v Clerk -H. Galliett wants to set up a pre -bid conference on the W&S
project with Council and Contractors for Sat. 14 Dec. 63.
60"'Mr. Potter opjects to money for tiling being taken from Con-
tingency Fund; he says this is part of the new construction and should
be paid for by School Bond Fund. Motion made on 6 Nov (minutes) that
the money come from Contingency Fund. (Amount not to exceed $1400.00)•

Ratify Morin's motion, McCann's second, that R. I. Morgan be nominated
by acclamation to represent Kenai on the Borough Assembly. Also per-
mission to use City pick-up for Borough meetings if no other transpor-
tation is available.

The meeting was called to order at 8:08 p.m. with all members present but Mr. Morgan.
Mr. James Clinton requested a member of Council to work with him toward planning a ter-
minal building at the Airport. fie wanted opinions from Council as to whether it should
be privately or City owned; should it provide space for offices? etc. Considerable dis-
cussion was held as to offices and facilities for Court System, Govn't., Air Guard,
Nat'l. Guard, Library, etc. Professional planners will be consulted before disposing of
lands, etc. Bud Lofstedt will assist Mr. Clinton in the preliminary phase, then the plans
will be presented to Airport Commission and Council for approval, amendments, etc. It
is hoped construction can start at the same time as the paving next Spring.
The City Atty's. opinion re collection of sales tax by the Kenai Bill's Club was read
and discussed. His opinion is included in the minutes. Mr. McGuire arrived late and
the subject was brought on the floor again. Mr. McGuire stated all monies taken in by
the Bill's Club are considered"donations': The Atty. maintained some of the revenue the
Club collects would necessitate collecting the tax, but some of it would be'exempt from
collection --the Club donates a portion of the Bingo money to the Cerebral Palst. Mr.
McGuire read from the Articles of Incorporation wherein the Club is a "benevolent,
fraternal and non-profit sharing" organization. According to the City Ordinance, this
classification does not exempt them from collecting tax. A lengthy discussion was held:
Mr. Morin moved, Knackstedt seconded, that the Kenai Bill's Club be identified as of a
"charitable" nature and be exempt from collecting the sales tax. Roll call vote: Affirma-
tive - Knakestedt, Morin, McCann, Negative - none; Abstaining with consent of Council -
Lofstedt and Swires. A copy of the Atty's. opinion was given to Mr. McGuire, and the
Atty. emphasized even if the Club is exempt from collecting the tax, they are obliged by
Ordinance to submit a return every quarter.
Regarding the window wall at the New School, Mr. ?Morin will contact Mr. Manley and request
in writing his opinion that the City will not be charged extra for any change that is made.
He will also let Mr. Stanley know the City is withholding payment of the architect's fee
until receipt of said letter.
Minutes of the last meeting were approved.
Correspondence was read: Proposal from Marshall S Meyer re W S Bonds.
The Atty. reported: By letter re 8% interest and penalty on delinquent property taxes.
He quoted State Law, AS 29.10.453 wherein penalties and interest are mandatory, and the
City has the right to establish the dates of collection. lie introduced a letter from
Mr. Arnold, Atty. for KPC re the disputed line at Cul. Council still does not wish to
be involved, and favors letting KPC and CUL work out their probl8m;- The Atty. inquired
about the Service Area --He was given the map and description as submitted by Mr. Malone
and he will make the application;to the Public Service Commission-
The Clerk reported: Since KENI and WAR Radio Stations had been so accomodating in
announcing anything the City requested, whether it be elections, rabies shots, Kenai Days,
etc., would Council favor a resolution thanking them for their service --the Atty. was
requested to draft such a resolution; bill for the Cat grader is $798; Plans and estimates
of the cost of adding two office rooms to the East and of the City Administration Bldg.
were presented and discussed --Mr. Swires will check the materials list, and the Clerk will
ask Stan Thompson if the City might buy this at cost plus 100.

Mr. Morin moved, McCann seconded, to nominate R. I. Morgan by acclamation as the City
r Representative at the Borough Assembly and he be authorized to use the City pick-up for
the meetings if no other transportation is available. Motion passed unanimously.
The Atty. will check on an Ordinance establishing position for Borough representative
and for an alternate. Mr. Morin moved, Swires seconded, to authorize R. Morgan, the
Bor. Rep. to make an offer of a contingency fund not to exceed $1,000 during the int-
erim perion and/or to offer a meeting place for the Assembly. Passed unanimously.
Mr. Knakcstedt reported on the City's acquiring lots adjoining the south end of the
school yard. Council feels this might be a problem the Borough can handle.
Re Water and Sewer, Mr. Malone will analyze permits after Phil Wilson gets signatures.
A meeting with Galliett and contractors has been set for Sat 14 Dec at Boyer Hotel.
The Clerk will notify Mr. Boyer and check with Galliett to verify dates.
The Atty. ok'd Mayer's proposal to buy the Water 6 Sewer Revenue Bonds: With unanimous
consent of Council the Mayor was authorized to sign the proposal from Mr. Donald Mayer
to purchase the bonds.
If it is all right with the Kenai School Board, Morgan can ffer the two newly-b
classrooms as headquarters for the Borough Ube&* Beer&. /�(,A,,�
Council also authorized Mr. Crinklaw to store KCL items in the quonset at the Airport.
Council authorized wages to pay for skidding Mayor Dye's office building to the City
lot to be used for Mr. Crinklaw's drafting office.
Mr. Crinklaw reported the City's line loss dropped from 22e to 14%, and he hopes to im-
prove this in the near future. lie will also draft up a street light rate for the City,
_ or for districts that may want to contribute to street lighting. Correspondence will
be checked re Beck's data on street lighting.

(I Mr. Ken Sappington, Gen. Foreman, Dept. of Hwys., Soldotna, says he will install a 45 mph
sign East of Beaver Loop Junction and will move the 35 mph sign West of Homesite Loop Road.
Pay rates will be discussed at Saturday's meeting at 10 a.m. at the Boyer Hotel. The
Clerk and Mr. Jaynes will coordinate the rates of FAA, PUD's, and the Alaska Dept. of
Labor, and also what we pay our men.
l�l Mr. Morin presented Ord. f60 requiring all City obligations be current before an applica-
tion for liquor license renewal be approved. Mr. Morin moved acoption of Ord. g60 for
first reading. Swires seconded and the motion passed unanimously.
Mr. Crinklaw reported re the Wildwood contract. Council authorized Mr. Crinklaw to

initial the tentative agreement which is to be sent to Washington. This was the agree-
went formerly drawn for Kenai Power Corporation. Howard will also pursue the possibility
of Kenai's joining the "power grid" which will take in the Rail -belt Area and the Penin-
sula.
