Hugh Malone r MINUTES OF KENAI CITY COUNCIL MEETTNG, JUNE 16, 1971 ROLL CALL: Member present - Robert Bielefeld, Jame: Doyle, Hugh Malone, Tru McGrady, Robert Norene and Mayor John Steinbeck. Members absent - Junior Councilman Browning and Powers. Excused absence - James Hornaday. B: PERSONS PRESENT SCHEDULED TO BE HEARD C: MINUTES 1. The Minutes of Regular Meeting of June 2, 1971, �. were approved as read. 2. The Minutes of Public Hearing of June 9, 1971, were approved as read. D: CORRESPONDENCE D - 1 Letter H. A. Boucher, Lt. Governor - Development Program Lt. Governor Boucher wrote "Congratulations to Progressive Kenai". He was delighted to learn the results of our recent bond election, especially the wide majority by which each issue passed. D - 2 Letter Ted Stevens - Development Program Ted Stevens wrote he would be happy to assist at the federal level on the Capital Improvements Program. D - 3 Irene E. Ryan - Civic Center The Dept. of Economic Development is in the process of reviewing the Civic and Convention Center Bill and when completed will advise the City. E: REPORTS E - 1 City Manager's Report (a) Things to do list - 6/2/71 Item F - 1 Ordinance Amending Ordinance 167-69 - Street Naming & Numbering is in process. (b) Meeting with Financial Consultant Don Meyer. st 1. 1971. Mr. Meyer will be in Kenai, Tuesday and can meet with the Council, Tuesday night to difibuss the selling of a million dollars of G.O. Bonds. The City Manager met with the Financial Consultant and the Bond Consultant of the National Bank of Alaska. They assured him when the City of Kenai held a public bond sale, they would bid on the bonds. The City Manager has a meeting next week with the Chairman of the Board and the Financial Advisor for the Alaska State Bank in Anchorage. The amount Mr. Glotfelty recommends selling at this time is $1,000,000. 40,000 - development planning of the Civic Center 2000000 - Water & Sewer 450,000 - Public Safety Building 35,000 - Airports 35,000 - Parks 5,000 - Small Boat Harbor 235,000 - Street Improvements Hopefully the bond issue will go on sale on or z._ before 1 August 1971. The City Manager recommends the Mayor retain his Committee for Capital Improvements. He also recomm- mends three committees be formed primarily for the development of the Civic Center. The first, Library Committee, the second a Committee to deal with the Health Services of the Community and the third committee to deal with the swimming pool and Convention Center Complex. He recommends a committee for analyzing the water & sewer assessments and street assessments. A committee on the development of the Airport. Three committees should be formed for Parks & Recreation. One for development of Fort Kenay, one for Rifle Range and Recreation, and the Committee on Aging to develop the cemetary. A committee for Small Boa's Harbor improvements. After each committee has made the recommendations it would require action by Planning Commission and back to Council for final consideration and approval. (c) Request for 50 units of Native Housing, F.A.A. Housing Area, Joint development agreement with Kenaitze Group - Memo. After much discussion Malone moved and Norene seconded to have the City of Kenai enter into an agreement with the Kenaitze Indians to assist in a low income housing beneficial to all. The motion carried unanimously. (d) Bid advertisement - Sewer Treatment Plant. Bid advertisement for Sewer Treatment Plant will be June 25, 1971 and bid opening July 25, 1971. (e) Bid advertisement - Public Safety Building. Bid avertisement for the Public Safety Building will be July 15, 1971, and Bid opening August 15, 1971. (f) Bid advertisement - Kenai Urban Section (State) Bid advertisement - Kenai Urban Section (State ) will be June 22, 1971 and bid opening July 22, 1971. (g) Bid opening Small Boat Harbor (State) Bid opening - Small Boat Harbor (State) will be June 25, 1971. (h) Resolution Homer Electric Assoc. - Membership. The City Manager read the Homer Electric Association's Resolution on membership. (I) Letter - Rates City to pay Homer Electric Assoc. for raw power. The City's rate schedule 13 is what H.E.A. proposes to charge the City for raw power. This is not agreeable to the City. The City will submit a schedule to them. MINUTES OF KENAI CITY COUNCIL MEETING, JUNE 16, 1971 Page four E - 1 - City Manager's Report - continued. 0) Alaska Barite Company There is a legal suit in process against the City by Alaska Barite Company. They feel the dock should be repaired by the City of Kenai. (k) Meeting with members of Industr 2 On June 14, 1971, the City of Kenai met with members of industrial water consumers of North Kenai. They were apprehensive about giving up the ground water rights. The Council feels the need for legislature in the near future to stop the depletion of ground water. They will co-operate in helping the City get a 80% grant. ' E - 2 City Attorne 's Report f Mr. Fisher recommends a motion for adoption of the revised section of Ordinance 197-71, feeling this is the best way to implement the sales tax. In Ordinance 199-71 it is necessary to have a date for the election. An Ordinance amending Ordinance 167-69 is now in draft form. The Street Naming & Numbering System is now complete and should be accepted by Council. E - 3 Ma or's Re ort ` No report 1 =� E - 4 City Clerk's Report No report F E - 5 Finance Director's Report ' Mr. Burt met with Borough representatives regarding sales tax implementation. They reviewed the forms they will use. A tax schedule (chart) and letter will be sent to all businessmen in the City. E - 6 Planning & Zoning Commission's Report Mr. Fisher felt Ron Miller's request further down on the agenda would up -grade the town. F__ MINUTES OF KENAI CITY COUNCIL MEETING, JUNE 16, 1971 Page five E - 7 Borough Assemblymen's Report Hugh Malone reported on the Assembly Meeting on the Assembly Meeting of June 15, 1971. Bill Johnson of Mackey Lake Road presented a petition to the Assembly for the up -grading and accepting of Mackey Lake Road. There were over eighty persons present scheduled to be heard concerning the Borough Zoning Ordinance. There were 79 who were violently opposed to it. The Assembly tabled the Ordinance for a year. The Assembly passed a Resolution approving funds for the total budget for 1971-72. The Assembly is going along with the State salary Increase of 13%. Harold Keiser showed films on garbage disposal in the Borough in areas where there were no sanitary dumps. The Borough is holding a public sale on foreclosed property July 23, 1971. The Assembly accepted a change order on the Central Peninsula Hospital for $12,000 and a change order on the Seldovia School The question was asked. Who has the power of Planning and Zoning? The State says the power belongs to the borough. The Borough, however does not have a Zoning Ordinance to enforce and the City of Kenai has. After much discussion on zoning powers, Norene moved and Malone seconded to instruct the City Manager to contact other home rule cities within the Kenai Peninsula Borough with the concept of a joint law suit to determine the right of power of Planning & Zoning by said home rule cities. The motion carried unanimously. MINUTES OF KENAI CITY COUNCIL MEETING, JUNE 16, 1971 Page six Borough Assemblymen's report continued The Borough is being funded $300,000 for access roads and they have no area wide road powers. Doyle moved and Norene seconded to direct the City Manager to find out if part of the State funds for local access roads allotted to the Borough can come back to the City. The motion carried unanimously. F: OLD BUSINESS F - 1 Resolution 71-28 - Adopting Budget - Setting Mill Rate Bielefeld moved and McGrady seconded for the adoption of Resolution 71-28 - Adopting the Budget for the Fiscal year of July 1, 1971 through June 30, 1972 and Setting the Tax Levy. The motion carried unanimously by roll call vote. F - 2 Resolution 71-24 - Setting Date for Special Election, August 3, 1971 - Sale and Permit to HEA. Doyle moved and Malone seconded to adopt Resolution 71-24 - Setting date for Special Election, August 3, 1971 - Sale and Permit to HEA. The motion carried unanimously. F - 3 Ordinance 197-71 - Sales Tax effective date July 1, 1971. tom, The Mayor called for a recess and called the meeting back to order for a public hearing on Ordinance 197-71 - Sales Tax effective date July 1, 1971. There was no public participation so the public hearing was closed. Bielefeld moved and Malone seconded to declare an emergency for Ordinance 197-71, as amended. The motion carried unanimously by roll call vote. Voting yes; Bielefeld, Doyle, Malone, McGrady, Norene and Steinbeck. Bielefeld moved and Doyle seconded for the adoption of Ordinance 197-71 - Sales Tax effective date July 1, 1971, as amended. The motion carried unanimously by roll call vote. MINUTES OF KENAI CITY COUNCIL MEETING, JUNE 16, 1.971 Page seven F - 4 Ordinance 198-71 - Omission in Vehicle Code Mayor Steinbeck called for a recess and called the meeting back to order for a public hearing on Ordinance 198-71, Omission in Vehicle Code. There was no public participation so the public hearing was closed. Norene moved and Malone seconded to adopt Ordinance 198-71 - Omission in Vehicle Code. The motion carried unanimously by roll call vote. Voting yes; Bielefeld, Doyle, Malone, McGrady, Norene and Mayor Steinbeck. ^, F - 5 Architect Agreement - Public Safety Building & Civic - Center with George Filer. There is a new concept in paying architects. They are guaranteed a certain amount whether bids go over or under the specific amount. If the bids go over or if there are change orders he is paid ` no more. McGrady moved and Doyle seconded to accept this concept. The motion carried unanimously by roll call vote. F - 6 Dedication of Land in Industrial _Air Park for local government use - Map. The administration would like Block 1 in the Fidalgo ►:�; SID be dedicated to local government, with lots 5, 6, 7, 8, 9, 10 & 11 set aside for the fire station, the other possible site for the Civic Center'. Bielefeld moved and Norene seconded to set aside Block 1 of Fidalgo SID for local government use with lots 5, 6, 7, 8, 9, 10 & 11 for the Fire Hall with the City paying 1�2t per sq. ft. per year. The motion carried unanimously by roll call vote. F - 7 Final Payment - Stanley S. McLane - House Numbering and Street Naming - Balance Due 51 .50. McGrady moved and Doyle seconded to pay the bill. The motion carried unanimously by roll call vote. MINUTES OF KENAI CITY COUNCIL MEETING, JUNE 16, 1971 Page eight G: NEW BUSINESS G - 1 Bid Award - Shopping Center Connector Street - Robinson Construction Company - 3-53.57. Doyle moved and Malone seconded to award the bid to Robinson Construction Company. The motion carried unanimously by roll call vote. The Mayor awarded the bid to Robinson Construction Company for $3,453.57. G - 2 Adopt collection procedures of HEA for all Kenai City L g t Customers - City MaRager. The City Manager recommended Council to wait until - after the election to adopt collection procedures It was the concensus of Council to do so. G - 3 Garbage Collection - Request - Mr. Ron Miller - Memo. The Council was given copies of the memorandum concerning garbage collection. Mr. Miller would like to have the Charter changed to make it mandatory that 30 gallon aluminum trash cans with air tight lids and a platform stand for these cans be required for the citizens of Kenai to dispose of their garbage. It was the concensus of the Council that our Ordinance pretty well covers the situation with the 70 lb limit when full. However, they feel the Ordinance should be more fully enforced. G - 4 Support City of Seward for Public Hearing on W lderness proposal - Request for hearing in Seward. The City Manager read Resolution No. 826 of the City of Seward asking for a public hearing on the Wilderness proposal. Malone moved and Doyle seconded to endorse the Resolution of the City of Seward for a public hearing in Seward and request the agencies to have a public hearing in Homer. The motion carried unanimously. G - 5 Lease - Lloyd McConnell - Airport Land Tabled until the next scheduled meeting. f MINUTES OF KENAI CITY COUNCIL MFFTING, JUNE 16, 1971 Page nine I G - 6 Ordinance 199-71 - Permit Sale of K.C.L. Bielefeld moved and Doyle seconded to introduce j Ordinance 199-71 - Providing for the submission to the qualified electors at a special election to be held therein on August 3, 1971 a proposition of whether the City should enter an agreement with H.E.A. The motion carried unanimously. G - 7 Request to borrow Ray Burt requested approval of Council to borrow the balance of $120,00, which is $50,000. Malone moved and Doyle seconded to give Mr. Burt 4 the authority to borrow $50,000. The motion carried unanimously by roll call vote. H: PERSONS PRESENT NOT SCHEDULED TO BE HEARD: CITIZEN'S GRIEVANCE ANDREQ STS. ' H - 1 Hugh Malone Hugh Malone, in regards to the letter to the Corps of Engineers, would like to register objections for things of this nature.
