Homer Swires and Mayor Dye; Absent - Roger Meeks.
Odin Strandberg reported the new generator from Chicano Pneumatic had scored a
piston and he was carrying the City's load on the two old generators. The Chief
Designer from the factory is here now working on reppirs. +tiildwood is on its own
generation at present. One cause of the major breakdown was inability to double
check the motor before being nut into operation last Fall. The City's load is
peaking about 870 now, and Strandberg expects next winter's load to be about 2600.
He has ordered a new unit which should be here by next Aovember. Cl1L made ap-
plication for Public Service Area with P.S.C. prior to 31 Dec. 162. There has
been no meeting to date with H.E.A. on inter -ties, but Strandberg hopes to get
together with them soon. ;?)
Harold Galliett recommends the City remain firm in opposing P.S.C. jurisdiction;
he suggests letters from citizens stating their preference for City owned power
might help. The possibility of a public hearing, was discussed. Council will
meet with Strandberg and Clay Lyons hnd City Atty. Thursday 11 Feb. at 7 p.m.
to discuss the _City's public service area and policy to adopt re P.S.C., etc.
Harold Jackson, Harry Riding and Tom Suthard appeared before Council, represent-
ing a group of creditors of CauRhran Excavatinp,, Inc. They were interested in
learning what guarantee there was for payment of the Contractor's obligations.
The payment bond covers 500 of the total cost of the project. The payment bond
money plus money yet due from HHFA and USPHS is more than enough to pay off the
creditors, according to Galliett. The grant money will not be forthcoming until
the job is accepted and all obligations are paid. The systems are 99.5% complete,
and there is $126,36S yet due from the Federal Agencies. City Atty. Fisher says
there might be some legal problems involving subcontractors, materials men and
subs to the subs, and recommends obtaining legal advise as each creditor has a
different situation.
The City has not withheld any money on the job; quite the reverse as over $14,000
has been spent from the General Fund in an effort to get the contract finished.
Gaines and Riley were engaged by the City to determine the payables due . This
list will be turned over to the bonding companies; also HHFA and USPHS will con-
tract for an audit to be made. Clerk will contact Gaines re this.
Ed Evans stated Mrs. Caughran had arranged for payment to be made to tho Internal
Revenue Service for withholding taxes due. She is exerting every effort for all
creditors to be paid. He and Galliett will meet tomorrow for a final accounting.
Galliett will get water samples Friday for testing with the Health Dept. In case
of defects in the systems --if the problem is on private property it is the owner's
responsibility --otherwise the City is lis:;le for repairs.
Minutes of the last meeting were approved.
�I Correspondence was discussed: Letter from Doyle tabled until after 10 p.m. when
he can be present; Fisher will contact the Japanese delegation re location of
i� lumber mills as a follow up of information furnished by Roguszka; Janet McCabe
requests meeting with Planning Commission on 15 Feb. and will report to Council
on 17th; Letter from Anchorage City Clerk states there are three known law
- firms in Anchorage affiliated with nationally known bond counsellors. They are
Ely, Guess, Rudd and Havelock associated with Roberts, Shefelman, Laurence, Gay
and [loch of Seattle, and Caldwell, T imbie and Mitchell of New York City. The
-- - Anchorage fires of Hughes, Thorsness and Lowe and Butcher, Riss and Atkinson are
also associated with like firms. Atty. Fisher recommends staying with Preston,
Thorgrimson, Horowitz, Starin and Ellis as the City has worked harmoniously with
them on the three bonding issues we have had, and each is mutually understanding
of the other.

Statement from Seattle Trust & Savings Bank interest due on W&S Bonds in the
amount of $3,818.76. Bond Redemption Fund has $10,000. This payment can be met
easily--Septembe$s payment will be almost $14,000 and that will be the one to
worry about. Request for payment from the School in the amount of $19,174.25
was tabled until next week.
There was considerable discussion on Borroughs, sales tax, public service areas,
etc. Speakers from the floor were Ruby Coyle and Harold Jackson.
The Atty. says the City's application for public service area with map will be
mailed Sat. to get to Anchorage for the deadline Monday. Clerk will notify
Strandberg of the meeting Thursday at 7 p.m.
Ordinance #79 Authorizing a Charter Change and Calling for Election was "resented
by the Mayor. This change will enable the City to transfer school bond payments
to the Boro in a legal manner. The Mayor also wants to change Council meeting
times to twice monthly. The Clerk will obtain the services of three judges and
three clerks. Swires moved, Morin seconded, to Accept Ord. #79 for first reading.
Motion passed unanimously by roll call vote.
There was considerable discussion re inviting Legislators to talk with Council;
money due the airport from the State; installment purchases; loans; ownership
of Civil Defense equipment; insurance ratings by Pacific Fire Underwriters;
i fire fighting and ambulance service policies.
McCann moved, Cone seconded,the Mayor proclaim next Wednesday 17 Feb as Jim
Evenson Day as a small acknowledgment of the dedicated work he has done with the
local basketball team. Kenai is tied with Fairbanks for first place in the State
Championship --for this district. (?)
Jim Doyle was heard on his request to install two 16,000 gal. storage tanks in
a residential area. One tank is for diesel and one for stove oil. The Planning
Commission recommended approval if the neighbors concurred. Doyle and Council
talked over the requirements of the Fire Code which also calls for approval of
the Fire Chief. Cone moved, Morin seconded, if he complies with the Fire Code,
Doyle be allowed to install 2 16,000 gal. tanks for stove oil and diesel for a
period of two years. Motion passed with McCann dissenting. Council says this
can be re -negotiated after two years.
Clerk will try to get a schedule of payments and anticipated revenues to Council.
Doris Swires announced the Governor's Centenniel Committee will have some members
visiting in Kenai on 12 and 13 Feb. There will be a dinner at Inlet Cafe at
12:30 on Sat. 13th. Council is urged to attend.
1 Clerk reported Sen. Kilcher is now a member of the Committee on Highways and Public
Works, a Sub -committee of the Senate Finance Comn. He has publicly stated he will
do his utmost to obtain the remainder of the funds for the airport which were com-
mitted by the State, but not enacted on. Mrs. Petersen had requested Ruth
Grueninger be appointed as a member of the Kenai Centenniel Committee --done with
consent of Council.
Council will rule on hiring of Deputy Clerk at Thursday night's meeting.
The balance of the Order of business was postponed until next week.
