Copies of correspondence have been sent to Councilmen. How do we answer? Deputy Magistrate, Jess Nicholas, has requested an Ordinance allowing him to Hold jury trials for misdemeanors committed within the City. Cost to the City would be $1.00 per day for each juryman (6) for each day of court. As it stands now, persons are not accorded a jury trial. ✓Standard Oil Co. requests permission to erect a sign about 4' x 6' which would read,"Standard Bulk Plant" with an arrow pointing toward plant facilities. They want to place this sign at the junction of Beaver Loop and the Kenai Spur Road in the "Y". The Outdoor Adv. Law prohibits signs with adver- tising within sight of a Federal -Aid Hwy. System, but the City does have similar signs along this road. ???? •/Nr. Lewis, of Standard Oil says the contract price quoted the City was for Heating Oil, or Furnace Oil. If we use Stove oil, the price would be one cent higher per gal. Is it okay to use furnace oil in the two furnaces? /Phe Planning Commission needs to be re -appointed. Outgoing members as of Mar. lst are Jay Lietzke, Donnis T Kompson and Elsie Seaman. The other members, with the exception of Roger Meeks, have not attended in months. -,'Mr. John Ault would like to meet with Council March 21, Wed., and with the Planning Commission the preceeding Tues., March 20. He is bringing his economic study engineer with him, and they will present the plan to the City. o4eninsula Developement Co. has plat for resubdivision to submit. City should have daily reports from Chief Peavley. Clerk and J. Hollingsworth keep a daily log, but there is no record for reference purpose from Police. The Borough study Group at Soldotna requests an expression from the people as to: 1. Should the Peninsula organize as a first or second class borough? 2. What should be the name of the borough? 3. Where should the borough seat lie? Have you had any hints from the electorate as to what they want? Letter to Floyd Guertin regarding the land by the Old Federal Jail has been s referred to the Division of Lands Office in Anchorage. A letter from Merbert C. Lang, Lands Officer of the Dept. of Nat. Resources, re the building says the Div. of Lands may offer the bldg. at public auction if the City thinks they might have use for it. If the bldg. is not worth $250.00 per year in rent, the Div. of Lands might negotiate a lease with y the American Legion for a period of not more than five years. Also, a "use arrangement with the City of Kenai could be negotiated under our public use authority. However, the use of the building would be restricted to municipal purposes." I Clerk's Report Page two ✓Letter from Alfred P. Steger, BLM, says the land on which the school is sit- uated may be had for $2.50 per acre. Our application is beitig processed and we will be further advised. Letter from DeLeonardis, Div. of Lands, says the hospital site in Sec. 36 may be set aside "as soon as official recommendations of the City of Kenai for the zoning of these lands are received in our office." The City has been presented with a statement of payment due the Dept. of Health & Welfare in the amount of $900.00 for "Public Health Sanitation Service". What have they done for the City? &"'A letter from Wm. The wheel dropped in the road less than two blocks from starting; from the Fire Hall. I had the ordee for new spindle wired in Monday afternoon. It is t6 be shipped by air direct to Kenai, so it shculd arrive at anytime., In the meantime i have removed the old part and I am ready to install the new spindle as soon as it arrives. Respectivel y Submitted y/ Kenai Street Dept. Kenai City Council Minutes Wednesday, March 21, 1962 Meeting was called to order by City Clerk and Mir. Dick Morgan was elected Mayor pro tem by unanimous consent. Mr. John Ault, of Alaska Housing Authority, introduced Mr. Fred Wysor, Economic Advisor, who is analyzing the economic base for Kenai in order that Kenai may formulate a Capital Budget and Capital Improvement Plan. Mr. Odin Strandberg presented a request to the Council that an assignment be granted approval which would allow Kenai Power to borrow money from the bank with the Franchise Ordinance used as auxiliary collateral, all according to Ordinance 18, Section 10. Mr. Monty Coleman, speaking for the Kenai Chamber of Commerce, announced the Chamber had passed a resolution that the second Kenai City sign be placed close to or on the airport premises, and Mr. Coleman respectfully requested that the Council reconsider and rescind its motion to place the sign at the North Boundary of the City on the North Kenai Road. He pointed out that the prime purpose of the sign was to greet tourists coming into the area, and placement at the Airport would serve this purpose, at this time, buck better that if it were out the North Road. After Turnagain Crossing is completed, the picture might be different. Roll call showed Mayor Swanson and Chet Cone absent. Minutes of the last meeting were read and approved. Correspondence was read and acted on later in these minutes. The City Attorney, James E. Fisher, recommended the Council acknowledge receipt of the letter from Kenai Power accepting the Kenai Power Franchise Ord- inance as a result of the special election. He also recommended the City have a copy of the assignment. He has commenced work on the law suit to collect the balance of sales tax from the cannery. He suggested the City follow up on Div. of Lands promise to expedite action on the sanitary -fill site in order to initi- ate a Spring C1eg-up. Also, Mr. Fisher warned against allowing the Figure 8 Highway Program/languish-An extension of the North Road is vital to this project. Mr. Morgan asked if the City could buy back the assignment from the bank in the event some unforeseen incident placed the control of Kenai Power in the hands of the bank. Mr. Fisher said that might be a clause of the assignment, but under the Franchise terms, the bank is obligated to continue operations. The Clerk requested instruction on reimbursement to Carl Seaman for funds advanced to Art Tauriainen for trip to Juneau re roads, bridge and school. Also asked if final Jail inspection had been held; announced receipt of a telegram from Rod Pegues informing the Council of finality of Local Boundary Commission's boundary change for the City of Kenai; requested the Council consider sales tax rules and regulations if effort is to be made to enforce the penalties; re- quested assurance on offices to be filled at the next election --that of three Council seats, Mayor's office, and one school board member; asked for clarifica- tion of DeLeonardis' statement re Hospital Site in Sec. 36; and requested in- struction re Old Federal Jail premises. City Council Minutes Page two Mr. Carl Swanson reported the Airport Committe is holding a meeting, Friday, March 23, and will report fully at the next Council Meeting. Carl Seaman moved, Carl Swanson seconded, that Council consent to assign- ment submitted by Kenai Power and that Acting, Mayor Morgan be authorized to sign. Motion passed. ClerR was i^strutted to write re sanitary fill site. Mr. Morgan suggested the Federal Jail might be acquired by opening the facilities for public use by any non-profit organization, but Mr. Roger Meeks reported the American Legion would not be interested in renovating unless they could purchase the building and that a lease would not be acceptable. Council meeting was interrupted by Fire Call when half the audience and two Councillors answered as members of the Volunteer Fire Brigade. The meeting resumed after an hours recess and Mr. John Ault addressed the Council, Planning Commission members (Meeks, Jeanne Lee, Tru McGrady, Al Poore, Ernie Knackstedt and Gene Morin) and the audience. Mr. Ault briefly reviewed the work of the Alaska State Housing Authority which contracted with the City for a 20 year General Development Plan. This consisted of a study on Land Capabilities which establishes a physical pattern; then a historical pattern is established, and a land capability pattern, and an economic base which gives the probable outlook for future years, and provides a legal envel- ope for future City Officials. The General Plan includes a study on schools, roads, airports, zoning,and results in known facts the courts can use. The steps for the City to follow are 1. General Plan, 2. Zoning, 3. Capital Budget and Capital Improvements Plan. Mr. Ault estimates the ASHA is 70% toward completion of the contract. Mr. Fred Wysor presented his report which is included in these minutes. Mr. Ault then reminded the Council and Commission the City is obligated to protect the business area regarding water, sewerage, fire protection which affects insurance rages. The best way to do this is to guard against a large "strung out" area zoned for business as opposed to a compact zone. Mr. Ault cited figures of cities of like size to Kenai in which only 2% of the land is zoned for commercial use. Frankfort, Ky. with 13,000 population has 40 acres of commercial/ use; Strater, Ill. with 17,000 people has 44 acres being used commercially; in comparison, Kenai has zoned for business 355 acres.
