PERSONS PRESENT NOT SCHEDULED TO BE HEARD ADJOURNMENT KENAI CITY COUNCIL - REGULAR MEETING, MINUTES DECEMBER 16, 1981, 7:00 PM KENAI CITY ADMINISTRATION BUILDING MAYOR VINCENT O'REILLY PRESIDING PLEDGE OF ALLEGIANCE ' The Boy Scouts of Troop 357 conducted the flag ceremony. Mayor O'Reilly expressed the appreciation of the City to the troop. A. ROLL CALL Present: Vincent O'Reilly, John Wise, Ray Measles, Betty Glick, Tom Wagoner, Ron Malston Absent: Dick Mueller (excused) AGENDA APPROVAL Mayor O'Reilly said Resolution 81-132, regarding support of the Peninsula Agriculture Association request for a feasibility study has been submitted for consideration. Councilman Wise explained the Agricultural Council will be meeting Dec. 17, 1981 and they have asked for Council support. Councilman Wagoner said this happens at every meeting, there is as much material in front of him as there is in his packet. City Manager Brighton noted there is a lot of material, but most of it is informational. Council agreed to place Resolution 81-132 on the agenda for the Jan. 6, 1982 meeting. B. PERSONS PRESENT SCHEDULED TO BE HEARD None C. PUBLIC HEARINGS C-1 Ordinance 725-81 - Increasing Rev/Appns - Drainage Study - $52,000 a. Substitute Ord. 725-81 - Drainage Study & Topography Completion - $170,000 MOTION: Councilman Malston moved, seconded by Councilman Wise, to adopt the ordinance. MOTION, Amendment: Councilwoman Glick moved, seconded by Councilman Measles, to adopt Substitute Ordinance 725-81. There was no public comment. Councilwoman Glick explained Public Works Director Kornelis felt that defining the scope of the project may be too restrictive. He would like more flexibility. He would like to add the topo- graphy at this time. We do have monies available. Councilman Wise said he was surprised at the sub- stitute ordinance. It was made without notification. The money back-up was not brought forward till this date (12-16-81). He questions the drainage section. We cannot keep open what we have now. We are surrend- ering policy to Administration. He had asked for a delay till the Soil Conservation Service gave their report. We have not heard from them yet. Council- man Wagoner said we should write a Request for KENAI CITY COUNCIL DEC. If, 1981 Page 2 Proposal, then set up the criteria, then ask for quotes. Public Works Director Kornelis explained the original funding started with a request for a drainage study for Section 36 for $52,000. The question was brought up to do the whole city. Two ordinances were made and changed after that. In talking with different engineering firms, they gave us the $150,000 figure, that was a little high. $70,000 was the figure we used for the topo. This is just submitted as a suggestion. We only have a draft of the flood study available. We have 3 possi- bilities for funding, one is capital improvement funds, one from City funds, or from a CEIP grant. VOTE, Amendment: Motion failed by unanimous roll call vote. VOTE, Main Motion: Motion failed, with Councilman Wise voting yes. • MOTION: Councilman Wagoner moved, seconded by Councilwoman Glick, for Administration to draw up Request for i Proposals, the scope of which would entail item C-1 and Substitute C-1, and present to Council on January 6, 1982. Councilman Wise said he is opposed to photographic work in the City. We need drainage now. The entire Capital Improvement program goes around roads. We are saying tonight not to do road work for 1-1/2 years. We have had topo work several years now. Councilman Wagoner said all Capital Improvements are on existing roads. It will not slow down the Capital Improvements. Public Works Director Kornelis said the topo and drainage could be done separately. It would be more than $70,000 if we went to another %5Kt1 film. OSHA already did a photo study, He suggested i t po be done by the same firm. The drainage study could be done by anybody. Councilman Wagoner said he is talking about firm figures. Also, if there are already phoLos, we should ask for them, they are our property. MOTION, Amendment: Councilwoman Glick moved, seconded by Councilman Wagoner, to: a. Present the Request for Proposal to Council through the mail and if they have problems they would bring them to Council Jan. 6, 1982. Otherwise Administration could advertise. b. The Request for Proposals could be one for topo and one for drainage. VOTE, Amendment: Motion passed unanimously by roll call vote. VOTE, Main Motion with Amendment: Motion passed unanimously by roll call vote. KENAI CITY COUNCIL DEC. 16, 1981 Page 3 City Manager Brighton asked if Administration should apply for CEIP funds. Councilman Wise replied, topo - yes, but the drainage is needed today. We will not gain by waiting. City Manager Brighton replied it is unreasonable to use our local funds if other funds are available. He asked Public Works Director Kornelis, are we designing roads without designing for drainage? Public Works Director Kornelis replied, no, there are quite a few. On the flood hazard study we are talking about 5 different areas. MOTION: Councilwoman Glick moved, seconded by Councilman Measles, to direct Administration to apply for any and all CEIP funds available for these projects. Motion passed, with Councilman Wise voting no. C-2 Ordinance 738-81 - Increasing Rev/Appns - Library Donations - $1,100 MOTION: Councilman Measles moved, seconded by Councilman Malston, to adopt the --ordinance. There was no public comment. Motion passed unanimously by roll call vote. C-3 Ordinance 739-81 - Decreasing Rev/Appns - Water & Sewer, Sect. 36 - Grant Decrease from Alaska DEC - $183,197 MOTION. - Councilwoman Glick moved, seconded by Councilman Malston, to adopt the ordinance. There was no public comment. Councilman Wise asked if adjustments were made in EPA funds. Finance Director Brown replied there were no EPA funds eligible. It was 50% State Municipal grant, 50% DEC grant, no Federal EPA funds. Motion passed unanimously by roll call vote. C-4 Ordinance 740-81 - Increasing Rev/Appns - Overtime & Benefits in Police Dept. - Airport Security - $20,910 MOTION: Councilman Measles moved, seconded by Councilwoman Glick, to adopt the ordinance. There was no public comment. Motion passed unanimously by roll call vote. C-5 Resolution 81-124 - Establishing Disposal Schedule for Tapes of Council Meetings MOTION: Councilwoman Glick moved, seconded by Councilman Malston, to adopt the resolution. Delahay explained the statute of limitations is 6 years on many suits, we need background material. There are no legal requirements for this. Motion passed unanimously by roll call vote. C-6 Resolution 81-126 - Transfer of Funds - Repair - Printer Word Processor in City Manager's Dept. - $417 MOTION: Councilwoman Glick moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Motion passed unanimously by roll call vote. C-7 Resolution 81-127 - Transfer of Funds - Provide Monies for Temporary Employees, Remodeling Fine Arts Building. MOTION: Councilwoman Glick moved, seconded by Councilman Measles, to adopt the resolution. There was no public comment. Motion passed unanimously by roll call vote. C-8 Beverage Dispensary - Eadie's Frontier Club Rig Bar Package Store - Eadie's Frontier Liquor Clerk Whelan reported that all taxes are paid current. MOTION: Councilman Measles moved, seconded by Councilwoman Glick, to send a letter of non -objection to ABC regarding the liquor applications as listed. Motion passed by unanimous consent. D MINUTES D-1 Regular Meeting - Dec. 2, 1981 Minutes were approved as submitted. E. CORRESPONDENCE E-1 Pam Burnett - Medical Insurance Inadequacy Councilman Wagoner asked that Administration review the letter. Councilwoman Glick noted the lady had to wait 9 months. If that is normal, we should look at a different company. Jack Webb, Clary Insurance, spoke. He explained there was a dispute between Blue Cross and the doctor. He will pursue the problem. E-2 Larry Farnen, City Manager of Homer - Resolution Requesting Title 29 Amendments Regarding Platting, Planning & Land Use Regulations �m KENAI CITY COUNCIL DEC. 16, 1981 Page 5 MOTION: Councilman Wagoner moved, seconded by Councilman Measles, for Administration to correspond with the Borough Mayor to draft a new Borough ordinance for cities to have full planning powers in the cities. Councilwoman Glick said Borough Substitute Ord. 81-2 was introduced, the 2nd hearing will be Feb. 16, 1982. She spoke to Borough Mayor Stan Thompson, he explained what he has done is change the wording and is just giving zoning powers to the cities. MOTION, Substitutes Councilman Wagoner moved, with consent of 2nd, to substitute the original motion to read, direct Admin- istration to prepare a resolution to forward to the Borough requesting the Borough continue with Ordinance 81-2 and also that it contain the City request to take over planning & zoning powers within the City limits. Motion passed, with Councilman Wise voting no. MOTION. - Councilman Wise moved, seconded by Councilman Malston, to direct Administration prepare a resolution similar to the Homer resolution and add, "Be it further resolved that it be sent to the State Legislators in toto." Councilman Wise explained any administrative body can make rules and then revoke them. They only way the Borough can change is by a Title 29 change. This is what Homer requested. Councilman Wagoner said if the Borough passed this ordinance, we have 3 years to change Title 29. Motion passed unanimously by roll call vote. F. OLD BUSINESS F-1 Architect Carmen Gintoli - Airport Design Development Carmen Gintoli spoke. His base bid for the project is $1,956,899, added alternate #1 is $71,040, for a total of $2,027,939. His consultant suggested they eliminate from the top down on the list. They would recommend this plan if the City has other funds avail- able. Councilman Wise asked, what if needed for funding? Mr. Gintoli replied, with the added alternate, about $300,000. Councilman Wise asked, is $90,000 contingency adequate? Mr. Gintoli replied, he would like to see more, it is 5% now. It should be higher on renovation than on new construction. MOTIONS Councilman Wagoner moved, seconded by Councilwoman Glick, to accept Carmen Gintoli's price estimate less items #2, #3, #4, & #7s leaving #1, #5, #6 & #8. Wayne Stephens, Wien Air Alaska, spoke. He asked if the fuel facilities would have to moved. Mr. Gintoli re -lied yes. "Ile Staahiiex-s (Arctic Aviation) will agree as long as it is not during fish season. F ff KENAI CITY COUNCIL DEC. 16, 1981 Page 6 Mr. Stephens asked, would the transient parking for fi aircraft have to be moved? Mr. Gintoli replied yes, -= it could be at the old City employee's parking lot. Richard Kochanuski, Gate 54, spoke. He asked if there was a plan dealing with the sewer system. Mr. Gint:�:1 replied he was unaware of the problem. Mr. Kochanuski noted the damage to the bathrooms comes during the day also, and is not always from bar patrons. He asked if the heating system has been considered. Mr. Gintoli replied there would be a smaller, more efficient boiler, forced hot water & forced air, Mr. Kochanuski asked, what is the design of the bathrooms. Mr. Gintoli replied ceramic tile. s Mayor O'Reilly asked, what is the cost for a temporary facility? Mr. Gintoli replied, $14,500; it does not show in the report. Jack Nelson, Wien Air Alaska, spoke. He said a security area must be available for the time the jet is on the ground, it is not on the specs. They will have to pull their service out till the work is completed unless screening and security is secure. They would be fined for each violation. He added, if the airlines do any remodeling work, it will be credited on the lease till it is paid off. That is standard in the industry. Council asked Mr. Gintoli - to check into the space requirements. Dave Diamond, Southeentral Air, spoke. He asked if his flights would hold during security checks for Wien. Mr. Gintoli replied he understood they always did. Mr. Diamond asked, is there any way to secure the baggage? Mr. Gintoli replied behind the counter as it is now. Jack Nelson suggested decisions on the items be made when the bid is made. Airport Manager Swalley spoke. They have an imaginary line for security, but when Wien is deplaning they have a person at the door watching people loading. He added the baggage handling process was not discussed. Also, the sewer line problem should be handled. Doug Haynes, Alaska Aeronautical, spoke. They will need a security area for money and supplies. Councilman Measles asked, what is the cost difference between renovation and new construction? Mr. Gintoli replied, renovation is $40 per sq. ft., new construction is $150 per sq. ft., 8600 total sq. ft. MOTION, Withdrawals Councilman Wagoner, with consent of second, withdrew his motion. MOTIONS Councilman Wagoner moved, seconded by Councilwoman Glick, to accept Mr. Gintoli's proposal as laid out at $1,389.899 level and add $71,040 for #1 added alt- ernate as already listed in the design (closing off the area). In addition, provide as added alternate, #8,#1,#6,#5,#7,#2,#4 & #3 in that order. W KENAI CITY COUNCIL DEC. 16, 1981 Page 7 Councilman Wise said he would prefer we approve the project as proposed and ask for additional funding from Legislature and,rather than wait for funding, provide from General Fund with the idea when the money was approved we could refund. If it is not obtained, we could loan to the Airport Fund. Finance Director Brown said the airport has funds to cover. Councilman Wagoner said the cost of the project is immaterial till Ste come in with bids. We are talking about $2 Million cap. We are also talking about a Senior Center, Gym, Library, Small Boat Harbor, that is a lot of capital projects. If we start going over on every project, we are in trouble. MOTION, Clarified: Councilman Wagoner, with consent of second, clarified his original motion. The base bid will include $1,389,899 plus #2 (covered walkway), plus added alternate $71,040, for a total of $1,550,939. In addition, added alternates will be as follows: #1 - Observation area #2 - Toilets (item #8) #3 - Renovation for future development (item #5) #4 - Ticketing lobby (item #6) #5 - Increasing ticket lculy 10 ft. (item #7) #6 - Airlines paying for renovation (item #4) #7 - Change conveyor belt from T to race track (item #3) Councilman Measles said we should take a look at the scope of the whole project. Maybe we should look at a totally new terminal, and use the present one for a freight terminal. Also, if we have a sewer problem, with the cost we are thinking,there is a problem with that. Also, we will end up with 2 buildings instead of one. Motion passed, with Mayor O`Reilly, Councilmen Measles, Wagoner, Councilwoman Glick voting yes; Councilmen Wise, Malston voting no. Mr. Gintoli said he would have the revised drawings for the Jan. 6, 1982 meeting, and will be out to bid in February. G. NEW BUSINESS G-1 Bills to be Paid, Bills to be Ratified MOTIONt Councilman Malston moved, seconded by Councilwoman Glick, to approve the bills as submitted. Motion passed by unanimous consent. G-4 Ordinance 742-81 - Increasing Rev/Appns - Purchase Crash Fire Rescue Vehicle - $249,003 MOTIONS Councilwoman Glick moved, seconded by Councilman Malston, to introduce the ordinance. Councilman Wise asked for an explanation of the 1st WHEREAS. City Manager Brighton explained, the Fire Dept. is asking that Council accept the fire truck that is not the lowest bid. The FAA will only pay for the lowest bid, the Fire Dept. is asking for the additional difference. Councilman Wise asked if the specs were approved by the FAA. Fire Chief Winston replied yes, they have no objection to accept- ing the bid, but will only pay on the lowest bid. He explained the main difference between bids is in pump operation and siphon deductor. Councilman Wagoner said Administration should start advertising the existing engine for sale at the time of receipt of the new engine. Motion passed by unanimous consent. G-5 Ordinance 743-81 - Repealing KMC to Make City Ordinances Consistent with Withdrawal of City from Social Secu ity System MOTION: Councilman Measles moved, seconded by Councilman Wise, to introduce the ordinance. Councilman Wise noted this will be up for hearing on the Special Meeting of Dec. 17, 1981 with the other Social Security ordinances. It coincides with withdrawal. Motion passed unanimously by roll call vote. G-6 Ordinance 744-81 - Increasing Rev/Appns - Library Materials and Supplies - U.S. Govt. - $1,000 MOTIONS Councilwoman Glick moved, seconded by Councilman Measles, to introduce the ordinance. Motion passed by unanimous consent. G-7 Ordinance 745-81 - Increasing Rev/Appns - Recreation Dept. Salaries & Benefits - $17,789 MOTIONS Councilman Malston moved, seconded by Councilman Measles, to introduce the ordinance. Recreation Director McGillivray replied, when they submitted the budget they anticipated the hours for the racquetball court and the Teen center. The original request was cut. Due to demand, they are now open longer hours. Councilwoman Glick s?;d Council was concerned during budget sessions about hiring permanent employees, are they still part time? Mr. McGillivray replied yes. Councilwoman Glick said we are setting a precedent by justifying increases by income. Police and Fire Depts. could do the same. Mr. McGillivray explained this was not used as justification, this was just to show income, they did not have an estimated revenue in our budget. Finance Director Brown explained 1 next year it will be in the budget. Also it will not come from Fund Balance, the money is there now. Motion passed unanimously by roll call vote. G-8 Ordinance 746-81 - City Wide Water & Sewer System Improvement Study MOTION: Councilman Malston moved, seconded by Councilwoman Glick, to introduce the ordinance. Councilman Wagoner suggested this be with the other 2 Request for Proposals we have already sent out as they are similar in nature. MOTION, To Tables Councilman Wise moved to table this ordinance till the hearing on Capital Improvement Projects is held. Motion died for lack of a second. Councilman Wagoner said he doesn't understand why the City has to hire an engineer to do the study. All it would take is a draftsman to do the study. Councilwoman Glick said this was part of the P&Z Capital Improvements recommendations. It was decided that the best approach was to do a study. The study is not appropriate capital improvement funds. Council- man Wise said we scheduled the Capital Improvement hearing for Sat. (12-19-81). If we are going to nickle and dime on the projects, why do we work on a priority list? Motion passed with Councilman Wise voting no. G-9 Architect Carmen Gintoli - Airport Terminal Renovation - $34,245 MOTIONs Councilman Measles moved, seconded by Councilwoman Glick, to approve the billing. Motion passed unanimously by roll call vote. G-10 Kenai Peninsula Community Care Center - $17,755.96 MOTION: Councilwoman Glick moved, seconded by Councilman Wagoner, to approve the billing. Motion passed unanimously by roll call vote. G-12 Small Equipment Warehouse - Pay Est. #4, Final Payment - Superstructures - $19,861 MOTIONS Councilwoman Glick moved, seconded by Councilman Measles, to approve the billing. Motion passed unanimously by roll call vote. DISCUSSION, Bills to be Paid: j Councilman Wagoner noted at the Dec. ?, 1981 meeting, Council discussed combining the bills on a list and putting back-up in the packet. i Council agreed to handle the bills that way in the furore. G-13 Assignment of Lease - Steinbeck to D&A Supermarkets MOTIONS a Councilwoman Glick moved, seconded by Councilman Measles, to approve the assignment. Councilwoman slick noted this was discussed at P&Z and they recommended approval. Motion passed unanimously by roll call vote. G-14 Tracts B&C, Agreement Between Bob Roper and City of Kenai City Manager Brighton said Atty. Delahay and he met with Bob Roper, and this is the agreeement they worked out. Council had directed it go to Harbor Commission for consideration and recommend- ations. Harbor Commission met Dec. 15, 1981, but did not have a quorum, so no action was taken. Atty. Delahay noted the agreement has a Dec. 21, 1981 cut- off date. Councilman Wise said he will abstain from any action with Bob Roper, as he had actions with him in the past. He added he objected to the agreement as it is committing funds without an appropriating ordinance. Without funds approved and public hearing held, we are in violation of State law. Finance Director Brovm noted we have appropriate funds for this. MOTIONS Councilman Wagoner moved that Council accept the agreement as presented between Mr. Roper and the City of Kenai. E; KENAI CITY COUNCIL DEC. 16, 1981 Page 11 Motion failed for lack of a second. j Atty. Delahay said the offer gives a termination j date of Jan. 21, 1982, but if Administration explains to Mr. Roper what has happened, he is sure Mr. Roper I will listen to another offer. j Council agreed to have Administration refer the matter to Mr. Roper, explain the delay and refer to the Harbor Commission. G-15 Delinquent Leases - Airport Lands & Terminal - Discussion City Manager Brighton explained all they have done is send letters. They have only filed suit on a few. Atty. Delahay reviewed Serendipity, T&D Realty, Ed Ambarian lease, Brown & Henry lease. Councilman Wagoner noted one of the lessees in the terminal building cannot pay their bills and are part of the design in the new building. The cost will be in- creased and they cannot pay their existing rates. Atty. Delahay replied they have been habitually delinquent. MOTION: Councilman Wise moved, seconded by Councilwoman Glick, to authorize suit against all delinquent parties listed. MOTION, Amendment: Councilman Wise moved, seconded by Councilman Wagoner, to specifically identify AAI (in reference to landing fees and operating expenses), and direct suit be started. G-17 Capital Improvement Priority List - Discussion Councilman Wise asked that more definitive information on the scope, tax maps and assessment roles be avail- able at the 12-19-81 meeting. Public Works Director Kornelis said they passed out a list at a meeting some time ago. Councilwoman Glick noted the list from P&Z is as they prioritized them. Mayor O'Reilly referred to the memo from him regarding the exhibition center, FAA/Daubenspek property and Section 36. There are 2 Borough ordinance the City should be aware of, one exempts certain community service organizations from sales tax, and one exempting senior citizens from sales tax. These will have an impact on the City. Councilman Wise suggested Administration formally ask for the economic impact on the City. Council agreed to the suggestion. 2. The City has been granted $1 Million for the Senior Center. He and Atty. Delahay had a meeting with FAA and discussed acquiring the land. They will be having meetings to discuss that and other items. Would the Council be willing to accept proposals regarding the structure before the meeting is completed? He has one proposal already. Councilwoman Glick asked if the proposal was reviewed by the Senior Citizen committee or anyone. Mr. Brighton replied no, once it is done it is public knowledge and he will be at a disadvantage with other bidders. Councilman Wise asked if Administration has pre- pared metes & bounds for the area. Public Works Director Kornelis replied he did not know. City Manager Brighton said he would check on the acreage involved. There was a change of zoning that City Manager Brighton sent a letter on. The zoning petition failed. 2. There was a gravel pit application, there will be a public hearing, 3. The Capital Improvement Projects list was discussed. 4. There was a memo regarding City support of utilities in right-of-ways. There will be a joint meeting with the Borough and utility people, etc. to settle this. 5. A lease assignment was approved. Councilwoman Glick asked if the gravel pit at Vekhelia Rd. is in compliance; City Manager Brighton replied it appears their attitude will be to ignore the situation. A penalty cart be assessed at $100 per violation per day after notification. Atty. Delahay said we can bring an injunction to force him to comply, he will check into it. Councilwoman Glick said if Borough Resolution 81-31 authorizing CZM funds passes, there will be funds available for cities to get assistance similar to last year. There was a question as to whether the Borough would be involved with CZM. The Federal Government is out of CZM but the State is still in. H-7 Harbor Commission None I. It looks very nice and I'm sure the separated belt system in that is something that makes it better for large groups coming off the aircraft. Our biggest concern is the time while you're building the terminal. We're very concerned how that's written into the specs to the general contractor that he realizes that business has to be carried on there during the construction and due to the fact we have security where the other airline people out there don't. When that jet's on the ground, if we don't have a free flow through there, and security gates and someplace to hold the people, the time the jet's on the ground will run too long and we will be up against meeting a schedule when we go on to Kodiak or someplace else. It's not shown here tonight how we're going to do that. Our station manager down here explained to us in Anchorage how he thought it was going to be done, using a trailer and then just screening one person at a time as they walk down a corridor to go to the jet. If that's so, and you have 20 or 30 people, we won't be able to wait that long. Someplace they have to be screened and held, in the summer months, if it gets into summer construction. We're very concerned that when you put the specs out to the general contractor that he realizes that that's the situation. Normally, on remodeling projects of this size you do half at a time and move the airlines people into the other half and you've got those areas. But without a holding area and without a screening area, it's a problem for a jet operation with the number of people we've got on the jet. We fall into a different category. The only way we could do it if it's not available, we would have to pull that type of service out until it was completed and depend on Doug - AAI - or someone else because they're not under that situation. But if the screening of people and the holding area isn't taken into effect and we can't get the FAA to go al ong with it, we're penalized $1,000.00 for every incident and there could be four (4) incidents they could find on one thing if they're passing each other in the hall or someplace that's not secure. That's the big thing we're concerned about. The finished terminal looks fine. One thing you - brought up that the airlines you were going to delete #4 and let the airlines finish their own area. For a savings, that's not uncommon. But when the airlines do that with the Port district or the State or anybody else, they're credited back 10% a month against the money that's spent, against their leases. That's how - we can go in and do the work. I am owner of (inaudible) Gate 54 and Concorde Restaurant. And, one of things I'd like to know is, what's in the plan - or in the proposal - you submitted that deals with the present sewer system? Is there any money there to upgrade it? The sewer system in that whole terminal, to my estimation, is not adequate for the existing facilities, never mind expanding it. It always has been in bad shape, and about two weeks ago I had a call on a Saturday night, water was backing up through the floor drains in the bathrooms in the ladies (inaudible). There was a flood down by the street somewhere. But it happens quite frequently. Ever wince I bought the place from Gary Eitel it was always said that it was the grease from the kitchen or something. But the sewer system in that old building is not very good. Carmen Gintoli - May I ask you a question? Have you expressed this concern to Jim Swalley, the airport manager? I have never been made aware of it. Rich Kochanuski - When I tore that place apart last summer - there's another question I wanted to ask. You ,just mentioned about the design of that place. I've mentioned (inaudible) on that one sheer wall, (inaudible) you move that one wall that used to be partitioned at lounge (inaudible) that wall - the construction of the building is not as the prints say - that wall over there is supposed to be a sheer wall connected to the roof and the corrugated roof that goes above the place - the top header on that wall was just nailed through. It wasn't secured. It was 8-penny nails driven through the corrugated (inaudible) and bent over. Carmen Gintoli - that might be (inaudible) we are aware that (inaudible) if you look at (inaudible) Rich Kochanuski - These walls that are along here. I know the damage that has been done there. A lot of the damage that's caused in that building - I understand you people think it all comes at night. But it doesn't all come at night. It comes in the daytime, although it's not quite 50-50. 1 would say 40-60 is something of an honest estimation. Carmen Gintoli - that also happens to be a sheer wall. That`s designed to uniform building code. Rich Kochanuski - I agree with that Carmen Gintoli - there's no code restriction that says you have to do anything, but 5/8" sheet rock. Rich Kochanuski - yes, but when you have an area like this that has a lot of access through it, you're talking about - how many people come through this area in the course of a year? Somebody bumps into that and knocks the wall with dollys or moving freight in and out of that place. Carmen Gintoli - there's to be no freight through there. That's one of the reasons we're doubling the width of the corridor is to allow freer access between the two ends of the terminal building by the traveling public. But there'll be no freight in the terminal building. Rich Kochanuski - well, just somebody (inaudible) I also wondering what kind of a heating system you will install in this whole complex. Carmen Gintoli - what we're going to do is, we plan to replace the existing boiler with a smaller, more efficient one, cut back some of the --- to answer your question we're going to have a combination of both - hydrophonic and forced (inaudible). The system that operates your restaurant (inaudible) Rich Kochanuski - the restaurant is still on the existing heat in that building which is not adequate. I get complaints from the gentlemen that are running it now, that's there's not enough heat in there. That's one of the things I wanted to ask Council if they could find some way to get in a couple of temporary little heaters in there. The heating system and the ventilating system in that whole building is definitely way behind the times. when I remodeled this thing I didnif want to come and spend slot of time and ask the Council to approve all that. I wanted to (inaudible) air conditioner and heater up there that services only the lounge, that doesn't service the restaurant at all. I hope that in your plans that the heat and ventilation in this restaurant is taken into consideration. The cost of $10,000 (inaudible). Another question I wanted brought up is the design of the restrooms. Exactly what type of design are you using for your fixtures as for making them - I know what you said about the walls. Rich Kochanuski all the way up or (inaudible) Carmen Gintoli - we're going to use a wainscote on the (inaudible) Rich Kochanuski - all the towels and stuff like that - a lot of people tear those towel fixtures off of there. (inaudible) take the towel fixtures, don't put them there. Put those Little air things them.. They're terrible and all that, but nobody takes the towels and throws them away. Use the criteria to build as many things as you can recessed into the wall so people; don't have a tendency - especially what happens in the summer time. We have all these people coming here from outside. They don't care about that. They come in and out of that airport. That's how they get here. They don't get here down the road. They come through that airport. they're coming in here to make big money, working on fishing boats and that airport gets abuse when they come in and when they leave. So if we can design it so theycan't abuse it the maintenance costs and everything else will be reduced. You ought to think about that, maintenance first instead of just making it look good. one thing I wanted to also find out, the acs:Pas that you're going to put in here for the temporary construction, the (inaudible) is going pass up this way and go out this way? Carmen Gintoli - that's correct. What we're trying to do is, one of the last things (inaudible) we intend to have a partition that jgoes through this: here like so, the existing corridors (inaudible) that location so we'll penetrate it here and have access here to the toilets, etc. and we'll go out (inaudible) Rich Kochanuski - the people will have to come this way and go out?
