KENAI CITY COUNiCIL MINUTES 29 January 1964
Meeting was called to order at 8:25 p.m. by Vice 'Mayor Swires. Poll call
showed all members present but Morgan, Lofstedt and Dye. The latter came
in at 9:10 p.m.
Joe Kuchta of the Dept.of Health announced he would conduct a survey of
the sanitary fill site and would inform Council how much longer the site
could be used. He also will select a site for future use. He emphasized
he cannot approve an FHA loan with reference to the water and sewer install-
ations if the system has been covered. His inspection must be made while
the lay -out is still exposed. He usggested a Building Code might solve
part of the problem; also that people should be informed when bldg. permits
are issued that a Health officer must inspect the sanitation if they want
a Federal loan. Kuchta will see Gen. Carroll in Juneau and talk with him
re a Natl. Guard unit in Kenai. He said the first step is to maintain a
unit for a year; he will see about getting an officer to come once a month
to talk with Sr. -class boys and interested persons explaining that a man
can fulfill his military service in the Nat'l. Guard.
Minutes of the last meeting were approved.
Correspondence was read: letter from Odin Strandberg signifying power de-
manded by the City would be available; Letter from J. N. Thompson offering
the Chisum property for sale to the City. Homer Swires announced Mr. Rankin
of Chicago Neumatic will be here 10 Feb. and would like to meet with Council.
There was some discussion on purchase of the Chisum.propertv--Council felt
it best to apply any money that might be available on a new bldg., built to
specifications, rather than on this property.
Atty. Fisher presented an application for a Ganbling License for the Chamber
of Commerce for use during Kenai Days, Dog Races and for the Clinic. He
says the City's case vs. Daubenspeck is amounting to a test of validity of
the City Sales Tax Ordinance; a cursory study of copyrighting the property
maps shows it could cost $6.00 a sheet --he will study this further. He
has conferred with Howard Crinklaw re the dispute between KCL and KPC on
property, easements, etc. He thinks tha easement will have to be obtained
thru the Court; the Chamber is urging participation in the Nat'l. Guard
program. The Clerk read the night letter the Mayor had sent to Gen. Carroll.

by the Commissioner --no reason was given; additional names had been suggested
for the Kenai Planning Commission; the Bd. of Evaluation would hold its first
meeting Thursday eve; presented an application from the Russian Church for
Ganbling license for their May Day Dance when they raffle of a rifle or some
similar item.
Mayor Dye and Don Meyer of Marshall S Meyer arrived.
Mr. McCann moved, Morin seconded, the Russian Church application for gambling
permit be approved. Passed unanimously.
Gene Morin moved, Kuackstedt seconded, the Chamber of Commerce' application
for gambling permit be approved. Passed unanimously.

Mayor Dye reported: HHFA had not approved the bonding for Caughran Excava-
ting, Inc., but he, Harold Galliett and Ed L. Caughran had arranged a solution
Telegram from United Bonding was read wherein four bonding companies were
putting up the performance -payment -bond. This amended bonding has been sub-
mitted to HHFA and is expected to be approved.
Mr. Don Meyer inquired as to developments re the formation of the Borough.
He read a letter from Dick Thorg_rimson, Kenai Bond Counsellor, suggesting
a change in the City Charter which will allow the Borough to assume bonded
indebtedness for the new high school when the Boroughs take over the schools.
It was his opinion the Charter prohibits this transference the way it is
now. The Sec. in question is 6-1, 2nd para., after the word "retirement"
Thorgrimson suggests insertion of ", any general -obligation bonded indebted-
ness assumed by State Borough or municipality,". He does not usggest a
special election, but that it should be on the ballot at the next election.
Mr. Meyers pointed out the N6S revenue bonds could be cancelled and g.o.'s
issued; he could be relieved of this burden as rev. bonds for 'd6S are not
salable. He is primarily interested in the progress of lthe Boro; he is
aware of offers by the oil cols. on the Peninsula to pay to the Boro $18,000
a year in taxes as their sh� he to 1 d Meyer has written various
State personnel urging ��`�' o� ths.c�o� The School bonds cannot
be paid off sooner than 20 years; Atty. Fishe pointed out the cost of the
high school was $21 a sq. ft. as opposed to costs in Anch. of $23-24 psf.
The Clerk informed Council and Mr. Meyer the Boro school Board was estab-
lishing headquarters in the new high school at least until August. Consid-
erable discussion was held on taxation --does the Boro pre-empt the City's
powers?
Mayor Dye had talked with Maj. Allen who re -affirmed the offer of W/W fac-
ilities for Nat'l. Guard purposes; Mrs. Erwin is going to demolish the
old drug store bldg .,G,,
Billy McCann reported on the two Council meetings at the School: ?the y
will not pay any additional monies claimed by Lease Co. over soil study, etc.
The inspectors, school board, etc., are most pleased with the new bldg.; a
Supt. won't be hired and business will be conducted by the present school
Board until the Boro takes over --the City will be paying the bills anyway.
The City Atty. was requested to have a resol n ready for Morgan for the

chase these additional bonds.

An amended grant agreement from HHFA was read; Gene MoriA moved, Swires
seconded, the Mayor be authorized to sign the resolution/after conferring
with Galliett re the terms "50P and "whichever is lesser". Passed unan.
Billy McCann moved, Swires seconded, the Mayor be authorized to sign Res.
#6q=4, Amendatory Grant Agreement. Passed unanimously.
Clerk will give Mr. Meyer a verifax of the telegram from United Bonding.
Federal Housing men will be in Kenai Sat. at Bill's Club for a lobster feed.
Interested parties are invited to attend the potluck.
Clerk will request a written report from Dick Dority with re to roads in
Black Gold Estates Subdivision.

' Gene Morin introduced Ord. #61, Establishing Procedures for Appointment
of Borough Representative. Term of office was amended to read to serve
"at the pleasure of the Council" and Sec. 3 will be amended by Atty. to
show the office is filled by "Council appointment". Swires moved, McCann
seconded, to accept Ord. 61 on first reading. Passed unanimously. Some
a discussion was had between the Mayor and Mr. Meyer re alternates to the
Assembly. Mr. Meyer said it would never work; the Anch. City Atty. had
rendered an opinion it was illegal; the Anch. Boro had voted them out; that
it would be utter chaos. Mr. Meyer said Kenai must support early action in
the Boro to assume its powers --that it is most beneficial to Kenai to get
the Boro working. He will attend, by request, a meeting of the 9 Borough
Chairmen in Juneau next month.

Council re -appointed Roger Meeks and Dick Dority to the Planning Commission;
New appointments are: Kate Malone, Clifton Carr who have accepted. Also
appointed if they will consent to serve were: Jo Davidson, Bob Roper and
Jack Gensel. Atty. vas instructed to draft an Ord. establishing a quorum
of three people on the Planning Commission to enable business to be con-
ducted without undue delays for lack of a quorum. Clerk will inform members
of their appointment and set a date for the first meeting.
Clerk will also check with the Atty. re re -adoption of Ord. #34--Zoning
Change, and will place this on the agenda next week.'
Some discussion was held on mtce. of Airport; also Mayor advised the Clerk
to use discretion in having the Deputy Clerk on duty any more than necessary;
The Mayor suggested it might be beneficial to hire Smoky TumSuden as mechanic
and equipment operator on a full time basis; with consent of Council he
will o6ofer with the Airport Commission on this; the Mayor will also talk
with the Street equipment operator on handling of equipment; The Mayor
thinks it is possible some of the equipment used on the Soldotna airport
may be used in paving the Kenai strip; he also will urge building of an
airport maintenance building this summer.
