Mayor Dye called the meeting to order at 8:10 p.m. :nd roll call showed all members
present but Mr. Horgan and fir. Lofstedt.
Mrs. Doris Swires addressed Council on behalf of the Kenai Community Clinic requesting
permission to operate a concession at the site of the Tourist Center during the Dog
Races. Iler request was granted.
Minutes of the last meeting were corrected and approved.
Correspondence was read: Letter from the Div. of Lands rejecting once more the request
of the City's Civil Defense Director for a five acre area in Sec. 6 for a shelter. (See
C.U. File.); Letter to F&WL from Planning Commission re City's acquisition of site in
the event F&WL vacates the premises -(as indicated in Galliett's Sewerage Report).
Clerk reported: Mr. Marvin Smith called at the office in person to register concern re
his private sewer system serving the Smith -Little Apts; His system is not shown on the
City's design and Mr. Smith is fearful the lines will be damaged or destroyed when the
City constructs its own system. The Clerk contacted Mr. Galliett and received the
following reply: When his survey crew was working by the Smith -Little Apts. a man was
digging there at the time trying to locate the sewer. No one knew where it was and
rather than waste the City's money, his crew continued with survey work. Since that
time Mr. Galliett had searched the records and can find no mention anywhere of Mr. Smith's
having a right-of-way or easement through the streets of Kenai for his sewer system.
Lacking these rights -of -way, this puts fir. Smith in the status of trespasser. Mr. G. says
when the time comes for actual construction the City should meet with Rr. Smith and ex-
plain the situation and inform him that he will have to reimburse the City for any cost
incurred in re -placing the damaged line of Smith's (if any damage occurs). Kr. Galliett
also said there were two or three other instances of a similar situation: i.e. the
sewer line of Mrs. Erwin's trailer court, bakery, drug store, Kenai Commercial and Inlet
Bar and also the system of Archer's, Trade Bldg., Chapel, etc. Mr. Galliett suggested
the Council and City Atty. be alerted to this situation. Clerk had called Mr. McAllister,
Receiver for Kenai Power Corporation to inquire as to what was being done in regard to
extending,power service as per the Court order of 1S January 1963. Mr. McAllister said
the transformers had just been dug out of the ice that day in Anchorage and loaded for
shipment to Kenai; that the prime target was to furnish power to Luke's Welding Service,
Mr. Jaynes's and possibly P.A.F. Cannery. On being asked who was the manager in the
Kenai area, he replied he was the manager and Mr. Rowley was operations manager. The
Clerk inquired if the City should be doing anything which might influence the Court to
hasten a decision as to the disposition of KPC. Mr. McAllister suggested a few things,
** but said he did not feel qualified to give an opinion. About twenty minutes later Mr.
Dick Gantz, Atty. for the Receiver called and suggested the following: 1. the Mayor be
authorized to make a firm offer. 2. Consider closely the price in re to KPC estimate
of 3SO to 4SO thousand as compared to the City's 250 offer. S. Time and curditions of
payment. 4. Time of turnover. S. Whether or not the price should be according to
an appraisal. The Clerk also suggested out -going members of the Planning Commission
should be thanked for time and effort expended in behalf of the City. Suggested the
Alaska Municipal League or our Legislators should be informed as to the stand the City
takes regarding House Sill Nos. 14, 19, 47 and 48.
Mr. Odin Strandberg arrived at this time -nd with consent of Council, the rules were
suspended in order to hear him as lie had formerly requested to be heard. Mr. Strandberg
expressed the wish to meet with Council in Executive session for part of his report as
it concerned personalities and financial affairs, but for the record he wished to state
and wanted to publicly protest regarding the information put forth in a letter signed by
Mr. McAllister also wanted the City to know he had nothing to do with the letter signed and
distributed by Kenai Power just prior to election. That Mr. Rowley had no right to sign
the letter as representing Kenai Power Corporation.

Mr. Frank Rowlev as Manager of Kenai Power Corporation. Mr. Strandberg, wanted to go on
record that Consolidated Utilities had nothing to do with the letter, that it was com-
pletely in error and he wanted to protest publicly, especially as to the last paragraph
of said letter wherein it states Mr. Rowley has sold all his holdings to Mr. Garrett --
Mr. Strandberg says this is not tine --that fir. Garrett has paid only S5,000.00 down with
an option to buy. Mr. Strandberg thought the public should be made aware of what is
going on; that the option to contract between the City of Kenai and CUL contains
exactly the same rates as the agreement CUL has with KPC with the added benefits of a
cheaper rate to the City for electric heating and one which in no respect exceeds the
present rates agreed to by CUL and KPC. As to the contract with Wildwood Station, Mr.
Strandberg says this is necessary in order to boost the voltage for residents o` North
Kenai; that this increase in power for that area is imperative and the contract. with
Wildwood will fill this purpose thus benefitting the whole area. fir. Strandberg compli-
mented the City for its astute handling of a difficult problem re the adverse publicity
received prior to the election. He stated CUL wished to enter into a firm agreement now
with the City and to exercise the option agreed to. Mayor Dye asked him if the Court
was paying CUL and Mr. Strandberg said the Court is now paying for power, but they have
not been paid for three month's revenue and CUL cannot afford to subsidize KPC, that CUL
has enough generation to supply all of the area, but the distribution lines are not
adequate. Council agreed to meet h Mr. Strandberg in executive session an hour later.

Mr. McCann presented Ord. #4'e transference of liquor licenses for first reading.
Trooper Robertson was asked to comment on his suggestion that bartenders be licensed. He
will study the question, confer with the Atty., and submit his recommendations to Council.
After Council discussion, public discussion was invited. There being none, Mr. Sims
moved, Swires seconded, Ord. }.bpproved for first reading. !Notion passed.
As inspector for street constructiofi in Black Gold Subdivision Council agreed

Thompson should be contacted as to whether or not he would serve in this capacity and
what his fees would be; an alternate to Stan Thompson was appointed in the person of
Mr. Bob Tachick. The City Clerk was instructed to work with Jay Lietzke of the Alaska
State Bank with regard to the escrow payments. The Atty. said the City would have to
sign an escrow agreement with Black Gold. The question of the trailer at Bush Lanes is
to be referred to the City Sanitarian.
Mr. Swires moved, Knackstedt seconded, the question of the Wildwood ditch thru Mason -
Bennett homestea.: should be placed on the agenda for next week. Motion passed. The
Atty. suggested it might be advisable to acquire this r.o.w thru declaration of taking
rather than to set a precedent of paying such a price for an easement, especially as the
planned ditch would benefit the land in question.
The Attorney reported on convention called by Area Redevelopment Agency in Anchorage
Feb. 2S and 26 at the Anchorage -Westward. WIFA officials are supposedly going to be
present and it would be an opportune time for the Kenai Council to meet with them; he
*i inquired as to the status of rights -of -way for the City water and sewerage and the Clerk
was instructed to write Mr. Galliett re this; the Atty. had been in close contact via
telephone with Son. Bartlett re the City's application for APW funds. Mr. Bartlett
called Durkee of HHFA and was informed there were no more funds, that Kenai would have to
wait until ad6itional monies had been appropriated --said appropriation is due to be made.
The Atty. presented a draft of a letter to thank Sen. Bartlett and the Clerk was instructed
to type same, etc. The Atty. stressed the need for a man to go to Juneau to lobby for
the funds for the Kenai airport repairs; to seek assistance on APW application from the
i Bureau of Indian affairs; to inquire as to the status of the Bridge, the Highway out the
North Road, the $5,000.00 limitation on a City's right to sell or lease City -owned prop-
erty without a vote of the people. lie had written FAA and the Title Insurance and Trust
Co. and was told no title insurance can be had if a property is sold for more than $5,000.00
without consent of the voters. The Atty. suggested the State statute should be repealed.

Mayor Dye reported on a meeting with Virgil Knight of FAA and Roguska of Div. of Aviation.
tie said the data had been passed on to the Airport Commission and they were working on
plans for the City to take over. Mr. McCann will call Mr. Roguska re the City•s priority
to funds for the Airport. Mayor Dye had received work that the chances for water and
sewer were hopeless, that Kenai priority had passed. lie stated the City, the Chamber
of Commerce, all City Commissions MUST coordinate efforts and information; that without a
concerted effort on our different projects we will be wasting our time. Information
passed out must be authentic and our aims must be identical.
Mr. Knackstedt presented Resolution 063-9 re operation of the City Dump and amending
Res. 1128. (This res. leaves the Dump open to the public -no fees, etc.) Mr. Sims moved
Swires seconded, the City adopt Res. #63-9. Motion passed.
In response to request from Dr. Chas. Spencer, now working with the City Charter Commission,
the Clerk was ordered to order one more copy of the Alaska Code for Dr. Spencer who will
reimburse the City. Mr. Sims made the motion, Swires seconded, and it passed unanimously.
Motion was made, seconded and passed to table ordinance re water and sewer systems for
subdivisions and amending Ord. 11.
Motion was made,seconded and passed to table the Ord. re adoption of the National
Electric Code by reference.
Council adjourned for executive session with Mr. Strandberg for one hour. Reconvening at
11:25, Mr. Swires moved, Knackstedt seconded, the Council authorize the Mayor to make a
firm offer regarding the purchase of Kenai Power. Motion passed. The Mayor requested
a meeting with Council to discuss the mower situation, but no date was set.
