have a sub- contractor who is the expert. Mr. Leman was sub- mitting a proposal prepared by someone else. H-8 Airport/Land Committee Councilman Mueller spoke. 1. They had a meeting May 11, 1981 and discussed: a, water & sewer hook-up fees. They suggested eliminating them and increasing inspection fees. b. 50% cap on leases. They recommended re- moving the cap all aw, restricted to airport uses. C^ �.� ►az.sc, not- c. They suggested a 7% rate for lease Lat"est rate. d. Lease cancellation policy. Lessees should be allowed to reserve land for future expansion.. That motion was distributed tonight. (5-20-81) Mayor O'Reilly suggested the Council direct Admin- istration to prepare an ordinance eliminating the $400 water & sewer fee and establishing $50 for inspection. Council agreed to the request. Councilman Malston said he had asked that the 50% cap and percentage rate be postponed till the e:;3 of the meeting was he thought a speaker would be here. Mueller moved, seconded by Councilwoman Glick, that the City of Kenai set a policy of refusing to seek cancellation if leases for failure of construction where a substantial building on one or more lots in accordance with the proposal in his application, has reserved one or more other lots for future use or expansion, and has not subsequently begun con- struction on said other lot or lots, and that the City Manager be directed to adhere to this policy and to advise those lessees to whom it would apply of the setting of the policy.
