Kenai City Council Minutes,
February 21, 1962
Meeting was called to order by Mayor Swanson at 8:00 pm. Roll call
showed all members present but Carl Seaman.
Minutes of the last meeting were read and approved.
Attorney Fisher reported a bill introduced in the Legislature which
would return to the Cities the tax on coin -operated machines; this would
amount to approximately $855.00 for Kenai. Mr. Fisher also asked for com-
ments from the Council regarding the contract with Harold Galliette and Mr.
Morgan suggested the following addition: "a clause to include a provision for
consultation with the Army and to furnish a full and complete report of additional
costs and revenue and general feasibility to the City if Wildwood Station Water
Supply can be served by the City of Kenai. In the event that it would be to
the advantage of the City to enter into an agreement with the Army, the design
of the water supply system would be included in the size of mains, etc., to
accommodate this agreement." Mr. Fisher also suggested a change in the agree-
ment with Mr. James G. Dye X Discussions will be held with Mr. Dye when he re-
turns from California next week.
Clerk"s report was given and correspondence read: A letter from Killen
requesting the City take action, if possible, on anyone littering the roadways
with refuse and trash; also a letter from David Boyer protesting the "Road
Closed" Signs blocking the way to his Hotel. Action was deferred until a re-
port can be had from Chief Peavley and the school board respectively.
Clerk submitted names for Judges and Clerks in the coming Franchise Election
for Council approval. Judges would be: Louis Nissen, Ralph Pettersen and
Mrs. Grace Cole; Clerks - Dale Turmell and Norma Jordan. Clerk also mentioned
various bills before the State Legislature which Rep. Leonard and the League
of Alaskan Cities have requested opinions of the City.
Mr. Talmadge Nelson appeared before the Council which resolved itself
into a Board of Equalization: As a result of testimony the Board re-evalued
Mr. Nelson's homestead as follows: 105.37 acres 4 $200.00;A32 acres @ $25.00.
and the 20 acre subdivision at $400.00 per acre. This action was in the form
of a motion by Mr. McGahan, seconded by Morgan, and passed unanimously by Council.
Mr. McGahan moved, Carl Swanson seconded, the City pay the Fire Dept.
$2295.88 for the rest of the fiscal year. Motion passed.
Mr. Morgan moved, Chet Cone seconded, all funds which Council authorizes
and which are not budgeted shall automatically come from the General Surplus
Funds. Motion Passed.
Mr. Morgan presented ordinance #20 providing for building permit fees.
Ordinance passed first reading.
Mr. Morgan presented Ordinance #21 prohibiting driving a vehicle without
vehicle owners consent. Ordinance passed first reading.
Mr. Morgan presented Ordinance #22 prescribing tresspass upon another's
property. Ordinance passed first reading.
Mr. Morgan moved, Chet Cone seconded, the Legislators be urged to
support the passage of HB 239 which would require the State to turn over to

Cities all State-owned lands within City boundaries which is not in use or
for which no immediate plans for use are made. Motion passed.
Mr. Carl Swanson moved, Chet Cone seconded, the City Council oppose
HB 288 which would deprive the Cities of the right to acquire land bi a declar-
ation of taking and that the Legislators be so informed. Motion passed.
Mr. Morgan presented Res. #20 Naming the proposed extension of the
North Road to Hope, Alaska as the Kenai Peninsula Coastal Highway. Passed.
Mr. Morgan presented Res. #21 urging construction of the Kenai River
Bridge. Passed.
Mr. Morgan presented Res. #22 naming the proposed new bridge as the
Kenai River Bridge of the Kenai Peninsula Coastal Highway. Passed.
Mr. Morgan presented a progress report of the City of Kenai and moved
it be accepted as the views of the Council and that it be published in the
Cheechako and that copies be made available to the Chamber of Commerce and any
other interested parties. Carl Swanson seconded the motion and Council Passed it.
This report is included in the minutes.
Meeting was opened to public discussion: Mr. Bill Wells asked if the
Council had set a policy for appraising new construction. What was the standard
to be --cost of construction? market value? Mr. Rodger Meeks also spoke point-
ing out that construction costs would not be a fair an accurate evaluation due
to fluctuation in contractordi' prices. Assessment is generally made on market
value less depreciation basis.

MUNICIPAL PROGRESS AND STATUS REPORT
February 21, 1962
Kenai became incorporated into a first class city in May of 1960.
Many of the citizens of Kenai are unaware of the extent of the municipal
activities which have been undertaken since that time. There has been con-
siderable progress in this period of less than, two years. The Council pre-
sents the following municipal progress and status report of the City of
Kenai for the information of these citizens:
Education: The Kenai School Board has assumed the administrative
responsibilities of the Kenai City School District. Progress is being made
toward full accreditation. A High School site has been selected and an app-
lication for advance funds for planning and design has been submitted to the
State. Construction is anticipated in 1963.
Planning and Zoning: A comprehensive plan was contracted to the
Alaska State Housing Authority on 15 August, 1961. Completion of this
planning service, which is quite extensive and includes such things as pro-
jected population, economic studies, subdivision control and zoning ordinances,
is scheduled for the summer of 1962. A Planning Commission has been estab-
lished; an interim zoning ordinance is in effect pending completion of the
comprehensive plan; a subdivision control ordinance is in effect.
Police Department: Personnel includes one fulltime police chief with
part-time policemen and jailers as required. Physical facilities include a
1961 police car and a newly constructed, expandable, two -cell jail.

Department: The facilities of the Kenai Volunteer Fire Depart-
ment which include three fire trucks and an ambulance, housed in a concrete
block fire station, are being expanded with financial assistance from the
City.
City Administration: The City Administration Building, which includes
the Community Library and the City Clerk's office was deeded to the City by
the Kenai Civic League. The office of the City Clerk is open from 9:00 am to
5:00 pm five days a week.
Street Department: This department includes a grader with operator

for road grading and snow removal. A contract is in effect for road gravel-
ling operations.
Sewer and Water Utilities: Advance planning funds from the Community
Facilities Program of the Housing and Home Finance Agency have been approved.

A Preliminary Engineering Agreement is being signed with Mr. Harold Galliette,
Civil Engineer, and completion of this engineering is scheduled on or before
October 24, 1962. Construction is anticipated in 1963.

Electrical Distribution: A complete study of the power situation in
Kenai has been completed for the City by the firms of R. W. Beck 6 Associates
and Arctic Consulting Engineers. As a result of this survey, a franchise

proposal of the Kenai Power Corporation was approved by the City Council and
passed by people's referendum February 23, 1962. Natural gas power generation
for Kenai Power Corporation is under construction by Consolidated Utilities
Corporation and is scheduled for operation in the Spring of 1962. Overall
rates are presently the lowest on the Peninsula and decreases in rates are
provided for as the power load increases.
Natural Gas Distribution: Private proposals to date for a natural
gas franchise have been rejected by the City Council as not being in the best
interests of the City of Kenai. The council is open to legitimate private
proposals in which rates and facilities are dependent on local usage and con-
ditions. The council considers a municipal natural gas system will be re-
quired if suitable provate proposals are not forthcoming.
Kenai Harbor: A Dock and Harbor Commisssion has been formed and a p
proposal for a sheet steel piling, gravel fill, barge unloading dock facility
on City of Kenai land has been accepted by the Council. Construction is anti-
cipated during the Spring of 1962.
Kalifonsky Beach - Kenai Bridge: The Bridge Committe of the City
Council is working in cooperation with the State of Alaska on the economic
justification of this bridge route. Preliminary Survey of this project has
been authorized and is scheduled for the summer of 1962.
State and Federal bands: The restrictive land holdings of the red-
eral and State governments are being released. Section 6, T6N, R11W, S.M. is
presently being subdivided by State authorities in accordance with planning
dommission and council directions and the lots will be sold at public auction
during the late summer of 1962.
Health and Welfare: A contract is in effect with the State Department
of Health and Welfare for local services. Negotiations are underway for the
establishment of a permanent Health and Welfare office in the City Administra-
tion Building opening in June of 1962.
Dogs: A dog control ordinance is in effect with enforcement by the
police department and a part time dog catcher. Pound services are provided
through contract with a local dog kennel operator.
Taxes: A 2% sales tax was approved by the boters and has been in
effect for over a year. A real property tax of 15 mills on 60% of assessed
valuation is in effect. No personal property tax is anticipated.
