Dye; Niambers absent - Roper Meeks and Carl Seaman. Also present: City Nlgr..James IV. Harrison; Planninq Comm. members lbtby Coyle and Catherine Malone; and City Atty. James 1.. fisher. 'rho latest draft of the Union Oil4larathon Gas Agreement for sale of gas to the City was reviewed by the City hlgr. A letter from Eugene P. Griffin, NIRr. Gas Sales F Development, Union Oil, cleared up the point most unacceptable to the City --that of confining the City to its City Limits for gas distribution, It was the City's position that Union -Marathon should not concern themselves with the City's service area, from the Atty. A memo on the Agreement/was studied and is included in these minutes. This latest draft pretty well followed the suggestions of the Council for cor- rections and amendments, etc. The Atty, recommended the City should notify U-M they approved of this draft and to forward the signed copy of the contract along with the r-o-w agreement and the $109000.00 payment for execution by the City. Morin moved, ,j\icCann seconded, to approve the "Gas Sales Agreement" of Union - Marathon dated 17 December, 1965. Motion carried unanimously. The Proposed Five Year Capital Improvement Program was presented for Council con- sidoration. Mrs. Ruby Coyle, Chairman of thePlannina Commission read their recom- mendations for the Plan and these are included in the minutes. Harrison corrected some of the estimates for construction costs, and explained different items. The principal point to be emphasized is that this program is subject to change at every budget time, and does not bind the City to a strict schedule of projects. After considerable discussion Cone moved, Morin seconded, to accept the pro- posed Capital Improvements Program (5 Years) and submit it to HIiNA. Roll call vote passed the motion unanimously. Harrison presented the application for permit for Games of Chance and Skill for the Holy Assumption Orthodox Church for 1966. Morin moved, McCann seconded, to approve the application. Carried unanimous. Leo Oberts talked with Council regarding a real estate agent handling the land sales and leases for the Industrial Air Park, lie was concerned About -the defini- tion of "light" and "heavy" industry. Harrison will get ASIIA's opinion on this. Oberts said in the event his company is hired by the City he would work with any other real estate agency; fees would be the common charges for like services; he will get a schedule of fees and present them to Council if they wish. Even if he is agent, the City or State could still work on sales and leases of their own accord. It was the opinion of Council the leases agreements would be at the direction of Council, also sale of lots; the Agent would draft the documents to Council specifications, etc. ! Harrison reported on the Norough meeting he attended at Clam 0-11ch 11 Jan. lie was afforded every courtesy by President Williams and !given a chance to be heard on issue affecting the City, and often was asked for an opinion on other matters be- fore the Assembly. This was appreciated as our own representative, Mayor Dye, was - unable to be present. The Assembly passed its ordinance amending the Sales Tax ordinance. Tab City will now he required to collect sales taxes on all utility i y services. The Horo will collect delinquent taxes for Seward, llomer and Seldovia, but will allow Kenai to handle its own tt 14464 Nee title for foreclosed property should go to the City's but monies due each entity will have to he allocated for delinquent taxes from 1965, when the properties are sold. The Horo chairman said it would he arranged that titles would ! go to the Cities to whom taxes were due. The Assembly strongly objected to the State's handling of a tax incentive for Union -;Marathon. The F3oro had recommended a 50% incentive whereas the State i Minutos, Specia.L Meeting 12 Jan 66 page two granted a S mill levy for ten years on real property only. It was the Boro's position they should not have had to endure the agony, uncertainty, and discord to resolve such an issue of the State was gaing to ignore its action. A resolu- tion was drafted by the Bore Atty. requesting more cooperation, coordination, continuity and conversation between the two entities, and was passed unanimously. Harrison took issue with the Chairman's statement that the Boro would have to implement the schools' share of the tax that is reduced by a tax incentive pro- gram, since he had been told at the Atty. Gen.'s office in .Juneau that this was not the case. Anything excluded by a tax incentive would not have that evaluation included in the base for figuring taxes forschools. Regarding the docks in the Inlet: Harrison said it would be appreciated if the Boro would take a neutral stand, offering neither support nor objection to the various applications for docking facilities. The Assembly once more requested Pomeroy's letter to the eM be withdrawn from its file as it did not reflect the opinion of the Assemblyy, and that another letter be written stating the Bore's prime concern that there be no curtailment of air service to the Peninsula, and that they did not favor one airline over an- other. Council authorized the City Mgr, to get best rate of interest for loan application to pay Adams-Corthell-Lee statement. Money is expected from FAA for this, but it will not be received for about two months or longer. The Attorney reported: Most of his time has been occupied with preparation for the CAB hearing on the Cordova ruling --said hearing to he in ANchorage 1 Feb., 166. The Washington atty's. fee is only $1238; this is most reasonable, considering the immense amount of work involved. Fisher says the City will have witnesses - possibly Gene Roguszka, etc; there was some discussion as to remuneration for said witnesses. The City of tiomer has not entered the case, but the City of Soldotna and Greater Soldotna Chamber of. Commerce has. North Kenai has offered to assist if needed. Fisher mentioned the nominations for Awards to be made by the Chamber. This was in last week's minutes. In addition, regarding the change in City Govn't. from Mayor -Council to City Mgr. -Council, he said the Mayor had the greatest adjustment to make. Mayor Dye expressed the sentiment of all in congratulating Fisher for coming out of the homy. accident with minor injuries. Tentative plans for a Kenai Municipal park which would cover all phases of recre3tioii and is a most worthy ;project. The paanning Commission approvers of these tent?tive plans most heartily. There was not too much discurssion on the Youth Center, ilhich if it is done will be done through force account work and a pentle aosist from Housing and Home Finance. The City -Hall and Library program is not i.^minent and so was not discussed in detail. The next item of discussion ums the Industr-tal ;.ir Park. This is a proposed sub -divi- sion of part of the Airport lands in close proximity to the proposod Terminal Bldg., . ADDENDUM: The Planning commision at q later meeting on We-inesday the 12th of January at 7:30PM at the, City Hall questioned a railroad Shur from VP dock to the Air Par. In the interest of good planning, it is the consensus of the Commission that railroad or spur crossings should not he permitted on the highway. V • Rif
