Should this happen, it might be possible to hold the increase in tax levy to 3 mills.
'rho City Administration will do everything possible to "held the lino" in exoonsos,
but demands from the citizenry for sorvices can chango this picture in a hurry.
Utilities are not so critical as they operate an revenues. Materials are Rot-
ting scarce; copper is not available without waiting months; aluminum wiring can ho
used. Por this reason, the City will negotiate with IiBA for as much - equipment as
possible.
Councilman Lofstedt joined Council during this period.
The City has arranged to buy the Buroughs Office machines for $2,000; now they would
cost between 10 and 12 thousand dollars.
The City is also entering into a now classificnti.on of accounts; this is the
system used all over the country In Municipal accounting.
Mr. Halloran of NBA will be gone for two weeks and has requested the City wait
until his return to place City accounts between the two local banks.
Harrison presented Res. 066-4 accepting the amended budget for 65-66. Meeks
moved, McCann seconded, to adopt Res. #66-4. Roll call veto passed the motion unanim...
With consent of Council, Harrison added another atom to the Agenda: 'rho City staff
has been working around the clock to organize a presentation to BOA for application
for a grant for the Industrial Park. Said presentation will be hand -carried to Mr.
Tom Bischol Friday as it must be in Washington right away. A resolution requesting funds
must accompany the application; the grant would amount to about $263,000,
McCann moved, Meeks seconded, to adopt Res. #66-5 applying for $263,000 grant
for Industrial Air Park. Roll call vote passed the motion unanimously.

Audience: Don Railoy, and Mr. and Mrs. Loren Whittington
Harrison opened the meeting at 2:00 p.m. and reviewed the conditions
of sale as per attached notice.
He called for bids at the minimum acceptable price of $140000, Having
called for a bid three times, and receiving no bid, the auction was
closed.
This lot is now available for over-the-counter sale at any time.

CONDITIONS APPL10ABLE TO SALE OF LCT 19 PROPOSED
ALEYESKA SUBDIVISION, PAST Y , CITY OF KENAIp ALASKA
1. The City of Kenai is the owner of that tract of land in Soo.
5, T-5N., R. 11W. of S.M., Nanal, City, Alaska, lying North of
Kenai Spur highway ani d6scri►sod as followss "From the inter-
section of the center -.'.. ins of Kenai Airport Access Rosd with
the Northerly right-of-way of Kenai Spur highway, running N.50-
331-1511 W, along said center -line for 200 feet; thence 8.84°-
261-4511W. for 50 feet to the point of beginning; thence S.84°-
20-4511W. for 150 foot; thence s.5°-33c-19st E. parallel to
said Access Road for 150 feet; thence 11-84-261-451 s E. for 150
feet to the Westerly right -of -.way of said Access Road; thence
N-5-331-1511 W. along said Westerly right-of-way for 150 feet
to the Point of Beginning.#' This tract is part of a fifty
acre tract for which the rederal Aviation Agency, pursuant to
Public Law 81-311 (63 State 700), has issued a Deed of Release
from the terms and conditions of the Quitclaim Deed, dated
Deoember 1, 1963, from the federal Government to the City of
Kenai.
A condition of the Federal Aviation Agency Deed of Releaso re-
quires that if and when the property is sold, a complete des-
cription of the property will be publicly advertised and sold
to the highest bidder.
2. The instrument used to convey the above lot will expressly in-
clude the following reservations and covenants
A. There is hereby reserved to the City of Kenai, its successors
and Assigne, for the use and benefit of the public, a right
Of flight for the pass9ge of aircraft in the airspace above
the surface of the promises herein conveyed, to -other with
the right to cause in said airspace such noise as ma,,] ))a
Inherent in the operation of aircraft, now known or here-
after used for navigation of or flight in the air, using
said airspace or b nding at, taking off from, or operating
on the Kenai Airport;
Be The Grantee by accepting this conveyance expressly agrees
for itself, its heirs, representatives, successors, and
assigns that it will not permit the erection of any structure
or object, nor permit the growth of any tree on the land
conveyed hereunder which would be an airport obstruction
within the standards established under the Nderal Air Reg-
ulation Part 77, In the event the aforesaid covenant is
breached, the City of Kenai reserves the right to enter on
the land conveyed hereunder and to out the offending troop
all of which shall be at the expense of the grantee, or its
heirs, successors, or assigns.

C. The arante by accepting this conveya6e expressly agrees
for itself, its heirs, representatives, successors, and
assigns, that it will not make use of the said property in
any manner which might interfere with the landing and taking
off of aircraft from said Kenai Airport or otherwise con-
stitute an airport hazard. In the event the aforesaid
covenant is breached, the Grantor reserves the right to
enter on the 3a nd conveyed hereunder and cause the abatement
of such interference at the expense of the Grantee,
3. A public outcry sale will be had on Lot 1p "Aleyeska Subdivision"
City of Kenai, on January 26, 1966 at 2:00 P,M. AST at the City
Hall in the City of Kenai, Alaska.
4. The lot is generally described as 150 feet along the Spur High-
way and 3.50 feet along v illow `.street. The East boundary ooincides
with the right-of-way for the paved street (Willow Street) which
Is the road to the Terminal Area; the boundaries are clearly set
out on the plat filed according with platting requirements of the
City of Kenai.
5. Although the City of Kenai Zoning May may indicate that this lot
is subject only to a classification of "Unclassified Zone", the
sale of this lot is subject to the condition that uses permitted
are those as defined under Section 5, Business (B) Zone shall be
automatically voided and, thereafter, the lot shall be subject
to normal Zoning procedures.
6. The buyer agrees to commence development of the lot within two
(2) years of the completion of the sale. Commencement of devel-
opment shall consist of improvements (site pro oration and build-
ing construction of a substantial nature). Building shall be
completed within three (3) years.
?. The buyer will be required to hook-up to City water and sewer
systems at the time such services are required.
Be City electrical service and city water service are now available
adjacent to the lot. Hook-up to the City water main shall be at
the expense of the buyers construction shall meet City standards.
City sewer main is within 130 feet of the lot line. The buyer
has the full obligation for extension of the water and sewer
lines from the mains abutting the property line to his building.
9. Water and sewer extensions will lra made by the City of Kenai to
the property line of Lot 1, "Aleyeska Subdivision", City of Kenai.
10. The purchase price of the lot shall be all-inclusive of water and
sewer assessments.
j 11. The minimum acceptable price of. Lot 1 is $14,000.00. Ten per
cent (10%) of the bid price shall be payable at the close of
biddin the balance of the bid price shall be payable within
time o
sixty RO) days of the f sale. This lot is offered for
sale on an "as is, where is basis", as this is an unimproved lot.
12. Bidders are advised to familiarize themselves with these conditions
the subdivision map, City Zoning Ordinances and site conditions.

Harrison announced to the audience two tologrnms had boon received as addenda to the
bids, and they would he included in the reading of the bids on construction of the
Airport Terminal Building.
The Bids were given to the Mgr, by the City Clerk and were as follows:

A copy of tabulation of bids with alternates accompanies these minutes.
Determination of low bidder will be on next week's Council Mooting Agenda; a
tentative award will be made for approvalbp the Housing and Home Finance Agency,
Agenda Ttem #2: There were no bidders on Lot 1, Aloyeska S/D at the audtion this aft-
ernoon, so this lot is now available for over-the-counter sale. The minimum price on
Lot 1 is $14,000.
Item N3: The City Atty. briefly reviewed tostimonv to be submitted to the CAB hear-
ing on the "Cordova Case".
The issues before the CAB Bureau Council are: 1. Does traffic warrant renewal
of a Certificate for Cordova Airline: 2. If so, how long should the route be? And
under what conditiona? 3. Are they eligible for subsidy?
After this application was made, thoncbrdova filed a petition to suspend PNA's
service to Kenai, Yakutat and Cordova --later, the last two were struck. This action
was what brought Kenai into the case; petition would affect the turn -around at Ilomer,toc
The City's position will be to: 1. Show why Kenai should be an Area Airport;
2. Distances between towns; 3. Map showing off -shorn oil activity and pointing out
that Kenai is in a location to best servo these activities.
Witness for the City are: City Manager, Mayor, Airport Sunt., Councilman Sea-
man, Airport Consultant Goruszka, PNA Agent Joanna Iiolltor; ASIiA Planner, Tom Smythe;
and Jay Lietzke. The latter's letter was read urging, that exhibits accepted in the
rase should not be of a promotional nature.
Witnesses will not be called on to testify unless under cross -examination --the
Atty, thinks this is unlikely, but cannot be sure.
The accident frequency will be touched on in Seaman's deposition, and could be
extended on; Normally airlines do not relish talking "accident records"; the City's
position is the desire to protect its citizens.
PNA to concentrating its case on economics: 100t of the traffic out of Kenai
goes Outside; 5$ is long -haul, i.e., Cordova, Kodiak, Fairbanks, etc. These two
factors puts PNA in the black and eliminates any need for a subsidy.
The City Mgr, will be in Anchorage all next week to attend these hearings; $io
will be back for Council meeting, but there will, of necessity, be a very short Agenda.
Item 04: Review of the Budget: One of the principal changes was to re-classify
Council's budget; i.e. Civil Defense, Nat'l. Guard, etc. remain in their category, but
other activities have boon placed in more related classes.
The revenues on the June budget showed $157,550--a review of estimated revenues
brings this figure to $170,193. Expenditures are extimated to amount to $140,976 at
the and of June. If this is true, the City could end with a surplus of $29,217.
