Rarnain read the rules for public hearing and opened the floor to public hearing. Mike Boyle, 1515 Stellar Drive -- Spoke in favor of the encroachment. There being na further comments, the public hearing was closed. MOTION: Commissioner Brookman MOVED to approve the application as written and Commissioner Bryson SECONDED the motion. Scott Wehrstein, 1514 Stellar Drive, Kenai -- The applicant stated the shed was four feet ten inches from the rear lot line and the skids faced the wrong way to make the shed easy to move. Application submitted by Katharine A. Pool, P.O. Box 178, Soldotna, Alaska. (Postponed from 7/23/08 meeting.) Kebschull reviewed the staff report included in the packet, noting there was an option for this to become an annual event. Romain opened the floor to public hearing. Katharine Pool, Applicant -- Reported, since this application was on the agenda for the July 23, 2008 meeting which was adjourned due to lack of quorum, she would not have time to prepare for a fair this year and she would like to hold the fair next year. There being no further comments, the public hearing was closed. MOTION: Commissioner Bryson MOVED to approve the application including staff recommendations. Application submitted by Vince Redford dba Redline Sports, 168 Trumpeter Street, Soldotna, Alaska. Kebschull reviewed the staff report included in the packet, noting the application was approved in 2006 but site work postponed the installation of the sign and the variance expired. Romain opened the floor to public hearing. Kristine Schmidt, 513 Ash Avenue -- Spoke against the application, suggesting a sign on the building rather than free standing. PZOS-43 - An application by the Kenai Historical to relocate five historical cabins as required in KMC 14.20.105(h). Application submitted by The Kenai Historical Society, P.O. Box 1348, Kenai, Alaska. Approval. Kebschull reviewed the staff report included in the packet, noting the walking tour would be updated to reflect the move. MOTION: PLANNING AND ZONING COMMISSION MEETING AUGUST 13, 2008 PAGE 5 7 Commissioner Bryson MOVED to approve the application and Commissioner Brookzxkan SECONDED the motion. George Ford, President, Kenai Historical Society -- Reported they had received $68,000 in cash donations, a grant from the Rasrnusan Foundation, and Nelson 8~ Associates would provide design of the foundations. Ford reported they hoped to move the cabins this fall and complete the renovation by the summer of 2009. Commissioner Braokxnan thanked Ford for his efforts an the project. Discussion/Set Work Session -- Amendment to KMC 14.22 -Radio/TV Transmitters/Cell Sites. Kebschull reviewed the information provided in the packet and Ramain opened the floor to public comment. Janine- Espy, 403 McCollum Drive -- Spoke in favor of a work session and requested consideration to be given to her husband's work schedule. The Commission asked Espy to meet with Kebschull to schedule the work session. 7-c. Discussion/Recommendation/Set Public Hearing -- Amendment to KMC 14.20.180 preventing the same or substantially similar variance permit applications from being considered by the Planning & Zoning Commission more than once in any nine months period. Lease Application -Alaska Court System, State of Alaska, Lot 13, Block 1, Cook Inlet Industrial Air Park. Kebschull reviewed the information included in the packet and Romain opened the floor to public comment. Janine Espy, 403 McCollum Drive -- Spoke in favor of a public hearing and encouraged the Commission to recommend changing the code. The Commission requested a public hearing on the issue. 7-d. Discussion/Recommendation -- Lease Application -Alaska Court System, State of Alaska, Lot 13, Block 1, Cook Inlet Industrial Air Park. PLANNING AND ZONING COMMISSION MEETING AUGUST 13, 200$ PAGE 6 8 Kebschull reviewed the staff report included in the packet, noting the City would design and develop the parking lot. Commission was requested to find the application met criteria of whether the application was complete and complied with the Comprehensive Plan and the zoning code. MOTION: Commissioner Wells MOVED the application met the criteria and recommended approval and Commissioner Brookman SECONDED the motion. Commissioner Bryson recused himself due to conflict of interest. Romain opened the floor to public comment. Box 7S 17 Nikiski, AK 99635 Preliminary Subdivision Plat -Rogers Subdivision A subdivision of Government Lot 1S6 108 Highbush Lane 04522015 RR - Rural Residential Residential Neighborhood Residential This plat subdivides Government Lot 1S6 into two lots. Lot 1S6A will contain approximately 40,996 square feet and Lot 1 S6B will contain approximately 49,791 square feet. The lots meet the minimum lot size and dimensions required for the Rural Residential zone. The plat dedicates a half dedication for the Highbush Lane and Rainbow Drive right-of--ways. The property is served with on-site water and sewer; city water and sewer are not available. Highbush Lane is a gravel road maintained by the City in the winter. Rainbow Drive is platted and nat developed or maintained. There is a structure located in the area that will be designated as Lot 1S6B. That structure is accessed via a driveway along Rainbow Drive. According to the survey, the structure that exists on the new Lot 1 S6B encroaches into the front setback along Rainbow Drive. Because this is a non- conforming structure (mobile home} and the subdivision will not increase the non- conformity, the property maybe subdivided. The City is not requiring an installation agreement for the Rainbow Drive right-of--way dedication. This decision was made because the property is accessible off Rainbow Drive by a driveway that has been used at least since 1984. 11 PZ08-45 Comments Final plat should be corrected to note the correct street name as Highbush Lane. Public Works Director: Concur with the recommendations. Building Official: Not available to comment. RECOMMENDAT)~ONS Page 2 This plat subdivides a government lot into two parcels and dedicates a half dedication for the Highbush Lane and Rainbow Drive right-of--ways. The resulting lots meet the development standards fox the Rural Residential zone. Anon-conforming structure exists on the newly designated Lot 156B. This structure encroaches into the Rainbow Drive right-of--way. The subdivision does not increase nor cause the encroachment. Recommend approval with the following requirement: 1. (a) Intent. A variance means the relaxation of the development requirements of this chapter to provide relief when the literal enforcement would deprive a property owner of the reasonable use of his real property. (b) Permit Application. An application for a variance permit shall be filed in writing with the administrative official and signed by the owner of the property concerned. (1) The application shall contain the following: (A) A legal description of the property involved; (B) Plans showing the Iocation of all existing and proposed buildings or alterations, elevations of such buildings or alterations, and such data as may be required. (C) A nonrefundable deposit/ advertising fee of one hundred dollars ($100.00}. (c) Review Criteria. The Commission shall establish a finding that all of the conditions have been found to exist as a prerequisite to issuance of a variance permit. (1) Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same land use or zoning district. (2) The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconvenience. (3) The granting of the variance shall not authorize a use that is nat a permitted principal use in the zoning district in which the property is located. (4) The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land andlor structure. (5) The granting of a variance shall not be based upon other nonconforming land uses or structures within the same land use or zoning district. (d) Public Hearing. The public hearing and notification procedure for a variance application shall be accomplished in accordance with the requirements of this chapter. The applicant shall be required to pay a one hundred dollars {$100.00) nonrefundable fee to cover the casts of the public hearing notice. (e) Permit Expiration and Extension. An approved variance permit shall lapse twelve (12} months from the date of approval if the variance for which the permit was issued has not been implemented. The Commission may grant a time extension not to exceed six (6) months upon a finding that circumstances have not changed sufficiently since the date of initial permit approval. A request for extension must 6e submitted prior to expiration of the permit. A public hearing shall not be required as a condition to granting the extension. The following are required in the site plan: • Parking - o The code requires one parking space for every 500 square feet of gross floor area plus three spaces for patrons.. The manufacturing portion of this structure is 3,000 square-feet. Nine (9) spaces will be required. The plan shows 10 new parking spaces for the development. • Parking Lot. o Parking lot must be paved. The site plan identifies the area already paved and shows the new parking area that will be paved with this development.
