This Ordinance will be refined and made a part of the Code, but time does not permit such action now. He recommends its passage. Harrison presented Ord. #123 and recommonded its approval. liulien moved, Cone seconded, to create an emergency regarding Ord. 123. Motion carried unanimously by roll call veto. McCann moved, McCollum seconded, to adopt Ord. M123, Establishing Regulations for Drilling oil or gas wells and Declaring an emergency. Vice Mayor opened the meeting for public discussion; there being none, roll call vote passed the Motion unanimously, 2. Atty. Fisher said closing papers will be executed at Alaska Tittle Office; City needs to sign the deed and contract of sale of the lloalth Center Site. Council agreed Alaska Title be authorized to receive the check in the name of the City for disbursement later. With consont of Council, Item 3 was added to the agenda: Harrison explained the action needed. Bielefeld moved, Ilulien seconded, to accept the assignment of lease of Lot 4, 81. 2 and Lot 1. 81. S, CIIAP from Sinclair to Carver. Motion carried unanimously. 'later short reeeas,.Couricil met at 11:00 A.M. with City Commerce people. Harrison briefly explained the background on relations between the C4ty and City Commerce. .Toe Costa said he was sorry they had not kept the City better informed as to their trans- actions; they had enlarged their plan for apartment house from 100 to 171 units - 32 of which are to be built immediately. He introduced the members of the Board of City Commerce Corporation: Mrs. Brideen Crawford, Chairman Thomas Wharton, Lawrence Schachle, Richard Kennard Edward M1cElligott and Von Baxter. Vice Mayor Soaman introduced members of Council and Cfty personnel. ► Council discussed hazards of selling the old Fed. Jail Lot without assurances the building plans would be completed. Mrs. Crawford is personally going to build the first phase of the development; i.e. the 32 unit apartment bldg. parking area ratio -now is 1.1 1/2; if they put in .drainage on the former municipal reserve portion, the ration wil increase .2%. They have spent $47,000 on plans already. After considerable discussion, Cone moved, McCann seconded, to rescind action on Lot 3, B1. 6, Original Townsite and =-consider sale to City Commerce Corporation. Motion passed unanimously by roll call vote. Following more discussion, Bielefeld moved, McCollum seconded, to authorize the sale of L. 39 B1. 6, O.T., to City Commerce,to be hold in escrow until the 32 unit apartment bldg. is started, which shall be within 15 days, and that substantial construction shall continue until the building is completed and ready for occupancy. Motion carried man- imously by roll call vote. Cone moved, Bielefeld seconded, to authorize the legal closing of Alaska Ave. be- tween Lots 3 $ 49 B1. 6 and Lots 192,39 Bl. 149 O.T., but do not close it physically until construction impairs the use of it. Motion carried unanimously by roll call vote. Costs aays they still have a problem getting one parcel for the shopping center; dl:.o Safeway hesitates to coma into Kenai before there is more competition -they do not want to violate the Fed. law an monopolies. I Each party expressed appreciation for the others efforts; it is hoped better com- munications will exist in future developments; City Commerce was invited to the ground breaking ceremony for Etolin S/D and vice versa for ceremonies of City Commerce. The Press was present to take pictures.
