KE AI CITY COUNCIL MINUTES 3 APRI L 1963 Meeting was called to order at 3: )_, p.m. and Mr. Homan was elected Mayor pro tem. Roll call showed Mayor Jye and Mr. Lofstedt absent. Mr. Mullin, Pres.1'FD, notified Council the fire hose can be ordered for $lt+87.80; Clerk was instructed to make out a check for this amount. Joe Kuchta, Health officer, announced the Dept. of fleaith b Welfare was now affiliated with the medical aid portion of Civil Defense; this includes immunization, disaster training, blood bank, equipment for a 200 bed hospital, etc. Storage facilities will be needed approximately 28' x 40'. Mr. Kuchta will talk further with Council re this. Mr. :McCann moved, Swires seconded, that Mr. Kuchta be appointed to represent the City in the Medical Aid portion of Civil Defense. Motion passed. Minutes of the last meeting were approved. Correspondence was read. Attorney Fisher reported: Council should make some decisions re sc;iool bonds, i.e. type? when due? redemption feature? tax levy? portion of property tax allotted? etc.; there are 50 sets of plans being studied by various potential bidder:; he had talked with Mr. English, Chairman of the Planning Commission re suodivision without proper procedure which makes it impossible to get title insurance, etc.; inquired as to fur- ther action re Army drainage ditch; suggested the City get a notice in the paper to aid Mr. Coyle, Chairman, Small Boat harbor Commission, in getting information; said the Chamber of Commerce was sponsoring a meeting Monday 8 April re housing and all people interested in building were to be invited as well as trailer court operators and contractors; suggested a clean-up effort should be made before 30 June -the Chamber will cooperate but thought the City should Sponsor; inquired about airport -- the Atty. was instructed to draft a night letter to Benny Leonard re the airport money if Stan Thompson hadn't already talked with him. [Letters were sent to Reps. Clem Tillion and Benny Leonard that eve.] Clerk reported: City did not have enough cash to give the school the amount requested until money was received from1111FA - City could give $7,000.00 and the School Board can use contigency fund which will tide them over until 25 April if this was o.k.- Clerk was instructed to write check for $7,000.00; inquired if Council wished a report similar to last year showing money spent, revenues, and estimate of disbursments in next three months - [Council instructed this report be drafted.]; in answer to questions re tax on Kenai Community Clinic it was determined this group is a charitable organization, thus exempt from tax; also, according to atty. general's opinion,parson- ages as well as churches are exempt from property tax --Council thought this might also apply to the sales tax re sale of stove oil to parsonages; inquired if the City wished to take an official stand at Borough hearing held by the Local Boundary Comm. next Friday 5 April. The hearing for application for liquor license opened with statement from Mr. Boyer (applicant - Kenai Hotel) that he was initiating a guided tour business with brochures distributed all over the U.S.; that he hoped to stimulate industry in Kenai, attract new people and businesses; that tourists required 1. sleeping quarters, 2. eating accomodations, and 3. a cocktail lounge; that he was applying for a license with the State Liquor Control Board under Sec. 35.04.13, liotel-motel provisions; that he was 207' from the school ground, the area was zoned for business, that 60% of the money would go to the City (money for the liceese); that lie was expecting 300 to 500 people from a travel agency in Vow York; that his proposed cocktail lounge would not j1 1 Council minutes page two 3 April 1963 detract from present businesses; Mr. Boyer quoted Mayer Dye's statement last week that "business must be allowed to expand and grow if Kenai is to prow"; that the City Council is responsible for Kenai's growth, and as Council's recommendation is almost binding to Alcoholic Beverage Control Board, lie respectfully requested approval on his application for a license. Mr. John Shaffer, minister for Methodist Church, and speaking for the Ministerial Association of Kenai presented a letter from Mr. Bill Ray, Chairman of the ABC wherein he stated the Board was "not a rubber stamp" for decisions of local councils, that deliber-ition and study is given to each application; he pointed out hotel -motel license provisions are for establishments outside City limits; that he was opposing issuance of the license, not on distaccs, but on the grounds that there are too many (7) already in Kenai; that not is the Church Board opposed, but he, as a resident, was opposed to it being so close to the parsonage, church and school. Mr. Ed ilollier, President of the Kenai School Board, read a resolution from the Board opposing approval of the license as it was too close to the school. Mr. Jess Nicholas stated distance was not a full criteria, that economics was also in- volved and if there were too many bars, none of them would make a living; that Kenai did need a first class hotel, but putting in a bar will not make one. Mr. Fred Croqier, minister for Kenai Chapel, pointed out consent of the people over 21 within one mile of the proposed new business is necessary and that many were opposed. Mr. Carl Zehrung, minister for the Church of Christ, referring to the quote from the Mayor, suggested some businesses should be curtailed so more wholesome, economically businesses can grow, that we need to attract desirable, worthy citizens, and not get a reputation such as Anchorage as being the "longest bar in the world". Other speakers from the floor were Joe Consiel, Marvin Mullin, Roger Meeks, all opposing the new license. Mrs. Boyer and Leonard Patnode spoke in favor of the license, saying this wo>>ld not detract from local businesses as it was for tourists and that a first class cocktail lounge was needed in Kenai. A show of hands revealed six in favor of the license and twenty one opposed. Police report is also included in minutes. Mr. McCann moved, Sims seconded, to disapprove the application for liquor license for the Kenai Hotel. Roll call vote: affirmative - Knackstedt, McCann, Morgan, Sims, Swires; negative - none. Mr. McCann moved, Sims seconded, fuel deliveries to parsonages shall be sales tax exempt. Motion passed. Air. Swires moved, Knackstedt seconded, question of another hearing for application for Kenai Hotel liquor license be tabled until Atty. can advise Council. Passed. Acting Mayor Morgan asked Air. Kuchta if he would act as coordinator of the Spring clean-up Program. Mr. Kuchta preferred the Garden Club acting in this capacity, but said he would take charge of the public nuisance areas. Mr. Kuchta also said the garbage dump should be covered daily for rodent control; he announced the water system plans for Mommsen Addition Nos. 1 $ 2 had been approved by the Div. of health. Ir. %forgan presented Resolution #63-13, included in these minutes, and moved its adoption. :•Motion seconded by Swires and passed. This resolution supports action taken by (comer area to establish a Borough on the southern tip of the Peninsula. Mr. Morgan moved a copy of the resolution be sent to Local Affairs Agency, Juneau, Borough Steering Committee, Homer, and to the Local Boundary Commission Bearing in Soldotna. Motion passed. Discussion on the above resolution was opened to the public: fir. Allan Petersen favored one Peninsula -wide Borough. Mr. Patn.ode thought there should be two boroughs on the Peninsula, having the boundary be the Peninsula Range, and that [comer should be included with Kenai, etc. Mr. Knackstedt moved, Sims seconded, the Receiver for Denai Power Corporation be given a copy of the R.W. Beck Power Appraisal. Motion passed. Attorney was instructed to draft an ordinance amending the sales tax ord. enabling organizations such as Boy Scouts, Girl Scouts, Brownies, etc. to be exempt from the tax. Mr. Leonard Patnode addressed Council, stating he was manager for Alaska Aggregate, and had requested power from Kenai Power; that Mr. Rowley had told him he could have it by April first; that HEA could give them power within a day and a half of applica- tion, and that Alaska Aggregate was ready to go to work and needed power badly. The Clerk was instructed to contact the Receiver, find out if Kenai Power could service Alagco within a few days, and if not, to notify HEA to go ahead. ALASKA RESOLUTION NO 63-13 rSI WHEREAS the Constitution of the State of Alaska requires that each borough shall embrace an•'area and population with common interests to the maximum degree possible,and li+MERM Election District No. 9 does not have population, geographical, econ- ooic, transportation or other factors in common with Election District #10, and WHEREAS the Homer area had made a request for an election for a borough en- copapassing the Homer Recording District, and WHEREAS a borough encompassing the area as set forth in CS for HB90 as amended would result in less local school control and therefore inferior educational standards, and WHEREAS a borough study group dedicated to the establishment of a borough en- compassing an identical area to the area presently included :n CS for HB 90 proved highly unpopular and failed to secure any areawide support NOW THEREFORE 'ME CITY OF KENAI RESOLVES: 1. That the City of Kenai is opposed to the borough boundaries as set forth in CS for HB 90 as amended and including election districts 9 and 10. 2.
