Don Bailey, Consignee for Untion Oil, asked about delivering heating oil to the New School; his contract reads "to provide oil for Kenai City School", expiration date 30 June 64; the School Board will take this matter under advisement. Ken Jordan presented signed completion papers on the ,Jew Kenai high School and announced the City now had ownership of the school as of 12 Harch 64. Insurance becomes effective on that date also. Final payment will be made within forty five days of closing. There was considerable discussion on depth of wells and water treatment; the School Board is working on a solution to the problem; Ilomer Swires discovered in Juneau a check will be forthcoming to the Kenai school in the amount of $29.586.36. the State's remaining share of the 62-0 budget. Odin Strandberg stated construction has started on the sewer outfall of the Mommsen Subdivisions from the beach and upward; his new generator is complete and will be leaving on the first of April --he will contact American Tug 6 Barge about hauling to Kenai. Mr. Galliett asked Council to either reject or accept his request for payment -- It has been five months since the work started and he would appreciate having the money. Tre Clerk and Mayor will arrange to have the funds available by cashing in or borrowing on the trust funds with First Fed. Say. 6 Loan. McCann moved, Swires seconded, to pay Galliett out of the trust fund. Past Unanimously. Homer Swires reported on Juneau trip: he visited with Coast Guard, discussed rocks in the !fiver, etc., worked on tidelands and saw it thru various committees; hunted the school money; the Tidelands bill passed the house and is headed for the Senate; Phill Holdsworth says the City can lease the Tidelands in less than two weeks if necessary; He and Fisher also saw Maj.Gen. Carroll; the Mayor talked with some Seward officials --they are ready and willing to meet with other City officials to map a policy re various aspects of Boro Govn't.; Bill wells inquired as to action on the Plumbing Code as discussed at last r week's informal meeting. This has been referred to the Planning Commission with a request to submit recommendations to Council within two weeks. Clerk was instructed to get a notice in the paper about Break-up time asking property owners who have abandoned wells, excavations, etc. to notify the City and these places will be filled in and they will be charged for costs -- the owner may fill in the holes himself if he prefers. Some attention should also be given to the bank overhang. There was some discussion on payments to Caughran. Galliett thinks the City will have at least thirty days from date of request for payment. Correspondence•was:submitted in verifax form to Council --letter from Ur. Spencer thanking Council for the Code money. r Minutes of the last meeting were approved. Clerk reported: new signs had been ordered for City Sts. and Coveyou has -- - been working on the posts; called Council's attention to a report b Helen P Y Fisher on the last Boro Assembly meeting. i IAW, Council Minut 11 :-far 64 Page two Inquired as to Atty. Fisher's request for payment for additional expenses on Juneau trip; McCann moved, Swires seconded, to pay the $264.36; Considera- tion of purchase of a check protector will await budget time. With consent of Council, the order of business on the Agenda was changed until Atty. Fisher could be present --he was expected to appear later on in the meeting; The meeting was open to a public hearing on Zoning change affecting Ordinance M34. The Clerk reported 28 notices had been mailed to property owners, two had been returned Address Unknown, one resident had stated in the office he saw no reason to change from the present Unclassified status (Jim Evenson); L.W.Hartley did not object to Unclassified Zone, but does not want it Resi- dential; the only letter objecting to the change and requesting a Business Zoning was from Wallace and Lois ;4cIvers, Nome, Alaska. The Clerk also stated a notice on the hearing for Zoning Change had run in 28 Feb and 6 afar issues of the Cheechako. Council feels if AcIvers or Earl Towner show evidence of intent to establish a business on their property Council can consider a zoning exception or variance. Knackstedt moved, Morgan seconded,the land (as described in Ord. #34) remain Unclassified. Passed unanimously. (Ord. #34 included in Min.) There was considerable discussion on the contracts and proposals from Adams- Corthell-Lee and also Gene Roguszka re Airport projects. It looks good for securing advance planning money for the Terminal Bldg. from HHFA-CFA loans; KCL has had notice to vacate the C.A. Bldg.s by 1 May; The Assessment Ord. will be placed on next week's Agenda. The Attorney reported: The next meeting of Boro Assembly (according to the Mayor) will be in Seward --perhaps we can go on a bus; the City should write each Legislator and thank them for efforts re the Tid4lands Bill; doesn't know the status of the land of KPC's on which the City needs a r.o.w.; there was some discussion on exempting property from taxes--Atty.'s opinion is that according to Ord. 8 and Amending Ord. 26, no property is exempt unless Council so orders --American Legion and Bill's Club would not be exempt; $24,000 has been allotted by Congress for removing Kenai River Rocks; Mr. Coyle says the Navigational Light is about to go over the bank again; He suggests three lights are needed and a request should be ma4.s for buoys to mark the entrance. Mr. Morgan will see Loo Oberts re a report to the Boro requesting a feasibility study on deep draft harbor, recreation areas, etc. similar to a resolution submitted by Homer, Alaska. The City Code was removed from the table; ,'Mr. Morgan amended the Code, Sec. 8-6 add "except by specific permit issued by the City Council at a regular meeting". There was considerable discussion on Fireworks --Mr. Morgan would amend the Fire Code for City adoption by deleting Sec. 13.2.6, 13.2.c and Sec. 13.3, 13.4, 13.5 and 13.6. McCann moved Swires seconded to leave these para- graphs in. Affirmative: :McCann; Negative-Knackstedt, Morgan, Swires. These paragraphs of the National Fire Code will not become a part of the City's Fire Code. Section 18-10 is amended by adding, after the last comma, "or cause any of the afordescribed substances to be buried within a public right _ of way". There was some discussion on Public Works Dept. p.1-10, but no change was made. Sec. 1-5 is amended to read: 'The regular meeting of the council of the City of Kenai, Alaska, is declared to be at 8:00 o'clock p.m. on every Wednesday of every month unless circumstances warrant deviation from 1 the regular meeting date when the council may, by majority vote, change the - - date ani give public notice of such change." page 5-1, Article �2y is amended to J N\ Council minutes 11 Mar 64, Page three include Motels along with hotels. Sec. 7-3(c) is amended to read "before the first day of April" instead of July. Sec. 7-5(a) second sentence, delete the words "the back of" each asses anent notice, etc. Section 14-5(3) (1) delete "of one acre or less in area" before (2). Sec. 14-16(d)-Final Plat should have requirements added thusly: "(18) Signature of property owner. (19) Covenants (20) Place for Council -Resolution No. accepting the Plat." Mr. Morgan moved, Knackstedt seconded,to Adopt Ordinance #57 adopting the City Code and to change the the dates as of today. Passed unanimously. Clerk was instructed to address a letter of Congratulation to the Homer City Council on election decision to incorporate as a first class City, and to offer any assistance that might be helpful and to enclose a list of the City Ordinances along with a copy of the first book of Ordinances (up to $10). The Mayor reminded Council of the Ceremony for National Guard recruits when the oath will be administered, etc. It is desirable that a good crowd be present. WHEREAS, a petition, or request was submitted to the City Planning Com- mission for a re -zoning of certain real property in the City of Kenai, Alaska, on 24 July, 1962, said premises being more fully described as follows: Lot 21-34, Section 34, Township 6 North, Range it West, Seward Meridian, according to dependent resurvey and subdivision of Section 33 and 34, according to plat on file with Bureau of Land Management.
