PLEDGE OF ALLEGIANCE
A. ROLL CALL
Present: Charles Bailie, Ronald Malston, Vincent O'Reilly, Michael ROAmnn and
Phillip Aber.
Absent_ Edward Ambarian and Betty Glick
Pursuant to Section 2-6 of the Kenai Charter, the following motion was made,
MOTION:
Councilman Bailio moved, seconded by Councilman Reaman , that the Kenai City
Council hereby ascertains that an emergency does exist and such meeting is
justified for the purpose of discussions with specific City Manager applicants,
Motion passed unanimously by roil call veto. ;
City Attorney Sehleroth advised that he had discussions with the three applicants
present and informed them of the City's present legal status wherein the Court had
Issued a temporary restraining order to prevent further meetings with City Manager
applicants that are held in private, Mr. Sehleroth advised Council that the three applicants '
wore in agreement to discuss the position with Council at this time.
Councilman Aber inquired if matters of personnel records and applications wore not
of a confidential nature? City Attorney Sehlereth responded that personnel records
are confidential, however, it would depend upon how in-depth the interviews would be
for determination of the confidentiality situation. R
Councilman Malston suggested that Mayor O'Reilly gg Y Y appoint a committee from Council
to interview the three applicants present and report back to Council,

MOTION - ADJOURNMENT it
Councilman Malston moved, seconded by Councilman Aber, that the special meeting
of the Kenai City Council be hereby adjourned.
City Attorney Sehlereth advised that appointing a committee at this time would not
be following the outlines of the restraining order,
Councilman Malston stated he would withdraw him request for appointment of a committee
-- and would recommend that Council request that the applicants depart without being
- interviewed at this time and no further interviews be held until such time that the

Councilman Bailin stated that he would wish to continuo with the interviews as
taxpayer's monies have bean expanded to bring the applicants to the City of Kenai
and the applicants have, in addition, stated that they would not be adverse to being
Interviewed in a public meeting,
QUESTION - ADJOURNMENT
Failed by roil call vote. Voting no: Railio, O'Reilly and Reaman. Voting yes: Malston
and Aber.
MOTION - RECONSIDERATION
Councilman Seaman moved, seconded by Council Aber, for immediate reconsideration
of the motion to adjourn.
Councilman Seaman stated that he had voted no because he wanted to see the issue settled
but would not want to continue with open interviews of the applicants,
QUESTION:
Motion for reconsideration passed by roll call vote. Voting yes: Malston, Seaman and
Aber. Voting no: O'Reilly and Bailie,

Sallie and O'Reilly.
