Resolution 70-24 S. H-P PERSONS PRESENT NOT SCHEDULE TO BE HEARD: 1. 2. t F i i k MINUTES OF KENAI CITY COUNCIL MEETING NOVEMBER 18, 1970 A - ROLL CALL: Members present - Charles A. Bailie, Robert Bielefeld, James Doyle, James iornaday, Hugh Malone, Florine McCollum, Mayor Eugone H. Morin. With consent of Council, two items were added to the Agenda; Kelly Dickson, under B-2, and Resolution 70-24 under G-4. A - 1 Publ Hearing on Ordinance 189-700 amending Ordinance 127- , deleting "Kenai Joe Only" from liquor license of Kenai Joe's Bar. Bailie moved and Malone seconded to accept Ordinance 189-70,,deleting Section 3, for first reading. The hearing was opened to the public. Kelly Dickson spoke saying the Ordinance should be turned down, stating too many liceftses for population and the Council is compounding the situation. Elsie Consiel spoke stating this was her only livelihood. There was no further public participation so the public portion was closed and brought back to Council table. After much discussion the Council voted - Ayes; Bailie, Hornaday, Malone, $ McCollum; Nays; Bielefeld and Doyle. The motion passed. A - 2 Def#rred until next Council meeting December 2, 1970. B - 1 Bob Harris protested the Emergency procedure in the adoption of Ordinance 188-70. Councilman Malone explained to him the need for the Kenai Code to conform with State Statutes. B- 2 Kelly Dickson also protested the Emergency procedure in adopting Ordinance 188-70. He feels the voice of the other side is cut off. tie asked Council to re -consider -ti the Emergency Ordinance and hear it tonight for the second reading. Mayor Morin; asked Council how they felt about this. Bielefeld moved and Malone seconded to go on with the agenda. The motion passed with Hornaday dissenting. C Minutes of November 4, 1970 were approved as corrected. G-2 should have read Malone dissenting and Hornaday voting yes. D Correspondence covered in reports. B - 1 City Manager's Report. (a) Mr. Robbins.reported on the fire damage done to the 2nd Priest House on the lot near Fort Kenay. The insurance company reports it is a hazard. Roger Meeks asked Council to give the Historical Society 30 days to eliminate the hazard but not hold them to 30 dayys to restore the roof. Council advised this should be handled administratively. and was so instructed. Red Jaynes presented Council with pictures of the facilities in the park. MINUTES OF CITY COUNCIL MEETING NOVEMBER 18, 1970 Page two City Manager's Report continued. (b) Bruce Massey introduced Dick Spills from Engineer Equipment Co. He discussed the possibility of filtering the water from the Kenai River and supplying water to the plants in North Kenai. (c) Bruce Massey gave his Completion Report on the Beaver Creek Valley Water Trunk Line. fie reported on the Current Status, the Time Schedule, the Costs, and the Method of Bond Repayment. The Council commended Bruce on a job well done. Kjelstad and Corky reported they are working on the as-builts. Bielefeld felt there should be one pump and one motor for standby. Ray Burt stated this should be delayed until the project is finalized and pensued. The project was completed to within 11% of the original estimated cost. The City Manager was directed to write a letter of appreciation to Mr. and Mrs. Homer Swires for their co-operation in this project. E - 5 The Finance Director's report was heard at this time r� so Clyde Sherwood could make his presentation. He reported on the various different funds, the improvements i and the deficiencies, and ways of remedying the deficiencies. He further stated Mr. Burt did a commendable job in his short length of time with the City. Ray Burt requested a work session with Council. It was agreed upon for Tuesday, November 24, 1970 at 7:30 in the City Manager's Office. E - 2 City Attorney's Report. James Fisher reported that due to the change in voting age, we should review our election code, possibly repealing our election code and adopting the State's election code. E - 3 No report _ E- 4 No report E - S Finance Director's report heard after E-1 "I E - 6 No report E - 7 Borough Assemblymen's Report. James Hornaday reported on the Assembly meeting in Seward November 10, 1970. A recount report, on the two Assembly seats, was examined by the Assembly. A re -zoning within the City of Seward did not pass. - The Fire Service Area equipment for North Kenai was approved. Approximately $42,000 for furnishings for the Borough Building was passed. Assembly meeting of November 17, 1970. An Ordinance dealing with rezoning with the City of Soldotna was approved.' An Ordinance for Tax Exemption for Senior Citizens was introduced. MINUTES OF CITY COUNCIL MEETING NOVEMBER 18, 1970 Page three Borough Assemblymen's Report continued. Mr. Hamilton introduced a resolution to stop antlerless Kenai moose and ewe Dall Sheep hunt on the Peninsula. The Resolution failed. The Air Pollution was funded $2,500. A Resolution was passed proposing Kenai Municipal Airport as an alternate airport and establishment of a Customs Agent Office. F - 1 Deferred until next meeting, December 2, 1970 F - 2 After some discussion on Betty-Ame's plan to move the gift shop to the first floor and to keep the Museum on the second floor of Fort Kenay, Bielefeld removed his notice of reconsideration. So the motion carried as of November 4, 1970. A Museum Advisory Committee will be established to run the Museum. F - 3 The addendum to the Building Code, regarding mobile homes P was presented. Any suggestions are to be in writing. G - 1 Malone moved and Bielefeld seconded to accept Resolution 70-23 as amended to read "Other qualifications being equal, preference in employment or promotion is given to City residents. Per annum personnel selected outside the City shall be allowed a period not to exceed 90 days, following the 90 days probationary period to establish residence within the City of Kenai except in the event of extinpating circumstances to be determined by the Council. The motion passed unanimously. G-2 The shooting within two miles of the Post Office was ' discussed, and no action taken at this time. The City Manager was instructed to invite the Gun Club to the ' next Council meeting to see how the progress is coming �, on the rifle range. G-3 Six delegates from the Chambef of Commerce are going k to Fairbanks to the Board of Regents for the Community College to boost Kenai's proposed site for the Community College. Bailie added the City Manager should go and _ this was affirmed by Council. Malone moved and Bielefeld seconded to have Mayor Morin go as the second member of the delegation from the City and to reimburse him for the two days missed from teaching. The motion passed unanimously by roll call vote. G-4 McCollum moved and Bailie seconded to accept Resolution 70-24 authorizing filing pf application with the Depart- ment of HeAlth and Welfare, State of Alaska, for a Grant and/or a Loan under the terms of 33 USC 466. The motion passed unanimously. Council advised him this was their intent. Malone moved and McCollum seconded that the site preparation clause for the City's 160 acre site for the Community College be applicable to Section 36, the other City Site for Community College.
