Lyons, Jr. full time --showing salary, etc. Also his duties could be outlined --he is not sure just what he's supposed to take on.* PO'Carl Seaman requests a r-o-w from the City to run his W&S lines on Willow St. Oberts says the water hook-up to the School would not, in itself, reduce fire insurance rates; Approval of the entire system will re- duce rates all over town and incidentally also the School. Bob Dozier, State Assessor was here Friday gathering information re taxation for Boro purposes; Incidentally, he pointed out the City's contribution toward the School, after the Boro takes over, is not only the equivalent of a 3.5 mill levy on 100% evaluation, bat also is one-half Public Law 874 money of the pre -fiscal year. Charles Archer, representing the Fire Dent. announced his resignation has raised the question of a workable fire alarm system. A 24 hour watch must be maintained on the phone. The City will approach FAA re this as they are the only ones in the area with 24 hour watch. Council expressed sincere regret for Archer's decision to resign, and thanked him for his untiring efforts as Fire Chief. He has made a model organi- zation of the Volunteer Firemen and the City is proud of the achievement. Larry Lancashire requested transfer of Liquor License from Tony 6 Eyvohn Bordanelli, d/b/a Jet Bar, to him. Public Hearing will be held 26 August and Dept. of Health and Police will be alerted to conduct investigation according to City Code, Chap. 2. Tony Bordanelli also spoke re this. Joe Kuchta inquired as to space for the C.D.Emergency Hospital slated for Kenai. The 20 x 60 quonset at the Airport is being readied for storage. The Fed. ('ovn't. will transport the facility to Kenai and pay for loading and storing. Maintenance costs will amount to $30 to $SO per month. Clerk will contact Don Lowell as to whose re- sponsibility this is --City or State? McCann moved, Swires seconded, to accept the C.D. Emergency Hospital from the Dept. of Health. Passed unanimously. Kuchta will over -see its arrival, etc. Kuchta also says the D-4 fat at Unalakleet can be ob- tained for the Garbage Dump and will get it for the City, thru the Dept. of Health. "Mac" McGahan will be the State custodian for the Hospital. Ron Thiel says water and sewer connections are in on Main St. Gravel will be spread and St. will be brought up to grade. He asked Council to be thinking of a priority schedule for additional areas to be serviced by WFS. The low number of connections will make additional monies available which can be applied to an extension of the system. Thought should be given to connecting Peninsula by the Hotel up Bluff to Marine (for water) so as to form a loop --else the system will be subject to freezing. Thiel suggests the City should not let anyone,�other than an authorized, bonded, contractor install water and sewer lines, or do any work on City rights -of -way. Not doing so would thrust too heavy a burden on the City Engineer and could lead to all sorts of problems. The Atty. will draft an agreement with Carl Seaman for r.o.w on Willow St. for Wf,S to Seaman's establishments. Thiel also suggested water should be run from Main to Upland to avoid possibilities of freezing. Fill from Cook St. will be used on the road to the Sewage Treatment Plant. John Nichols will be here next week, and Galliett is due Friday, and deductible alternates will be discussed. i --,_„Clay Lyons said assessment -due notices should be sent as soon as practical. Due dates were discussed. Clerk will contact Don Meyer for due dates on interest on the bonds. It is possible assessments will be due on same dates as property taxes. The State will re -pave these spots on notification the City is thru digging there. Minutes of the last meeting were approved as corrected. t Correspondence was read: Letter from Clerk to Local Affairs Agency with suggestions =- for changes in the Municipal Code (included in the minutes). Billy Mize's cost est- imate for printing Bridge report --Council authorized SO copies at $260.00. In response to request from BUN, McCann moved, Swires seconded, to authorize Frances Torkilsen, City Clerk, to sign papers for cemetery land -application. Passed unanimously. The City will maintain the grounds. Boyer's letter was acknowledged and the Atty. has directed a letter to Caughran asking him to acknowledge receipt of notification from Boyer, and to signify to the City that he (Caughran) has notified his insurance carrier. Ell Council Minutes 12 Aug 64 Page two The Mayor reported the Army will be conducting exercLses in the area from the 15th to the 18th with landings, para-troopers, etc. Don Statter was here to take pictures of the Floats and was perturbed to see they and not yet been installed. The Dock Commission cannot locate a pile driver, but hopes to acquire the use of one from the Cannery in the near future. These must be installed or we cannot hope to get addi- tional float sections. The Clerk reported: Raw Fish Tax refund for 1963 was $7,071.02 as compared to 1962's $16,458.04. Frank Darnell and Mrs. Blanche Ryan were suggested as members for the Centennial Committee --as they had signified willingness to serve, Mayor Dye appointed them. Re Airport Director's salary: Council agreed to abide by the recommendation of the Airport Commission which does not allow for an increase this year. Clerk reported on recent State Legislation, Chapter 102, Appropriating $3,200,000 for PaymnSt to Municipalities and School Districts for Shortfalls of revenue Cause by the Earthquake; the Clerk and Attorney will draft a letter requesting aid under this Act. (to Joseph Fitzgerald -Governor's Liaison officer to OEP. Clerk will direct a letter to%�Thiel requesting a culvert at the end of Main St. and by the hotel for drainage run-off. Clerk requested direction as to proration of Lyon's salary: McCann moved, Meeks seconded, to hire Clarence E. Lyons, Jr. at $11,000 a year as Kenai City Light Manager and manager of Water and Sewer Utility when it becomes operable; this was effective as of 1 August 1964. Motion passed unanimously. Clerk inquired if Oil Companies were paying a Gross Production Tax --if so, this exempts them from a Borough tax --Mayor Dye announced a Boro meeting Tuesday 18 August, when Boro taxes will be on the Agenda. The Attorney reported: Kenai Days Committee will need help from Coveyou--He and his helper, Richard Kivi will assist all they can in leveling the grounds, raising the tents, etc. Swires flat bed will be used --Guards will be hired to watch the grounds, etc.,--Atty. will prepare a form giving the Guards some authority --they will meet with Trooper English to get instructions. Council inspected the lay -out of the grounds presented by "Red" Peavley, who is in charge of the Kenai Days Activity. Peavley announced Dick Rand, in his KFQD program every day 9:30 to 11 a.m. invites visitors to be interviewed on "Rand About Town". He has given publicity to Kenai Days. Fisher has sent invitations to Boro Assemblymen, Peninsula Mayors, etc. to be present on the reviewing stand at the Parade. Peavley invited the City to have a display of projects under way, but no one was placed in charge of this project. The Tourist Center will be open to direct people to points of interest, and a booth on the grounds will be manned as an information Center. The Attorney will prepare a r.o.w agreement between the City and Carl Seaman for his i WF,S lines; The Mayor presented Res. 64-21 Accepting Offer of $26,000 Advanced Planning Money 1 for Airport Terminal Building. Meeks moved, McCann seconded, to approve Res. 64- � 21 accepting $26,000 grant offer for advanced planning for --terminal building. Passed unanimously. The Attorney presented aNIgport ram Trans -Alaska i response to our request for same. The Kenai Chamber of Commerce will contact TAT regarding a General Accounting Office. The Atty. will work on a change in the Electrical Code at the request of Lyons. He pointed out the need for some knowledgeable person to obtain r.o.w., or easements, for the South Approach Zone at the Airport --Clerk will direct a letter to the Airport Commission suggesting Roguszka be assigned this task, and asking their opinion. The i Atty. inquired of Council if he should take on personal business involving claims against the Wf,S contractor --Council left this to tiis descretion. The Atty. pointed out the Code should be changed if the Airport Commission wants more than three mem- bers --they will be asked re this. Fisher announced fir. Morin had talked with Cone who consented to serve until the May election. With Council's consent, the Mayor appointed Mr. Cone. (McCann moved, Swires seconded, to appoint Chet Cone to fill in on Council 'tit May. Motion passed unanimously.) Clay Lyons asked Council if they wanted to take any action re Res. 63-29, Listing Street Priorities, which expires on 22 August. This will be on next week's Agenda. Lyons also asked more detailed direction re Res. 63-22, stipulating use of City - owned equipment by private parties. Srires moved, Morin seconded, in absence of other available equipment and in case of expediency, City equipment can be rented, with City operator, when and if available and at A4eaka General Contractorsrates. BOX 710 JUNEAU, ALASYA Ju]y 27, 1964 Dear Sirs: House Concurrent Resolution No. t4 of the ?st Session of the Third Legislature directs the Local Affairs Agency and the Department of Law to prepare a revision of Alaska's municipal code. The resolution notes that the law relating to cities is "a product of the territorial period and offers a disjointed body of law which does not serve the best interest of the state and its municipalities." This revision is now in progress. It will inte- grate Title 7, Boroughs, and Title 29, Municipal Cor- porations. If those concerned with the operation of municipalities will offer suggestions, the updated code can meet both present and future needs. Such a code need not be subjected yearly to disjointed additions and deletions, as is the present code. The revision must, for example, clarify the re- lationship of city to borough. It must establish a meaningful classification of cities. It must untangle what is now tangled, remove what is now obsolete, and add what is now missing. The job is a big one and should not be done entirely at the state level. We wish to incorporate as many of the worthwhile sugges- tions of local officials as possible.
