B-1: (Moved up from F-3) Don Brown, Alaska Barite representative said he had
been asked to shut down of certain periods morning and evening when CUL had peak
power loads. There was considerable discussion and Mayor Morin read a letter
from CUL Pres., Odin Strandberg stating he had never requested a shut -down to
Barite, but nad asked that their schedule be arranged so as not to come during
the peak demands for CUL. Council saw no reason why Barite could not bring in
auxiliary generators if tney wished. KCL Mgr. will continue to work with Barite
and CUL on this matter.
Mr. 3rown also objected to Inlet Co. using the old Beaver Loop r.o.w.
as access to their dock. The Dept. of Hwys. had agreed, three or four years ago,
in exchange for a r.o.w. for the new Beaver Loop Alignment, they would vacate
the r.o.w. for the old road, and would return the property to existing owners.
This has never been done, hence the confusion. Failure of a Court trial to
resolve the conflict has put the City in the middle of something over which it
nas no control. Tiie City Mgr. will work with Barite, Inlet Co., Dept. of Hwys.
and Don Fredrickson to secure vacation of the old r.o.w. and provisions for a
new r.o.w. to Inlet Co. holdings.
After some discussion, Hulien moved, Malone seconded, to ask the
KCL Supt. to look into the possibility of acquiring power from another source.
Motion passed unanimously.
Percy bergt, KCL Supt., said he had already obtained some data on
purchase or lease of generators; he was aksed by the Mayor to attend Planning
Commission meeting next week. The Mayor hopes to present some ideas for capital
improvements to the Committe at that time.
B-2: Dennis Bernard, speaking for the Youth Action Council, asked for a defini-
tion of "adult chaparone"; must they be 25 years of age or older? Etc. Police
Chief Heffner said the chaparones thus far have been all right. Council suggested
the Jr. J.C.'s and other Clubs in town be contacted to help chaparone - parents
of Club Members also may be interested in helping.
Bernard also asked the age limit for those using the Club be raised
from 19 to 2U years. Council concurred with this request.
YAC is agreeable to opening the Recreation Building a few hours
daily for non-members; hours will be 1 to 4 p.m. weekdays and 8 a.m. to 1 p.m.
Saturdays.
Minutes of the meeting of 17 December, 1969, were approved.
Minutes of the special meeting of 23 December, 1969, were corrected by the Clerk
by adding "Council also directed the leash law be observed sometime in January
to allow City forces to impound all stray dogs".
Dates for observing the leash law are 12 Jan, through the 18th.
- - The City will concentrate on one area at a time for gathering up stray dogs.
E-1: Acting City 11gr. George L. Jaynes reported:
1. Receipt of a letter from James Hornaday requesting information for a study on
possibilities of constructing a Community College Building. This data will be
furnished him.

2. The Legislature convenes It January; a meeting on water resources will be
held in Kenai 13 January, B p.m., Library Room.
3. The City nas received $31.857.UU from the State's revenue snaring program.
4. Water Supt. Massey had submitted copies of correspondence from Fir. Skinner,
State Water Resources representative, to Council along with his proposed answer.
Wi to concurn_nce of Council. this answer will be sent. Generally, the letter
was asking for financial assistance in determining the extent of the Beaver
Creek and Kenai River aquifers, and possible drilling of test wells closer to
the City's distribution system.
dielefeld said the Administration should notify Galliett of the
meeting of the 13th and ask tnat he oe present if possible.
The Mayor has written a letter to Mr. Kelly asking why the City has
had no response from their application for water rights, pending now for about
five years.
Massey and Jaynes will meet with Skinner prior to the meeting and
they will ask about this.
5. Council concurred with Jaynes' request to go ahead with a complete and major
study of the City's pay and classification plan.
' 6. Malone moved, McCann seconded, to table the request for KCL Supt. to attend
the American Public Power Workshop in Phoenix Feb. 2 thru 5. Motion carried
unanimously. Travel costs would be about $525.00.
7. Sherwood had recommended to Jaynes the City should hire a Finance Officer
right away.
In answer to questions, the Clerk said the revenue sharing money of
$31,857 received this week was $4,193 short of what was budgeted. It is hoped
the balance of $33,493 will be received this fiscal year; the Legislature must
appropriate the money this session if this is to be had before 1 July'70. Coun-
cil urged the Legislators be encouraged to enact this legislation.
E-2: Atty. James E. Fisher reported:
1. The airport lease forms are all right to use; Council's concern should be
with the figures, costs, revenue and conditions of the lease rather than the form.
2. The Chamber Award meeting is to be January 13th.
3. Fisher said the City should talk with the Governor, the Local Affairs Agency,&
= our Legislators about the financial problems of the City; i.e. they are the re-
sult of accumulated problems resulting from our explosive growth. The State
has never taken care of impacted areas. The State should donate people and
cash grants to assist municipalities trying to cope wittf unusual influx of people.
For instance, they could furnish more State Troopers without increasing cost
of services.
Malone inquired if the Atty. had approved the contract with Crews,
McInnis and Hoffman; Fisher said it is okay.
Morin asked Fisher if Kenai Terminal Enterprises was complying with
- the lease agreement. The Cafe is not opened during flight times. Fisher said
it would be "a reasonable operation" to expect them to be open during these hours.
- - He will direct a letter to Jaynes to this effect.
E-3: The Mayor reported:
1. Receipt of a letter from Matlock. Dir. of Dept. of Highways, that he has
requested Federal approval of Site B for the Kenai River 3ridge crossing. Morin
has asked when the hearing for bridge design will be held? When will the project
be funded? When will it be started? And if objections are made, he hoped it
would be done in public meeting, not by correspondence after the public meeting.
2. Morin signed two proclamations: 1. Recognizing the beneficial efforts of
Dan Sutton to help the youth of Kenai. 2. Proclaiming 24 January as Little
League day.

3. Ile will go to Planning Commission m;:eting on the 14th to present some ideas
on planning public improvements. Ile hopes Galliett can be present at this meet-
ing also.
4. Mr. Robbins had asked lie be. administered tine oath of office this evening so
he can speak with some authority on City business. dis time for the City will
be donated until lie takes over on 21 January.
The Clerk administered the oath and he was introduced to the assemb-
lage. Mayor Morin welcomed him to the "fold".
E-4: Tne City Clerk reported:
1. In addition to the sum already reported, the City leas received from the Fed-
eral Government $53,212.b9 as finial payment on the Federal Aid to Airports Pro-
ject for the paving program at Kenai. This money will be used to repay other
funds of the City which paid some costs of the Project during construction.
lltce. and Operation Fund of the Airport also received $5,114.59 from
the State as a refund from gasoline fees for sales on the Airport.
2. The Dapartment of Public Safety has amended the agreement between them and
the City for Communication services to stipulate the agreement can be terminated
by "either party" on appropriate notice.
3. The Alaska Association of Municipal Clerks is raving a meeting with the Local
Affairs Agency in Ancnorage, Jan. 28,29 and 30. A Uniform Election Code will be
part of the Agenda as well as other procedures concerning bonding, investment
of funds and other clerical matters. If Mr. Robbins and Council agrees, the
Clerk will try to attend this meetinq.
Council asked about the businbss meal cdming to-Anchdrage from;Canada. Ao one'
present know of their -plans -or itinerary:' The Chamber of'Commerce might -be better
informed.
Morin asked the Attorney to draft an ordinance separating the position of Finance
Director from that of City Clerk. The Clerk has not been the bookkeeper since
1968, Due to press of other duties on'the Clerk, a'Controller-was mired 7/l/68,
but the position was never made a part of the pay and classification plan. The
City Council has been screening applications for a Finance Director and 'hopes to
hire someone very soon, but wants to do it legally, and according to Charter.
E-5: Mrs. Ruby Coyle, Planning Comm. Chairman reported:
1. Due to Holidays toe Planning Commission hasn't had a meeting since early in
December, The Planning Commission wants a paid employee to take minutes and
check Plats for subdivisions. Bone of the Planning Commission members are quali-
fied, or has the time, to attend to the duties imposed on them by the Code.
Morin said this would be woriked on by the Administration.
2. A public hearing is called for Jan..9th at .the Jr. High to discuss the Borough
proposed zoning ordinance; a speaker in the audience said the gearing was not
on the Zoning Ord., but on ASHA's Comprehensive Plan for the Borough.
E-6: Malone reported on the dorougn Assembly meeting:
1. They hope to get the State to pay revenue snaring money before the end of the
fiscal year. Everyone is urged to write iris Legislator about this.
2. They are supporting the action to get a judge for the Kenai -Kodiak area.
3. Also hope to get more pioneer access roads for Alaska.
4. They hope to get the gross receipts tax repealed
S. They want a plan of revenue sharing designed to help Cities and Boroughs to
provide services,iischool construction.
6. Tnere's no money tnis year to provida buses for Anchor Point children who live

7. They hope to get a vocational school in Kenai next fiscal year, using steel
bui Idings.
3. The Assembly is concerned about they water resources study having to do with
North Kenai.
g. Tax adjustments were approved, and bad debts of $34,130 were written off;
additions were made for $6,890; waivers of penalty were denied to applicants.
10. A company in Norte Dakota will talk to the Uoro about operating a Hospital.
The question of who is responsible for enforcing air pollution laws
was discussed; the Moro will be the authority wnen the new zoning ordinance is
passed.
Acting
F-1: The Clerk and/City Mgr. urged approval of the lease form for the Airport
as the terminal building has had a tenant for months who has no legal right to
be there; approval of the Attorney was needed before passage and this has now
been received. Council tnought the new City Mgr. should be given a chance to
look it over.
Nalone moved to approve the lease form for the airport. Motion
y seconded by Hulien.
McCann moved to table action on the lease form, bailie seconded,
and the motion passed, with Malone dissenting.
F-2: After some discussion, Malone moved, Bielefeld seconded, the City should
participate in the Trade Fair in Newport Beach, California, in Marcn. Motion
was defeated unanimously by roll call vote.
F-4: The Clerk said the following unsold bonds are authorized:
$215,000 Water bonds, G. 0.
125,000 Sewer Bonds, G. 0.
100,000 Terminal Revenue Bonds
425,000 Kenai City Light Revenue Bonds
Don Meyer has said the bond market is still not encouraging, but
realizing the City's need for money, he asked Council how much and for what pur-
pose they would want to put bonds up for sale, and also how soon.
Council discussed water bonds only, saying the money should be spent
for hook-up to the artesian wells, and pernaps for drilling a test well closer
to the distribution system.
Bielefeld moved, Hulien seconded, to instruct Bond Counsellor Thor-
grimson to draft ordinances authorizing issuance of sale of all authorized,but
unsold, bonds. Motion passed by roll call vote with McCann dissenting.
i F-5: Malone reported on conversation with the Kenai Postmaster wherein the postal
department has said they want to build their own building on City land. Malone
'j wants Planning Commission to recommend a definite spot. Mrs. Coyle said they
had done this - recommending Site A, since this was the one the P.O. Dept. wanted.
The Mayor said Council had taken a vote and recommended Site B, and asked Malone
if he was after a two out of three ballot. Council is the legislative body for
the City while Plan. Comm. is an advisory committee. This will be on Planning
Commission Agenda next week.
G-1: Mr. Sherwood called late this afternoon saying he would not be at this
meeting as his report "had a few holes in it". As soon as the report is received
in the mail, copies will be made and mailed to Council.
Tne mtce. man for the Burroughs machine was here today, and Art Day
wile be here next Tuesday to assist the accountant in getting the postings set
up on the machine.

G-2: Tne Clerk reported foreclosures on delinquencies on the UU271 Assessment
districts involved $35,9!)5.05, 35 owners and b5 parcels.
The delinquent assessments on the "Caughran" or first water and
sewer districts totals $7,e35. No list has been compiled, so number of -parcels
or owners is not now known.
These are delinquencies for two years or more. One year delinquencies
are not included; also those protected by the Charter are not on the list; the
City's policy in the past, and the present doro policy is to foreclose after one
year's delinquency. This money is used to make interest and principal payments
on bonds; payments which are delinquent becomes a lien against the property the
same as delinquent taxes. After publication of the list, the owner has one year
to redeem his property.
Council authorized the Clerk to compile the lists for two•year de-
linquencies in all public improvement assessment districts for their perusal.
G-3: The Clerk explained the $100 service charge by the Alaska Municipal League
is not a part of a membership fee, but is to cover "such services as research
coordination, library, inquiry, mailing, special meetings, etc. pertaining to
specific city problems and not involving the required interest of the areawide
government". This expenditure does not have to come to Council, but was on
the Agenda for informational purposes only.
McCann moved, 3ai lie seconded, to pay the $100 to AML. Motion car-
ried by roll call vote with Bielefeld and Malone dissenting.
G-4: McCann suggested Council authorize a study group t&W9'*aA-
possibility
of Cities in the Borough serving as Service Centers for In his -
mind, this would eliminate one layer of government and costs to the taxpayer.
This might be something for the school government classes to work on. Council
saw no objection to a committee of citizens forming for this purpose if they want.
G-S: McCann moved, Hulien seconded, to approve the application for a permit for
games of chance and skill for the Catholic Men's Club. Motion passed unanimously
with Bailie abstaining, since his name is on the application.
Malone said if any one has any questions on fiscal affairs to please come to
Council and get answers in public meeting. He hoped this would eliminate rumors
and incorrect deductions.
