KENAI CITY COUNCIL SPECIAL MEETING MINUTES
1968 11 SEPTEMBER
Roll call: Members present - Charles A. Bailie, Robert Bielefeld, Chester Cone,
John Hulien, dilly McCann, Florine McCollum and Mayor Eugene H. Morin.
Also present: City Mgr. James W. Harrison, Atty. James E. Fisher.
L. Harold Galliett presented plats showing areas to be assessed for water, sewer
and associated street improvements and lists giving property description, owners'
names, addresses, square footage of area to be assessed. These will be on file
with the City. A summary of costs, giving rates per sq. ft. was alao presented and
discussed.

The levy against Eto11n S/D is heavy, but they have a large fire protection
system; in the opinion of the Engineer, this is a fair and equitable levy, but it's
a Council policy decision.

Galliett said EDA will not pay on street construction costs, but to the City
it's all one project; assessments have been distributed in proportion to Project
costs.
Harrison asked three questions:
1. Was this assessment done according to the policies of the City Council?
2. Were the parcels assessed according to the depth of the lot area as
set out by Council? (i.e. 150' .on unsubdlvided areas.)
3. Were the areas given in the assessment list according to those in the
Borough records? And does the City take the area given times the rate to get the
cost of lump sum assessment?
Galliett answered all questions in the affirmative.
There was brief discussion on interest charges for financing for payments
on the installment plan; i.e. a ten year pay period.
Cone moved Hulien seconded, to accept the assessment rates as presented
by Galliett; i.e. $0.063422521 for water; $0.047117104 for Sewer and $0.060006745
for Associated Streets. Motion carried unanimously.
Following discussion in time, place, and date of public hearing, Cone moved,

Hulien seconded, the public hearing for accepting the assessment roll will be at
8:00 p.m., Wednesday 16 October, 1968, in the Kenai Library. Interest and penalty
for delinquent payments will be as set forth in the City Code, Sec.16-6, and interest
on financing shall be %6. Motion carried unanimously.
Galliett presented plats showing the areas to be assessed for the Paving Project
saying the Project is finished except for one chage order; i.e. the sidewalk by the
Post Office. There's $7,070.00 left in the contingency fund. These assessments are
based on front footage as agreed by Council.

The Engineer and Council has originally thought the assessment might run
about $17.00 per lineal ft., so this was welcome news.
If the property doesn't front on the paving, the lot is not assessed. The
City Code allows for assessing by "zone" which would assess benefited users, but
it was determined at the start to assess by lineal foot, so this was done,as the
=� Code also provides for this.
The Mayor inquired as to any sort of guarantee as to quality. Galliett
thought there might be a one year guarantee, but would have to research the con-
tract to be sure; he pointed out the streets have already gone through one winter.
Harrison asked the three questions again and received affirmative answers;
i.e. assessments were made according to Code and Council direction.
Galliett said the natural grade of the street is designed to take care of
drainage without culverts.
After some discussion, McCollum moved, Bielefeld seconded, to assess for
paving at $15,015960 per fron ft. Motion passed unanimously.
Bielefeld moved, McCann seconded, to hold the public hearing on this assess-
ment roll for 8:00 p.m., Wednesday, 16 October, 1968, in the Kenai Library. Penalty
and interest for delinquent payments shall be according to Sec. 16-6 of the City
Code, and interest for 10 year financing shall be at %6. Motion carried unanimously.
2. Harrison stated the City had kept a record of every inspection on the CAP Bldg,
and had kept in constant touch with Holleran and Hoyt on the progress of the con-
�d_ struction. He read a review of action on CAP Bldg. from the minutes of:past meet-
ings. A report from the Bldg. Inspector, Sam Cunningham was presented to Council
and appears in these minutes. All corrections to the bldg. can be made without
further cost to the City as they are a part of the agreement.
The contract is the inVitation to bid and the City's affirmation of the
bid accepted.
The At ty. was asked to lend assistance in an effort to get the attention-V
the Con tractor as he had ignored the City's atempts to communicate. The City is
still under contract with Lacher; Harrison does not recommend the City have the
floor finished at this time.
Holleran said all the C.A.P. is concerned with is the bldg.'s completion
before the snow flies.
Mr. Henry said his contract with Lacher was only to put in the floor.
Cone said no condemnation of any City official was meant in any manner;
the minutes do not always reflect all comments that are made.
There was discussion on contractors vs. sub -contractors. The Atty.. will
meet with Council next Wed. in executive session at 7:30 to discuss financial advan-
tages and disacvantages of the City.
Cunningham said putting the floor in now would not aggravate the correc-
tions that need to be made to the rest of the bldg.

3. Morin said he had taken a good look at the new Sterling Sears school and
had liked what he saw; McCann, Cone and McCollum had also looked it over.
There was discussion on the building and on the architects who had met
with Council a few weeks ago.
Galliett said the City should be sure that whoever designs the bldg.
should consider structural engineering to be done for earthquake safety factors.
Council asked the City Manager to invite Mr. Pendergrast to talk with them at
the next meeting.
Harrison called the CouncillIs attention to Item k-1 in the minutes of the last
meeting; the City Clerk said the Mayor's Memos to Council pertained to any cor-
respondence or contacts he might have had outside the Administration.
Incidentally, Morin said there is to be a meeting in Seward 16 Sept.
concerning buildings.
There was discussion about the minutes of the last meeting; these will
be corrected at the next regular meeting where necessary.
Harrison urged Council to confer with him if they have any problems or
questions regarding administration of City policies.
Harrison said Munson's fence would be restored.
^. Holleran inquired about the present power outage. Lightening had caused a surge
in the lines which caused the Fairbanks Morse generator to quit; the F.M. "man"
repaired and re -started it.
Harrison reported on his trip to Washington.saying he had never been afforded
such hospitality by any government department. Rep. Pollock had prepared the
ground so well, that many representatives not on the Committee knew what was
going on. His reception was far beyond his expectations. Bartlett had alerted
the BLM people; Harrison had prepared a thick brochure with 14 pages of colored
pictures; the map showing the proposed right of way for the new highway cut-
ting right through the Health Dept. Site seemed to make the best improession.
The Capital improvements Plan and Bond Brochure was also in the package. The
hearing was very formal, and all business. Sec., ball had to leave before the
time for the hearing on Kenai's item; Aspinall from Colorado chaired the meet-
ing; Pollock made an impressive opening speech; a representative from the
Bureau of the Budget was also present; (a telegram was received today compliment-
ing Mr. Harrison on his presentation.)
Then - to the Senate sub-committe the next day for their hearing; this
was even more formal; chaired by gruening; the presentation was well received
and all members were very interested in Alaska.
The City will get copies of the minutes of the meeting. After passage of
the bill by the House and Senate, the City will move the building.
Harrison also talked with the Corps of Engineers and EDA offices. The City
can apply for EDA funds before the Borough's Plans are completed, but not for
HUD funds; EDA does not have any money for Water and Sewer Projects.
Harrison concluded that Alaska is held in very high regard by most of the
people he was in contact with.
A letter from Pollock was also received complimenting the City on Harrison's
presentation.

SUBJECT: C.A.P. Building Inspection
I have chocked the attached punch list item for item,
some I could not agree with, others I do.
As for the building and its present condition, the
components to produce an acceptable structure exists
The building must be re -aligned and plumbed. The
stay braces tensioned with winter temperatures taken
Into consideration, all bolts and turnbuckles checked
and treated with a rust inhibitor and washers applied
as needed.
In the office portion of the hangar the workmanship is
deplorable, it is recasmiended that the doors be removed
and out down approximately 2" and all the objectionable
floor sections removed. Additional work on the windows
is required.
It is recommended that the existing concrete under the
hangar doors be removede A section that has failed shows
reinforcing steel had not been placed. This should be
poured 4" bIgher to match the elevation of the outer
perimeter fbotirig walls. This should allow sufficient
fall and the floor drain in the hangar can be installed
as originally planned.
It is further recommended that only werienced structural
steel crew be allowed to accomp s re -alignment and
plumbing the structure.
There should be no extra cost with any of the above
work because all of these items should have been done
to complete the structure as originally intended.
