AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KMC 13.40.040 TO PROVIDE FOR A SPEED LIMIT OF TEN (10) MILES PER HOUR
WHILE DRIVING MOTORIZED VEHICLES ON A PORTION OF TH NORTH SHORE
PUBLIC BEACH WITHIN THE CITY OF KENAI.
WHEREAS, the City of Kenai is the owner is significant
city limits, including the North Shore public beach; and,
WHEREAS, use of the North Shore public beach area
area; including walking, picnicking, horseback riding
vehicle use; and,
of public beach within its

WHEREAS, use of motorized vehicles travelling i excess of ten (10) miles per hour on
the North Shore public beach can conflict with fixed use of the beach; and,

endanger other public beach users; and,
WHEREAS, it is in the best interest of�he citizens of the City of Kenai to enact a speed
limit of ten (10) miles per hour for motorized vehicles on the most used portion of the
North Shore public beach within tl E city.
NOW, THEREFORE, BE IT OR D IN BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that Kenai Municip Code 13.40.040 is hereby amended as shown on
Attachment "A" - Appendix I and as follows:

The speed limit e ten (10) mph while riding in a right-of-way of a residential
or business area,eaches as shown on Appendix IV of this chapter, a parking
lot, as authorized i 13.40.020(c), or in close proximity of another person(s).

SUBJECT: Ordinance 2412-2009, 10MPH Speed Limit on a Portion of the
North Shore Public Beach
The administration has not developed a position on the above referenced ordinance.
Administration does recommend that action on this ordinance be postponed until a
comprehensive discussion about public use of the North Shore can be held by Council to
provide direction to the administration.
Suggested topics of discussion should include, but not necessarily be limited to:
l . Areas where vehicular traffic is allowed/prohibited.
2. Areas where ATV/Motorcycle traffic is allowed/prohibited.
3. Areas where campfires are allowed/prohibited.
4. Areas where camping is allowed/prohibited
5. Areas where vehicular parking is allowed/prohibited
6. Seasonal limitations
7. Speed limits
In advance of the proposed Council work session we are going to provide the following
direction/signage on the North Shore:
1. Prohibit campfires within 25' of the upland grasses.
2. Allow Campfires to the east (left) of Spruce Street
3. Allow Campfires to the west (right) of Spruce Street to a point on the beach
where the extension of Forest Drive would intersect with the beach.
4. Prohibit Campfires to the west of the where the extension of Forest Drive
would intersect with the beach.
5. Allow camping only to the east (left) of Spruce Avenue.
6. Prohibit vehicular/ATV/motorcycle traffic to the east (left) of Spruce Street.
7. Allow vehicular/ATV/motorcycle traffic to the west (right) of Spruce Street.
8. Off -road vehicles must maintain a 1 Omph speed limit while in close proximity
of another person(s) (KMC 13.40.040).
