MINUTES
6YDENCE: Tom Smythe, Alaska State Housing Authority wants to set up a
meeting, possibly 27 October, on Deep Water Facilities in Kenai. He
has Mr. Edward Leutheuser, Vice Pres., of Real Estate Research Corp. and
ASBA's Director of Planning, Mr. Wm. Rogers lined up to be here also.
Mayor Dye is to donfirm date, time and place of meeting.
Received a copy of Pomeroy's Memo to all Assemblymen outlining
Financial and tax program planning. He proposes to get out City's tax
bills by 1 July 196S so we will get out property tax money just about on
same schedule as if we were doing the billing. This bill will also con-
tain 1/2 yr.'s taxation for the Boro. Leter, those outside the Cities
will get their tax bill for 1/2 yr. for the Boro Tax. All of which makes
good sense. The City bills will be coming out first as we need this re-
venue before all the Born can be billed.

✓ Graening's telegram says Federal Aid to Airports Program has
allocated $68,750 to Kenai for sea plane facility, landing area, parking
area, turn -around and access road.
' -Have invited Kilcher and Tillion to be here on 28 Oct., but
haven't had time to get confirmation yet.
rThey are having a real dog -problem at School. We should make
a special effort to get the "strays" rounded up --but, not having a dog
pound, it's going to be difficult. ???

Atty. says we should rescind the action regarding the City's guarantee
to pay the Airport fund $20,000--He has drafted a new guarantee, only
$2900 this time.

Roll call: Present -McCann, Meeks, Morin, Swires, Dye: Absent -Cone, Lofstedt.
Harold Galliett reported: Ire and Thiel had tried to ascertain what accounts of
Caughran were paid, and what were unpaid. fie recommends we do not make any pay-
ments until an audit is completed, and that the audit should be done as soon as
possible. Thouren should be here Friday or Saturday, and perhaps we can get a
partial payment from USPHS. We can also ask HHFA for a partial payment. Aean-
while work is going ahead in spite of a slow -up because of weather, funds, etc.
The Bank has no recourse against the City --the contract says we can withhold money.
The policy we are following now is the right course of action. SAunders, Inc. shouls
be persuaded to return to the job to finish the sewage treatment building. Electric
work in the well house can go on this winter. The well mechanical work is next;
the;staeet:work is:sbout completed--cadastral monuments have to be reset. When
one well house is done, we will flush and chlorinate the water mains, and test the
sewer system. The ramp to the sewage treatment plant needs two layers of steel
matting to safeguard it.
Tom Suthard needs capital to continue the street work --he has oil bills that need
paying. Council assured him the money owed him would be paid, but the City cannot
pay anything until an audit is made. Gravel yet to be hauled amounts to $15,000.
Gallietts says Council can terminate the contract if they so desire as Caughran has
violated it by either nonpayment or slow payment of his obligations. If this is
turned over to the bonding people, work would be stopped and might not continue for
weeks --then the weather prohibits completion this year. Ted Gaines will audit the
Accounts of Caughran for the City, and Mrs. Caughran has consented to this. Going
to the bond Co. will hurt the sub -contractors. Galliett suggests the City may want
to substitute an,: electrical engineer as there!s no need to keep Thiel an the job
unless he can be kept busy. They should be able to finish by next Wednesday.
A phone call to Atty. in Anchorage by the Mayor was side. Morin moved, McCann
seconded, to audit the books and retain Ted Gaines, CPA, as auditor. Passed unan-
imously. Fisher will inform the bonding company of the situation. Morin moved,
Meeks seconded to withhold payment to Contractor and make payments as the audit
and conditions warrant. Passed unanimously.
Stan Thompson asked Galliett about the sewage treatment plant. This is in danger
from tides and wind unless it can be enclosed.
Gene Roguszka reported: the ]SO' x S000' paving of the run -way is complete --aprons
will have to be finished in the Spring; $804,000 has been spent of the $1,140,000
project. Also to be completed --three taxi -ways, two gravel surfaced. Only the
South taxi -way will be used this winter. The City's force account work amounted to
$27,000 on stripping and $27,000 on clearing --with some of the latter yet to be done
The lighting system is 56% complete and can be used this winter. Mtce. building re-
mains to be built and entrance road to be finished. $22,500 has been allotted for
r.'s of way. This may or may not be enough. The sea plane project has been ap-
proved for dredging of turning basin, parking area, drainage canal and access road.
the latter would be an extension of Birch Drive. Total cost to be $110,000--Fed.
participation is $68,750, with State and City to share the remainder. The City's
two Cats obtained from the Fed. Govn't cannot be used on the force account work.
In mtce. and operation the Airport is still well within its budget of $30,000.
Money for sale of land will be dedicated to capital improvements. Roscoe Bell of
Div. of Lands has offerred to assist the City in adopting procedures for land -lease
or sale. Council will invite them to meet with Kenai officials the week of Nov.9-14

Aerial zoning is necessary and will require publication and a hearing. An ord-
inance will have to be drafted within the next three months. Then building and
land -use zoning will also be necessary. Kenai does not appear on the National
Airport Plan -- Roguszka was assured this was an over -sight. No Federal Aid is
possible unless the Nat. Airport Plan includes the projects. The Airport Commission
will prepare a long range program for NAP, which will then go to FAA. This plan
will include an extension of the run -way. SAS needs 8500'--PNA also wants to start
direct service to Seattle. The City needs to devote some time to getting this ex-
tension. Some subdivision of lots has been made from Spur Road to Access Rd. The
Alaska State Housing Authority will assist in complete subdividing and land use
study. FAA will not approve any further exchange of land without a Plan. An effort
will be made to trade some airport land with three tracts West of the sea -plane
facility. Another subdivision should be made within Birch Rd. -Stump Homestead and
the Sea -plane Facility. The Div. of Lands has given approach zone easements and
construction easements to 10 acres.
Representative Clem Tillion talked with Council regarding work to be done in the
coding Legislative session. Tillion will not know whether or not he can
obtain the State's $20,000 for the sea plane facility until he returns
to Juneau. He has a copy of the Bridge report and will work for a
Bridge across the Kenai. fie thinks a floating bridge at first will
help as a "car count" can then be made and show the need for a perma-
nent bridge. He also realizes the need for paving the North Road,
at least to the refinery. He will look up law on Cities getting title
to vehicles acquired thru Civil Defense, also the law requiring Cities
to hold an election before selling or leasing land with a value over
$5,000. Mr. Tillion was given a copy of the Alaska Municipal League's
State Policy for study and research. The Mayor read a brief report
of allocation of funds under the "Shortfall of Revenue" legislation;
Evidently Kenai's application requests were marked for $35,565. The
Clerk reported on a meeting with Bob Sharp of the Dept. of Administra-
tion while in Cordova. According the Mr. Sharp, nine applications
had been made, and no money would be appropriated until all applica-
tions were processed. He stated many applications were not accompanie
by sufficient evidence of loss of revenue --that forms Would be sent
to applying Cities, and a possible audit would be undertaken by Peat,
Murdick 6 Kitchell
Council will meet with the School Board Monday 2 November at 8:00 p.m.
The answering service contract was signed by the Mayor for Haller's
Service for the Fire Calls. The Fire Dept. will be instructed to buy
their gas at the Airport and pay the Airport Fund.
Clerk was instructed to write Mary Riley urgently requesting a Balance
Sheet of 30 June 1964 for Kenai City Light and offering assistance.
Also requesting Mr. Riley to put his problems in writing if help is
needed. Leon Spencer of R.W.Beck 6 Assoc. has conferred with Riley
and was able to help on inventory and funds spent in the past.
Correspondence: Letter from McGowan, Dept. of Health stated several
Cities have contracts similar to Kenai's: i.e., Sitka, Palmer, Kodiak
Homer and Annette Island. Letter from Nichols states approval for
purchase of water softeners for the two wells. Letter from Adams-Cor-
thell-Lee says work at the Airport has been terminated for this season
as of 24 Oct 64.

City Clerk reported the water at City Hall was now circulating once
again --Jimmy Hollingsworth had replaced burned out wires in the motor
to the pump for $22.50 The City Hall personnel also wish to heartily
thank Clay Lyons for the excellent paint job he did in KCL's Office
and Clerk's office, plus the ante -room and the two rest rooms. Now
we have to get drapes to match the paint!
Mr. Stan Thompson requested an executive session with Council who
adjourned for a half hour.
Reconvening, Billy McCann reported on a meeting of elected officials
at the AML Convention. There were two items he particularly wanted
Council to take note of: 1. The Cities agreed there should be a
Student Government Day to stimulate interest in local government
among our Junior Citizens. #2. All Cities have the problem of "too
long, drawn -out Council Meetings. They agreed, meetings should be
held only twice a month with breakfasts, luncheons, etc. in between
for the study sessions and discussions --then Regular meetings would
be composed of business only; also no one not on the Agenda should
have a hearing until the time for"Persons Not Scheduled to Be heard,"
which is at the last of the Order of Business; also, the Mayor shoul4
use his gavel more to keep discussion to the subject and the meeting
in order. If necessary set a closing time --meet more often if nec-
essary, but don't drag out the meetings until the small hours of
the morning. The study sessions in between regular meetings should
eliminate the "bull sessions" at Council.
Mrs. Swires announced Sen. Bartlett will arrive in Kenai Friday
morning; lunch at Riverhouse at noon, come to Kenai at 3 p.m., no -
host cocktail hour at Tide's Inn 6-7 p.m. and dinner at 8 p.m.
Clay Lyon presented a breakdown of costs for the new line truck for
KCL. with funds to come from Water b Sewer monies. More study will
be trade of authority to use these funds, and whether or not the truck
can be of equal value to WITS. Wildwood can be hooked up at any time,
but date will be after loth of November.
