Receive report on status of lands for proposed shopping center on the Kenai Municipal Airport Lands. -N IM KENAI CITY COUNCIL %fNUCUS - SPECIAL N1l:UING 2 MAY, 1967 TO IU AR PRESENTATIUV OF CITY C(NERCE C0141ORNfION FOR UEVELOP,MW PLAN Roll call: Members present - Bob Bielefeld, Chester Cone, Roger Meeks, Gene Morin, Carl Seaman and Mayor James G. Dye; Members absent - Bud Lofstedt. Also present, Planning Comnission Members: Ruby Coyle, Bob Norene, Bob Hol- loran, Jim Wilder, Jim Hornaday and ex-officio member Gene Morin. City Manager Harrison introduced Mr. Joe Costa, Manager, City Commerce Corp., and Miss Kelly Martin. 1. Mr. Costa submitted designs and plats showing the proposed development his Corp. has in mind for Blocks 6,.14,ldnd•a,porti-on of-16, Original Townsite, Kenai. Since he has not been able to acquire all lots necessary for the complete development, he proposes to first construct a 100 unit apartment building on lots overlooking the Bluff in B1. 14, and a part of the shopping center in Bl. 16. Total cost, $2,580 000. He also asked for the City to vacate parts of Alaska Ave., the Municipal Reserve and Highland Way. Costa will also need a Quit Claim deed for the City's interests in property _ formerly belonging to Barney Dawson. The third request from Costa was for approval of sale of the City's Lot 3, B1. 6, O.T. formerly the Federal Jail property. Council declared,a recess -while Planning -Commission met to discuss this proposal as City procedure requires a recommendation from them on development. Reconvening at the close of Planning C wdssion's meeting, Council: 1. Considered sale of Lot 3, Bl. 6 for $12 000 - $2,000 earnest money, bal. within 60 days. Council was concerned about the timing as another party also wants this lot, and if City Commerce decided not to take it, a good part of the construction season would already be lost. Council was also concerned about the development policy, set by them, at the time of first notice of sale of the lot, in that it leaves three years for actual completion of a project. Costa said construction would start within 60 days, and pointed out it was to their best interest to get the project going and completed, as their costs are excessive and they need to get it into a revenue -producing shape. The Planning Commission:r4commended: 1. L. % B1. 69 O.T. be sold on the terms mentioned. 2. Alaska Ave. and Municipal Reserve be vacated according to the Plan with the City's reserving the drainage ditch already there. 3. the Dawson prop- erty be Quit claimed to C.C.C. if Dawson is satisfied and the City's taxes, penalty Literest and foreclosure costs are paid. 4. Highland Way be vacated according to the laws and ordinances of the City. Morin moved, Cone seconded, to sell L. 39 Bl. 6, O.T. to City Commerce Corp. for $2,000 dawn and balance in 60 days or as soon as documents are prepared and approved by both parties, whichever comes sonnor. Motion carried unanimously by roll call vote. 2. After some discussion, Morin moved, Meeks seconded, the City, after proper public - - hearings should vacate that portion of Alaska Way and the Municipal Reserve shown on the Plat, but reserving the necessary easements for drainage, provided that proper dedication of additional street width for the widening of streets abutting all City Commerce preperty be exchanged at no cost. Motion carried unanimously by roll call. 3. Cone moved, Morin seconded, since a quit claim deed has been signed by Barney Dawson to C.C.C., the City shall quit claim its interest in Lot 4, B1. 6 to C.C.C. on payment of All delinquent taxes, penalty, interest and foreclosure costs. Seaman moved Morin seconded to vacate a option of Highland Way after proper � � P B Y p PeT public hearing and in exchange of easements to widen streets abutting C.C.C. prop- erty in Bl. 169 O.T. Motion carried unanimously by roll call vote. Harrison announced plans for the shopping center in Etolin S/D arc coming along. FAA will not consent to sale of the land, but a long-term lease can be arranged. so Gravel and Carr are re -negotiating their financing on this basis. Also CAP has signified a willingness to work out an acceptable agreement. The Engineers are preparing the paper work for realease of this land from F.A.A. restrictions along with the 37 acres at Beaver Loop -Kenai Spur Junction, plus other parcels for which the City has had development plans presented. No work has been done with the Dept. of Health yet re moving the Health Center as we first need to know if the FAA land can be had. Mr. Taft cannot be here tomorrow night for the executive session with Council re a gas distribution system. Speakers from the floor during this session were: John Hulien and Ruby Coyle. The Plat referred to accompanies these minutes.
