KENAI CITY COUNCIL NINUTG! 6 1PPIL 1966 Roll call: Members present-CALlster Conu, Billy McCnna,koger Meeks, Gunc Morin, f-41yur -1. G. Dye; Hembern absent - Bud Lofntedt and Carl Feaman. Also present: City Manager James W. Harrison, City Attorney James K. Fisher, Planning Commission members Ruby Coyle and Catherine Malone. Mr. Odin Strandberg, CUL mgr. reported on arrival and installation of the new unit. the 60 day delay turned out to be 5 months, but it is in place now and things are in pretty Rood shape. Ile invites Council to come and see the plant and requests a con- sultation relating to power needs for the future* lie estimates another 5000 watt turbine gill be required, but substantial data must be furnished for the financing. Council will meet with him and tour the facilities 5:00 p.m. 15 April. Strandberg estimates it would take 9 months to yet another turbine. Minutes of the 16 March meeting were approved. Minutes of the 23 March meeting, were corrected and approved. -� Minutes of the 25 March meeting were corrected and approved. The City Manager reported: 1. Letter from Councilman Seaman, in Texas, says he has undergone an operation and requests City data be sent to him there as he is not sure how long he will be gone. Council will send flowers. 2. J. Be Warrack has extended his contract for another 15 days to allow HUD to get approval and paperwork done. Alaska State )lank has wired IiUD they are satisfied regarding the 3 conditions they had -in then letter of proposal regarding interim financing. Bunnell will furnish certificate re bid documentsgi also, he will expedite State Dept, of Health's approval of water 6 sewer facilities at the Terminal Bldg. The Atty's. certificate will be mailed tomorrow. All these things should put us over the hump; the City knows of no other requirement that has not been met. 3. Airport funding for an extension of the airstrip hinges on passage of the State Bonding bill which has passed the House and is now in the Senate; although it's not a line item, Kenai hopes to get between 140 and 150 thousand from this. 4. Letters to Thorgrimson and Meyer. were sent apprising them of the City's hope to issue revenue bonds for acquisition of HEA facilities. The bond market is very poor now, but another few weeks may see a change for the better. 5. The Kenai Volunteer Fire Dept. has signed a mutual aid agreement with Wildwood to help each other out in case of fires. Jurisdiction depends on location of the fire* The Atty. suggested the insurance should be reviewed for the City's protection. 6. Letter from the Pacific Fire Rating Bureau says they will have a ratingp, for us in the very near futur--. 7. Sen. Bartlett keeps nudging the Corps of Engrs. re the City's small boat harbor; this is a separate project from the Anchorage package. It is hoped the median draft harbor.project can be divorced from the Anchorage plans also. 8. Letter from the State forester says there is $42,275 available for the City for Municipal Park. 9. The Weather Burueau says :it's not possible to get a station located in Kenai yet In a year or so, we will try again. 10. Letter from D. N. Boyer requests something; be done to preserve the Bluff by his hotel, and gives the City right of access to work on the project. Harrison will investigate. 11. Union Oil has sent $10,000 payment for Fas line r.o.w.--no documents, just money 12. Harrison has received permission from Anchorage ;Natural Gas to read report from Commonwealth Engineering Co. who did the feasibility study on Ras distribution for Anchorage prior to their installations of facilities. The City has applied for Council minutes 6 April b6 page two $4,000 for a similar study, and Commonwenith may be able to use gtrno of the game data for KenU as for Anchorage. larrison will write several firms for propoanls of cost of such a study. 13. Tomorrow is Student Government Day. Council is to meet at the school at 8:30 a.m. and their elected officials will return to City Hall and accompany their counter• parts in the day's routine. 14. Harrison met with Wildwood personnel and USPHS agents re sewerage in WW. They anticipate building a lagoon type of facility which will give them primary and secondary treatment of their waste materials through aerobic processes. 15. Letter from Can. Lynn, Alska Command, says they cannot consider pipeline from Kenai to the military in Anchorage --plans are already is the works for Whittier. 16. On 23 April, 2 p.m. the Army faun will be dedicated to the City on City grounds. 17. There will be a formal hearing on second reading of the new Zoning ordinance on 20 April. The City is publishing and posting notices around town. FAA will be specifically notified for requirements of aircraft approach zones, etc. 18. There has been phenominal interest in Kenai; land, buildings, apartments, etc. Inlet Mechanical, owners of the Anchorage L St. Apt. are interested in L.39 B1. 66 Original; Harrison met with Gottstein and Carr, owners of Redoubt Terrace Subdivi- sion, Sec. 6. He asked them to put in writing what thegrplans for development are, what they will want in the way of W&S, power, etc. Harrison will write a letter of thanks to the Washington Delegation concerning the raising of the $159000 limit on FHA mortgage insurance. 19. Harrison asked Allan Corthell to explain regarding funding of Float Plane Basin. Corky says FAA has approved and is holding funds for this project. Since the City will not be constructing run -way extension, there is no hope, this year, for build- ing the float plane basin. Corky recommends the City either proceed to build or drop it. Harrison recommends we release it and tell FAA we want to consolidate FPB with run -way extension. McCann moved, Morin seconded, the City drop Floar Plan Basin and incorporate it into run -way extension later. Passed unanimously. Re approach zone r.o.,v.--we need 10 acres from Stump who said he would be glad to work with the City in any way possible. 20. The City has received two more pieces of equipment from FAA: a digger truck and a sna-go. i There was discussion on site for reconstructing the Fort, and the old Fed. Jail ` property. The City had agreed the latter could be used for the site of Ft. Kenay, but now it appears Russian Gy urch property can be leased and used for this. The "Jail" property is not large enough anyway. The Church will grant a 20 year lease on land and the Parish House. The City will pay W&S assessments (annual payments for 5 years) at which time a review of Che•lease-agreement will be made. It will cost about $12,000 to make payments and renovate the building --this is to come from Centenniel money. The Centennial money to build the Ft. (Fed.) amounts to $94,000 and the City Is to contribute a like sum. Cone moved, Morin•seconoed, to rescind agreement to donate land to the Centen- niel Committee described as Lot 3, Block 60 original Twnsite, since they hope to build on Church land. Passed unanimously. — - There was discussion on policy regardtna, sale of land. i.e. sealed bids? auction? Negotiation? There are advantages and disadvantages any method. Morin moved, Meeks seconded, subject to conditions of quit claim deed, to make L. 3, Bl. 6, Orig. available for sale. Passed unanimously. Ruby Coyle says the Planning Commission recommends Overland Ave. be widened to 501, Morin moved, McCann seconded, L. 39 B1, 6, Orin. be appraised by 3 appraisers ' and it be sold at public outcry auction under terms and conditions to be set by Coun- cil. Passed unanimously by roll call vote. Harrison will work up terms and conditions for Council approval, and will get 3 appraisers from out of town, if possible. �.r Council Minutes 6 April 1966 Pnge three The Attorney reported: 1. Ile will thauk Legislators for change made on "Fannin 'Lae" financh-tv and for the work on Airport Bonding. 2. Said insurance should be checked closely with the Fire pept. working with Wildwoo 3. Requests executive session with Council to discuss W&S possible court case and HEA court case. 4. Letters to PSC must have done some good --the City is now netting advance notices of hearings that pertain to the City. 5. Trans -Alaska has requested a wide degree of authority in the City; Harrison will talk with them. There is to be a meeting of HUA, CEA, MVA in Anchorage. Kenai should at least sit in, and observe. Subject is to be consolidation with Tyonek for cheap power. Kenai has the lowest power in Alaska, and it. W. Beck suggested a study for furnishing power to Anchorage, and even Fairbanks, but this would necessitate a large bonding program to buy generation, etc. 6. Peninsula Enterprises has finally sent a check for past three quarters due on airport land lease; They do not want the lease re -written; the City doesn't want to continue to maintain the airstrip giving aircraft acce4s to the site; Harrison asked Council to authorize the Atty. to negotiate to release the City from this re- quirement. No action was taken. 7. Re PNA-CAB case (Cordova) the Carriers will file their breifs first. The Mayor reported: 1. Meeting with Don Wilcox revealed there would be no semi. -final payment to the City until progress is shown on securing approach -zone r.'s-of-way, and the berms at the ends of the run -way are cleaned up. Wilcox also said there had been no letter asking release of ground for the Industrial air park, and the City was advertising lots for lease there. Harrison said he and Corthell talked with FAA's Kempton and he had said they would go along with this plan. Corky is getting the applicattons ready now along with the subdivision plat, etc. Council had to authorize this before we could go ahead. Advertising was done now, so interested parties would know land was avail- able here and would not 'look elsewhere. The City has nothing in writing, nor has it been told, these rights -of -way must be had before semi-final payment was made. Never in the negotiations for semi-final audit have these been mentioned. The delay in getting the Raluga S/D Plat has held up any negotiation for exchange of land for rights -of -way. Just to- night the Raluga S/D Plat is to be presented to Council. Harrison will meet with them neat week to determine just what they want. Item F-It Harrison read letter from Roguszka and Cortholl, developers of the pro- posed Motel, and the Plat was inspected by Council. They first asked for land in Aleyeska lil; now they are applying for the parcel East of Lake St. and West of the gully --airport lands, on So* side of Kenai Spur., amounting., to 2.2 acres. This is a long-range project, and they would like a lease with a ten yr. option to purchase. They would protect, as much as possible, any barabaras that might be in the area -- in fact, their presence would enhance the attraction of their facility. Trouble is, this same property was wanted by the Assembly of God Church. There was considerable discussion as to who should have the land; how it should be disposed of; sold? leased? etc. McCann moved, Morin seconded, the City should ask FAA for a deed of release for the entire parcel so. of the Kenni Spur.. Motion passed unanimously. Cone moved, Morin seconded, to put up for lease or purchase a parcel East of. Item F-2s The City Ml;r. will work lease rates out with FAA with consent of Council. Item F•-3t Morin moved, Cone seconded to approve Ran. 66-15, lialufta s/1). Motion passed unanimously. This Plat will. he nubmitted to CAA for approval also. Item.F-4s Morin moved, Meeks seconded, to approve Res. #66-16, Ueyeska S/D #1. Passed unanimously. Item C-5t A public hearing was held, attended by 15 interested parties, on new airport rules and regulations. The City 11rr. presented Res. #66-99 which is the result of this public hearing. McCann moved, Morin seconded, to approve Ras.66-9, regulations regarding airport policies. Notion passed unanimously. Item G-18 The Atty. will draft and ordinance regarding sale of ftreworlcs in the City. The Fire Dept* wishes to ban these sales. Item G-2s The Atty, ruled Sec. 20-14 requires a public hearing be held when�a taxicab company applies for permission to have more than one cab. This will be set up by the Administration. Council expressed agreement for Northway Cal, having a second car, but the formality of a hearing must be observed. Item H-It Mr. Herrick "Al" Poore addressed Councils lie had presented a prelimin- ary plat to Planning Commission for a trailer court on 2 acres of land. The new ordiance (in limbo, now) ,requires 6 acres. McCann moved$ Cone seconded, to grant a variance to Al Poore to have a trailer court on 2 acres instead of 6. Passed unanimously. i Res. #66-17 was read by the Mayor. McCann moved, Morin seconded, to approve Res. 66-179 Authorizing the City Mgr, to apply for funds for Small Aircraft Apron development. Passed unanimously. The Mayor continued his reports 1. Says a new committee on EDA must be formed. 2. Read two telegrams to Legislature he sents (a)regarding municipally owned air- ports sharing appropriations with state-owned airports, (b) requested public hearings on UB 151 before Legislative action. 3. Said City should request the Coast Guard to install permanent buoys in River Mouth. 4. There isn't much happening in the dock area --hopes to generate some traffic here. 5. Says HUD advises the City should go the cheapest route re interim financing. 6. Next Boro meeting is 19 April. in response to suggestion from the audience, he will inquire about an audit report to the Assembly. Council adjourned for 15 mine for executive session. Reconvening, Council decided the City would stay in the law suit with 1117,A in order to get a judicial determination on jurisdiction of our own utilities in our City Limits. A letter will notify HLA of this decision, with the understanding; they do not press for damages. Reduction in rates will depend on the commercial load.
