Morin; Members absent - Robert Bielefeld. B-1: Borough Chairman George Navarre was not present to discuss Summer Recrea- tion Program. C: Minutes of the meeting of 6/17/70 were corrected: P. 4, F-5, name "Coyle" changed to Doyle; P. 1, last Para. Hornaday requested deletion of "he was in favor of the— safes tax"; Hornaday also submitted a letter to be included.in the minutes wherein he states he voted in favor of the Operational Budget, but abstained from voting on the section of the Budget establishing monies for the City Attorney's expenses. This letter is filed with minutes of 6/17/70. Minutes of 6/22/70 were approved. 0: Correspondence was presented in Departmental reports. E-0: City Manager Robbins reported: 1, A letter was received from J. W. Scott, Dist. Mgr. for Bureau of Land Man- agement, expressing his appreciation for the work done by Fire Chief Wisecarver and Police Chief Heffner during the last fire emergency. Robbins added his thanks also. 2. Presented a list of surplus materials with his recommendation they be ad- vertised for sale on "as is, where is" basis and with a 90 day removal clause. He also suggested item 18 be added to the list; i.e. 1 ea. Lockheed Aircraft. Doyle moved, Hornaday seconded, to approve the advertising for sale of surplus property. After some discussion as to the medical equipment, Bailie moved, Malone seconded, the City should receive a definite bid on the X-Ray machine from Dr. Armstrong. If no bid is received, put the X-Ray machine on the sur- plus materials list. Amendment roll call vote: Affirmative - Bailie, Hornaday, Malone; Negative - Doyle, McCollum. The'mairi'motion.passed unanimously. Mfterial list is included in these minutes. A $2.00 minimum was placed on each landing mat. 3. The City Mgr. said the City Charter was adopted 4/9/63 and is now seven years old. He suggests its time for a revision, preserving the spirit and in- tent of the original Charter. Doyle moved, McCollum seconded the Administration should investigate the forming of a Charter Commission to study possible Charter Changes. Malone said we don't know what changes are needed until we live with the Charter longer. The two times we have needed a change, the City has gone to the people and been granted the needed change. Charters and Constitutions are not to be -compared with Ordinances or Statutes which are changed often. The Mayor said Constitutions are not considered old until they have passed their 100 yr. mark. The motion carried with Malone dissenting. 4. Robbins has agreed thatuthe:V ty will furnish the concrete blocks and cement for latrines at the ball park. The Lions will furnish the labor. This is some- thing the City would have to do anyway, and going this route will save us some:. Oidney: - . Cost of mate ri a 1 s is $250.00. 5. Robbins referred to Massey for a report on the Beaver Creek water Line. Massey presented cost estimates of construction under contract vs. the City doing the work under the supervision of a contractor/engineer. He Kenai Council Minutes 7/1/70 Page two E-1-5, Cont'd. reviewed advantages and disadvantages under all different possibilities. Total cost with a contractor doing the work is $287,785. Total cost if City does the work with a consulting staff and professional inspections is $1779352.30. He said whatever Council decides, the decision should be made now because the City is short on time and money. The pipe has been ordered at a saving of 5% or, 10-11 000 dollars. The rights -of -way are about 9004 compete; some costs (about 50%5 will be paid back through assessments; the City has $1890000 in bond money for water im- provements. The saving on costs for chemicals alone will pay for the interest on the bonds, according to Massey. It is not known if the City can get HUD loans or grants, or loans or grants from the State, but every avenue of assistance is being explored. Fisher mentioned his concern over furnishing water to Wildwood; i.e., will it deplete the City's water supply in future years? Will it cause subsi- dence? Alan Corthell, of ACLW, does not think it would harm the City. Massey and the City Mgr. recommend the City proceed with construction of the water main to connect to the artesian using City forces and a Consulting. Staff. Malone moved, Doyle seconded, to accept the recommendations of the City Administration regarding the Beaver Creek main water line. Motion carried unanimously by roll call vote. Massey said the materials should be here about the 4th of August; completion date is estimated to be 60 days from the day the pipe gets here. Massey also asked for an executive session with Council after the meeting to discuss prices of merchandise. Council agreed to this. E-2: Attorney Fisher reported: 1. The Ord. for taxes has been presented and should be passed as an emergency Ordinance. 2. The Supreme Court requires jury trials in cases where penalties involving incarceration are involved. If the City has cases 6f this nature coming up, they will file on a State charge, so the State, and not the City, will bear the burden of prisoner costs. Fisher suggests the City's penalties should be reviewed and lesser sentences should apply for minor violations. Errors have been made, but considerable knowledge has been gained and the rights of the people are being protected. He $aid the City should also used the State s revised Rules of the Road. E-3: Mayor Morin reported: 1. He had talked with Governor Miller, Rep. Pollock and Rep. Tillion on: 1. The Bridge Project, urging them to expedite construction; 2. Small Boat Harbor and Navigational Aids; 3. Setting a Judge in Kenai. There was some discussion on the last point. James MacDowell sug- gested Kenai should also include Homer and Seldovia areas when pointing out the need for a Judge here. After discussion, it was decided a letter should be written, over the signature of the Mayor, to the Chief Justice of the Supreme Court, and the Mayor is also to call him, urging the seating of a Judge in Kenai. E-4: The City Clerk reported: 1. Councilman Hornaday had addressed a Memo to Council requesting a leave of absence during the month of July. The Code provides for such absences, so no action is required of Council. 2. The Kenai Borough is holding a public hearing on the final draft of its Zoning Ordinance. The definition for Mobile Homes (Trailers) is of importance to Kenai due to our change in taxing property. It appears to be all right, but Kenai Council Minutes 7/l/70 Page three City Clerk's report, Cont'd. Council should take a look at it and try to attend the hearing.on 16 July at Ft. Kenay. 3. The City has posted afiotice of Landlord's Lien on the BMR Aviation planes. And alerted FAA they are not to be removed without checking with the City. All interested parties have been notified. The Atty. and Council also recommended a ditch be dug around the planes to prevent removal. There was some discussion as to the polling places for the Borough and State Elections. No one knows why the Mail was chosen when the City has established the Recreation Center as the polling place for precincts within the City. The Clerk will endeavor to get new booths from the State and to find out why the polling places were named as they were. E-5: City Treasurer Ray Burt reported: 1. A protest had been received on Council's action regarding insurance for Fiscal 1971. Burt had answered the letter pointing out the City had awarded no bid for insurance, but had appointed a Broker of Record to purchase insurance. Oberts has placed insurance for the City with a possible saving of $3,000 over the offer of La Bow Haynes, who had protested the action. this year. He does not recommend a reconsideration of the insurance Faction for 2. There has been a 33 1/3% increase in group insurance and retirement costs. On retirement, the employee gets back only what he puts in, plus 2%. Burt says hardly any employee retires here; he thinks the City should start its own re- tirement fund, paying at least 6%. He has proposals from several companies coming in for insurance, and is working with an actuary for concrete figures to present to Council. 3. Brian Peck, who assumed the leases in the Terminal originally made to Jack Peck has requested a release from his contract to rent the small offices form- erly used as the Airport Manager's offices. Burt proposes to move the City Mgr. into these offices as he needs more privacy than he now has. After brief discussion, Malone moved, McCollum seconded, to release Peck from his contract on the small offices and to put the City Mgr. there. -Motion passed unanimously. In answer to a question from Malone, Burt said the audit has already started. The cash count is done, and they are working on inventories now. Starting 20 July, there will be three men here working every day to complete the audit. Answering a question from Bailie, Burt said proposals for next year's audit should go out in August. l E-6: Hornaday said the Borough stated if Cities -fished a return of the Planning and Zoning authority to them, they should make their request in writing. He has asked the Kenai P. and Z. Commission to study this suggestion and to make their recommendations to Council. The Mayor said the Boro has the authority, but the City has the re- sponsibility, which is not an advantageous position. He says the Cities' votes in the Assembly are not in proportion to their representation. E-7: Malone reported on the Borough Assembly meeting: 1. The Ordinance, final draft, on air pollution and control for the Tr4-area has been completed. It provides a 6 man' commission; two from Matsu Boro, two from Anchorage Boro and 2 from the Kenai Boro. It also provides funding on a per capita basis, and for the Commission to provide rules and regulations. Morin inquired as to the census figures for the Borough. Kenai's population is now 3,934. Other figures will be obtained from the Census Bureau. Kenai Council Minutes 7/1/70 Page four F-1: Robbins said the Ordinance fbr.Street Naming and [louse Numbering specifies the Project shalt be done by August. The City has budgeted for this and we should get it contracted out for implementation. Hornaday moved, Bailie seconded, the City should prepare bid proposals for the Street Naming and I -louse Numbering System. Motion carried unanimously. F-2: The Mayor presented Ord. #184 as submitted by Atty. Fisher. Malone moved, Hornaday seconded, to declare an emergency for passage of Ord. #184. Motion passed unanimously. Bailie moved, Malone seconded to adopt Ordinance #184, Intent for real and personal property taxation. Motion carried unanimously by roll call vote. Hornaday said the Legislature has now passed a bill waiving lien rights on property for welfare assisted families. This will solve some of the City's problems on delinquent obligations of some of its citizens. He also thinks the City should go ahead with a Recreational Program. Robbins says he is meeting tomorrow with representatives of the Salvation Army, and later with agents of the Elks Club. The City Manager will also seek the Atty, General's opinion concerning RADAR or VASCAR. G-1: Robbins suggested the City change the meeting place for City Council meet- ings to Ft. Kenay as there is more space there and it's a better place,which might encourage better participation in the meetings on the part of the public. Morin said the Code would have to be changed if this is decided on. The City Clerk asked Council to consider several factors before de- ciding to move: 1. Ft. Kenay cannot be used during Russian Holidays and their Holi- days do not coincide with ours. 2. It's very hard to hear what's being said, due to the fan on the heating system, and this winter it will be worse than at the Council meeting in June. 3. The lighting is very poor. 4. Parking space is very limited. Malone said he thought the parking space was not adequate and Horna- day said the noise df the fan prevented him from hearing what was going on at the meeting the Council held there. Burt suggested Council table a decision until a cost study can be made on what the change involves. Jaynes said the heating system could be changed but had no idea as to cost. Bailie moved, Malone seconded, to table action on Ft,.Kenay.as�&_ . meeting place for Council until a cost study can be made. Motion carried Unan- imously. G-2: Robbins read the results of the bidding on sale of materials to the City. Council made the awards as follows: to the low bidder VcCollum moved, Malone seconded, to award the bid/for 20,000 gal. of gas to Doyle Fuel Service at $0.2375 a gal. Motion carried with Doyle abstaining. Bailie moved, Malone seconded,to award the bid for 30,000 gal. of heat- ing oil to low bidder Doyle Fuel Service at $0.1875 a gal. Motion carried with Doyle abstaining. Bailie moved, Hornaday seconded, to award the bid for 800 gal. of Delo-type oil to low bidder Standard Oil Co. at $1.16 a gal. Motion carried unanimously. Malone moved, McCollum seconded, to award the bid for 150 gallons of hydraulic fluid to Sow bidder Union Oil Co. at $0.68 a gal. Motion carried unanim. Kenai Council Minutes 7/1/70 Page five G-2, Contd. Hornaday moved, Doyle seconded, to award the bid for 720 lbs. of SAE r 90 grease to low bidder Standard Oil Co. at $0.2025 a lb. Motion carried unanim. Bailie moved, Malone seconded, to award the bid for 120 lbs. of No. 1 grease to Standard Oil Co. at $0.275 a lb. This is not the low bid, but was recommended by the Administration since Standard had low bids on all other greases and oils. Motion carried unanimously. Malone moved, Hornaday seconded to award the bid for 220 gallons of solvent to low bidder Standard Oil Co. at 11.52 a gal. to be delivered in al. cans. Motion carried unanimously. 000 Hornaday moved, Malone seconded, to award the bid for yr of gravel to Inlet Co., Inc. (low bidder) at $0.54 per cu. yd. There was some discussion on this award as Jaynes said the gravel here is of poor grade, but it is the low bid and is 360 below that of Be -Co -Pro. Also, buying from Be -Co - Pro would make a longer haul. He thought enough good.�gravel could be had from Inlet Co. to warrant the award to them. Motion carried unanimously.
