MINUTES OF KENAI CITY COUNCIL REGULAR MEETING AUGUST 4, 1971 8:00 P.M. KENAI LIBRARY ROLL CALL: Members present - Robert Bielefeld, James Doyle, James orna ay, Hugh 1Nalone, Tru McGrady, Robert Norene, and Mayor John Steinbeck. Members absent - None A - I Canvass Ballots of Special Election of August 3, 1971. The City received 21 absentee ballots. The ballots were opened and counted. Voting yes - 16. Voting no - S. The official count of the election is as follows: Operating 6 Franchise Ord. Yes 227 Operating & Franchise Ord. No 77 Spoiled Ballots 0 Challenged ballots 0 Absentee ballots 21 Total Ballots Cast 304 The Mayor asked if there were any protests from the floor. There were none. Hornaday moved and Doyle seconded to certify the election results. The motion carried unanimously by roll call vote. Voting yes: Bielefeld, Doyle, Hornaday, Malone, McGrady, Norene, and Mayor Steinbeck. B: PERSONS PRESENT SCHEDULED TO BE HEARD B - 1 Mr. Halcro - Alaska Parking Co. Mr. Halcro wrote a letter to the City Manager outlining 6 recommendations they have covering the parking contract at the Kenai Airport. The City Manager did not receive:+ this letter until 7:00 P.M. this evening. Doyle moved and Malone seconded to table this until the next Council Meeting to be able to study the recommend- ations. The motion carried unanimously by roll call vote. C: MINUTES 1. Minutes of Regular Meeting of July 21, 1971 were approved as presented. 2. Minutes of Special Meeting of July 28, 1971 were approved as presented. D: CORRESPONDENCE D - 1 George W. Easley Commissioner - - - of Pubic Works continued Mr. Easley regrets the State will be unable to participate in Kenai's planned Airport Construction Project for this year. D - 2 Governor Egan - Soldotna Outfall Sewer Governor Egan does not seem it appropriate.to initiate a plea to the Corps of Engineers for a public hearing on the Soldotna Outfall Sewer under the circumstances. E: REPORTS E - 1 City Manager's Report (a) Things to do list - 7/21/71 In process _(b) I.B.M. Customers Executive School The City Manager and Ray Burt are invited to attend an I.B.M. Customers Executive School in San Jose, California August 23 through 27. Everything is paid except trans- portation. There were no objection from Council for their attending this school. (c) Procedure of transfer of K.C.L. to Homer Electric Assoc. Mr. Glotfelty will work with Mr. Rhodes to get committments and approval from P.U.C. and R.E.A. Don Meyer and the holders of K.C.L. Bonds are in approval of the concept of selling K.C.L. to H.E.A. The City will enter into an agreement with I.B.E.W. to p) have the men unionized before the transfer. The joint meter reading will take place by August 1S, 1971. N.B.A. will be a paying agent with H.E.A. A full crew will be stationed in Kenai. MEETING AUGUST 4, 1971 Page three E - 5 E - 6 l E - 7 04 i 3. 1 i 1 I 1 Finance Director's Report The audit is Red relatively smoothly. Should have it finished by the last Council Meeting in September. The I.B.M. System 3 computer should arrive between December 20 and 30, 1971. Plans are to be "on line" by January 1S, 1972. It will be ran parallel until March 1, 1972 and the old system abandoned. The schedule for the computer is: 1. Accounting system. 2. Project Control. 3. Personnel and Police Data. Planning f Zoning Commission's Report No report Borough Assemblymen's Report Hornaday reported on the Borough Assemblymen's Meeting of August 3, 1971. An Ordinance amending the election Ordinance was adopted then given notice for reconsideration. An Ordinance giving preference to local business failed. The notice of election for re -apportionment came up and was tabled until the next meeting, hoping to get an opinion from the Attorney General in Juneau. Ke("h Kelton and Sig Strandberg of Environmental Protection Agency want the Borough to take over the garbage powers. The Borough Chairman is to come up with a recommendation. A Resolution transferring land, 40 acres, to Community College with a public use restriction was passed. An equipment list for the Jr. High in Kenai was approved and one for Seldovia was approved. State Access Roads were brought up. There were two questions - 1 the legality and 2 - if legal should they accept responsibility. There will be a further study on this. �� MINUTES OF KENAI CITY COUNCIL, MEETING AUGUST 4, 1971 Pagge four Malone reported that while in Juneau he called Bill Prichard and asked why there was no information on the reapportionment. It was sent to the Attorney Generals Office March 1 of this year. Malone called the Attorney General's Office and spoke with Rick Bradley. He spoke of the State-wide problems on this and would take time to research and study this. Malone told him of the election coming up in October. Bradley was unaware of the election and said he would have an opinion out the next day. Malone went back the next day to see Bradley and Garnett. They concluded that under law each City has to be represented by 1 or more Assemblymen and will forward their opinion to Kenai. F: OLD BUSINESS F - 1 Ordinance 200-71 - Street Naming & Numbering. The map with the street names and numbers has been hanging in the Airport Terminal Building for two weeks. The City has received no objections or comments. The Mayor recessed the meeting and opened the meeting to the public for a public hearing. Hearing no public response the meeting was brought back to the table. Norene-moved and Malone seconded to adopt Ordinance 200-71- Street Naming $ Numbering. The motion carried unanimously by roll call vote. Voting yes; Bielefeld, Doyle, Hornaday, Malone, McGrady, Norene, and Mayor Steinbeck. Hornaday noted that with the adoption of this Ordinance there is a passing of an era. 2 Ordinance 202-71 - Prohibiting consum tion of alcoholic everages on sc oo prey ses. The Mayor recessed the meeting and opened the meeting for a public hearing. Hearing no public response the meeting was brought back to the table. Btelefeld stated this is unnecessary paperwork and is cluttering up our Ordinances as this is already a State law. Malone moved and Norene seconded to adopt Ordiance 202-71 - Prohibiting consumption of alcoholic beverages on school premises. The motion carried 6 to 1. Voting yes; Doyle, Hornaday, Malone, McGrady, Norene and Mayor Steinbeck. Voting no; Bielefeld. MINUTES OF KENAI CITY COUNCIL MEETING AUGUST 4, 1971 Page five F - 3 Kenaitze Indians request of approximately SO acres - Memorandum - city manager The City Manager read a letter from George Miller Jr. President of the Kenaitze Indian Tribe requesting the City of Kenai to make available approximately fifty acres of City land for a housing development for the Kenaitze Indians. The City Manager recommends that the NW 1/4, NW 1/4, Section 3 near the Junior High School be reserved for a period of one year for this Kenaitze Indian -Housing project and if progress is underway and the committments have been made by the Federal Government for the building of 100 units of native housing that the City of Kenai at that time would deed this ground to the Kenaitze Indian Tribe. Under this program the Kenaitze Indians or the Federal Government would be required to have this land surveyed and would also be required to construct the streets and utilities within any subdivision that was formed on this ground. All roads and utilities within this area would be part -of the overall development of s this area and at no cost to the City of Kenai. George Miller Jr. stated there will be 30 or more new families moved in and local people will be hired with preference first to the Kenaitze Indians. ' F - 4 i lie) F - S G: G - 1 Hornaday moved and Doyle seconded to accept the City Managers recommendation. The motion carried unanimously by roll call vote. Alaska Parkine - Letter Heard under Agenda Item B - 1. Soldotna Sewage Outfall Will be heard last on the Agenda. NEW BUSINESS Liquor license transfer - Nickolas J. $ Georeia L. Pounin The City Manager received a letter from James Doogan of the Alcoholic Beverage Control Board asking if the City has any objection to the transfer. MINUTES OF KENAI CITY COUNCIL. MEETING AUGUST 4, 1971 Page six G - 1 Liquor license transfer continued The Administration and the Police Department have no objections and the City Manager recommends approval of the transfer. Doyle moved and Bielefeld seconded to accept the City Manager's recommendation and approve the transfer of the liquor license. The motion carried by roll call vote with Hornaday abstaining. G - 2 Letter from Lowell Thorsness - Cunningham Memorial Park. Mr. Glotfelty received a letter from Lowell Thorsness with Totem Realty. Mrs. Martha Cunningham expresses a desire to donate Tract 4, a little over 2 acres, on the Kenai River to be used as a park and to be named "Cunningham Memorial Park". Malone moved and Hornaday seconded to accept Mrs. Cunningham's offer of approximately 2 acres on the Kenai River for park use. The name of the park to be Cunningham Memorial Park. The motion carried unanimously by roll call vote. G - 3 _Bid - Sewer $'later Highway cross over - Recommendations mnsraton. The Administration recommends the bids not be accepted or force account, as the bids are all over the estimated cost. b Malone felt the bids were too high and we should not accept any of the bids. Others felt that although there is time to re -bid the contract, the bids may not be any lower. Malone moved and Hornaday seconded to reject all bids and call for a re -bid. The motion failed 4 to 3 by roll call vote. Voting yes: Hornaday, Malone and Steinbeck. Voting no; Bielefeld, Doyle, McGrady, and Norene. Doyle moved and Bielefeld seconded to accept the low bid of Cook Inlet Construction Co. The motion carried 4 to 3 by roll call vote. Voting yes; Bielefeld, Doyle, McGrady, and Norene. Voting no; Hornaday, Malone and Mayor Steinbeck. G - 4 Proposed Joint Park - School Use Agreement with Kenai Hornaday asked consent for this item to be put on the Agenda for the next meeting. There were no objections and was so ordered. MINUTES OF KENAI CITY COUNCIL MEETING AUGUST 4, 1971 Page seven G - 5 Naming Sharon Sterling City Clerk from Acting City Clerk The City Manager recommends designation Mrs. Sharon Sterling as City Clerk to be effective September 15, 1971. Malone moved and Bielefeld seconded for the Council to appoint Sharon Sterling City Clerk of the City of Kenai to be effective September IS, 1971. The motion carried by roll call vote with Hornaday dissenting._: G-a 6 Naming Architect for Civic Center The City Manager recommends naming George Filler as architect for the Civic Center using the same concept as the Fire $ Police Station. Doyle moved and McGrady seconded to accept the City Managers recommendation of naming George Filler Architect for the Civic Center. The motion carried unanimously by roll call vote. Malone moved and Hornaday seconded for the City Manager to make the presentation of the architect contract for the Civic Center at the next meeting. Unanimous - consent was asked and granted. Bielefeld asked the Administration to present the plans and specifications of the Fire and Police Building at a public meeting for public review and comments. There were no objections and was so ordered. F - 5 Soldotna Sewage Outfall There was a public hearing Saturday at the Little Theatre at the Kenai Central High School. The City of Kenai showed up. Mr. Brewer and Mr. Anderegg listened to use and objected to us. Mayor Steinbeck reported on their trip to Juneau. They met with the Governor at 3:30 P.M. Tuesday August 3, 1971. They had one hours private conference with him and more time with him and the Commissioners. Kenai gave their presentation and the Commissioners presented theirs. Kenai asked for a public hearing. We are to get the answer today. It was pretty much a re -run of Saturday's hearing. MINUTES OF KENAI CITY COUNCIL MEETING AUGUST 4, 1971 Page eight t At the close of the meeting Mr. Glotfelty told Council that the City has received one dump truck and reminded Council of the meeting Friday, August 6, 1971, at 8:00 P.M. in North Kenai concerning the unification of Kenai and North Kenai.
