Walt Steige - Dog control 2. 14I3UTES OF KENAI CITY COUNCIL MEETIAG JAAUARY 6, 1971 ROLL CALL Members present - Charles A.Bailic, Robert Bielefeld, James Doyle, Hugh Malone, Florine McCollum, and Mayor Eugene H. Morin. Members absent - James Hornaday, Judi Browning and Nancy Powers. With consent of Council, Clarence Ladd will be heard under B-2, and add Ordinance 192-71 under G-4. With consent of Council there will be an executive session immediately following this meeting. Junior Councilman Powers came in at this time. A - 1 Public Hearing on Ordinance 191-71, Amending Traffic Code. E� Acting City Manager Raymond Burt recommended Section 4 of the Ordinance (declaring an emergency) be deleted, that the Ordinance be accepted for first reading tonight but not heard for second reading until the citizens of the community are well informed. Bailie Moved and Bielefeld seconded to table the—To—mathe-To—mal public hearing at this time until further publicized but to open it to the public for informal discussion. The motion passed with Malone dissenting. Councilman Hornaday came in at this time. The public was invited to participate in an informal discussion. Sam Best, Vice President of the Kenai Peninsula Snow Machine Club, stated hey was not opposed to laws regulating the use of snow machines as long as they were not too astringept and there are provisions for races. Mike Multanen spoke stating he can ride his snow machine to town without it getting impounded. Mary Meeks of the Cheechako Snow Machine Club stated the Kenai - Homer race of January 16th and 17th is a National sanctioned race. They are using all safety precautions. The drivers, officals and spectators are insured. The informal discussion was closed to the public. After some discussion Malone moved and McCollum seconded to introduce Ordinance 191-71 for first reading, deleting Section 4 (declaring an emergency) and having the Ordinance widely publicized before second reading. Voting yes; Bailie, Doyle, Hornaday, Malone, McCollum, Mayor Morin and Powers. Page two A letter was read from Chief Heffner regarding the Multanen vehicle impound. Mr. Multanen was asked several questions regarding safety precautions, such as; were the parking lights on and was the police informed the car was out of commission. The answers were negative. The Council sympathizes with him but under the circu stances will up -hold the police=actions. Mr. Multanen further asked why the impounding company was $15.00 higher than any other towing service. lie was told it could be because he has a permit and is insured. The City administration to look into this. B - 2 Clarence Ladd regarding road problems. Clarence Ladd asked why Riverview Drive can't be opened up. If his house were to catch on fire a fire engine couldn't make it to his house. The administration was instructed to find out if this is a recognized street or if it had been vacated, to get a surveyor or -whatever was needed to correct this situation and so inform Mr. Ladd. There will be a progress report on this in two weeks. C MINUTES The minutes of the Special Meeting of December 9, 1970 were corrected to read; James Doyle, present. The minutes of Regular Meeting of December 16, 1970 were approved as read. D Correspondence Correspondence covered in reports. E - 1 City Manager's report Acting City Manager, Raymond Burt reported two power outages in the last two days. The first outage was caused by a fire at C.U.L. H.E.A. was allowed to tie in the Woodland Drive area. The City did not enter into this. The second outage was caused when the bus bars fused within the greenhouse. Malone suggested the City should investigate other major users, especially those who have been here for a number of years. i MINUTES OF KENAI CITY COUNCIL MEETING, JA4UARY 6, 1971 City Manager's report continued. E - 2 Page three Burt also reported he has received a proposal to operate the garbage dump. He further stated the City has received permits from P.U.C. for the electric, water, sewer and gas utilities. Mr. Glotfelty was in and met most of the City empolyees December 30, 1970. The City also held a meeting on the heAlth insurance program. Mr. Burt presented an application for games of chance license for the Beta Sigma Phi Sorority. Bailie moved and Malone seconded to approve the application. The motion passed unanimously. City Attorney's report Fisher stated we should take some action in the City on Ordinance 191-71 to make them comprehensive with State Statutes and get the benefits of the fines. He further stated the drunk driving and reckless driving statutes needs to be revised. There are too many repeats in spite of fines and restrictions of driving. He feels the penalty should include jail time, perhaps using the work release system. The City Attorney feels that Ordinance 1190 passed in 1967, Electrical construction standards, is difficult to administer and needs revision. Mayor's report The Mayor received a complimentary letter from Mr. Henry Harmon of Health, Education and Welfare. He wrote of the outstanding report received. It is by far the best and most complete and will serve as a model for other communities throughout Alaska. The Mayor; requested the administration to prepare a letter to George Miller, President of A.A.R.P. saying the success of the report was not through the effort of Mayor or Council but rather from the efforts of George Miller and the A.A. R.P. Mayor Morin further expressed his desire that the future Mayor and Councilmen continue to give moral support and perhaps minimal monies to this organization and to get copies of their reports. Mr. Halcro asked the Mayor to serve on the Walk for Hope committee. MINUTES OF KEAAI CITY COUYCIL MEETING, JAN UARY 6, 1971 Page four i E - 4 City Clerk's report The Acting City Clerk reported on petitions filed for Mayor and Councilmen. Petitions returned and checked for Mayor: Jim Bookey, Petitions out: George Ackerson and Oscar Thomas. Petitions returned and checked for Councilmen: Lester Borgen. Kenneth Stock picked up two petitions but has not declared r candidacy. E - 5 Finance Director's report Mr. Burt reported the news media has been notified that January 12, 1971 is the deadline for filing petitions for Mayor and Councilmen. r� The City has received the petitions for reapportionment, and they are being checked. They do not have to be property owners to sign the petition. Mr. Burt read a letter from E.D.D. showing their apprW attow: of the City's interest in participating in the matching grant program. The delinquency filing on Associated Divers is moving ahead. The bank promised to pay money on CIIAP. The City has nearly exhausted methods to get money from North Air Inc. but has not given up. The IRS is going to have a sale and will have first rights. The City is among the unsecured ` cri di tors. F d Mr. Burt would like to have a meeting with Council January 14 ` or 15 on the proposed budget amendment. The Council agreed on k January 15, 1971 at 8:00 P. M. in the City Manager's office. The City received a check today for $85,000 from titre borough r< for tax revenue. We have now received 85% of the tax revenue. In January 1966 the Union -Marathon partnership agreed to sell r to the City certain quantities.of natural gas in return for an easement through the City. The partnership agreed to the price - of 264 mcf and graduating a cent mcf every four years for twenty years. However if the price to Anchorage Natural Gas is: less -- than this the City receives the same price paid by Anchorage Natural Gas, plus 1 cent. t i f MIAUrES OF KENAI CITY COUICIL MEETING, JAIUARY 6, 1971 Page five Finance Director's report continued. The City granted KUSCO a franchise to operate a natural gas distribution system within the City for 20 years. The City installed mains and distribution lines in CIIAP and extended an agreement with KUSCO to operate this system for 20 years. The franchise payment in 1968 was $3,200 and in 1969, $46686.61. The City has received a rebate..KUSCO's 1970 audit should be received a few days after February 16, 1971. E - 6 Advisory Planning & Zoning Commission's report No report. E - 7 Borough Assemblymen's report Hornaday reported the Assembly passed an Ordinance which would allow agenda changes with two thirds majority vote. The assembly agreed to ask for withdrawal of lands from the Borough near Homer for the sale of timber. The assembly heard from Ted .Smith, Director of the Dept'.,—' of Parks and Recreation selecting land at the end of the North Road where Swanson River crosses , for a public park. Mr. Westphal, President of Independent Businessmen asked the Borough for a 5% local purchase preference. The assembly voted against collecting taxes for extra curricular school activities. J The assembly approved a change order for the Homer High School They also approved a change order up to $000 on the Vocational Education building. The assembly passed a resolution restricting commercial fishing in Cook Inlet and Prince William Sound to resident fishermen only. Mr. Keener gave a report on the possible closing or 4-imiting the salmon fishery off Cape Sitkinak 'South of Kodiak Island. He stated these are fish returning to Cook Inlet. The assembly took a tour of the new Borough Building. r� MINUTES OF KENAI CITY COW CIL MEETING, JANUARY 6, 1971 Page six F - 1 Second reading of Ordinance 70-190 Providln for the repeal of Section 6-10, Kenalo e. Bailie moved and Malone seconded to adopt Ordinance 190-7 % Providing for the repeal of Section 6-10, Kenai, Code 1963. The motion passed. Voting yes; Bailie, Bielefeld, Doyle, Hornaday, Malone, McCollum, Powers, and Mayor Morin. F - 2 Betty Ames and Historical Society regarding Ft. Kenay The City has received letters from the Historical Society, American Legion and the Kennel Club protesting the losing of Ft. Kenay as a community meeting place. The Mayor read a letter from the Historical Society. They are not objecting to the move but list 5 provision. After much discussion Doyle moved and Bielefeld seconded to take the motion off the table, The motion back on the table was passed. Voting yes: Bailie, Bielefeld, Doyle, Hornaday, Malone, McCollum, Powers, and Mayor Morin. Betty Ames moves down stairs. Bielefeld moved and Doyle seconded that Ft. Kenay be available for public use until a reasonable length of time before the Ames move down stairs, the administration to bring up proposals spelling out responsibilities. The motion passed unanimously. F - 3 Janitorial Bid Award After hearing from several bidders from the floor, Bielefeld moved and Doyle seconded to accept the low bid of Mr. Neary for the janitorial contract for the Terminal building. The motion passed. Voting yes: Bailie, Bielefeld, Doyle, Hornaday, Malone, McCollum, Powers, and Mayor Morin. F - 4 Sno-Shoe Gun Club_ renardino progress of rifle range Red Jaynes reported the road going into the rifle range should be completed by the end of the week. He needs to contact someone from the Sno-Shoe Gun Club. The Council would also like to know if the Gun Club are going ahead with their plans. F - 5 After much discussion on whether certain employees with large accumulated leave shall be paid for such leave, the Council advised the administration to get a dollar figure and bring this back to Council. -_ - --wv. MINUTES Of KENAI CITY COUNCIL MEETING, JM UARY 6, 1971 Page seven G - 1 Lease of Alaska Aeronautical Industries in Terminal Building Hornaday moved and Doyle seconded that in the future the City require the first and last month estimated payment of rents and fee leases to be paid in advance. i Mc Collum moved and Bailie seconded to enter into a lease agreement with A.A.I. The motion passed unanimously. Bielefeld moved and Malone seconded to amend the motion stating the lease not to be completed until such time as the certificate is secured. The motion passed unanimously. G - 2 Life and Health Insurance coverage for Mayor and Council Bailie moved and McCollum seconded to obtain Life and Health Insurance coverage for the Mayor and Councilmen. The motion passed unanimously. G - 3 Assessment District - Beaver Valley transmission line Malone moved and Bielefeld seconded to accept the proposal by Adams, Corthell, Loe, Wince and Associates in the preparation of the water assessment roll. The motion passed unanimously. G - 4 Ordinance 192-71, Establishing_ a_ requirement_ t1tat Department Doyle moved and Hornaday seconded to introduce Ordinance 192-71, Establishing a requirement that Department Heads shall receive ratification of appointment by the City Council and striking Section 3, declaring an emergency. The motion passed. Voting yes, Bailie, Bielefeld, Doyle, Hornaday, Malone, McCollum, Powers, and Mayor Morin.. The administration to come up with who are department heads. H - 1 Walt Steige - dog control Walt Steige brought a picture of the trash the dogs dumped over this afternoon at his residence. He stated this occurs every Wednesday, pick up day, throughout Woodland Subdivision. The Council instructed the administration to run another week of the leash law. 14EETING AWOU94ED 1:20 A. M.
