Roll call at 8:20 showed all members present but Roger Meeks.

Meeting was opened to public hearing on transfer of liquor license from Eugene S.
and Mary Lou Cupps, d/b/a Rainbow Bar, to Charles Lester and Marjorie Marie Eaton.
Council refrained from comment when the Mayor asked. Joe Kuchta, Health Officer,
stated there would be no health problem after they are hooked up to City water.
The Police investigation revealed no negative information. Telegram from T. Stanton
Wilson, Sec.-Treas. for Food li Spirits, Inc., owners of the premises was read, opp6s-
ingrthe transfer on the grounds the applicant did not have a lease on the property
and the license was for Rainbow Bar. Considerable discussion was held on this as-
pect of the situation. It was finally agreed this should be between the owner and
the licensee. Clerk reported property taxes were yet due from the present license
holder; third quarter sales tax is due, and water and sewer assessments against the
property have not been paid. Morin moved, Cone seconded, the transfer (Cupps to
Eaton) be granted subject to satisfaction of City Tax situation. Roll c a$i vote:
Affirmative - Cone, Lofstedt, Morin, Swires; Negative - none. McCann abstained
from voting, but spoke against the transfer. His abstention was granted by Council
due to a pecuniary interest in the premises.
Ron Thiel says the partial payinant to HHFA will be $30,660.94, but not to pay it
yet --he needs to finalize a more detailed report. lie presented a final payment re-
quest on engineering for the project. McCann moved, Morin secoonded, to pay the
$3,413.32 to engineer for W$S to 26 Sept., the termination of the contract. Motion
passed unanimously. Swires moved, McCann seconded to accept the addendum to the
contract, as per Galliett's letter, to 7 November. (Approximately $4800 or $120 a
day.) Passed unanimously. Council favored the $120 per day route, as the project
codld possibly be finished before the stipulated time. Thiel reported the steel
water and sewer lines are in from Mission to the sewage treatment plant, but no
tested. Four dump trucks are working on gravel hauls for Main, Mission, Overland,
Upland and Highland. Monuments have to be replaced, and the as -built survey will
have to be done. Thiel will present figures next week on a collection basin, cul-
vert, etc. to prevent erosion over the bank by the Kenai Chapel. The letter to FAA
was written with revised figures from Thiel in the amount of $20,000 for the sewer
line to FAA facilities. He wrote Caughran asking for a list of paid bills, with
proof of payment, and a list of unpaid bills. Plans and �- materials list were
given to Oehler to be mailed Outside to Landht for the Motel. The lines will be
drilled under Kenai Spur as permission to dig up the HWY. was -refused. The City
Hall is without water, but will hook onto the 6" line going to the Fire Hall and
Jail. A connection for sewer for the jail is in on Peninsula, but the City will
not hook up immediately. Discussion on Consiel's assessment and right of way was
moved to table, but it was discussed anyway. Exemption of the $2.000 assessment
would have to be paid from City General Funds --this pays for two of the bonds.
Council seemed to think a trade for a 35 or 50 ft. easement might be arranged in
lieu of assessments. Clay Lyons pointed out, the assessment still should be made,
as Consiel's property still abuts the r.o.w.
Joe Kuchta will g s get the D-4 next week. New injectors are being installed. Council
"y will pay travel expenses for him. Kuchta will be on leave for 6 weeks.
Corthell reported the rain had stopped all paving operations, but they had finished
8501. Requests for payment from FAA were signed by the Mayor. Partial payment of
$116,289 was made to M.K. Co. and payments for $5,199.45 were made to Cortheii, etc.
A breif detailed report was made on the power requirements for FAA, and for future
City needs on the airport. He will bring in a definite estimate of costs next week.
The lines will come in by the Army road.
Alaska State Housing Authority has approved the extension of the General Plan -Study,
but no written word has been received.

The Atty. now being present, Mr. McCann inquired how much liability insurance a
liquor license holder should have. No one seemed to know --Clerk will check with
Oberts on this. After Council has determined at least a minimum amount, all listed
liquor dealers will be requested to furnish a Certificate of Insurance yearly.
Minutes of the last meeting were approved.
Correspondence was read; Dock agreement from Army was received agreeing to Condition
30 which specifies 1968 instead of 1963 as formerly agreed on. Letter from Don Meyer
requesting Bolance sheet from KCL (third request); information an tobacco tax money,
Boro sales tax election, etc. Clerk had talked with accourtant who is still work-
ing on KCL books --this information was passed on to Meyer along with other data he
requested. Letter was directed to BIM re City's small boat harbor lands, inquiring
as to status if the City leased said land as industrial site. When this land was
bought, the City paid extra money rather than sign the agreement for restricted
land use, the only conditions were those set forth in the Notice of Publication.
Letter from ABC Board requesting Council action on renewal of liquor licenses for
196S. This is tabled until next week. Memo from Clerk to Council requesting per-
mission to invest $10,000 in Time C.D. for school bond interest payments --Council
says okay. No action was taken on Tachick's Bill for street work. Gravel use per-
mit application from Standard Oil was tabled for further study.
The Attorney presented draft of letter for resolution re shortfall of revenue:
The Mayor presented Res. #64-23 applying for funds for extra -ordinary expenses due
to the earthquake. Swires moved, McCann seconded, to accept Res. 964-23. Motion
passed unanimously. No copy ofthis resolution was filed with the City. Council
approved the letter also. Swires moved, Cone seconded, to accept Ordinance #72,
emergency Ordinance presented by Mayor Dye, wherein authorization was given for
sale of 2.9 acres of land to Kenai City Development Corp. Motion passed unanimously.
Cone moved, Swires seconded, to delete the words "Airport Commission" and to author-
ize the Mayor to sign the assignment of 20,000 shares of KCD stock to the Airport
Fund. Motion passed unanimously. Swires moved, Lofstedt seconded, if the transfer
of shares isn't accepted by FAA, then the Mayor is authorized to sign a guarantee
to pay $20.000 to the Airport Fund.
Discussion of tax levy for the City's needs was brief. Clerk will contact Seward
and Homer to ascertain their levy for City uses.
Clerk's report was not given. Unfinished Busines was not acted on.
