The Clerk read Resolution #35 and the agreenent between the Dept. of Fublic Safety and the City of Kenai, Alaska. The neetinp, was open for public discussion, but no questions were asked. Capt. 3ayfield of the Dept. of Public Safety, in answer to a question from Council stated the State will furnish police vehicles from now on and the contract price for a trooper for the City will be $12,240.00 per year in the years succeeding June 30 1963. Mr. McCann presented Res. #35; Morgan moved its adoption. Swires seconded, and the motion passed unanimously. Capt. Mayfield announced there had been 29 arrests and 67 warnings, mostly hving to do with traffic violations. Mayor Dye emphasized traffic enforcement was not meant to be a money -making proposition in which Capt. Mayfield concurred stating it was the policy of the State to have law enforcement in an orderly and uniform manner and they would welcome constructive criticism any time. Mr. Chas. Archer asked if the troopers made reports every day and was answered in the afirmative. Mr. "Bud" Keener of the Fishermen's Co-op addressed -he Council to apply for exemption from the City sales tax on gear and groceries sold to them by the canneries other than "over the counter sales'. He also wished to protest the "opening up of fishermen's records" in the coming court case with Kenai Packers. It was explained by the City Atty. the records would not be "opened up"; that an auditor would inspect the records and all information would be confidential and for the court only. Mr. Keener stated if out of town buyers could not be exempt from the sales tax, the Fishermen's Coop had -agreed to boycott the City on all purchases. Mayor Dye said threat of a boycott bears no weight but if there was in inequality, something should be done aLout it. for. Chas. Archer pointed out of Kenai Pakcers could exempt sales tax from sales made to customers outside the City, then he and other merchants could do the same. Mr. Navarre's opinion was that it did no good to threaten the Council; it is their job to enforce the ordinances of the City and if they don't, they should resign. He also pointed out that it was the wish of the people to vote in the sales tax as most everyone felt that was one of the most fair and equitable taxes the City could have. City Atty. Fisher emphasized this would never have happened if Kenai Pakcers had cooperated with the City in the first place and obeved its ordinances. In addition to Council members and those already mentioned, other speakers from the floor were: Mrs. Burton, Messrs. Ray Burton, Bob Schmidt, Dave Boyer, and roger Neeks. The Sales Tax ordinance was discussed at great length and in closing Mayor Dye informed Mr. Keener a letter from the City would be forthcoming to the Coop. Minutes of the last meeting were approved. Correspondence was read. Att. reported that while it is against the law to dedicate revenue to any particular pur- pose, the Council could state by resolution that it would be the City's policy that not less than all of the sales tax revenue would be applied to the school budget; he also mentioned that the only limitation on bonding is the market; for. Thorgrimson had called from Seattle and suggested changes in the resolution to be presented to Council; those changes had been made and the res. given to Council. The Atty. was instructed to draft a letter to the Fishermen's Co-op. firs Mnrgan moved, Swires eeconded, the Atty. be directed to continue with court action re Sales tax and the cannery. Mir. McCann moved, Kanckstedt seconded, that as far as our authority goes, the Council approves Mr. David Boyer's proposal to move his Hotel sign from the junction with the school street where the road is closed during school hours. The motion passers and Clerk was instructed to notify Mr. Boyer the City has no jurisdiction over placement of signs on State Primary highways. i Mr. Morgan moved, Swi.res seconded, we accept ordinance #!35 for Second Reading. Passed. Mr. Morgan moved, McCann seconded, we accept Resolution #38. Motion passed.
