1 Meeting called to order by Mayor Swanson at 8:00 pm in the Home Economics
Room of the Kenai High School. --All members present.
Minutes of the last meeting were read, corrected anc! approved.
City Attorney, James E. Fisher, presented his report. Resume is included
in the minutes.
Correspondence was read.
Clerk's reports presented. Outline included in the minutes.
Clerk was instructed by Mayor to enter minutes of special meeting called
with regard to loading barge at the City Dock Site.
Mr. Seaman moved, IWes seconded, the City accept Robert0ehler's revised
bid in tlx amount of $19,872.00 in accordance with amended plans for City Jail
construction. Said construction to start immediately. Funds to come from time -
savings bond of $20,000.00 received from State. W. McGahan brought out that use
of these funds for City Jail leaves nothing in the treasury :br purchase of land
for school site. Roll call vote showed: Affirmative - Morgan, Cone, Hayes, Seaman.
Negative-McGahan, Carl Swanson.
Mr. Morgan moved we accept Alaska Aggregate's bid for gravel haul for
City @ $1.75 per cu. yd. as against Mr. A.A.Farmer's bid of $2.00 per cu. yd.
Motion seconded by Hayes. Motion passed.
Mr. Morgan moved, Cane seconded the Clerk write Horave Davi to the affect
that he has fifteen days in which to designate a preference for a location for a
taxi -stand. Failing this,lkis permit to operate a taxi will be cancelled. Passed.
Clerk was instructed to send formal notice of acceptance of bids to Robert
Oehler and Alaska Aggregate.
Amendment to Ordinance #8 regarding exemption of churches from property tax
on property used for religious purposes was presented for second reading. Discus-
sion called for, and motion to accept amendment, known as Ordinance #13, passed by
roll call vote.
Mr. Seaman moved, Swanson seconded, the plans for Sec. 33 as drawn up by Kenai
School Hoard be submitted to Bureau of Land Management. Motion ruled out of order
by Mayor Swanson as move to reconsider must be made by member previously voting
on the prevailing side.
Monday night was set as date for meeting with Kenai School Board and City
Planning Commission with regard to future sites for new school.
Mr. Seaman moved, Morgan seconded, we furnish the school with 40 yardd.;of
gravel immediately. Passed.
Mr. blelMan moved, Morgan seconded, we have sufficient gravel in front of
City Administration Building to fill. in low spots. Motion passed.
City Clerk was instructed to write State Highway Division in regard to ketting
more gravel on secondary State roads in the downtaw district of Kenai.
Mr. Morgan presented Ordinance #14 for first reading: Amendment to Ord. #4
which would prevent students from standing in school buses and also overloading of
vehicles beyond designated capacity. Mr. Morgan moved, McGshan secanded,

that an emergency exists. Motion passed. Ordinance adopted without second reading
by unanimous roll call vote. ts
Mr. Swasnon moved, Beaman seconded, that proposed Ordinance #34 be presented
on the floor for first reading. Motion passed. Mr. Seaman read the Ordinance -
Franchise proposal presented by Kenai Power Corporation. Members of the audience
followed along with copies placed in their hands by Mr. Rod Franck. The meeting
6 thrown open to discussion with Council members and audience both participating.
Speakers from the floor were: Messrs. Jess Nicholas, W.E.Mullen, Stan Thompson,
Leo Oberst-s, Phil Stetze ill We s,1d Mrs. Helep Stetzer.
/ Council member Morgan attempted to bring Ordinance 15 to a vote but was
ruled out of order by the14ayor on the grounds that the meeting had pregressed
in the Order of Business to the last stage, that of "Persons Not Scheduled to
be Heard" and that motions were no longer in order.
No further action being possible, meeting adjourned.

Re: Weekly report and comments on portions of agenda for 26
September 1961.
Gentlemen:
1. The proposed bridge across the Kenai River requires
additional information before any conclusions can be reached.
However, Information is already at hand (in the Ci.ty Dock files)
indicating what needs to be done for clearance over the Kenai
River from the Corp of Engineers. I would urge that the Council
make application for permit in the same manner as is required
for the City Dock.
2. The City Council should designate their official
representative for the activity required under the Area Re-
development Act. This representative plus any other Council-
men who are able should attend the Kenai Chamber of Commerce
meeting on 27 September 1961 when Mr. Leibenthall will describe
what is being done under the "Area Development" projects of the
Department of Agriculture. This program has caused some con-
fusion in Election District No. 12, the area designated as a
re -development area.
►,; 3. It is becoming more and more important that the
City have a full time administrative officer. The most obvious
i official to designate as such would be the City Clerk. In the
event money is secured from the HHFA, there will be a need for
extensive follow-up on the project required to install water
and sewage. Much assistance will be required to secure right-
of-way easements. At the present time, the City Clerk could
probably be doing far more for plans on the bridge if a full-
R f time official was available. Tax collections could be more
systemized with, it is hoped greater revenues resulting.
- 4. In attempting to prepare the letter forwarding the
resolution passed by the City Council amending the HHFA appli-
cation, the City Attorney noticed that a portion of the

payment was to be by assessment bonds. to my knowledge, s:.wh
bonds are not provided for in our Alaska law. This one d4screptancy
will require some concentrated attention by the Council as well
11 as the City Attorney.
5. I have understood that budgeting adjustments may result
in the City not having available those funds originally so called
"released" back to the City by the School Board.
1). With respect to the electrical franchise being applied
for by Kenai Power, the City Attorney would recommend at least
- a course of action requiring that no one person, nor immediate
members of a person's family be permitted to own more than 25%
of any company securing a franchise from the City of Kenai. In
addition, it is recommended that the franchise parallel the
terms previously recommended by the former City Attorney Burton
C. Biss. It would also seem that rate schedules and regulations
' and rules for use under the proposed franchise should be forth-
coming prior to further consideration by the Council.

7. Also presented at this time is an emergency ordinance
regarding standing in moving motor vehicles. This proposed ord-
inance was primarily prompted by a request for closer regulation
of riders on school buses.
8. Also forwarded by separate letter is a proposed
ordinance on abandoned property within the City limits of Kenai.
