PZ08-49 - An application for a Conditional Use Permit for a professional office for the property known as Lot 2, Block 4, Central Heights Subdivision (211 Portlock Street), Kenai, Alaska. Application submitted by Madigan, LLC, 37100 Edgewood Drive, Kenai, Alaska. Kebschull reviewed the staff report included in the packet, noting, because the owners would not occupy the house, a conditional use permit was required and stated the Commission had to find the following items to be true: • The use would be consistent with the purpose and intent of the zoning district. • The value of the adjoining property and neighborhood would not be significantly impaired. PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 10, 2008 PAGE 2 4 The proposed use would be in harmony with the Comprehensive Plan. Public services and facilities were adequate to serve the proposed use. The proposed use would not be harmful to the public safety, health or welfare. • Any and all specific conditions deemed necessary by the Commission to fulfill the above-mentioned conditions should be met by the applicant. Twait opened the meeting to public hearing. Richard Aber, 205 Portlock -- Spoke against the permit, noting concern with noise and property values. Debbie Adamson, 209 Portlock --- Spoke against the permit, noting the public notice sign was small and hard to see from the street, and concerned about children in the area. Susan Fore, 213 Portlock -- Spoke against the permit, noting she had been told the house would become an insurance or real estate office and the entire front yard would be paved. Patty Adams, 210 Portlock -- Spake against the permit, noting she wanted the area to remain residences only. Laurie Bookey, 115 Walker Lane --- Spoke against the permit, noting concern for the children in the area. Layla Mitchell, 208 Portlock -- Spake against the permit, noting she had heard rumors the use of the house had something to do with McDonalds and she did not want a business in a residential area. Dena Cunningham, Owner of McDonalds, Buyer of 21.1 Portlock -- Spoke in favor of the permit, noting there would be no more than two people in the office; there would be no mail service or parcel delivery; they would not pave the gravel driveway; they would fix the water damaged area in the back; they would replace the roof and perhaps replace the windows; and, they had no further plans for the house. Cheryl Samples, 302 Sterling Court -- Spoke against the permit, noting she did not want a business in a residential area. Kellie Kelso, 117 Walker Lane -- Spoke against the permit, noting concern with decreased property values. Sheryl Main, 207 Walker Lane -- Spoke against the permit, noting the streets were narrow without curbs and sidewalks, there were many children in the area, and she had concern with the building being empty at night. There being no further comments, the public hearing was closed. MOTION: Commissioner Romain MOVED to approve PZ08-49 with staff recommendations one and two. Commissioner Koester SECONDED the motion. Commissioner comments included: • Residential zoning allowed businesses to operate from a home. • Businesses and homes could coexist within a neighborhood. • Concern with rumors regarding paving, expansion, etc, • The City would enforce code violations. • Appreciation of the residents' desire to keep the area residential. • A one-year timeframe for the permit was suggested with the permit reevaluated (at the end of the year) with a public hearing, • Want the home maintained as a residence, including cutting the grass, snow removal, planting flowers, etc. MOTION TO AMEND: Commissioner Romain MOVED to add the following conditions: • The conditional use permit would be for one year, with a reevaluation at that time. • The house would be maintained as a residential home including yard and home maintenance year round. Box 1669 Kenai, AK 99611 Requested Action: Encroachment Permit --Side Yard Legal Description: Lot 19, Block 1, VIP Park Estates Subdivision Street Address: 2765 Watergate Way KPB Parcel No.: 04936014 Existing Zoning: RR -Rural Residential Current Land Use: Residential Land Use Plan: Rural Residential ANALYSIS General Information: When applying for a building permit for addition to the residence, an encroachment into the side yard was discovered. The house was built in 1975 and is considered nan-conforming. However, since the owner wants to build an addition which adds square footage, the encroachment must be applied for and received before a building permit can be issued. An as-built of the property was completed by Swan Surveying in 2000 and shows 13.78 feet as the distance from the rear corner of the house to the side lot line. This is an angled lot and it is possible the front corner of the house is closer to the side lot line. An administrative exception can be granted for up to twelve inches (12"). Because this is over twelve inches, a formal application must be filed. KMC 14.20.185 details the definition, intent, and permit application process for Encroachment Permits. Code also lists the review criteria that should be considered by the Planning and Zoning Commission when determining if a permit should be granted. The Commission is to establish that the following conditions exist before issuing an Encroachment Permit: An encroachment as defined in KMC 14.20.185 (a) exists. An 9 P~08-51 -Comments Page 2 encroachment as defined in KMC 14.20.185 (a) exists. 2. The encroachment does not encroach upon a Federal, State or City right-of-way or utility easement. The encroachmenf does not encroach into a righf-of-way or ufility easement. 3. The issuance of the encroachment permit will not authorize a use which is a not a principal permitted use in the zoning district in which the property is located. This is an addifion to asingle-family dwelling which is a permitted use in the districf. 4. The encroachment is not located across a platted lot line. The encroachment does not cross fhe lot line. Building Official: There are no building safety violations or concerns. RECOMMENDATIONS The owner wants to build an addition to his house, The house is located in the Rural Residential zone and the side setback is fifteen feet (15'). When applying for a building permit, an as-built survey was submitted. The as-built shows the rear corner of the structure as 13.78 feet (13' 9.36") from the side lot line. The lot is angled and the house appears to match the angle of the lot. The applicant believes the front corner of the house could be 10 feet from the side lot line. This house was built in 1975 and is considered non-conforming. Because of the planned addition, an encroachment permit must be received before a building permit can be issued. Even #hough the as-built shows the structure at 13 718 feet from the side lot line, the applicant is requesting a five foot (5'} encroachment permit in case the front comer of the house is closer to the side lot line than shown on the as-built. Granting afive-foot encroachment permit will eliminate any further setback issues in case the front corner of the house sits further into the side yard. KMC 14.20.270 describes amendment procedures. Section 2 states, "Amendments to the Official Zoning Map shall be considered only if the area to be rezoned contains a minimum of one {1) acre (excluding street or alley rights-of-way) unless the amendment enlarges an adjacent district boundary." This subdivision contains 2.97 acres and meets the requirement for an amendment. The applicants would like to build a professional office for Dr. Wortham's dental practice. The Fong-term plan would be to have other professional offices developed on the site. The Rural Residential 1 zone requires a Conditional Use Permit for professional offices. The City of Kenai Comprehensive Plan (Page 37) recognizes the issue of neighborhood concern relating to commercial development near residential areas as conditional uses or through rezones, particularly along the Kenai Spur 16 0852 Comment.dac Highway. The Plan continues, "One of the goals of zoning is to achieve stable, livable residential neighborhoods by separating them from incompatible uses. This is best achieved by zoning sufficient suitably located land for all expected uses, then adhering to the zoning plan." The City of Kenai's Planning & Zoning Commission and City Council recognized the issue of development along the Kenai Spur Highway and developed the Limited Commercial zone to provide a transition area between commercial and residential districts and allow a mix of low volume businesses as well as residential use. KMC 14.20.115 -Limited Commercial Zone (LC Zane} - "Intent: The LC Zone is established to provide transition areas between commercial and residential districts by allowing low to medium volume business, mixed residential and other compatible uses which complement and do not materially detract from the uses allowed with adjacent districts." The Limited Commercial Zone requires that developments meet the requirements in KMC 14.25, LandscapinglSite Plan Regulations. Included in those regulations is the requirement for a buffer separating commercial uses from adjacent residential properties. Building official: Rezone would cause no building safety violations or concerns. RECOMMENDATIONS This is an application to rezone approximately 2.97 acres from Rural Residential 1 to Limited Commercial. The applicant plans build a professional dental office. In the long-term, the hope would be that other professional offices would be built on the site. This property abuts the Kenai Spur Highway and Cinderella Avenue. The property is across the street from Kenai Central High School, The previous owners attempted to develop this property by applying for Conditional Use Permits for a retail office and then a professional office. The application for a retail office was denied. The application for a professional office was approved and then appealed. Prior to the Board of Adjustment meeting on the appeal, the owner withdrew the application. Since that time, the property has been cleared. The most recent attempt to develop the property was by the Kenai Church of God. They received a height variance for the structure. For unknown reasons, the church was never built. Since the original developer attempted to develop this property, the City completed the 2003 Comprehensive Plan and the Zoning Code was amended to include the Limited Commercial Zone. The Landscaping ordinance has been updated to include specific landscaping and buffer requirements between residential and commercial uses. The possibility of a daylight basement has been considered to allow for easy implement of plumbing for dental applications. All designs will follow current city codes and regulations.
