Bill Dobrinski of Peter Kiewit and Mike Fargo of the State Highway Dept., were on hand to answer questions on problems with the construction of the Urban Section. Please refer to attached manuscript. MINUTES OF KENAI CITY COUNCIL MEETING OF NOVEMBER 17, 1971 Page two C: MINUTES I 1. Minutes of Regular Meeting of November 3, 1971, were approved as distributed. D: CORRESPONDENCE D - 1 John R. Werner- Civic Convention and Community Recreation Centers 1 Mr. Werner informed the Council that the City's _ application for State aid for a feasibility study, for a Civic, Convention and Community Recreation Centers has been approved. D - 2 i Warren W. Willey - Manpower Administration Grant No. Mr. Wiley sent a fully executed copy of the City's agreement covering the Manpower Administration Grant No. EEA-02-2c0020, awarded under the provisions of Section Six of the Emergency Employment Act of 1971. D - 3 James E. Fisher - CUL vs City vs Chicago Pneumatic This correspondence was self-explanatory. E: REPORTS E - 1 City Manager's Report (a) Things to do list 1 i Assistant City Manager, Ray Burt, reported the Things E to do list as being complete or in the process of completion with the exception of arranging a meeting with the Kenaitze Indian Group. George Miller Jr. has been out of town a great deal of the time on Kenaitze Indian affairs and this meeting will be arranged in ' the near future. (b) Police Chief Johnson 1. Enforcement of loitering - High School and the Mall - Police Chief Johnson reported a continuing problem - of loitering at the Kenai Mall. Last Sunday, over $2,000 of damage was made to Kenai Chrysler Cars in the Mall. There is similar problems at the High School. There will be a more rigid enforcement of ' the Loitering Ordinance. Malone suggested publishing ' i E a notice to that effect in the newspaper. i M i - I }; l j� I P i f i = MINUTES OF KENAI CITY COUNCIL, MIIETING OF NOVEMBER 17, 1971 Page three E - 1 (b) - 2 Temporary re -shuffling of personnel Since the re -shuffling of personnel, to provide for a full time investigating section, 20 to 25 cases have been solved. (b) - 3 Snow machine report The Police Dept. have received many complaints and are enforcing the snow machine ordinance. E - 1 (c) Progress Report - Chr.is Adams Mr. Adams reported the race track closed down for the season. The cross country course will be laid out this week end. Two sanctioned races are scheduled for the '_. Peninsula in February 1972. There is a suitable track in Soldotna and the cross country will be held in Kenai. Dog sled races will be held on a 6 mile course, November 280 1971. The hockey rink is coming alone with minimal problems, all the plywood paneling is painted, the posts and lights are in, and in a weeks time, weather permitting, the rink should be completed. The Recreation crew is kept busy keeping the snow off the ice pond and improving the warm up shack. H.E.A. are installing the lights -today and tomorrow. Capt. Matzsa of Wildwood has donated some sports equipment to the Recreation Dept. The adult winter basketball season has started and has six teams. There are 30 people signed up for batan twirling in December. There was not enough people involved in the speed reading course, so it was tabled. Norene took exception of the City becoming involved in private enterprise such as the Evelyn Reed Course. Hornaday requested an outline of the Winger Recreation Program to be presented at the next Council meeting. - 1u t MINUTES OF KENAI CITY COUNCIL MEETING OF NOVEMBER 17, 1971 Page four E - 2 Petition - Nikiski Borough Mr. Burt reported there are 450 plus signatures on the petition. The signatures according to precinct are as follows: Kenai 01 107 Kenai N2 95 Kenai #3 66 Nikiski H1 46 Nikiski #2 122 Soldotna 1 Registered with City only 20 Total 457 City Attorney's Report Mr. Fisher's memo to Council concerning his attendance at Council Meeting was distributed to Council. The Council felt that an hour or so in attendance was all that is necessary. If a legal opinion was needed further down on the Agenda, they would seek it the next day. Fisher would like to know if Council would like him to start Decertification Action - C.U.L. to be consolidated with the rate hearing. Fisher stated the City has an adquate amount of regulations for snow machines. It is a matter of enforcement. He has written a memo that outlines the regulations and feels this should be published in the paper. Norene commented on snow machines on City streets in Highland Trailer Park. Bielefeld asked Administration to clarify the street situation in Highland Trailer Court. There has been so many complaints on snow machines running at all hours through subdivisions, it was suggested that snow machines be banned from certain areas of the City and set up reserves for them. The Administration was asked to study a ban on snow machines. Mayor's Report No report City Clerk's Report No report i MINUTES Oil KRNAI CITY COUNCIL miurrING Oil NOVEMBER 17, .I971 Page five B - 5 Finance Director's Report Mr. Burt introduced Ilan Whelan, the now Finance Director, who started work, 'Tuesday, November 16, 1971. Mr. Whelan is reading the City Ordinances and is familiarizing himself with the accounting system. He anticipates, early in the year, of having the monthly and year to date report to Council by the loth of the month following. Hornaday raised two questions for Mr. Whelan: 1. Hopefully at the next meeting, could he have recommendations on the preliminary report from auditors to satisfy points raised. 2. Within one month, have his written opinion on I.B.M. Systent 3- Computer Malone stated it would be helpful if Mr. Whelan submitted to the City Manager for Council his recommendation for re -organization of the Finance Dept. E - 6 Planning $ Zoning's Report No report E - 7 Borough Assemblymen's Report Malone reported on the Borough Assembly Meeting in Homer, at 3:00 P.M., November 16, 1971. New Assemblyman Robert Bielefeld was seated. There was a public hearing on an Ordinance relating to re -zoning within the City of Kenai, BLM lot 103, behind Larry's Club, to General Commercial. The Ordinance was passed. An Ordinance making a supplemental appropriation of $69,476, relating to the Emergency Employment Act was passed. An Ordinance relating to vote abstention by Assemblymen was tabled. The Assembly passed an Ordinance making a supplemental appropriation of $340,000 to the Capital Improvement Program. MHEIT1NG OF NOVEMBER 17, 1971 Page six L - 7 - Borough Assemblymen's Report - continued t An Ordinance was passed making a supplemental appropriation of $37,740 to the Capital Tmprovoment Program. A Petition for Abatement of Air Polution Source - Collier Chemical Plant was considered and discussed. The Assembly discussed the road across the Inlet in the vicinity of Dillingham. The State Highway asked for adoption of a Resolution as to the location. The Assembly felt the road should be further South. A Committee of two, Davis and Arness, wrote the Bristol Bay Borough and asked their feelings on a road route. They felt the Southerly route was better also. The Assembly is going to draw up a joint Resolution with Bristol Bay area regarding this road. ' A number of students came in and plased posters on the back wall, stating that if the Assembly didn't buy desks, the Assembly would get no dinner. The Assembly, however did approve this appropriation, which could have been channeled elsewhere. Bielefeld reported there will be a Public Hearing in Anchorage tomorrow on the Katmai Wilderness area. ` President Noah and Assemblyman Arness will attend. The Assemblymen enjoyed a swim in the new swimming pool. This has been an unbelievable attraction. The magistrate stated juvenile delinquency has taker, a sharp downward drop. I F: OLD BUSINESS f F - 1 Casino Bar - Liquor License Transfer Mr. Burt reported the Fire and Health inspection had been made. Malone withdrew his motion of reconsideration. Norene moved and Doyle seconded to remove the motion 1 y from the table. The motion carried unanimously. Bielefeld moved and Hornaday seconded the transfer be - -- allowed. The Administration recommends the purchase of all rights, interests, assets and other evidences of operation and ownership of the Alaska Parking Company at the Kenai Air Terminal for the stipulated price of $2,S00. McGrady moved and Norene seconded to approve the recommendation of the Assistant City Manager. The motion carried unanimously by roll call vote. F - 3 City Attorney's Attendance at Council Meetings Taken up under Agenda Item E - 2. G: NEW BUSINESS G - 1 Lease cancellation - Conright's Furniture The Administration recommends terminating the lease as 7/l/70 and 7/1/71 lease payments amounting to $931.50 have not been paid. They were notified and the City has had no response from their letters. Malone moved and Doyle seconded to accept the recommendations of Administration and cancel the Conright's Furniture Lease. Norene moved and Hornaday seconded to table the motion until the next meeting as the business has changed hands. The motion carried unanimously. G - 2 Request for payment - Anchorage Asphalt Paving; d- Mr. Burt F.A.A. re reported the p proper form has been completed and signed by our engineer and recommends approval for payment for progress estimate #1 in the amount of $26,406.00. Doyle moved and Hornaday seconded to accept the Administrations recommendation and pay Anchorage Asphalt Paving, $26,406.00. The motion carried unanimously by roll call vote. Mr. Burt reported this projoct has boon inspected by the City Manager and the Public Works Co-ordinator and recommends payment to Mt. McKinloy Fence Co. in the amount of $3,563.00. McGrady moved and Doylo seconded to accept the Administration's recommendation and pay Mt. McKinley Pence Co. $3,S63.00. The motion carried unanimously by roll call vote. G - 4 Request for payment - Blocky Rutherford and Gil Wol£or. The Administration recommends final payment due Ruthorford/Wolfer in the amount of $7,220.44. Doyle moved and Noreno seconded to accept the Administration's recommendation and pay the two contractors $7,220.44. Doyle asked, are they bonded? Mr. Burt related they are insured. Doyle asked how does the Charter read? Hornaday moved to table the motion until the next meeting. The motion died for lack of a second. Doyle withdrew his motion with consent of second (Norene) Doyle moved and McGrady seconded to pay the contractors $7,220.44 less 10% to a held for a period of one year, the term of bond. Malone moved and Norene seconded to amend the motion to delete the time limit. The amended motion carried 4 - 2 with Doyle and McGrady dissenting. The main motion carried unanimously by roll call vote. McGrady asked for reconsideration at the next Council meeting. G - S Request for payment - Wince,Corthell and Assoc. The Administration recommends that the fees for engineering services on Airport Project 071-1 be aid to Wince, Corthell and Assoc. in the amount of 3,647.23. The City Manager and the Public Works Co-ordinator has reviewed the bill. Doyle moved and Norene seconded to accept the Administration's recommendation and pay Wince, Corthell and Assoc. $3,647.23. The motion carried unanimously by roll call vote with Malone abstaining. L. - i MINUTES OF KHNAt CTTY COUNCIL M101,11NG OF NOVEMBER 17, 1971 Page nine G - 6 Request for payment - Cook Inlet Construction Tho Administration rocommends payment of. $9,630.00 plus the 10% withheld or a total of $10,700.00 to be paid to Cook Inlet Construction for extension of sewer lines across the Kenai Spur Road in the Lawton Drive area. Doyle moved and McCrady seconded to accept the Administration's recommendation and pay Cook Inlet Construction $10,700. The motion carried unanimously by roll call vote. G - 7 Resolution 71-45 - Paving Beaver Loop Road Hornaday moved and McGrady seconded to adopt Resolution 71-45 - Paving Beaver Loop Road and Forest Drive. .- The motion carried unanimously by roll call vote. G - 8 Request for payment - Corthell, Wince and Assoc. $1,327.50 Norene moved and Doyle seconded to pay Corthell, Wince and Assoc. $1,327.50 for engineering services on water and sewer lines as described in the request for payment. The motion carried unanimously by roll call vote with Malone abstaining. Hornaday gave a notice of reconsideration for the next meeting. G 9 Request for payment - Cook Inlet Construction - $17,907.09 Doyle moved and Norene seconded to pay Cook Inlet Construction Co. $17,907.09. �-' There were some questions on this for Bruce Massey, who is in Juneau. Hornaday moved and Malone seconded to table the motion until the next meeting. The motion carried unanimously by roll call vote. G - 10 Bond Sale The City Manager and Assistant City Manager have been in contact with Don Meyer concerning the sale of $2,000,000 G.O. Bonds. Mr. Burt talked at length with Mr. Glotfelty by phone and it is his recommendation we go for bids on November 23, 1971. Malone moved and Doyle seconded to accept the recommendation of Administration for the $2,000,000 bond sale, subject to a favorable opinion from bond Counsel. The motion carried unanimously by roll call vote. T MINUTES OF KENAI CITY COUNCIL MEETING OF NOVEMBER 17, 1971 rage toll G - 11 Discussion on Wildwood Proposal Bielefeld registered a flat objection to the proposed high intensity airport. He feels the location would result in a major depression of the tax base. It was felt that a meeting be sot up as soon as possible with the Kenaitze Indians. G - 12 Replacement - Personnel Board Luke Caro's term on the personnel board has run out and he does not wish to serve another term. A replacement for the personnel board term will be brought to the attention of the Mayor. G - 13 Kenai Community Water System The acquisition of the Kenai Community-Wator System was discussed. It was the concensus of the Council to get a report from Bruce before discussing this at length. MEETING ADJOURNED 11:45 P.M. What are your plans for maintenance during Spring break - up? Mr. Dobrinski: For the dust problem, we plan to apply calcium chloride. Mr. Burt: Two People wont into the Fire Water Reservoir, the result of inaccurately marked detours. The question is this: Whose at fault -- the City or the Highway Department? Mr. Norene: Would it be possible to open up the access off Spur opposite Cams Market, to a road which heads South between the Junior High and Alaska State Bank? The businesses are being served only by two entrances. Mr. Fargo: The frost is down deep enough to where it would be more of a mess than now. There is 1 1/2 to 2 feet of frost. The gravel is frozen. We're stuck with that. Next year, the Department will allow the Contractor to place Calcium Chloride on the roads. This will keep the dust down and will be,easier to maintain. The detours next year will be short and not quite so long a duration. They will be working with shorter sections of the road. This year the entire roadway was sand and everybody would have. been stuck. TRANSCRIPT OF MINUTES, KLNAI CITY COUNCIL Page -2- r Mr. Fargo: There is S to 6 feet of gravel, which will be beneficial during break - up. The Highway maintains the road during winter and when the contractor resumes operation, he will maintain the road. Mr. Mc Grady: What is the target date to resume operations? Mr. Dobrinski: We're shooting for April 1st. If we can start sooner, we will. Mr. Fargo: It depends on the weather. Mr. McGrady: There is not enough gravel. When it was graded, the gravel was scraped off and mud on. Who's responsible for the pot holes. The roads can certainly use some maintenance. Mr. Fargo: I will relay the message to the Maintenance Department. Mr. Hornaday: Who's responsible for the Willow Street entrance? Mr. Fargo: This is a multiple fault. There will always be a slope. There will be a taper to meet the grade. It will be ` steep this winter. Mr. Hornaday: What about the berm pile by NC Auto Center and the old P.N.A. Building? ' Mr. Fargo: They will be left there all winter. There is no way we can move them now. s Mr. Hornaday: Is this normal: -- Mr. Fargo: Somewhat, yes. These are stock piles for top soil for the seeding. The quick freeze up nearly left N.C. Auto - Center without any access. 1 i r. C I 9 TRANSCRIPT OF MINUTES, KFNAI CITY COUNCIL Page a 3- Mr. Hornaday: I have never seen a job left in such a condition by the Highway Department or a contractor. The road is a traffic hazard. The roads have no dividers. Its a disgrace. Mr. Fargo: flow many gravel roads have you seen in the State with dividers? Mr. Hornaday: You couldn't even see on Forest Drive because of the dust. Mr. Fargo: There were school crossing signs posted and people were to yield to children. But I've had reports that they didn't. Mr. Hornaday: How could they? You couldn't see it was so dusty. Mr. Fargo: Oh, it wasn't that dusty. Mr. Malone: I can vouch for that. I live on Forest Drive. Mr. Hornaday: It's a disgrace. We shouldn't have to put up with that kind of crap. There was inadequate control by the Department and the contractor. We should have a written report on what kind of detours there F' will be next spring. Mr. Fargo: The detours will be shorter and I have received authority to allow the contractor to put calcium chloride on the detours. This will: 1. Keep dust down. Z. Makes the road easier to maintain. It maintains a certain amount of moisture in the surface. Mr. Hornaday: The City needs a program on how this is going to be handled when they come back in the spring. - -d TRANSCRIPT OF MINUTES, KENAI CITY COUNCIL, page -4- Mr. Hornaday: Is the Contractor going to do anything else this winter? Mr. Dobrinski: We are shut down for the winter. I can't see what we can do with the ground in the condition that its in. Mr. Hornaday: Very dissappointing. Mr. Malone: Is the maintenance of the detours a joint res- ponsibility? You couldn't see a 100 yards. There was no attempt at dust control and that combined with marginal marking. There was problems with maintenance.on detours, signs swiped and torn up, etc. Mr. Hornaday: That does not lessen the responsibility. Will there be dust control? Mr. Fargo: Yes, as mentioned twice before. Mr. Norene: The City had a detour by the school. We should have an access to the highway even if it takes a cat. f� Mr. Fargo: I will speak to the maintenance crew to see if they could get their equipment to fix that. Mr. Burt: I have a meeting tomorrow with Mr. Fargo to go over some of these problems. Mr. McGrady: Will the detours be left in as good as, or better condition as before? Mr. Fargo: They will be accepted to the City or State. They will be the same standard as they were. TRANSCRIPT OF MINUTES, KENAI CITY COUNCIL, Page -5- Mr. Malone: If an accident occurs at Willow Street, who is liable? Mr. Fargo: I'm not sure. It might even be the Airport. They have a White Alice Cable in there that was a problem. It was broken and spliced. Mr. McCrady: On the access roads where the stop signs were, but are not now, could create liability, ie: Birch Drive. Mr. Norene: The opening up of an access past Alaska State Bank - Broad Street. It would alleviate the traffic jam at Willow Street. All the traffic is funnelled to Willow Street. What about the stop sign at the top of Willow Street? Mr. Fargo: I will talk to the maintenance crews. They might be able to bust it loose. Mr. Hornaday: The access road that crosses the Airport by the C.A.P. hanger should have a "No Thru" traffic sign or a snow berm. The Administration should take this up with the State Highway Department followed up with the Governor and the Commissioner of Highways. FRI
