Atty's. letter to Cov. Egan re IiB 138 is in circulating File; Coun-
cil is supposed to say whether or not it should be delivered to the Governor.
Letter from BLM re Lot S, B1 8, Original (by the grade School); says
this lot is held in reserve for school purposes. In order for the City to
acquire it, we either 1. buy it at public sale or, 2. aoply thru RF,PP Act.
.They prefer we go public sale rte., but want the City to decide which way???
City's :cater to Corps of Enters. orompted a letter from them to
Gall£ett re erosion on the bank in the event a gas line goes thru the City --
Letter is in circulating file.
rLetter in Circ. File from Farnen suggesting a meeting be set up to
arrive at a "mutually acceptable solution" to our problems. Lyons will meet
with HEA personnel on Tuesdwk 6 April.
Letter from Bureau of Indian Affairs re trapping wild animals; they
want to know if the City has any comment or recommendation --Morin is contactinf
Brian Johansen, and thot Lofstedt might have some interest, since he hauls
trappers.
Copy of Boro's estimate of real and personal property for the entire
Peninsula is in circ. File; also estimate on revenue from 3% sales tax, Bus-
iness license refunds, etc. Cost of schools, etc. can get a tentative est-
imate of the Boro levy from this??? Need estimate of costs far Boro admini-
stration to be very accurate.
Pictures in Circ. File of water in the sts., Dtommsen S/D, Beaver Lp.
Rd., Birch Dr., --also a picture of Doyle's tanks by Coveyou's--he has not
erected the fence he said he would ---????

Clerk - Have found correspondence in the Files says "the City Council will
definitely take over mtce. of the streets [in Mommsen Adds. 1 $ 2] after they
are paved". This should settle THAT questi-n. Also letter to Gagnon, FHA,
saying the City would assume surface drainage at such time as Killen's system
can no longer handle it, IF the roads are approved by FIIA.
Have closed the books for March. Will provide figures for budgeting
as soon as possible. Will get copies to all Councilmen, along with copies of
Budgts for each department so you can study them prior to Council Budget
sessions. Incidentally, we have $900 in the Ceneral Fund. Needless to say,
we cannot take on any street work, graveling, etc. There will be some sales
tax coming in which should take care of personnel and payment of monthly bills.
Had a reply from Daigle, Ketchikan City Mgr. requesting more informa
tion re City's government, population, etc. Ilis letter implies he is asking
in the event he can refer someone else to us. ???

Roll call: Members present - Chester Cone, Bud Lofstedt, Billy McCann, Rueer
DlecJca, gene Morin, homer Swires and Mayor .James G. Dye.
Mr. Van Antwerp of Center Service Station requested consideration for issuance of
a franchise for wrecker service within the City. lie ras a permit from the PSC and
a common carriers permit; his wrecker is equipped with a welder, and has been ap-
proved by the State Highway Dept. for servicing their behicles on towing jobs.
There are two other wreckers in town (taildwood %tors and Wildwood Cbevron) but it
was thought these were used only in their line of husiness. (garage). Clerk will
check with PSC for their views on granting such a franchise, also check the City
Charter, and check with the two garage owners. lie offers 24 hour service. Billy
McCann sail he had called Van about 15 times, and had a response every ti,-me, and
the.rates were not excessive. Van says he would nut on another wrecker in the
event business warrants it.
Mrs. Doris Swires reported the City Centenniel Committee had agreed to try to get
a park area on the beach and wondered about the F'iunicipal Reserve owned by the City.
Has it been staked out? Does the tide cover it? Can it be used for a Park? The
State Centenniel Committee has encouraged them to go ahead with this Plan. Council
says fine, and to contact the Parks and Recreation man with the Div. of Lands.
The Centennial Committee is also going to take over the operation of
the Tourist Center ( with the blessing of the CHamber of Commerce), and they are
seeking a permanent site for the bldg. They want to fix it up, perhaps enlarge it,
and want a place on the tiignway convenient for Tourists. Billy :1cCann and Chet Cone
will work with the Centenniel Comm. on a site, etc.
Gene Roguszka presented a report projecting Revenue and Expense for the Airport for
the next five years; this is in resnonse to a request from Bond Consultant Don
Meyer for presentation to 1111FA, etc. Roguszka reviewed the report briefly and
gave copies to all Councilmen. A ten page summary of the Realestate Research eorp.
report was made available to Roguszka to aid 'him in his projections.
Clerk reported Atty. Fisher had called Thorgrimson tied. morning and
as a reiult of the phone conversation, Fisher had drafted the Bond f.lectfon O:dinanc
for Council's consideration at this meeting; notice of election can be published
in next week's paper.
Minutes of the last meeting were discussed and approved.
Correspondence was read: Letter from BUI re the lot by the school says the City
can acquire the property in one of two ways: 1. Through public sale, 2. Thru
Recreation and Public Purposes Act. Council says notify them we will bid on the
lot at public sale.
Council reviewed Fisher's letter to Gov. Egan re CSHB 138; %brin
moved, Meeks seconded, to send the letter to the Governor. Motion passed unanimousl
ly. The Mayor will hand carry it if he is going soon.
Memo from Fisher says Gantz recommends a meeting with W&S Payment
Bonding companies as soon as the insurance adjustor's report is received --(' ant z
is expecting this daily.
Letter from Corps of Engrs. requesting comments on application for a
permit to construct a petroleum loading dock on East shore of Cook Inlet at Port
Niki6ki. Council says "no objection". Clerk will so inform them.
The Clerk reported: Map of Kenai Packer's application for tidelands was presented
and discussed. Ruby and Waldo Coyle participated in the discussion; Council will
portest the extent of the application in that it takes in navigational waters in
the River channel --also that it encompasses more land than necessary on the shore
line. McCann moved, hb rin seconded, a memo be sent to Div. of Lands protesting
Kenai Packer's application for tidelands as it takes in too large an area and in-
cludes most of the River channel. Passed unanimously. Atty. will direct a wire
to Div. of Lands as date for protest deadline is 8 April.

Clerk presented Final Plat of Inlet View S/D approved by the Pla ning
Commission. Considerable discussion was had re the City s granting a r.o.w. for
road. McCann moved, bb rin seconded, to accept the statement accompanying the
Final flat of Inlet View S/D. Passed unanimously. Morin moved, Swires seconded,
to accept Res. # 65-11 on Inlet View S/D. Motion passed unanimously, with McCann
dissenting as he thought the City should abide by the Ord. requiring streets be
constructed before acceptance of a subdivision. McCann acknowledged the owner
had deposited money in escrow for street development, and that the owner would un-
doubtedly complete his agreement to construct streets --his "nay" vote was based
on principle. McCann moved, Morin seconded, to authorize the Mayor to sign the
easement permit for roaJ r.o.w. for Inlet View S/D. Roll call vote passed the
motion unanimously. and Tom Smythe
Clerk reported Janet McCabe/of AS11A had called in a.m. They were
sending material from Realestate Research Corp.. Ed Leutheuser should be here
in a couple of woeks; they will meet with Planning Commission by the 19th of Apr.
the price for additional copies of the revised General Plan would be about $70 for
each additional 100 if they are ordered at the first printing --otherwise it would
be more; ASHA will get enough data to the City to enable action fro sale and
lease of land during this construction season.
Clerk also reported the corrected copies of the ASHA contract had
been received and could be signed.
ASHA also requested a summary of capital improvements the City hopes
to complete in the next few years as Son. Greuning was presenting a bill to Cong-
ress to increase, or continue,APW Funds; improvements named were: Airport Termin-
al Bldg.; Civic Center Bldg.; Street improvements, including paving; Small Boat
Harbor; Water and Sewer Extensions; etc. ad infinitum. Smythe said that was
enough for a start.
A copy of 1961 Forclosed property with minimum bids acceptable was
in the Circulating File.
Staff Sgt. James Thompson at Wildwood had asked to buy and remove
the building on Lot 17, 31 s, 0 rip. twnsite. Boro evaluation on the bldg. is
$781. Council says to re -check with Helen Stetzer that she doesn't want the bldg.
and to notify Thompson he can have the buildl:ar, for hauling it away and cleaning
up the grounds after removal.
Clerk requested approximate anticipated revenue from Shortfall Fund
for preparation of budget report to Council; sum was set at $5,000.
Clerk suggested the City advertise for bids for gravel purchase as
the Code stipulates purchases exceeding $500 must be competitively bid. Council
had purchased some gravel on an emergency basis, but the needs will be greater in
a short while, and notice should be in the paper inviting proposals.
The Attorney reported: Boro report for meeting at Homer was circulated. Presented
Ord. for a turn -over to the Boro of the taxing power --said Ord. will be taken up
next week. The City Code will have to be amended also re taxing for real pronerty
and taxing for sales and services. The Atty. advised the City should advertize
for proposals for oil and gravel --this is a yearly procedure. In reply to the
Mayor's questions, the Clerk reported the City had obtained gravel on an emergency
basis, using City personnel. Word had been received that gravel was being hauled
to Birch Drive at a price five times the cost of the City's purchase of the emer-
gency gravel. Swires reported he had ordered the gravel for Birch drive as the
City trucks could not travel that road with the small size tires --also that haul-
ing on Beaver Loop had been curtailed temporarily--Swires doubted the City would
be billed for the gravel or hauling, and said he would pay for it himself if a
statement was presented. (Code reference, Sec. 7-36.)
The Atty. presented a letter from Manley of the Alaska R.R. inquir-
ing about ice in the River and discussing a R.R. to Kenai.
No additional action has been taken re HEA and the Court case, but
the City will present its evidence and move for dismissal.

Lyons met with Farnen 'Tuesday and reported the fol!owinr propositions from HF.A:
They want the City to put a stop order nn the f ,)urt case --this we
do not concur in.
There are 100 concumers III?A has in the City; they offer them to
us for $3,166 each. This includes part ofthe distribution and generating system
according to their breakdown. Wien Lyons brought this to IIIIA's attention, they
stated their Atty. would have to amend the estimate of cost.
Lyons recommends the City's service area should be everyting within
the City Limits, plus 1/4th mile each side of the transmission lines outside the
City, plus all of the Wildwood area.
On discussion of an inter -tie with HEA, they quoted a price of
$65,000, and the City build the substation (cost 20 to 30 thousand), plus purchase
of any power we would use.
Lyons will compile figures for servicing these 100 consumers with
our own lines --this will aid the City in negotiating. Lyons will also request a
meeting between dEA Board of Directors and the City Council.
In addition to the $316,000 asked for HEA system, they also want the
amount of projected revenue for these customers for a five year period.
Morin moved, Cone seconded, to write HEA Board notifying them the
City wants to meet with them. Approved unanimously.
The Mayor announced the Boro school budget hearing will be on April 14; they
anticipate a move of Bore headquarters as more space is needed --Morin contacted
Navarre who offered his bldg. on a S yr. lease at $600 a month and he will fix it
to Bore specifications --or, they can fix it themselves and rent for
The Mayor announced a hearing on the Bore Sales Tax Ord. on 20 April
at Seward at 10:30 a.m., then a hearing on Boro land at 2:30 p.m. 01
The Insurance fire -rating underwriter will be in Kenai between now

The Mayor presented Ord. #81 on Notice of Election for Airport Terminal Bldg.
Revenue Bonding. Cone moved, Morin seconded, to adovt Ord. #81 as read. Roll
call vote passed the motion unanimously.
The Mayor presented Ord. #82, Amending the Taxicab Code. Morin moved, Swires
seconded to change Sec. 20-11 in the City Code so that insurance required will
read 25,50 and S. Passed unanimously. This conforms with the Anchorage Code.
Second reading will be held after Duke Deering, presents additional suggestions
for amending. Swires moved to strike the emergency clause in Ord. #82. Passed
unanimously, after ,a secori¢ byl Morin. Swires moved, ',brin seconded, to accept
Ord. #82 on first reading. Motion passed unanimously.
There was discussion on lease -hold interest taxation prompted by a letter from
David J. Preo, Atty. for Kenai Peninsula Development Corp.
Discussion also on the North Road; Clerk will write Gov. Egan thanking him for
sending emissary Stein at this busy time of the year. (In Juneau, etc.)

Construction accounts.

Discussion on price of gravel for building, a road on the flats across the River.
Cone moved, Florin seconded, to authorize the Mayor to negotiate with the construc-
tion companies on purchase of gravel for the road on the flats. Passed unanimously
